AZ Immigration Facts and the Left’s New Hate of Affirmative Action
by Zach LahnOne pen stroke from Arizona Governor Jan Brewer has given her state a no-nonsense immigration policy and given America yet another opportunity to see the full face of leftist hypocrisy.
First some key points of the policy-
As shown in the picture above (featuring MSNBC’s poster child of intelligence, Contessa Brewer) this bill essentially says illegal means illegal. If you are in the state of Arizona illegally you are guilty of trespassing (page 2 line 44), and if you are caught trespassing you will be transferred immediately to the custody of the ICE (Immigration and Customs Enforcement). I will address the profiling allegations later.
This bill has teeth, and it puts the screws to employers who knowingly hire illegal immigrants (page 6 line 7). The burden of proof of work eligibility is now on the employer since this bill officially makes it illegal for an undocumented alien to “apply for work, solicit work in a public place, or perform work as an employee or independent contractor in this state.”
Complaints can now be filed with the Attorney General of Arizona or with a county attorney when a business is suspected of employing illegal aliens. After an investigation, if a business is found to be employing illegal workers charges are brought upon the business, and expedited court status is given to the case.
1st Violation:
- 3 year probationary period for the specific business location (5 years if the employer intentionally hired illegal employees)
- Employer must file a signed sworn affidavit with the county attorney within 3 business days stating that all illegal employees have been terminated and that the hiring of unauthorized aliens will never happen again. If this is not filed in 3 business days all licenses for that business location are suspended until filed
- Quarterly reports must be submitted documenting each new employee hired for 3 years
2nd Violation:
- Permanent revocation of all licenses held by the specific business location which hired the employee
With a system like e-verify available to employers there is no reason that the 2nd offense shouldn’t mean jail time, assuming the empl. Maybe next session…
Next the hypocrisy-
As expected and as usual, the left is crying foul at the top of their lungs and accusations of racism are flying aimlessly. What is being largely – if not completely – ignored by leftist media outlets and especially by President Clinton is the nearly immediate turn to violence by those protesting the legislation.
Unlike the reason based protests by tea partiers, the Arizona protesters are acting solely on emotions stirred by a constant barrage of leftist demagoguery. No civil rights have been violated, no racial profiling has taken place, and the motivation for this law was not racism. The motivation is completely founded in reason which is backed by facts and by a definitive understanding of the word ‘illegal’.
For example: A recent study by the Pew Research center shows that in 2008, 10% of the Arizona labor force was made up by unauthorized aliens. At that very time the unemployment rate in the state of Arizona was approaching the same 10% mark.
Couple those statistics with an increase in innocent lives being lost due to drug cartel violence and a federal government who refuses to adhere to the constitution and you have a $1 billion crisis. The Arizona people knew something had to be done which is why a recent Rasmussen poll shows that 70% of Arizona citizens approve of the new law.
As for the unfounded accusations of racial profiling, the sponsor of the bill Rep. John Kavanagh sums it up best:
“This provision merely extends to immigration offenses a half-century-old tool called “stop and question,” created by the U.S. Supreme Court. To prevent racial profiling, the law states that in constructing “reasonable suspicion,” police officers “may not solely consider race, color or national origin.””
To understand the full extent of hypocrisy you must to understand that liberals are not subject to reality.
For example: think back to the liberal argument for Affirmative Action. Liberals argued that the American people were inherently racist, bigoted, and oppressive towards minorities, and due to that fact, laws must be passed to give certain ethnic groups preferential treatment over others. In their ‘reality’ this was ‘righting a wrong’. In actual reality this was and is a flagrant abuse of the law which encourages racial profiling and discrimination.
In fact, the very tenants which serve as the enforcement mechanisms for Affirmative Action: racial profiling, discrimination, and one big equal protection violation, are the sole misnomers driving the left’s demonization of the Arizona Immigration bill – which contains none of these mechanisms. Without the slightest clue, the left is demonizing Affirmative Action.
So before you think the immigration rallies scheduled for May 1st are a bad thing, remember – protesters will literally be screaming their admission of the unconstitutionality and purposeful racism which has been brought upon the American people through Affirmative Action.
This is definitely a net-positive since admission is always the first step.

Thank you for writing the obvious. All individuals (this includes citizens who are white) must show proof of identification if stopped by the police, troopers, sheriffs etc., for any infraction of the law. BUT WITH SANCTUARY AREAS, illegal aliens used to get off FREE. Why should there be two sets of law enforcement? Everybody who does not have identification will now need to be checked and it makes no difference if you have no skin at all.
The illegals probably have their own lawyers and lobbyists and think it's their right to be here. Thanks to LaRaza.
I agree with ArmyMom. Time for action, time to send them back and let them apply for immigration status like otherpeople do. Look at the crime because of some of them!! U.S. citizens are afraid to come out of their homes in AZ. This is not right and worse yet, those politicians and screamers like Jesse Jackson who live thousands of miles away have not felt the fear or experienced the crimes but opt in with their assanine remarks.
I personally love this Bill and hope the good folks/politicians of AZ do not buckle to outside pressure

When Americans move to Mexico, violations result in jail, fines or deportations:
-must have/carry valid ID and legal port of entry required
-must prove in good health
-must prove no criminal history
-must prove have assets/income so won't be a social burden on their economy
-prohibited from political involvement and demonstrations
-deported/jailed if commit crime
-may be deported if Mexican government unilaterally decides there are too many whites in the country
-prevented from owning property outright, other countries have no restrictions on property ownership
Mexican immigration law is not dissimilar to other immigration laws in the world, it is our immigration lack of enforcement that is woefully lacking.

A question from the employer perspective. If an employer has a person apply for a job that is suspected to be an illegal alien, what do they do? Will they get in trouble if they report?
When I say — "other countries have no restrictions on property ownership" — it means Americans are specifically prohibited from owning property, but if you're an Austria citizen, for example, you may own property in Mexico.

One aspect of federal law which should be pursued, once we've replaced the leftist traitors in congress, should be to state, that NO PERSON living here illegally, or who enters the country illegally, or is in violation of existing immigration law, will EVER BE GRANTED PERMANENT RESIDENCY OR CITIZENSHIP in the United States.
This would eliminate in the minds of those here illegally that there will ever be a reward of amnesty for violating American law. Aside from sealing off our borders, this should be a top priority of the next Congress.

There are plenty of times that I have to pull out my ID as I tread through my daily activities. What's the difference here? None, show your ID.
The problem is Hawaii, New Mexico, Washington and Utah are the only states that don't ban illegal immigrants from getting driver's licenses. Residents of these states need to apply pressure on their officials tighten these state's restrictions.

It's easy for illegal immigrants to get around e-verify.
All they have to do is to use a stolen ID or the green card (for their cousin or friend who somewhat resembles them). By the time the government does some follow-up, triggered say by having people using the same SSN or ITIN for two different full-time jobs, the illegal immigrant has gone on to the next job – maybe even just down the street.
It would help greatly if e-Verify came back with the name of the most recent three employers. Then the employer could match those with what the applicant says. Also, e-Verify needs to be able to display a recent photo of the applicant, not one that is up to 10 years old.
The federal government should outsource e-Verify to Visa and MasterCard – they'd get a better job done for a fraction of what a government system would cost.

If you are in AZ Tom I could not advise. In TX if I have an applicant furnish suspicious documents I
question them, look the docs over carefully, in their presence, usually while they fill out their I-9. If
the docs are fake they usually become nervous when questioned. Many do not show up the next
day, even if you tell them they have the job.
Our accountant has E-verify, so I call him with their SS# and full name to check. Some docs that
look perfectly legit turn out to be fake. If you don't have an accountant and hire folks daily or weekly
you might want to sign up for E-verify yourself. We don't hire but one or two new folks per year so I
have avoided subscribing. I always make copies of the front and back of their documents, and the
license plate # / description of the vehicle they are driving. Thus far I haven't bothered reporting any
of the folks I suspected of being illegal. The Border Patrol is not going to show up to get them if I
call, so why bother, and if you did call to report them and they were legal, I'm sure they could sue you
for discrimination. All this BS can really be a trap for employers.

I would think that with the availability of biometrics, matching the fingerprints of a job applicant with their ID shouldn't be that hard to do. I'm not really familiar with e-verify, but I can't see why we don't use this kind of technology to prevent fraud in the verification process.

Unfortunately the "anchor baby" would require a Constitutional amendment. The 14th starts out:
"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
Expecting common sense to prevail in a court of law is a bit of a stretch.
States are more capable than the national government of identifying and rectifying problems that affect them directly, particularly the continued physical and fiscal well-being of its citizens. This is the arrangement anticipated by our Founding Fathers in establishing our federal system of government, that is to say, a government comprised of a national government endowed with an enumerated slate of limited powers, and state governments empowered by the people themselves to carry out other governmental functions not delegated to the national government.

No it wouldn;t. Since the parents of said anchor baby are illegal and were never subject to the jurisdiction of the US in any legitimate way, the baby isn't to be considered a US citizen. Adding the jurisdiction bit was intended to rule out things like anchor babies. When it first came into being it was added specifically for Native Americans who were not paying taxes. It took them 10 years to pass a special dispensation to make Native Americans legal American citizens.
The problem is that the intent and wording have been skewed much like the "right to an attorney" which was not intended to provide lawyers but merely to bar the court from disallowing a lawyer.
What Obama states and what actually happens in reality have no real relation to one another.
If in the united states every citizen had to have a special ID in order to work then only american citizens would be able to work. Where is the hypocrisy. Dont get me wrong, I am totally against a federal ID but you didnt make any sence with your post.
The only finger the government will get from me to add to their data base is the middle one right in their face. Same goes for a cop asking me for my ID for no appearent reason and the ATF had already got it while trying to verify what guns i own.

Either we are a country of laws, or the rule of man. Either way, we all just need to get an understanding for an even playing field- – a list of laws that we can ignore would be helpful, as well. I think “real” Americans should get a Mexican mulligan, or a get out of jail card, if you will. We should be able to use a phony Social Security number when it helps the bottom line, use the emergency room for our free Barrycare, subdivide our homes and move a half dozen families in, no auto insurance or drivers license, get on every kind of federal assistance, and on, and on, and on…

One commentator made a good observation — which is that many illegals could care less about becoming a US citizen because they prefer to come here for the free benefits and then skip back across the border when they want.
That way, they get the freebies without the social obligation to pay taxes, etc. They're enjoying "special privileges" right now that are better than ours.

Every immigrant is adding a 0.00 to the average income of the lowest 20% of income earners. This keeps the "average" income down, which neccessitates Government program increases.
