Louisiana Legislature Floating Bill Making Obamacare Illegal in State
by Warner Todd HustonLouisiana State Senator A.G. Crowe (R, Slidell) is introducing a bill for the 2010 legislative session in Baton Rouge that would make Obamacare illegal if it violates state laws, effectively making Obamacare null and void in the Pelican State.

Senator Crowe states that his bill “provides that no law or rule shall compel, directly or indirectly, any person, employer or health care provider to participate in any health care system or health insurance.”
Crowe’s proposed Senate Bill (download .pdf file) begins as follows:
HEALTH CARE. Prohibits state or local governmental coercion of any Louisiana employer, health care provider, or individual to compel participation in any health care system or health insurance plan.
Crowe insists that Obamacare violates Article I, Section 8 of the Constitution and “is therefore unconstitutional.” He also feels that the president’s plans violates the 10th Amendment among others.
In addition to the proposed legislation nullifying any possible federal healthcare laws, Senator Crowe has asked Buddy Caldwell, the State Attorney General, to determine if, in his opinion, Obamacare would violate any state laws, the Constitution, or would pass onerous unfunded mandates on the state. (download .pdf of letter)
Senator Crowe has been involved in many conservative projects including the 2009 State sovereignty resolution, a Tenth Amendment policy project. Also in 2009 Crowe introduced a resolution proclaiming April as “Abortion Recovery Awareness Month” which was signed by Governor Jindal. Crowe also became a signatory to AFP’s No Climate Tax Pledge. (Crowe’s committee assignments and associations can be seen at Project Vote Smart)
Senator Crowe is part of an increasing push by state lawmakers to affirm state sovereignty and Tenth Amendment rights, laws that will likely come before the U.S. Supreme court in short order once Obamacare is passed in D.C. According to Michael Boldin’s Tenth Amendment Center some 25 states have introduced state sovereignty resolutions or bills that would nullify federal laws that the state legislature feels violates their laws and those of the U.S. Constitution.

Hmmm, we'll see if this works.
I like the independence of it all though.

Sen. Crowe is doing some good work. We need many more like him on the national level.
If NO-Bama care is passed we will see a fragmentation of our country. What happens next? Does the US Govt start the next civil war? If so it will be over states rights, again.
We live in trying times.
Good for the state of Louisiana! May all States soon realize it is their inherint right to deny the Federal Government from opposing tyranny set forth upon them.
As Thomas Jefferson wrote in the Kentucky Resolutions.-
"Resolved, that the several States composing the United States of America, are not united on the principle of unlimited submission to their general government; but that by compact under the style and title of a Constitution for the United States and of amendments thereto, they constituted a general government for special purposes, delegated to that government certain definite powers, reserving each State to itself, the residuary mass of right to their own self-government; and that whensoever the general government assumes undelegated powers, its acts are unauthoritative, void, and of no force: That to this compact each State acceded as a State, and is an integral party, its co-States forming, as to itself, the other party….each party has an equal right to judge for itself, as well of infractions as of the mode and measure of redress."
This is good.
This coupled with many States' Attoneys offices bringing a lawsuit aimed at the Nebraska and Louisana payoffs for the HealthScare vote. States rights shouldn't be sacrificed because of poor Federal legislation. It's time all States to bring the Constitution back in front of the People and perhaps refresh the memories of the CrookedSouls in washington. Remember, Obama bin laden thinks the Constitution is an inconvenience, irrelevant and a document of 'Negative Rights'.
Bravo.
Would it not be interesting if we voters pushed all 50 states to pass this legislation? Then, when the feds try to force health care, cap and trade, etc. we can all secede from the union leaving the District of Columbia to foot the bill. Of course, the inhabitants there would have to change their name to the United District of America.
First order of business, build a moat around Washington and the residents there would have to seek an individual state' s permission before traveling to it.
I will never have any sway with my federal representatives, but my state representative lives down the street. If states are empowered, the people have a voice that will be heard.
"Benjamin Franklin, Poor Richard's Almanac
It would be a hard government that should tax its people one-tenth part of their income."
If you add up all the taxes today, including the hidden taxes, they would ammount to over 80 %.
Thankfully the states are waking up. They realize the financial disaster this would cause in most states. Of course, I live in OH, which is the wrong color on the map provided in the post.
Alabama passed the State Sovereignty Resolution (SJR27) on 1/19/2010. The Alabama AG Troy King has joined with other State AG's to declare Healthcare legislation Unconstitutional.
Ever since "The New Deal" the Federal Government has been ignoring the US Constitution and taking more authority and expanding government control over the American people. It is time for this expansionism to stop and be reversed.
oops, posted in wrong place….oh well.
None of this was even considered before the Ron Paul revolution. So, you want more Ron Paul Republicans or more McCain style Democra….I mean "Republicans."
To bad I live in a peoples republic state, it will never happen here, they will embrace any socialst program with open arms, at least 51.3% of the people will anyway.
Which means they are going to see their revenue drop even further as people move out, already happening in New York.
How is that "Tax the rich" mentality working out for you New York progressive biatches?
Well if the states say no..the people in those states will still pay taxes for the other states..catch 22..Pay to play or not
I think the clowns in DC think the Tea Party movement
is a fluke, and what happened with Scott Brown was
an accident…I hope we all stay active, stay organized,
and contribute to people that we feel will do the right
thing..We have to grow the teaparty movement and
overwhelm them like they are trying to overwhelm us
with all their s–tty ideas and programs….
Go Louisiana!!….Show those in DC they can't shove
their stupid ideas at you….
good – an interesting position for all to be in if it gets passed
Nullification is the way to go for now. The Constitutional court cases will take forever to resolve. If it fails, secessions will likely follow.
Texas subtly nullified the mortgage schemes that brought so much damage to the rest of the nation. I dearly hope that each State (in its own way) nullifies the EPA and DOE in order to advance their economic interests. With Banks, Brokers and Hedge Funds under fire, any state that can figure out how to override federal regulation will enjoy a great future.
Well, knock me over with a feather … Pennsylvania is on the map! Never imagined I'd see that, as we have Slick Eddie Rendell marching in lockstep with whatever scheme the Dems dream up. I figured we'd all be going off the cliff with them as well. But PA has that red "T" factor going for it in the wide swath of central and north counties. It's the greater Pittsburgh and greater Philadelphia areas that tend to vote Democratic and pull the rest of us into the abyss.
This should be a battle cry to the states to stop suckling the fed tit and take back their rights. States have been giving up their power to the fed since the civil war. Push away from the trough of federal funds(paid for by your own citizens anyway) and regain your sovereignty, Follow the will of the people and start taking it back.
Same thing in California. People leaving in droves.
When are we going to get some leadership that actually takes the Tenth Amendement seriously? They have been overstepping their bounds for a LONG time not just this last year. It has to end before America does.
Don't lose all hope. A week ago I would have said the exact same thing about Massachusetts, but…..
The sad thing about people moving out of California and New York is that they take their progressive ideas with them. They continue to vote for the same kinds of people and the same kinds of laws that drove them out in the first place.
But . . . I thought Harry Reid bought Louisiana's vote to pass Obamacare! Man, is he ever going to be pi**ed.
Just now found and joined the Colorado Tea Party. Bennets seat is up for grabs. We have to make sure he doesn't win. Gov. Ritter is going down too!!! I would like to see Colorado on that map, then I wouldn't have to move to Texas or Arizona. I like the mountains here.
How does Harry rescind a bribe? This is great!
hopefully now that MA has woken up and done the right thing we will never have to find out whether universal health is constitutional or not.
I live here, I like it. We will outlaw Landrieu next!
Wow! Could it be that enough people are starting to learn that when you accept "unearned" benefits, you also implicitly accept the terms that the "benefactor" attaches to them. Sure, at first it feels good, and hey it's "free", so why not? But then the reality of your created dependence sets in and you realize there was no free lunch, they have real power over your life. You have been paying all along while allowing someone else to set the rules, and now you have become so entangled your not sure how to get yourself out of this mess. Could this be why the Founders designed a National government that is supposed to be Constitutionally limited? Time to stop the Marxist Regressives and get back to the philosophy that made this country great. Three cheers for all who are working toward that goal!
The tide is turning. The commies will soon be swept out to sea.
What he bought was Mary Landrieu, who has completely destroyed her approval rating here. She couldn't get elected alligator-catcher in Grand Chenier the way things are right now.
Yes, the tide is turning, and it's a relief. The feds need to be neutered and this is exactly the way to do it.
As a former resident of Slidell, La., good for Senator Crowe! There is a movement to try to defeat Senator Landrieu that is taking hold, too. But, her brother,Mitch, will probably win the mayoral race in New Orleans,so the Landrieu Dynasty(started by their father,Moon) will continue to live on…The good thing, is that he'll be a lot better for New Orleans than Ray Nagin has been(think BO on a smaller scale!).The next month ought to be interesting.
for all my life my state has been run by corrupt politicians, we are trying to turn the corner by electing new people that are not in the old boy network but we still have a long way to go the liberal entitlement mentality is still alive and well in this state as was demonstrated by katrina in N.O. but some of us are paying attention and trying help our state by electing good people this is a good start but we still have a long way to go.
This looks like it could potentially be a much bigger states rights issue that what brought us to the Civil War. Then, the country was fairly evenly split. This map makes it look like there are rumblings in about 2/3 of the states.
If it makes it to ballot I will vote for it. It's nice to see a few true representatives stand up against the incessant power grabs being made by the Federal Government.
Didn't Mary Landrieu just get re-elected? If so, that's
probrably why she felt she could get so cocky..She
thinks the voters of LA will forget about this.
Don't get too excited. It was proposed and lies in limbo because the chair of the committee refuses to let it see the light of day.
This past week has held a lot of great news for real Americans, but we do truly live in interesting and dangerous times. At least Clinton had the political savvy to move toward the center after his spanking in 94. Unfortunately Obama actually hates this country to a psychotic degree, and is too much of a narcissistic megalomaniac to do the same.
When the American people and their state legislatures start telling The Most High Grand Potentate to go deflate himself, Obama will lash out like a cornered rat. Ironically, any civil war will be started by him against normal red-blooded working Americans. Be prepared!
Ever since the Civil War the Federal Govt. has ignored the Constitution. After the Civil War States Rights were not only diminished but eliminated. It has only gotten worse since then.
This has nothing to do with Ron Paul. The Fed is not the Boogy Man but the people running it are up to thier ears in corruption. Monetary Systems depend on International Co-operation and agreements. Commodity Based Systems that worked in times past would doom the world to a much reduced monetary supply and no method of creating new wealth. It is only because we have abandoned commodity based monetary systems that we were able to generate the wealth that we have today. The real problem is Govt. Spending all Govt. spending around the world that has contaminated the financial markets.
The Constitution never entered in to the equation for these people! Why should it? Hell, they don't even pay their taxes! I, for one, am tired of being slapped in the face daily by my elected officials abusing and ignoring the Constitution. Just because we have tolerated it in the past does not mean that we will continue to do so. All you career politicians had better start updating your resumes. You're going to be needing them very soon!
YESSSSSSSSSSSSSSSS!!!
I live in WA state..home of corrupt elections and a very BLUEEEEEEEE population plus governement. How did it get on the map? Amazing if something like this passes.
You will notice that North Carolina, like BHO's claimed state of Illinios, is NOT on that map. That's because the Democrat machine down here is just as corrupt as that of Illinois, if not more so. Corruption in the "Old North State" is not as sophicticated or subtle as it is in Illinios. But it's more fun to watch: The former Governor, Mike Easley, is being investigated for corruption and the former Speaker of the Legislature, Jim Black, is serving time for taking a bribe. It's time for a clean sweep that the TEA Party movement provides.
VOTE ALL INCUMBENTS OUT IN 2010!
I would respectfully disagree. The worlds economy is commodity based.
The US went of the gold standard in 1973. The Petro-dollar was created.
Do you know how many petro-dollars the US alone exports to the Gulf States in a month, a year? The number would surprice you. It is impossible to sustain.
Wait, Ron Paul was the author of the 10th Amendment?
Who knew!
See Houston and Arizona for examples.
Wrong, because none of Obamacare would be implemented.
You do not know that Monetary systems are based on the percieved total economic output and stability of the contry involved? You do not know that without the co-operation of multi-national banks there would be no monetary value? You do not know that money has and awill always be an agreed upon fiction that we place value on so we do not revert to a barter system? It is the type of backwarsd thinking that Ron Paul suggests that is more dangerous than you realize? If we were to try and revert to any of Mr. Ron Paul well intentioned ideas the rest of the world would laugh at us and move forward while we would have to revert to an Agrian Society?
There are plenty of problems with the current system but it is largely self correcting. Even without the Bailouts and Tarp the system would have self corrected. Huge Banks would have failed but other institutions would have bought up the scraps and saved the system as a whole. You may not like the way it works, but it works and Ron Pauls Ideas have been priven by history not to.
Yes you are absolutely right, this State is pathetic when it comes to politics the people are zombies. You can travel all over the U S of A and see all kinds of bumper stickers proclaiming this or that. In New Youk State you might see a easy does it sticker once in a while. They are afraid to expres their thoughts or beliefs if they have any. I sit outside of Higgins office occasionally in my pick-up with a dozen anti obama stickers stuck on it. Occasionally some one will give me the thumbs up after they lookm around to see if any one is watching.

"But what is government itself but the greatest of all reflections on human nature? If men were angels, no government would be necessary. If angels were to govern men, neither external nor internal controls on government would be necessary. In framing a government which is to be administered by men over men, the great difficulty lies in this: You must first enable the government to control the governed; and in the next place oblige it to control itself."
States rights ir states independence I say citizen.
Screw the feds.
