Obama Starts Constitutional Crisis, Installs New Radical Czars
by Tom FittonApparently, “respecting the U.S. Constitution” didn’t make it onto President Obama’s 2012 New Year’s resolution list, as evidenced by his “recess” appointment of anti-business extremist Richard Cordray to head the Consumer Financial Protection Bureau (CFPB). Just an few hours later, Obama made three additional appointments to the National Labor Relations Board (NLRB), which has become little more than a Big Labor battering ram under this president.
Obama is terming his appointments “recess” appointments. They are nothing of the sort, because Congress is not in recess. Article I, Section 5, Clause 4 of the U.S. Constitution provides that “Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days …” To prevent any recess appointment, the Republican-controlled House has refused to consent to Senate adjournment, resulting in the Senate coming into pro forma session every three days. But as Ed Meese, who served as Attorney General under Ronald Reagan, points out: these pro forma sessions aren’t gimmicks. The two-month extension of the payroll tax holiday was approved during a pro forma Senate session.
But in an unprecedented power grab, Obama has decided that he can decide when Congress is or is not in session. Meese rightly calls it a “constitutional abuse of a high order.” If this abuse stands, the U.S. Senate’s constitutional role to advise and consent in the confirmation of key executive appointees, already undermined by Obama’s many czar appointments, could become moot.
The response to these outrageous and unconstitutional appointments was swift and severe. The editors at Bloomberg immediately splashed an editorial on its website warning that the “president is playing with fire” and choosing “politics over principle” with these appointments. “He risks an election-year legal challenge that could hamstring the consumer bureau and several other financial regulators whose pending confirmations will probably now stall,” they warned.
Any substantial actions by Obama’s pretend appointees at the CFPB or the NLRB would, it can seriously be argued, “null and void.”
Nonetheless, Barack Obama appears undeterred by such considerations.
The Cordray appointment, in particular, earned the ire of Senate Republicans who filibustered this nomination in December 2011. According to The Washington Times:
Defying Congress, President Obama used his recess appointment powers Wednesday to name a head for the controversial Consumer Financial Protection Bureau in a move Republican lawmakers said amounted to an unconstitutional power grab.
The president acted just a day after the Senate held a session — a move that breaks with at least three different precedents which have held that the Senate must be in recess for at least three days before a president can act…
…The appointment in question is former Ohio Attorney General Richard Cordray, whom Mr. Obama tapped to head the CFPB. The board was set up under the new Wall Street regulation bill Democrats powered through in 2010, just before losing their majority in the House.
You may recall that the CFPB was created by the Dodd-Frank monstrosity and got its sea legs under its first head, Elizabeth Warren, another anti-business zealot now running for Senate in Massachusetts (you can read more about Warren’s troubled past here).
If Cordray is the “right man for the job,” as Barack Obama noted in his remarks, then why would the president need to resort to such extreme measures to get “his guy” in position at the CFPB? Because given Cordray’s controversial background and penchant for inflammatory and irresponsible rhetoric, there is no chance he could survive the confirmation process — especially when you consider that Congress does not control the agency’s purse strings. The CFPB gets its funding from the Federal Reserve.
Here’s what I mean by “inflammatory and irresponsible.”
In a scathing editorial when Cordray was first nominated, The Wall Street Journal said that throughout his career, Cordray has demonstrated a “hostility toward business.” The Journal explains:
[Cordray] sued Ally Financial’s GMAC Mortgage over its foreclosure practices—a lawsuit that helped spawn the national robo-signing uproar, which has mushroomed into an effort to force big banks to cough up billions for Democrats to redistribute. He sued rating agencies for grading mortgage-backed securities as safe investments. He sued Bank of America for purportedly hiding losses and bonuses prior to the Merrill Lynch merger. The list of cases is long.
In an interview with the Journal, Cordray also compared employees of a financial services company to the “Nazis at Nuremberg” who said they were just following orders.
And, as John Berlau points out in The American Spectator, “Cordray has long supported ESOP, formerly known as the East Side Organizing Project, an Ohio housing advocacy group that has distinguished itself by storming into banks and launching plastic ‘shark attacks’ on the lawns of private homes.” These are tactics that would make any Wall Street Occupier proud.
But while Cordray was all too happy to spew venom at U.S. corporations, the then-Ohio attorney general showed little regard for one of his own constituents, including Ohio citizen and small businessman Joe Wurzelbacher, also known as “Joe the Plumber.” Cordray looked the other way while Ohio government officials (and Obama hacks) combed through Mr. Wurzelbacher’s private government files and attempted to dig up dirt and smear his name – all because Mr. Wurzelbacher had the gall to question then-candidate Barack Obama about his tax policies.
Commenting on his decision to bypass Senate confirmation, the president explained, “I’m not going to stand by while a minority in the Senate puts party ideology ahead of the people they were elected to serve.” The president said it was his “obligation” to ignore the Senate and simply install Cordray.
And following through on his “obligation,” Obama moved quickly to install three more of his cronies over at the NLRB. Obama first announced these three NRLB nominees on December 15. They haven’t been filibustered, they haven’t had their background checks, and no hearings have been scheduled yet by the Democratic-controlled Senate. So Obama thinks it appropriate to install appointees in violation of the law of the land simply because he anticipates opposition? I understand this president fantasizes about being king, but this act shows that he is acting out his fantasy.
According to The Washington Post blogger Greg Sargent, “The move, which is arguably as important as the Cordray appointment, will ratchet up opposition from Republicans and make this an even bigger fight, since they have been attacking the NLRB…” Sargent accurately points out that the president’s appointments will “help energize unions in advance of the 2012 election…”
So, who is it exactly that is putting politics ahead of what’s best for the country?
Barack Obama cannot toss enough bones to his friends in Big Labor. From Obamacare waivers to recess appointments to the NLRB’s controversial Boeing lawsuit, the president seems intent on paying Big Labor in advance for union votes coming his way in November.
What is there to be done about Obama’s power grab? Short of impeachment (which, however extraordinary, for the first time in this presidency ought to be given serious discussion), Congress can make its displeasure known through the appropriations process and by holding up more nominees (which may not be any good given the president’s usurpations this week).

There is a better than 50 50 chance Obama will be reelected, mostly due to the power of incumbency and his being the first non white president. Add to that the fact that his constituency can't read, and if they can, they will only read the headlines that unemployment is falling–obviously, things are better, lets not change horses in mid stream.
What a tragedy that the greatest country the world has ever known was reduced to ashes by such a patently phony, lying scumbag cockroach and his supporters.
I'd like to share some of the optimism others in here have that we can fix the problems we face in Government. But I don't.
Think back just 4 years ago, did you fear your government? Did you think they would take your private property, spy on you, keep all your emails? Put you in jail indefinitely without trial? Send guns to the Mexican cartels to attack the 2nd Amendment? We all know this list could go on for pages, now………..think of what they are doing that we DON'T know about yet.
I hope these appointments go to court – and BO loses. If that happens, EVERY decision made by these unlawful people will be overturned. I would love that!

If one looks closely at the US Code being modified, you can plainly see “who” this targets……”A person who is a national of the United States whether by birth or naturalization, shall lose his nationality by voluntarily performing any of the following acts with the intention of relinquishing United States nationally.” Considering this statement, and the list of persons considered by DHS to be a threat to national security and the US government, should one still feel secure in knowing this is only for those “terrorists” who come to the US to attack us?
These two bills, not reported by the media’s and promoted by members of Congress, virtually work hand-in-hand to leave discretion to the POTUS as to “whom” are considered a terrorist….AND upon such determination (ie: S.1698 modification), allows the government to strip an American of their citizenship thus arresting according to the NDAA…..
Sorry if I didn't articulate this good enough, but if I am wrong about this…..I welcome “legitimate” clarification….from a most reliable source……

Here in AZ, I am aware of many friends/acquaintances who voted for Obama. Most of them won't even mention his name any more (they couldn't rave enough about him before the election of 2008). I spent 20+ years dealing with attorneys. They are the one's who make these bills. They have a language all their own and are masters at illusion with words. These two bills, while people argue don't say one thing or say another, are in fact exactly what the Liberals want them to say….and will result in labeling opposition to Obama/Soros's agenda as either terrorists or enemies of the State.
This survey is suspect. First, I don't know of any "Mandatory, by law" survey other than the census, I'm researching it. Secondly, it came with my ex-wifes name also on it, at this address. I divorced 8 years ago, in a different state. Something is extremely odd here.

We can only hope to be free of this or future administrations of its ilk when we restore the original limits on the national government which have been stripped away by Supreme Court decisions since 1937. Judicial watch needs to sue to stop this immediately, and Obama needs to be in the hot seat ASAP in a senate investigation, just like Eric Holder. Therefore, Soetoro is ineligible to hold office. And we cannot be bound by the appointments and pronouncements and orders of a fraudulent usurper.

The government will be going into the landlord biz when people can't pay their property taxes and the property is seized. A preview of what I am working on. I call it 2012 Petition of Grievances. Let me run it by you. Naturally, the vast majority is the work of Thomas Jefferson.
When in the course of human event, it becomes necessary for one people to reassert their role as the source of political power, by rebalancing their governmental system to maintain their status as a free people, to which the nature’s God entitles them, a decent respect to the opinions of humanity requires that WE THE PEOPLE should declare the causes that impel our action.
We hold these truths to be self-evident, that humanity is created equal by their Creator, and that said Creator has endowed them with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. That whenever any government by man or men should deliberately seek to alter or overthrow this social contract, under our current system of governance, WE THE PEOPLE, by the mechanisms of election, impeachment, amendment, or application to our courts for redress, holding ultimate sovereignty, can terminate this effort. Should such remedies prove ineffective, WE THE PEOPLE, using historic precedents, have the right to alter or abolish said government, and establish a new system of governance that shall honor the social contract.
Prudence, indeed, will dictate that government long established should not be changed for light and transient cause. Nor should the leadership of said government be replaced, except by Constitutional means. However, when a long train of abuses and usurpations, pursuing invariably the same object to effect a transformation of our Constitutional order, imposing upon the people rule by one man or political party without the expressed consent of the people, it is the duty of WE THE PEOPLE, it is our right to stop such abuses and usurpations in order to protect our natural rights.
Such is the patient sufferance of the people of the United States under the current chief executive and his administration. Let the facts be submitted to a candid world as to why Barack Hussein Obama should be removed using the mechanisms the people have at their command to redress the balance between government and the sovereign people of the United States of America.

Glenn Beck had a gentleman on his show recently who is 're-working' the Constitution and Bill of Rights into 21st century terms. This is an important development; the biggest fraud being foisted upon us is the notion that these words of brilliance are the mutterings of 'slaveowners of privilege from a distant past'. It's why youngsters have no interest in knowing their freedoms.
This is being done to them on purpose, and it's up to people like you to set this straight…
I think many of us are being critical because of the reaction of Republicans to the 2008 financial crisis (I have to abandon the free market to save it???!!! WTH!!???), to the Tea Party, and the ever growing knowledge that many Republicans are actually Republican Progressives, and therefore not really "classical liberals" abiding by the Constitution, not really giving us limited government. They just do things slower than the Democrats, but still leading us to a social welfare state (at best).
Many of us had a bit of hope that the Tea Party would wake up the GOP and make them realize that we are done with Democrat-Lite. But Boehner and Cantor and McConnell and many others have showed us that they simply did NOT get the message.
I'm not looking for perfect. But Gingrich calls himself a real politick Wilsonian, loves FDR and thinks he was a great President at giving us representative democracy and he loves Teddy Roosevelt. What do all those men have in common – PROGRESSIVES (which by the way is just American-style Fascism). No thank you.
Romney gave MA Romneycare and although he touted 10th Amendment talk, he also said it would be a great template for the entire country. I'm willing to give him slack on the pro-choice/pro-life thing – even I have changed my mind from pro-choice to pro-life. It can happen.
So his "conservative" credentials are still in question, IMHO. But compared to the others that are left, I'm leaning towards him as the best we can do . . . for now.
Huntsman is an Obama lacky. I liked Cain, but he imploded. Ron Paul – make him Secretary of the Treasury, but keep him away from the Defense Department and/or the State Department. I liked Bachmann as well, but then she did the whole Jenny McCarthy thing on Gardasil and that lost me (mandates, no; but don't do the "junk science" thing).
Santorum has his problems as well – not as fiscally conservative as everyone would like to believe and a bit too socially conservative for my taste (I'm not interested in an Amendment to the Constitution regarding marriage; it's traditionally been a State issue and should stay a State issue; I don't like giving the Federal gov't anymore power or responsibilities).
You are writing what I have called for for over a year. First, we should be organized better, as our Founders were. A sort of modern "Continental Congress" so that there is a form of consent from Americans that we need to do something about the out of control gov't.
Second, as you were writing – and as I advocated – a new Declaration of Independence. And one that does not just concentrate on Obama, but what the Progressives (regardless of party affiliation) have done to our Constitution and our Country for 100 years.
It must be prepared and ready to sent forth to every local, State and of course the Federal government.
And on top of civil disobedience, we must be prepared and willing to fight if it comes to that. I would like it NOT to come to that. But our hearts and minds and souls must be prepared to do so. And that also takes organization, which, unfortunately, we lack. And that will be our biggest problem. Our Founders were organized and that helped a great deal. We should be spending more time organizing ourselves for whatever comes instead of just continuing the same old same old that the Right has always done.
And that is why we must NOT elect another like him…who has outside influences…influencing them!
There is only one 'real' conservative in this race who can really bring hope and change…Rick Santorum!
He is the one we need to clean up this mess…because his hands are NOT dirty…like the rest!
