Judging Alito – Obama’s Ultimate Arrogance
by Thomas Del BeccaroPresident Obama’s State of the Union obviously was a first in more than one way. Obama point blank, called out (to use the modern vernacular) our Supreme Court Justices on national TV. He did so because he politically disagreed with their legal decision. In doing so, Obama demonstrated his supreme arrogance – and let America know just how far he is willing to go to get his way.

As we know, our Federal Judicial system is one of three separate but equal branches. Historically, the judiciary has been the least political of the three branches. That status reaches well beyond our own system. Prior to judges and courts, civilizations tended to rely on counsels of elders to pass judgment on the actions of their village or tribe. Those elders held a special place, as dispensers of wisdom, in their societies.
The roles of judges today evolved from those wise elders. Importantly, our system and theirs was based on the notion that the decisions made were made dispassionately and not subject to mob rule or pressure. By publicly ridiculing the Supreme Court, and subjecting them to a standing ovation from the complicit Democrats that surrounded them, Obama demonstrated to everyone how little regard he has for our system. That disregard is in keeping with his Saul Alinsky radicalism and the methods he employed.
Obama, to be sure, is not the first President with a constitutional changing agenda to take on the Supreme Court – nor the most crass about it – at least so far. That dishonor belongs to Franklin Delano Roosevelt.
It is not remembered often enough that FDR’s initial New Deal legislation, the National Industrial Recovery Act, not only did not produce economic recovery – government forays into economics rarely do – the Act was unanimously rejected by the Supreme Court in 1935 as unconstitutional! In doing so, the Supreme Court stated that:
“We are told that the provision of the statute authorizing the adoption of codes must be viewed in the light of the grave national crisis with which Congress was confronted . . . Extraordinary conditions may call for extraordinary remedies. But the argument necessarily stops short of an attempt to justify action which lies outside the sphere of constitutional authority.”
In other words, as a matter of Constitutional law, the Supreme Court of the early 1930’s, bolstered by their brethren that had gone before, believed that our Founders did not authorize a central planning government dictating economic policy. To the contrary, they fought the Revolution to establish a decentralized, limited government that would leave economic development to the newly freed American citizen.
FDR, however, was not interested in such “legalisms.” Incredibly, Roosevelt asserted that Americans “cannot seriously be alarmed when they cry ‘unconstitutional’ at every effort to better the condition of our people.” To the contrary, he asserted that “We will no longer be permitted to sacrifice each generation in turn while the law catches up with life.”
To combat such tardiness, Roosevelt sought to “reorganize” the United States Court to remove the lone remaining obstacle to his empowerment of government. “He proposed a statute that would give him the power to nominate a new Supreme Court Justice whenever any sitting member reached the age of 70.” It was no less than a shot across the bow of the Supreme Court. In time, FDR would accept revisions to his plan but his aim was clear, he wanted a younger less historically or constitutionally encumbered set of minds to approve his transformation of the American government. According to Bruce Ackerman in his worthy book, We The People – Transformations, “The President’s Court proposal hit the country like a bombshell.”
Ackerman writes that the public debate that ensued “raged on . . . and culminated with addresses by the President . . . [one of which] asked how the Administration could fulfill its campaign commitments to farmers, workers and other groups given judicial resistance to “a progressive solution of our problems.”
It was a constitutional show down whose magnitude had not been seen since Marbury v. Madison. But rather than prolong what had become a crisis by all measures by defending our Liberty, two Supreme Court Justices simply and literally switched their vote under the mounting pressure of the times and in the looming shadow of 66 different proposals from politicians to end the impasse. Thereafter, another Justice who had voted against FDR’s activist government plans retired and Roosevelt had the newly compliant Supreme Court he wanted and – literally – it suddenly deemed constitutional that which was clearly unconstitutional just a few years before.
American would never be the same – and today the New Deal programs threaten our solvency in addition to taking away our freedoms.
As you consider all of that, reconsider the rhetoric of this President. Ask yourself if he is historically or constitutionally encumbered? Or whether he will use any means, including ridiculing the Supreme Court to get his way – so that American will never be the same.

Had the Court brought him down to size and devoted a moment to the birth certificate issue, we could have pre-empted this confrontation.

Not that it is a surprise, but my local news rag the Knoxville News Sentinel ran the AP story under the headline "Alito's Speech Reaction Sparks Controversy." I thought to myself, if this had been a Republican President making the comment (of course a Republican would not make such a comment) the headline would be "president's bashing of Supreme Court unprecedented."
Obama is an arrogant ass, and the whole world revolves around his highness, being the annointed one and blessed messiah. Get this usurper out of there before he completely destroys this wonderful land of the U.S.! Bring on the birth papers, college papers, medical records, and see what this Indonesian or Kenyan or whatever his nationality is out in the wide open.

Obviously the first President had the opportunity of appointing more Justices because the Constitution began with him. Washington appointed 11 Justices and Roosevelt came in a close second with 8 appointments. Had Roosevelt served out his 4th term he would have appointed a grand total of 9 Justices. The whole court would have been full of Progressive/Socialist. And look who FDR appointed; Robert Jackson, who was a strong proponent of nationalism. Early in his tenure on the Court, he wrote the Court's opinion in Wickard v. Filburn (1942), which laid to rest for over half a century claims made that Congress had violated the commerce clause. Hugo Black, a member of the Ku Klux Klan. William O. Douglas, the touchstone of Douglas's character was a willingness to do anything to forward his own career — including lie about his past, break his promises and ruthlessly discard wives, children, friends and clerks as soon as they stopped being useful to him. I could go on the rest of the weasels that FDR, and Trumans appointment of Justice Vinson (another Progressive/Soicialist), but I have an appointment. Great Article, exposing the creeping Progressive/Socialist mess that we are in now.
Obama's use of thuggish community organizer tactics on the SCOTUS was insane. Even Sotomayor appeared to internalize the insult. As for all the 'Schumers' that vigorously applauded the slight by Obama, start packing. You are ALL toast.
Somewhere down the road hopey is going to need a break from SCOTUS … good luck with that.

When the "tea party" candidates hold the power it will be time for a con con. We need to clean out the unconstitutional baggage the supreme court calls stare decisis for one and then set new limits on lawyers switching to politics. There needs to be a new US code for all elected office holders who lie, steal or otherwise violate their oaths. We also need to empower the people to petition for redress to the supremes should congress deny the right. A favorable decision for the people should require immediate election to fill the positions of the traitors. The people should only require a substantial interest in seeking a grievance to be heard to force congress to hear it. What has been going on is as illegitimate as a whore in the rectory.
I think there were many of us that knew what we were getting. Sadly some that knew still voted for "Hope and Change" because they vote with feelings instead of their brain. That is the segment of out fellow country men and women that we need to educate before the next election.
Having said that, I do think we have made great strides in that education because of the TEA Parties, Glenn Beck, Rush and even NO-Bama himself because people are waking up.

The separation of powers embodied within the US Constitution "expressly forbids" the president and members of congress commenting on anything the court does, likewise the court can't say a word about them either.

That is a powerful line. The failed pork policies from FDR's New Deal, in conjunction with the failed pork policies from LBJ's Great Society have crippled and stifled this country. Every time we have a "Progressive", we have an unmitigated disaster.

This was clearly an effort to intimidate the Court. I realized that we were in a very dangerous time, and that the intimidation would worsen before November. If they are able to resist the pressure, theRepublic may survive. Of course this means we must put three times the pressure on the legislooters in Washington, district of criminals.

(There was plenty of recovery in the New Deal- unemployment was cut in half and industrial production rose 14% each year for three years, and an average of 10% each year until the war build up!)

(The Founders had no concept of a National Highway System, the Manhattan Project, the Space Race to the Moon, World Wars, the Cold War, or nuclear threats! They at least rejected the Articles of Confederation!)
The court was a disaster in FDR's day and the Nine Old Men were in lock step with the failed greed of Wall Street who was ripping off the public then and now. We needed regulation and the New Deal went about it. Thank G-d , Justice Owen Roberts changed his vote and the whole history of America was saved. The rest of the corporate flacks on the court like the anti-Semite McReynolds, Butler and others finally figured out they were out of step with the times and resigned. On January 30th, this Saturday, Happy Birthday to FDR! You folks just want free reign to sell phony stock, phony bookkeeping, derivatives, debt-swapping and land under water in Florida.

As far as his actual statement being totally "not true", let us leave that to the politicians and pundits to sort out.
Spitting on our American way of life in front of all to see is what we must rally around and make a SUPREME effort in neutralizing this Chin in the air fraud for the rest of his term.
That's ridiculous on its face. The so-called pork barrel re-built America, but the Crash, the three Eisenhower recessions, the Nixon oil embargo and inflation, Watergate, the Savings & Loan trillion dollar give away to people like the Silverado Bank, run by Neil Bush, the 10% unemployment and runaway spending by Reagan, and the unfunded wars and the recent crash authored by Bush II don't count.

You have too many topics jammed together, so I'll pick one. Reagan. When he came to office, interest rates were about 18% and unemployment was higher than 10%. Where were those numbers when he left? You won't touch that, will you?
You also have a very selective, and progressive thought process.

That’s right keep on spreading the blame for GOP failures. When Taft failed, the progressive Theodore Roosevelt got into the 1912 race and the country elected the reform minded- Woodrow Wilson., but were the irreconcilables led by Henry Cabot Lodge happy with Wilson over the Fourteen Points, the World Court, The League of Nations, the Clayton Anti-Trust Act, the Brandeis appointment, the Federal Reserve, and other progressive legislation? No way! So what were we left with the know-nothings; Harding and Coolidge and Hoover who was over his head. Now in the wake of the New Deal, the conservative revisionists accuse FDR of not signing on to Hoover’s last minute, 11th hour actions in the lame-duck period! If only Hoover had another 6 months his market cycle ideas would have cured the whole mess, In fact, according to Newsmax and the Tea Party geniuses it was FDR who turned the 1929 recession into the Depression. But are we finished? It must have been those few Democrats in Congress in the 1920’s that steered Hoover into the crash!
But what of Eisenhower and his three recessions, the farm collapse, U-2, the collapse and embarrassment at Geneva, the sell-out to Joe McCarthy of Marshall, Nixon’s great triumph in South America where he was pelted by fruit, the over thrown of Batista, the civil rights inactivity, (he stated that his worse mistake was the appointment of Earl Warren), the CIA bungling over the Bay of Pigs, our non-support of Hungary’s freedom fighter, and the abandonment of Britain, France and the Israelis over the Suez Crisis? It must have been LBJ and the Democratic Congress that caused the GOP meltdown in 1958! But what about Nixon and his activities that led to Watergate, enemies’ lists, domestic spying, the extension of the Vietnam War with more casualties than LBJ, the oil embargo and a slew of other mistakes? It must have been the Democrats? But how about that clown Gerald Ford, and his WIN button? He couldn’t walk or chew gum at the same time. Blame it on Congress for that incompetent! In fact, because he was so weak, we got a rank outsider and unknown Jimmy Carter, who barely beat him with 50.06 of the vote.
But all is not lost we then inherited the biggest fraud of them all, Ronald Reagan, who gave us 70% tax cuts for the rich, unemployment of 8% for eight years, record deficits, Iran-Contra, 250 dead marines in Lebanon, Bittburg, the $1 trillion savings & loan boondoggle, the 600 ship navy, star wars and the wave of spending without cutting expenses that led to the Bush II disaster. Do we have star wars or the 600 ship navy? Funny thing is that we do have Daniel Ortega! But it was big government in Washington!
Let’s not forget Bush I, who squandered his post Gulf War popularity of 95%, stated “no new taxes,” and almost caused the country to go bankrupt. That is why in 1992 his vote as an incumbent was lower than Hoover’s and maybe Martin Van Buren’s.
Now we are again in another mess. It is all because Dodd and Frank wanted easier mortgages. They must have created the derivatives, debt-swapping, Country Wide Financial, Enron, and all of the de-regulation fathered by Reagan-Bush! They must have sponsored the Dubai Ports, Katrina, two unfunded wars, the 8 year failure in Afghanistan, the blurring of the “establishment clause,” the faith based initiatives, the porous borders, the migration of jobs, the petro dollar outflow, the disappearance of our manufacturing base, the drug and energy giveaway legislation and the collapse of our banking system, the auto industry and the stock market. They must have forced Bush to not veto a GOP sponsored bill for six years. They must have sent GW Bush to Crawford to cut brush during those eight months before 9/11. In fact it was on their watch, not his! He was only guilty of reading a book upside down on 9/11!
So you are right, it isn’t all Bush II fault!

I cringe each time there is mention or inference that Obama is not competent or is mentally disordered. The radio talking heads appear to be taking this path these days. To believe these sorts of statements/propaganda is dangerous, and grossly underestimates BHO capabilities and how very dangerous this man-child is, as are all of the people in the "shadows" that have enabled him. This action by BHO against the SCOTUS is extremely concerning. After all, Obama, according to his own past statements and representations, IS IN FACT NOT ELIGIBLE TO BE POTUS. So for him to take such actions in this very public manner, indicates only that he is so very emboldened in his positions and the belief that nothing can stop him or take him down. I also think that subconsciously, the Obama may have encouraged more conservative views to gain merit throughout the court, as well…slapping the entire court because you don't like a majority opinion doesn't sit well with ANY judge…and they have subtle ways to make that known, such as flipping one or two votes to the Constitutional argument in a usually close decision…and in what cases the court accepts…

I cringe each time there is mention or inference that Obama is not competent or is mentally disordered. The radio talking heads appear to be taking this path these days. To believe these sorts of statements/propaganda is dangerous, and grossly underestimates BHO capabilities and how very dangerous this man-child is, as are all of the people in the "shadows" that have enabled him. Along with Reagan’s tax cuts for the rich, we experienced the Stock Market crash of 1987, the Savings & Loan debacle and bailout for almost one trillion dollars, and the deregulation of broadcasting, which has led to the consolidation of ownership regarding thousands of previously independent stations.
What we have seen in this country has been an explosion in private wealth and a crying need for public revenues. This drought in public revenues has resulted in an aging infrastructure, which includes; poor and deteriorating bridges and roads, an antiquated electric grid system, weak, porous and inadequate levee systems, un-dredged harbors and rivers, a deteriorating reservoir system and over-crowded dangerous airports. In the Clinton Years, taxes on the wealthiest bracket went up to 39.6%, three extra brackets were created, there were tax cuts for the middle class, surpluses ensued, and over 20 million jobs were created. A benefit of that expansion of the work force, especially in the center cities, resulted in a dramatic lowering of crime in the period from 1993 through 2000. (Another urban myth was that Rudy Giuliani’s police tactics alone lowered crime in NYC. What is conveniently forgotten was that crime dropped dramatically in urban centers throughout America without Giuliani’s help!)
Of course, one immediate result is that the "entitlements;" Social Security and Medicare are under attack. Certainly they are threatened by the demographics facing us. We have a large "baby-boom" population (64-74 millions) that is aging. This population emerged from parents that had 2.6 children per family. It is now being replaced by a generation that is composed of 2.1 children per family. Generally speaking this smaller population is not as wealthy and earns less in the service sector than its parents, the baby-boomers, earned in the manufacturing sector! Is the answer less taxes for this wealthiest of classes? It was said that to tax these people at previous levels would only bring in 4% more! Well 4%, if that is correct, will bring in $40 billion at least. Also, why is $75 billion being used from the Social Security Trust Fund to be used to help balance the budget and defray more deficits? These same antagonists of Social Security say it is “broke” and therefore people like John McCain and his former leader, President Bush, have called for its partial or complete privatization. This would be another trillion dollar gift to our Wall Street “friends.” Conveniently they have forgotten that the Social Security system runs surpluses and that since Nixon’s time over $2 trillion has been borrowed from this Fund to pay for trinkets like Star Wars space missile defense systems, the 600 ship navy, and an all-volunteer army. I am sure that figure of $40 billion is probably incredibly low. I have also noticed that a recent report has stated that the IRS has been lax regarding the issue of corporate taxation. In fact, US Corporations are not paying their fair share, and many have been running to offshore tax shelters for years, while they drape themselves in patriotism! The case of Stanley Tool recently comes to mind! So with corporate taxes at all-time lows (post WWII) and the capital gains tax at 15%, and the highest marginal rate at 35%. I would like to see from you geniuses out there where you would cut. Wake up to the reality of our needs!
Medicare and Social Security are not part of the general budget, (SSI had a $169 billion surplus this year and is solvent to 2037). If you take out the military, Homeland Security and debt service, there is 14% left of the discretionary budget. After the last moron decided that the big issue in America was Obama's birth place, let's get on to reality! Where should we cut? Maybe we should start with your job. Is it connected to government, the military? How about clawbacks regarding your benefits!

As economists Milton Friedman and Anna Schwartz proved to the satisfaction of most economists, the core economic problem in the early 1930s was a contraction of the money supply by a third. This caused the general price level to fall by about 25%. Thanks to the Progressive/Socialist entity, the Federal Reserve. The "greedy speculators" were acting independently in the "free market". The Federal Reserve and negative interest rates were the real culprit. The speculators were following the false signal the Federal Reserve was sending via artificially cheap interest rates.In 1929, the Federal Reserve insiders (Progressive/Socialist experts) decided to jack up interest rates worldwide, causing a depression. The insiders knew what was coming. They stopped issuing loans and converted all their holding to cash. In 1933, President Roosevelt confiscated everyone's gold, defaulted on the dollar, and declared the USA bankrupt. The dollar was devalued relative to gold, from $20/oz to $35/oz. Since the dollar was no longer redeemable in gold, this allowed a further increase in the money supply. The insiders who borrowed to buy assets at the bottom of the Great Depression were allowed to default on their loans, repaying their debts with devalued dollars. Many loan contracts contained "gold clauses" requiring payment to be increased if the dollar were devalued relative to gold. Congress declared these "gold clauses" invalid, ripping off creditors and providing a massive subsidy to debtors. In this way, politically connected insiders profited from all three legs of the Great Depression. They profited by borrowing and buying assets at the start of the boom. They were first in line to buy assets with the newly printed money, so they were the primary beneficiaries of inflation. Due to their political connections, with the Progressive/Socialist, they were able to foresee the crash coming. They converted their holdings to cash before the crash. At the bottom of the Depression, they were able to borrow and buy assets at a discount. Later, they were able to default on these loans via inflation; inflation meant these loans could be repaid with devalued dollars.
Your lies involving how the New Deal was successful does not jive with the facts. According to Amity Shales research, "from 1934 to 1940, the median annual unemployment rate was 17.2. At no point during the 1930s did unemployment go below 14 percent. … Living standards remained depressed until after the war." Burton Folsom of Hillsdale College quotes Treasury Secretary Henry Morgenthau. (who's chief advisor Harry Dexter White was a communist spy)Testifying before the House Ways & Means Committee in May of 1939, the FDR ally and acolyte did not sugarcoat it:
"We are spending more money than we have ever spent before and it does not work. … I want to see this country prosperous. I want to see people get a job. I want to see people get enough to eat. We have never made good on our promises … I say after eight years of this Administration we have just as much unemployment as when we started … and an enormous debt to boot."
On balance, the New Deal damaged the nation profoundly by extending and deepening the Great Depression.
"Don't confuse me with the facts…" the free market is not free, and in the same way there is no free press unless you own one. De-regulation benefits some, and the consequences must be accounted for. I have never seen an American president act this way. Obama was clear in this address which was not so much SOTU as it was the state of Obama address, that is is going to get mean and he is going to punish the American people. We can look forward to reconciliation on Obama Care. Chicago type aggression on Cap and Trade and white card. Obama will try to do as much damage a s possible before November. Anything that Obama does, can be undone by we, the American people. So Obama is going to do as much as he can before constitutional conservatives take back the House and Senate in staggering numbers. Speaking of fairness… It is a known fact that in and around 1970, CEO's of Fortune 500 companies made in real dollars a ratio of 43 to 1 over the average salary of their employees. In real dollars, wages, taking in account inflation over the past 34 years or so, have gone up slightly. In other words, the $17,000 of 1970 is not worth much more than the $35-40,000 of today. Of course times have changed, and our economy has shifted greatly over the last 30 or so years. Our manufacturing has shifted to overseas, and we are much more of a service economy today. No question "freer" trade has brought more total prosperity to America. But where is that prosperity concentrated and what will be the affects. In that light, executive compensation is now 1000 to one! In “real” and tangible 1970 dollars, the average Fortune 500 CEO was making $731,000. By the year 2000 that same corporate CEO’s compensation went to between $35 and $40 million. While his worker’s income doubled in 30 years, their real income barely kept pace with inflation. But the corporate executive had his income go up 52 times. Inflationary worries were obviously not a factor. Besides all that good news, the top income tax bracket was reduced by Ronald Reagan and his buddies at Treasury.
So we have seen what has happened. The GOP/Right has encouraged the lowering of taxes, the conglomeration of industry, the exporting of jobs overseas, the deregulation of industry, and the accumulation of greater money in fewer hands. Now, as in 1929, less people own more of America! In the midst of this incredible increase in executive compensation, Ronald Reagan’s administration lowered the highest tax brackets by more than 60% from 71% to 28% in 1986, while raising the bottom tax rate from 11 to 15%. In reality the Reagan Administration created two tax brackets. The poorest earners paid up to 15% and multi-millionaires paid a little more than double? Did this increase revenue to the Treasury? No! No wonder we experienced record deficits. Did it increase wealth to the wealthiest? Yes! Recent articles have debunked the “urban myth” promulgated by the flat-taxer’s and other anti-tax groups that tax cuts increase revenues. In fact, tax cuts without expense reductions create greater deficits. With that in mind, the Reagan years offered some of the biggest deficits, (tripling the National Debt), continued high unemployment.

The president opposing the Supreme Court is as ridiculous as opposing Roe v. Wade. Established SCOTUS precedent is the word of God.
Alito has the same right as any other American to voice a political opinion. But his willingness to do it publicly in the face of 200 years of tradition of staying above the fray demonstrates he is a partisan and not up to the job. He and Roberts both lied to get confirmed and exposed what is wrong with the confirmation process… and the results when you have a president determined to plant political operatives on the court.

As I recall Gerald Ford, as a Congressman, called for the impeachment of Justice William O. Douglas and had hearings regarding that action, because one of Douglas's articles was printed in a magazine called Evergreen. The Court had been criticized by presidents going back as far as our history exists. Jefferson had problems with John Marshall, Teddy Roosevelt had legendary fights with Oliver Wendell Holmes, and Eisenhower was unhappy with Earl Warren. FDR criticized the Nine Old Men and the Republic stood. Obama is right about this horrible ruling that has nothing to do with individual rights but uncontrolled corporate power, greed, and money. This ruling could open the door to foreign corporations flooding our, now out of control, electoral costs.

The "make work" jobs of the WPA were temporary, and lengthened the economic downturn. The more the government employees workers, the less capital there is for private investment. With private investments, long term jobs and careers are procured instead of the damaging public sector employment. Your use of Reagan is mind-boggling. The Jobs created during Reagan's administration were private employment, therefore more income to the government from tax receipts (and low tax rates) and long lasting jobs. Oh and by the by, Ms. Shlaes Miss Shlaes was formerly a columnist for the Financial Times and, before that a member of the editorial board of the Wall Street Journal, specializing in economics. Miss Shlaes has twice been a finalist for the Loeb Prize in commentary, her field's best known prize. In 2002 she was co-winner of the Frederic Bastiat Prize, an international prize for writing on political economy. In 2003, she spent several months at the American Academy in Berlin as the JP Morgan Fellow for finance and economy. In 2004, she gave the Bradley lecture at the American Enterprise Institute. Her essay, titled "The Chicken vs the Eagle" looked at the effect of the National Recovery Administration on the entrepreneur in the New Deal. Shlaes graduated from Yale University magna cum laude. Now, she sounds like she knows her subject. May I inquire to your credentials that would confirm your conclusions on the errors of Ms. Shlaes analysis.

As to my credentials, I am not a poster child of the right or the editorial page of the Wall Street Journal. I was a history major from Boston University, worked on Wall Street, was a partner in a manufacturing business for 25 years, a licensed financial professional for 16 years, allowed to sell equities and variable products, and am a long-time investor in Wall Street and come from a family that has long-roots in capitalism and investment. I lecture and write on FDR and the New Deal and you can Google my name and go into my blog. I have been involved in local politics for 40+ years and still run campaigns when asked. I have run many. My wife was an American Studies major at a prestigious Ivy League school and worked for a Congressman for 8 years, and my son graduated from Princeton as a EE major, and my daughter works for the Kennedy School at Harvard. I have known the good, bad and the ugly, and I met Ms. Amity Schlaes and heard her talk at the FDR Library at the Roosevelt Summer Bookfest. I disagree with her conclusions and glib rationale. I spoke to her and challenged her positions in a gentlemanly way that rarely exists on this blog. I reflected on her opinions. The piece below I took from an essay that I wrote last year. Shlaes a graduate Yale University magna cum laude with a bachelor’s degree,[ writes a syndicated column for Bloomberg News]. She is a senior fellow in economic history at the Council on Foreign Relations. Her many appearances on television and radio include commentary on public radio for Marketplace.
Her Wall Street Journal piece on New Deal job creation noted that such jobs may not always increase productivity. She wrote a column for the Financial Times for five years, for which she won the International Policy Network's Bastiat Prize for Journalism in 2002. Before the Crash of 1929, more wealth was in the hands of fewer people then any other period in our long history. Unrestricted capitalism led to wild speculation in the market places, an eventual credit crunch, and since we didn't believe in "safety nets" or entitlements, the ensuing collapse devastated our social order. In Arthur M. Schlesinger Junior’s great works, on that period, which include The Crisis of the Old Order, and the Coming of the New Deal much of this history is accurately reported and eloquently described. As in 1929, tax policies from Reagan on, with the exception of the eight prosperous years of the Clinton Administration, favored the rich, have shrunk the middle class, and have concentrated more wealth in fewer hands than at any time since the crash. This period of “wonderful nothingness,” which is what the 1920’s has been variously described, ended with the fall of one of its great characters and swindlers, Richard Whitney and the Bull Market in late October of 1929.
Amity Shlaes is entitled to her own views, and I regard her as part of the "revisionist right-wing" of FDR haters. She and her acolyte supporters can twist history, but they will not reverse it. Over 1000 books have been written on FDR and 98% of them are quite laudatory and positive. Long after your bones, my bones and the younger ones of Ms. Schlaes are dust the positive legacy of FDR will be with the world, unlike Hardin, Coolidge, Hoover, Nixon, Ford, Bush I and II and even Ronald Reagan, the Teflon Man!

By the way I was not judging economic growth on governmental employment at the local, state, and federal level. I was just stating, the government employment has grown under GOP Presidents, Governors, Congresses and Mayors. Without government employment at the levels of the Coolidge Administration, it was 4%, the Reagan Administration would have had an unemployment rate higher than all of the years of the New Deal. I have shown, statistically that unemployment dropped significantly in the 7 out of 8 years of the New Deal, and only in the belt-tightening year of late 1937, with the FED raising interest rates, under pressure from the Southern Dixiecrats did it spike upward. Creating jobs in the future is going to be tough in this environment of low interest rates, with no room to go further down, the lack of the need for 17 million new cars, the over loaded toxic housing market, tight credit, the plethora of retail outlets and huge pre-Obama $11 trillion deficits. Where were you deficit hawks over the previous 8 years? There is very little wiggle room for either party. Skyrocketing health care costs along with education costs are hurting our growth and endangering our Medicare and Medicaid needs. What does the right recommend? Doe it recommend firing all of our workers? That will creat more unemployment. How about 20% clawbacks? How about a draft army? What are the solutions? Shlaes and Bush II were on record as recession deniers is that right or wrong?

It's WORSE than that. A port city, below sea level, located between the Mississippi, and Lake Ponchartrain. Levees which had been allowed to become decrepit. (Why? Corruption ate up the money.) People said for YEARS this could and WOULD happen. It was a "It Could Happen Tomorrow" program on the Weather Channel, FCOL! But the city and county and state always said "ah, it'll happen on the NEXT guy's watch."
Anyone who THINKS, KNOWS that the first responders are the nearest. You don't call the Army for a home invasion. The city, county and state systems failed. Evacuation plans were not carried out. Some people were trapped because of this. And face it, some people deliberately stayed behind, thinking it would be some wind and rain, either to ride it out or to ride it out and loot some stores.
I could go on and on about what a screw-up LA perpetrated.
Just moved from middle island area. Bought a house before inflation hits us. Hubby has gig @ SUNYSB, so we are committed to the area. As for fishing, I am originally from Tampa Bay FL area, so I am spoiled. I will try Montauk sometime this summer maybe. All my fresh-water fishing here has been fly-fishing on the Connetquot, and that's been fun.

I just received a phone call from Nassau County Presiding Officer Peter Schmitt announcing that he is recinding the pay raises passed last week.
An outcry from CSA members and other civic and grassroots groups was instumental in Mr. Schmitt's decision to reverse last week's decision to give 40% raises to the Presiding Officer, Deputy Presiding Officer and Minority Leader.
Mr. Schmitt said that unexpected budget shortfalls and other tough econimic news makes this the "wrong time to implement these raises".

You are sooo right. These programs not only make a lot of people dependent for a time, but dependent for life, thus voting for the party on which they depend. Get pregnant as soon as one can, drop out of school, get in the system, and then wonder why you are barely existing. When on these programs, dependents are robbing people who work, of their hard earned earnings, and it is all due to the poor decisions they made early on. Be responsible for yourself and all the mouths you bring into the world. I don't mind helping desparate people, but I highly resent helping lazy, irresponsible people. As I recall the Constitution has been amended many times. Would you suggest the elimination of those amendments. As I remember from high school, the Constitution, nor the Bill of Rights allowed voting for Blacks, women, non-property holders, and that Jim Crow southern states deprived people of the right to vote for generations. Maybe we'll go back to the 3/5ths Compromise. How small should our government be? Maybe we should go back to the Articles of Confederation and tariffs between states. Bring back the "Poll Tax" and maybe the chain gangs. Your concept of "clock reversal" may really portend a change for the better. Nancy Reagan's astrologer assured me of that fact.

My two cents: I believe that BHO is in fact constitutionally eligible to hold the office of POTUS. If there were a true argument (even a "credible rumor") that he was not, I'm sure that the Clintons would have made sure that that case would have been made during the '08 primary season–we all know that BIll and Hillary know how to fight dirty.
OTOH, the strange behavior that BHO has exhibited in this past year–bowing to foreign leaders, rejecting the concept of American exceptionalism, and now the dissing of SCOTUS–all seem to indicate that on some level or another, BHO is not, culturally speaking, an American.
Every schoolchild knows (well, theoretically anyway) that the US was founded on principles which rejected royalty–Americans bow to nobody. Further, they are taught of the three separate branches of the federal government, each one held to be of co-equal stature with the others, with the Judiciary having a somewhat unique role, in that it is proscribed from acting–rather, that it reacts to the matters brought to its attention. Since it is a reactive body and keeps something of a low profile (no C-SPAN coverage generally, few if any interviews given to the press, etc), the historic precedent has been to not criticize SCOTUS, and certainly not to do so publicly in a SOTU speech.
I know BHO is supposedly a constitutional lawyer, but he seems not to be a product of the cultural heritage that we all share. Never mind his birth status, he spent his formative years outside the US, in distant lands, being exposed to very different values than we.
Forget about political parties or specific policies; the bottom line is that Americans are waking up, and realizing that this man does not reflect our values. He cannot grow into the office, because he has no true sense of what the office is supposed to represent. He will surely be turned out of office in 2012, and will likely drag the Democrats down with him, both this November and two years hence.
The Constitution was framed for one purpose, and one purpose only: To protect the rights of individuals from the power of an overreaching government. To argue that it should now be somehow altered (or “transformed”) because “the Founders had no concept of a National Highway System, the Manhattan Project, the Space Race to the Moon, World Wars, the Cold War, or nuclear threats!” implies that the world has changed enough since 1776 that now—suddently, SOMEhow—it’s OK to violate individual rights! If Mr. Garfunkle does not want his rights protected, that’s his decision. But the Constitution was not written for him alone. It’s there to protect my rights as well, and I will not easily give them up.
There have been sub prime mortgages for decades, and when they went bankrupt, which many did, it did not bring down the whole system. The banks in my neighborhood in 1972, 1981 and 2002 when I bought different houses demanded adequate income statements, and large down payments. The poor, the speculators and the foolish didn't force the banks and the predator lenders like Countrywide Financial and their peers to make the rules. As I recall GW Bush was one of the biggest home-owner cheerleaders, and his brother Neil was involved heavily with the Silverado Savings & Loan, the biggest bank to go bust if the S & L Scandal. Wall Street repackaged the debt to investors, not Senator Dodd and Barney Frank. Wall Street created REITS and other debt-swapping gimmicks. Yes, there is much blame to touch many in the government, but more regulation and transparency isn't socialism, its good common sense.

That's hogwash! GNP went up each year from 1934 to 1938, the following: 14.5, 11.1, 14.3. and 9.7% dropped for the recession of 1938 and went up 7.9 and 10.2% – 1939 and 1940. Unemployment dropped in those same years, 12.9., 7.3, 16.4, and 14.8%. It rose dramatically because of the recession caused by tightening the budget, and when the pump was primed again it dropped again 9.5 and 15% in 1939 and 1940. Shlaes is wrong in her analysis. If you take into consideration jobs created through the WPA unemployment reached was at 8% by the end of the New Deal, the same as it averaged in Reagan's eight years. In our day government employment accounts for 16% of the work force. Reduce that to New Deal levels and there would have 15-18% unemployment throughout the last 25 years.

Was it Churchill who said something like " if you aren't a Democrat by the time you are 20, you have no heart; if you aren't a Republican by the time you are 40, you have no brain"? I for one can attest exactly. I was a Democrat until I was about 40 – for no apparent reason other than my folks were Democrats and my heart told me to vote in a particular way – and only for presidential elections – and without any clue as to the details of why/what I was voting for/against. Until I really started TRYING to understand what a Democrat was, and what a Republican was, did I realize that I was certainly more Republican than Democrat, and really neither but just a plain old conservative; in fact a Tea Partier. I finally used my brain to learn what my politics was all about, and I vote in EVERY election AND stay in close touch with my representatives. There are MILLIONS of Americans just like me. About 10 years ago I was calling myself a member of the Common Sense Party. Now that I am 53 and am surrounded – in the music business – by young liberals, I speak bold and loud trying to educate them to at least give thought to what they do with the rest of their political lives – to study the details of what is going on… of course I am just the 'old guy' who doesn't know much and couldn't possibly be as bright as them.
Some things may never change.
It was laughable to hear Obama tell the House Republicans today that he is not an ideologue. Only a radical ideologue could have such disrespect for the separation of powers and the rule of law. It is interesting the parallel between his disrespect for our own Supreme Court with that of the Supreme Court of Honduras which ruled to remove Zelaya from the presidency of that country. Obama took the side of leftist Zelaya. Without our system of checks and balances, this buffoon in the White House could easily become another Hugo Chavez. Hopefully next November he will become a lame duck president destined for one term.
The problem with Obama's attack on the Supreme Court decision he disagreed with is that his SOTU speech was not the appropriate venue. This speech was suppose to be about the state of the union and not about political disagreements with legal opinions of the Supreme Court. He also did not have his facts straight which compounded the spectacle he made of himself. It only further widened the credibilty gap he already has with the American people due to his constant falsehoods about other issues as well.
I couldn't believe his arrogance today in front of the Repubs. He was consistently lying and they knew it.
If Obama is hell bent on being the "Judge of the Judges", then WE THE PEOPLE will certainly JUDGE HIM come November.

The ones that still support him do not use logic because they love the way he made them feel on election night and they refuse to admit they were wrong. That is the biggest difference between Obie supporters and detractors, feeling and logic.
When you have a clown like Chris Mathews talking about a thrill going up his leg, that is feeling. When the same clown says that he forgot Obie was black because the way he was speaking, that is feeling as well. No explanation given therefore no logic involved.
The question is: are we to elect our representatives in government by the way we feel or by using logic? If the answer is feeling then we are no better than dogs trying to feel what their owner is thinking since they cannot understand their language.
What gets me the most is that Obie said the SCOTUS ruling has now left our elections open to foreign country influence yet his campaign was the one that was provably receiving funds for the Gaza strip during his 2008 candidacy.
Obama needs to be put in a lame duck status for the rest of his lying presidency until we can swiftly remove him in 2012.

FDR's entitlement programs have bankrupted this nation. Social Security is broke as well as all its spiritual descendants–Medicare, Medicaid, Welfare.
What part of $12 trillion debt and $2 trillion deficits and something called "unfunded mandates" do you believe are sustainable? It all began with FDR and Keynes who said, "In the long run, we're all dead."
It's not the "long run" and we're now dying.
Many Republicans have said those type of remarks from TR through Reagan!

In reading your response I wasn’t sure whether you were the product of a poor educational system, exposed to idiotic propaganda, were culturally and historically illiterate or just uninformed. For your information, Social Security is insurance, just like MetLife or Prudential. It ran a $169 billion surplus last year. Is that insolvent? It is owed $2.4 trillion by the Federal government. Is that insolvency? The system is not part of the Federal budget and has nothing to do with Federal withholding taxes, but payroll taxes funded by both the individual and the employer. Every civilized country in the world has some sort of social security insurance. The current financial projections for Social Security show it to be viable to 2037 without any increases in the payroll tax. After the baby-boom bubble these so-called unfunded mandates will be more manageable, but because of current demographics, a declining economy and the disparity between rich and poor, you'll have to suffer and pay a bit more.
As to Medicare and Medicaid, they are different. Medicare is funded in a similar way to SSI, but because people are living longer, many are more obese, their medical costs in the last three years of their lives, whenever that happens, are expensive and growing because of our moribund health system. Therefore, Medicare is less predictable by actuaries. Medicaid is a poverty program. Because there are more poor people because of fewer jobs, there is more expense. Medicaid has nothing to do with a funded entitlement, but it is an answer to the Poor House. Do you suggest putting poor people in the street? Unfortunately many middle class people abuse Medicaid when it comes to long term care provided by nursing homes. This is not the fault of the idea, and rules regarding look-back periods for gifting money and divesting have been tightened.
As too FDR, both Medicare and Medicaid are a product of the 1960s and LBJ and Richard Nixon. Every president, including the last failure, has supported all of these programs. Only Bush II wanted SSI partially invested in the stock market. We all understand how idiotic that would have been.
I suggest you forgo your SSI, reject Medicare at age 65, pay your own bills, and if you are young enough to have parents, tell them the same. The government and your fellow nihilists will send you an award.

The problem, of course, is that you expect partisans to be partisan. However, the Associated Press still pretends they are an objective news organization. This was not an opinion editorial, but a section one "new" story. Any independent thinker trained to read news will recognize just how strong the A.P.'s left bias has become.
By the way, when are most of the arm chair experts going to awaken to the fact that the middle class in America is disappearing because jobs have been exported, energy is imported and that their demands for services continue to increase. In truth, both parties have failed and for similar and different reasons. The fault is not in the so-called unfunded liabilities, it lies in a society married to a credit card mentality. There is too much personal debt, and too little savings. Whether that has been encouraged by the knowledge that one will have Social Security, or that Madison Avenue demands that we spend our hard earned money for more meaningless trinkets, or the educational system that does not stress practicality, I am not sure. For sure, the so-called conservatives and the new nihilistic Tea Bagger group have no clue.
The rugged individualism of the old Square Deal liberalism of TR is no more connected to the GOP. than the liberalism of Lincoln. The GOP has more of a legacy from the economic imperialism of William McKinley, the venal pragmatism of Nixon, the happiness profligacy of Reagan and the dopiness of Bush II.
But both parties suffer from the illusion that we can sustain this big ship of a country by empty platitudes. In fact, we have huge problems coming from many directions. Until we can decouple our sense of false security from the facts at hand, we will have problems. We need more domestic energy, more domestic home grown jobs regarding manufacturing and more exports. Without health and education reform to lower those insane costs, those ideals and goals maybe an illusion.

This ruling is horible and so political. It has always been understood that Corporations need to be restricted from buying elections. This ruling reverses this centuries old precident.
