Jerry Brown: Acorn, Suspicion and the Rule of Law
by Thomas Del BeccaroAccording to the legendary Greek Historian Plutarch, when asked why he divorced his wife, Caesar stated that: “All women shall be as Caesar would have his wife, not only free from sin, but from suspicion.” At the time, Caesar’s wife, Pompeia, was loosely associated with the commission of a sacrilege by someone else. As recent events have confirmed, Attorney General Jerry Brown is hardly burdened by suspicions – let alone high ethical standards.

As most everyone in the political world now knows, ACORN is under investigation in many states, and by the federal government, for a host of crimes. The same holds true in California – or does it?
Notwithstanding the purported investigation of ACORN by the California Attorney General’s Office, according to David Lagstein, ACORN’s chief organizer in the San Diego: the Attorney General Jerry Brown is a “political animal” and that “certainly every bit of communication we have had with them has suggested that the fault will be found with the people that did the video — not with ACORN.”
So much for investigating the supposed target of the investigation – ACORN – not to mention that it should be well beyond suspicious that an investigative unit of the government would tell an entity under investigation, i.e. ACORN, what will be found about others.
Perhaps, you say, the ACORN official was taking liberties with what was said to him and it can’t be attributed to the actions of Jerry Brown? Unfortunately for Jerry Brown, his cavalier association with the rule of law precedes him and gives rise to real questions as to what really is going on with the ACORN investigation.
Consider, if you will, these brushes with the rule of law that Jerry Brown has had as Attorney General – the official charged with upholding our laws:
- Attorney General Brown’s “spokesman” recently was given the boot for illegally taping telephone conversations with reporters – ironic yes? That Brown will find someone illegally taped ACORN while his office does the same?, or
- Brown’s blatant mischaracterization of Senator George Runner’s upcoming Voter ID initiative as the: LIMITS ON VOTING. INITIATIVE STATUTE. [which] Prohibits citizens from voting at the polls, unless they present a government-issued photo identification card. Under similar circumstances, Brown’s Democrat predecessor dubbed the Voter ID initiative he reviewed as “VOTER IDENTIFICATION REQUIREMENT. INITIATIVE STATUTE. Requires that voters present one of four types of picture ID before voting.” Brown was sued by Senator Runner for such misconduct; or
- Attorney General Brown’s decision to file lawsuit against San Bernadino County for “failing to consider how growth and new development will impact climate change” – even though the regulations related to AB32 had yet to be written at the time of the lawsuit.
If that is not bad enough, we can go one step further back to note that Jerry Brown never should have been seated as Attorney General because he was not legally qualified to be Attorney General.
I was the lead Plaintiff in a lawsuit to stop the seating of Jerry Brown for Attorney General because California Government Code Section 12503 states that: “No person shall be eligible to the office of Attorney General unless he shall have been admitted to practice before the Supreme Court of the state for a period of at least five years immediately preceding his election or appointment to such office.” Jerry Brown did not meet that requirement. Prior to his election, Brown had an inactive law license for 10 out of the last 14 years, and his license has been active only for three and a half of the preceding five years. As any attorney will tell you, an active license is required to practice before the Supreme Court of California.
Jerry Brown, however, was able to convince an activist Judge that he came close enough for government work and therefore the will of the people should not be thwarted. And you thought our nation was founded on the rule of law not men?
In this day and age, it would rather appear that that antiquated notion is under more suspicion than Jerry Brown. Sad as that is, it’s time that a formal investigation of Jerry Brown was undertaken.

I hope everyone knows that the Obama administration is behind all of this. They are protecting acorn & the seiu & because they are an intergral part of the Obama plan to take control of this country. Their grassroots movements are to prey on weak, poor & uninformed masses & brainwashing them to buy into the system. It is always that way with governments who pull this type of hijacking of a political system. They will do everything possible to to keep thier power. That includes utilizing allies in local governments to brush this kind of stuff under the rug.

We are no longer a nation of laws, we are a nation of men. If you have enough money, political connections or power, you can do as you will. The biggest weapon in a lawyer's arsenal is delay. I'm voting for Chelene Nightingale. I don't trust the CA GOP and certainly don't support anyone from the DNC, so if both parties are virtually the same doesn't it make sense to support the American Independent/Constitution Party candidate. Wouldn't this also prove if our votes truly count if she has enough support in the polls. Does it really matter if Brown, Whitman, or Newsome wins?

Maybe things are different in California, but in the two East Coast jurisdictions where I'm licensed as an attorney, there's a world of difference between being admitted to practice before a court and the active/inactive status of one's bar membership. For example, I have certificates from my home state Supreme Court and my local federal Circuit Court of Appeals stating that I'm admitted to practice before each, but those are completely independent from my two law licenses. Yes, I'd have to be active to actually appear in that state Supreme Court, but the fact that I'm inactive in that jurisdiction at the moment has no bearing on my admission to the court.
While I agree on the larger points about Brown, the information presented about his eligibility for office seems to indicate that the author's complaint rightfully lost. Judicial restraint means (in part) following the laws as they are written, and if the statute says "admitted to practice," it's difficult to see from this article how the judgment was judicial activism.
Voting fringe party, especially in a large state, such as California, is a wasted vote; you might as well just stay home.

Do not forget it was Jerry Brown that wrote the wording for the use of the word marriage. Brown wrote it up in such a way as to confuse voters into thinking it had something to do with equal rights. In California, this was in fact a lie. In California, marriage is only a word, and it carries NO rights at all!
Brown is an ideologue that will contort and lie to get his way. Notice that AFTER he twisted the wording of Prop 8, he decided to abandon his job of defending the proposition in favor of his perverted political ideological position.
Most fascinating, is the claim he is planning on using in federal court in January. He is planning on argueing that because HE twisted the title of Prop 8 that it should be overturned by yet another activist court. Jerry Brown is perverting the law from ALL sides in this issue, making a mockery of the entire legal and political process.
I don't agree with that statement. Nearly all Presidential elections in California have a Democrat winning the Electoral College doesn't everyone who vote for the Republican waste their vote? Shouldn't we test the system to see if our votes actually count? Since the GOP and DNC constantly implement new laws to destroy any momentum for 3rd parties doesn't that tell you that the GOP/DNC are 1 and the same and the true fringe parties? If I want our borders secured, water turned on for California farmers, and no more 45% of my check going toward taxes I choose to vote for the candidate who stands for a true California Republic.

The gist of what I wrote was that I lived in CA from '99 to '04 and I think there is NO WAY to dump the DEMs.
1 – The Teachers union runs CA, plain and simple. They got a constitutional amendment that you can't cut their budget to punish Arnold for taking "their money" to pay bills in CA back in "02.

I will not vote for a Democrat or Republican again. McCain proved to me this past election that it is a 1 party system. I've read Federalist Papers 44, 55, and 56. If I was old enough to vote in that election I probably would have voted for Perot. The Bush family has been nothing but a stain on our country. They are pulling a scam to collect money from unsuspecting donors… I wondered why their campaig site says THESE DONATIONS ARE NOT TAX DEDUCTIBLE….SHE HAS NOT REGISTERED with the elections board so she won't have to account for where the money goes. Says she is unemployed and alligations from other groups she has belonged to…have stated they use bogus reasons to ellicit donations of money.
