Ohio Election Fraud: Convicted Felons Illegally Worked for Anti-Smoking Initiative
by Warner Todd HustonMassive fraud and multiple violations of Ohio’s voting law has been uncovered in a recent ballot initiative effort. Among other violations, 47 felons were hired illegally by the advocacy group SmokeFree America to collect signatures for issue five, a ballot initiative to ban smoking in Ohio’s small businesses. Kidnappers, thieves and rapists were hired to collect signatures and addresses despite the fact that Ohio election law prohibits felons from working petition workers. Additionally, the smoking ban was approved for being included on the Ohio ballot by state officials despite the fact that thousands of signatures were invalid and despite the fact that SmokeFree America did not meet lawful requirements. These violations were easily discovered and some of them were known by officials proving that complicit state officials quietly supported the ballot push and turned a blind eye to law breaking by the anti-smoking advocacy group.

Ohio election law prohibits convicted felons from working as petition workers, yet 47 felons have been discovered as employees of SmokeFree America in its Ohio effort. Of these felons several were convicted of rape, one accused of raping a child. Alarmingly, SmokeFree America exposed Ohio residents to rapists who were collecting their signatures and addresses! There were also forgers and thieves collecting signatures and addresses of Ohio residents. Other criminal actions by petition workers: arson, burglary, breaking and entering, weapons violations, kidnapping, drug violations, drug trafficking, grand theft, etc.
The petitions also had multiple violations of Ohio election law. Some petitions were signed by those paid to circulate the petitions — a violation of the law — and their addresses were given as hotels instead of the required permanent home addresses. Also some were out-of-state signatories instead of Ohio residents.
There were also multiple violations of petition worker’s reporting forms (form 15s). In some cases petition workers didn’t file any form 15s at all, in other cases the form was filed after petitions were counted as valid, and in still other cases, the petition workers did not properly list the petition company they were working for on the form 15s reports. In each and every case, petitions should have been thrown out that were collected by paid petition workers who did not file a legal and correct form 15s yet these petitions were not invalidated by state officials.
Further, there were serious mathematical errors in tabulating the final count of valid signatures and many of the invalid petitions were counted as legitimate. Thousands of signatures were legally invalid but were accepted by the Ohio Secretary of State’s office anyway.
Finally, the Ohio Secretary of State’s office approved the inclusion of Issue five 20 days before the petitions were received — as incorrect as they are — and almost a month before they were approved as valid. This means the Sec. of State approved of the ballot initiative before authorities even had determined that SmokeFree America had satisfied the legal requirements to qualify for inclusion on the ballot.
It seems patently clear that the Ohio Secretary of State’s office had determined to add issue five to the ballot whether or not all legal challenges were satisfied.

The same thing happened in Dallas, all the "bars" have been banned from alowing smoking. Now those of us who smoke get to stand outside in the pouring rain or the heat and the cold. A lot of the bars tried to fight it and lost. I've definately noticed a lot fewer people at the ones I go to and I've even been going to ones where I can smoke. I CHANGED my habits and patronage. The places I used to go have LOST buisness!!
Do the "non smokers" care? NOPE!
The "Nanny's" and the "do gooder's" are to dumb to realize that THEY are responsible for lost revenue, jobs, taxes, liquor vendor sales, and a host of other problems just because of their selfish "need" to control the decisions of others.
Don't lump us all in. I'm a strong non-smoker (disabled vet with lung problems from the first Gulf War Oil fires). Gubment should only be able to control smoking on ONE place – Government offices!! If a private business wants to allow smoking, I will back them 100% – even though I don't smoke.

It is getting very hard to locate this information from the web these days, but the majority of scientific secondhand smoke studies involved non-smoking spouses of smokers. Basically, studies showing the dangers of continuous breathing within six inches of a chimney are being used to make policy which espouses it is dangerous to be within a block of the chimney. Now that "the science is settled" you do not see new studies being done, thus the smoking behaviors of the past (see Mad Men and older Hollywood films and shows) defines the argument instead of today's more moderated use and "take it outside" behavior. Moreover, I have yet to see where the presence of radon and similar other causes of lung cancer have been ruled out. Remember Dana Reeve, wife of Superman, died of lung cancer despite being a nonsmoker with a healthy lifestyle? As that did not fit the narrative, the MSM quickly pushed that out of the way, and she is rarely if ever mentioned anymore.
Of course, smokers are now properly demonized and smoking is completely disgusting, the science is settled, they are getting what they deserve (see Alinsky "Rules for Radicals"). Likewise Climate Change is settled science and carbon polluters are disgusting, and countless people are harmed merely by the existence of these uncaring bastards.

The current Secretary of State of Ohio is one Jennifer Brunner(D). She has strong ties to Acorn in Ohio right on up to Obama. Do a search on her and Acorn, lots of information to be found. To make matters worse, she is running in 2010 for George Voinovich's senate seat, who is retiring. Currently, Rob Portman (R) leads by just a few points in the polls, but it is way too early. Brunner, with her ties to Acorn, and a recent law suit that was settled in Ohio in favor of Acorn, gives Jennifer Brunner a chance to manipulate the outcome of the 2010 elections, including the Governors race, where the incumbant Democrat , Ted Strickland is being challenged by Republican John Kasich. The polls are showing a neck and neck tie betweent these two. Once again, way too early, but Jennifer Brunner has the tools at hand to manipulate the outcome if she is not stopped.
I live in Ohio and to call it liberal shows complete ignorance on your part. Unfortunately, the economy here is so bad that people just don't have the strength to fight back anymore. Businesses both large and small are taking advantage of Ohio labor laws to cut payroll. An employer can fire you for any reason here and if they can lie half as well as a 2 year-old, they can make sure you're denied unemployment compensation. They need no proof of their accusations. Many, many people here have been through this. When your worried about feeding, clothing and sheltering your family, election fraud has a way of being low on your priority list..
Back in the day, when almost ALL adults smoked ( whether it was a pipe, cigar, or cigarettes ) almost NO children had asthma. Now, all you ever hear about are all the massive amounts of child asthma sufferers. Connection ?
What's even weirder, is that some of the most rabid anti tobacco/cigarette people want to legalize pot and pot causes more lung disease than tobacco does.

I hate to be the one to break the news to all of you, but this went on the ballot and passed way back in 2006. Ken Blackwell, GOP hero extrordinaire, was the SOS at the time. It was his people who failed to do the due dilligence. Jennifer Brunner, ACORN ties and all, had nothing to do with it. Uncovering all this 3 years later isn't going to change anything.
I realize that this does not fit the narrative of many conservatives, but it is historical fact.

I have some problems, as well, from working the Emergency Services (Fire/EMS/Police) but this is so out of control. Indiana University, January 1, 2008, banned on campus, including all outdoor areas, that's about 2,000 acres just for the Bloomington campus.

I also live in Ohio……it is sad to see all the corruption…..and the ACORN bus loads of voters brought in from other states, college students and inner city folks driven and paid to vote several times……wow….what a country…..no need to verify your ID and where you live, simply just go and vote early and vote often — chicago style. Only in Ohio….another state following the deficit spending ways of California and New York……we actually have more conservatives in the state, but….the corruption has been taken to a new level…make up all the democrat votes out of thin air….we need for an outside observer to come in and audit the next election………..

If a suspect is wrongfully convicted of murder on the basis of a bloody glove that was found during an illegal search and seizure inspired by an anonymous tipster (who, incidently, might have been the real killer) then DESPITE the fact that 12 members of the jury agreed on the guilty verdict, the suspect is exonerated. The same should be done with Ohio's ban law, particularly since it's been clearly shown that the ballot language was deliberately designed to deceive the voters. {continued…}
If it can't be undone legislatively, it can still be effectively undone through the executive by following the example set by President Obama. Just as President Obama has recognized the undesirability of federal marijuana laws in states that have legalized medical marijuana use and has halted their enforcement, Governor Strickland could declare a halt to enforcement of the state's smoking ban in recognition of the fraudulent means used to bring it about.
He could even do so as a show of support for reducing smoking since dropping the enforcement would allow ban supporters to demonstrate to the rest of the nation that bars/restaurants will simply maintain the ban on their own since it's been so profitable to them and everyone loves it so much.
If it's good enough for America, it's good enough for Ohio!
Unless, of course, the smoking-ban folks are lying about its profitability and popularity just as much as they lied about their petitioning.

After all was said and done, the smoking ban did not qualify to be on the ballot. It was short by over 33,000 signatures but was put on the ballot anyway. Outright fraud. The ban should be overturned and all fines paid should be reimbursed. The more than 360 bars that closed due to the ban should be compensated!
At least this may raise awareness to just how fanatical the anti-smokers have become and how complicit our government is! Prohibition is alive and well, Al Capone had nothing on the extremely well-paid prohibitionists of today!

The controversy of second hand smoke could be ended quickly by a simple act of legislation. Anyone presenting information represented as science or health reliant information, which is later found to be false or misleading, would be rewarded with a mandatory ten year jail sentence.
I can guarantee the bandwagon of smoker hatred would end overnight and the profiteers would be making deals in self preservation convicting each other. Similar to the last time their ilk rose to prominence and Doctors were hanged at Nuremberg. The laws of Autonomy created in the wake, are largely being minimized by the bigots and zealots of Public Healthism, they are laws we found at the expense of millions who died without them. No one has the right to make health choices for others and no one has a right to demand rights to the detriment of others, especially with the convenience of a lie, as we find in the “toxic effect of second hand smoke”.

If this second hand smoke has been proven to be so dangerous, why wasn't the EPA or OSHA called to TESTIFY, UINDER OATH, before the State government? That under oath thing would be a REAL problem for the propaganda machine of the ban movement. All these grant sponging, pharma funded groups, spouting nonsence "science" should have been required to testify before ANY ban based on "science" was considered. Responsible Legislators should and COULD do this NOW, before anymore small businesses are closed due to hype.

I agree. As long as your bad habits don't affect me any my bad habits don't affect you, we should all be able to endulge them. However, don't expect others to pay for the consequences of your bad decisions. You know smoking can cause cancer, so, don't sue the cigarette company or expect others to pay your medical bills. You know alcohol makes for bad driving, don't sue the bar when you get into an accident.
The kicker to me is this:
At the same time as the government is cracking down on cigarrette smoking, it's also tossing around the idea of marijuana legalization.
Trading one vice for another is not progress, and I can argue the medicinal benefits of tobacco just as well as anyone else can argue the medicinal benefits of pot.
I am a smoker and even before the law I respected the right of people who were offened by smoke. The point is, let's make privately owned business decide what they want and give smokers and non-smokers their choice of which will get their business.

Yes, I saw that study as well; however, it still doesn't account for/explain why, supposedly, so many non-ghetto kids reportedly have asthma. I believe that the asthma stats have been cooked.

Michelle, this election fraud has impacted an entire sector in Ohio: bars & private clubs. We employ MANY people who have been laid off because SmokeFree Ohio lied. They told the voters it would NOT hurt our businesses. BIG LIE. They claimed exemptions the voters read when they voted for family owned and operated businesses, private clubs and outdoor patios. There ARE no exemptions. Lie #2.

There were 8 little words missing that would have clearly said no exemptions: "not open to the public" and "with no employees". Now we find they committed fraud to get it on the ballot? The proper term is "ex-felons", not "felons". Felons are people in prison. Ex-felons have rights too. It is very tough for ex-felons to find employment, but society is far better off when they do find employment. They are much less likely to offend again.
The First Amendment protects ex-felons' rights also, and one of the First Amendment freedoms is the right to circulate a petition. The US Supreme Court already ruled in 2001 that people who aren't registered to vote have a right to circulate petitions. The case was Buckley v American Constitutional Law Foundation.
The state of Ohio seems to be ignoring the situation by allowing an illegal law to thrive.

It's my understanding that the govenor of Ohio is a Democrat, the political party that has a JACK ASS as its mascot, named and done so after Andrew Jackson ('the jackass' per PBS).
Vote all of the Democrats out. I think most of us have had enough of 'it' in all directions.
I believe Richard is being deliberately misleading above by his careful choice of phrasing. Yes, the 1st Amendment most certainly protects ex-felons, as does the Constitution in general. HOWEVER… I believe that certain SPECIFIC rights *have* been taken away from ex-felons with the full approval of the courts: including the right to vote.
I do not know the specific law regarding petition circulation, but I find it notable that Richard did NOT quote a law that was directly applicable, but instead quoted one that might fool people into thinking it's the same – when it's not. "people who are not registered to vote" is NOT the same as "ex-felons." Given his evidence conversance with case-law my guess is that there simply is no case law to support his contention and thus he quoted something else while knowing full well that it was misleading.

2.Ohio law bars persons who have been convicted of any felony under the laws of this state, another state or the United States from circulating initiative petitions. (see R.C. 2961.01(B) and R.C. 2967.17(B)). You must invalidate any part-petition which was circulated by a person who has been convicted of a felony whose right to serve as a circulator has not been restored by a court of record. To verify whether a circulator has been convicted of a felony, you may seek the assistance of your county clerk of courts. If you determine that a felon circulated any part-petition you are examining, please provide the felon’s name and address to the Elections Division promptly, so that the Elections Division may share that information with the other boards of elections examining parts of the petition.

You are right. Local DA's and even the state DA's won't touch any of this acorn stuff or anything else. None of em are scared to get get in troube. And if they do it will be downplayed. And if that does not happen they will go to jail and do their time and then get a cushy government job when they get out.
Either way they know they will be ok in the long run no matter what they do.

Big pharma doesn't have enough people buying their brand of nicotine with extremely harmful side effects? They USE the state governments to help market it by force after they absurdly raise the tobacco tax and legislate smoking bans on private property! After all, doctors can prescribe big pharma's nicotine Nicoderm and Nicorette, they don't prescribe natural tobacco. But big pharma is trying to ban all natural products, they aren't benefitting from those sales! They have created an obesity "crisis" now. Johnson & Johnson makes Splenda and drugs for this new malady and will demonize the overweight as they have smokers just for profit. SHUT THESE PEOPLE DOWN!
