Government by the Courts, Not the People: Federal Court Thwarts State Budget Cuts

Of course, a long time ago, in a place far, far away, the legislatures of individual States of these United States, had a far greater say in the lives of their citizens. Indeed, for the first 150 years of our existence, the federal government – the Congress and the Courts – had little to say or do in the lives of Americans – the Civil War excluded.

With the advent of the Democrats’ Big Government New Deal, of course, all of that changed. The Roosevelt Democrats increased the federal budget tenfold – but not without the considerable help of a very activist Supreme Court. Recall that Roosevelt threatened to pack the Supreme Court which then proceeded through resignations and reinterpretations to redefine our Constitution. The result was a Big Government takeover the like of which the Supreme Court originally struck down during Roosevelt’s first term.
It also was the dawning of the age of the activist courts which threatens our Liberties to this very day. Thomas Jefferson, of course, warned us of this possibility. According to Jefferson:
The great object of my fear is the federal judiciary. That body, like Gravity, ever acting, with noiseless foot, & unalarming advance, gaining ground step by step, and holding what it gains, is ingulphing insidiuously the special governments [i.e, the states] into the jaws of that which feeds them.
Nowhere could Jefferson’s warning be more true than in California. In 2005, a federal court took over the administration of California’s prison health care system – literally deciding how the system operates. At the time, the federal judge “hailed it as a ‘bold and uncharted adventure’ that could last several years.” Doesn’t that sound like constitutional reasoning to you? And sure enough, he virtually runs the system to this day.
In 2007, a federal judge made a dubious ruling that protects a non-indigenous bait fish – the Delta Smelt – at the expense of the way of life of the entire Central Valley of California. The ruling has turned off the water for many farms, driven unemployment in some areas as high 40% among certain groups and driven up the cost of food for all of us.
Now, on October 20, 2009, a federal judge has “halted the state of California’s plan to cut or reduce caregiver services for 130,000 disabled and low-income seniors.” The cuts were part of an overall solution, however temporary, to the ongoing California budget crisis. In stopping the cuts, the federal court has all but ruled that the state of California cannot reduce expenditures in that area because the federal law may not allow it.
By the logic of this decision, untold billions of the California budget may be exempt from budget cuts. In other and plain words, the California legislature does not have control of its own budget – a federal judge does. Thomas Jefferson simply must be turning over in his grave.
A long time ago, Jefferson wrote that our Independence was founded on the notion of Life, Liberty and the Pursuit of Happiness – Now we know, that is only true until a federal court tells us otherwise.

I fear our Republic, as it was founded, is doomed. Oh well, it was fun while it lasted…
California has long been cited as leading the nation in social change. I view the current state of that state to be more like an insidious virus that must be destroyed before it can infect the rest of the body. Unless we want our entire nation to look like Detroit we need to bring common sense back. Strip the EPA of its omnipotent powers to disrupt the economy. Require the EPA to perform Economic Imact Analysis prior to any action being considered. At least in this way the damage they seek to do will be limited.

I want to know… where does it say that the fed trumps the state? I thought the bill of rights gave power to the state unless specifically stated… to the fed gov.
And of course California just bends over and takes it… They should pass a law saying the fed law doesn't apply in California.

The US Consitution is the liberals enemy and it must be destroyed at any cost… Look no further than Steny Hoyers comment that the "General Welfare Claus" gives the Federal Government the ability to force Citizens to purchase Health Insurance despite Fedralist Paper #41 and it's CLEAR intention that this term is no more than a synonym for the following Enumerated Powers. He even said that these are not seperated by anything more than a semi colon for a reason.
The TRAITOROUS CRIMINALS in Congress and in the Courts need to be held accountable for there actions NOW!

The courts also recently supported the Millionaire Tax, which will drive more high income people to Nevada, thus resulting in a drop in tax receipts. Morons.

Corruption and the Progressive ideaology has crept into every aspect of our Nation. It will be a miracle if we can pull out of this. I really don't know how we can come against it when it is so widely spread into every nook and cranny in our political process. Progressivism is like a flesh eating bacteria, once it has taken hold it is darn near imopossible to contain it. California is the perfect example of this, they know they have a problem but they are just living with it.
The quote by Jefferson of course is genius and it makes me ask where are our political geniuses today? Are there any? I believe the only way to defeat this flesh eating bacteria is to bring in people outside the beltway for Congress and the Executive Branch. Someone who has not been apart of the system and become corrupted by it. They also must have the intention to appoint Judges that are not ruled by ideaology but by the Constitution. Unfortunately I think we have passed the point of no return other than to stave off the inevitable for a few more decades. The Progressives will eventually win as more and more children are taught in our bastians of left leaning universities. Progressivism has infected the whole body of the United States of America.
Isn't this tied to the stimulus bill that SEIU wrote that prevents a state that accepted stimulus funds from cutting pay to union members? YES!

The biggest problem this country has are it's voters.It's obvious that most people could care less about a persons background or ideology.I'm not sure what most people look at so I guess rock star is good enough to describe it.
When Clinton ran for office I never thought that a draft dodger or proven philanderer could ever get elected.Man was I wrong.He governed from the far left until the republicans took congress in 94.That combination was great for the economy.But then Lewinski came along and I said no way would he get re-elected.I stopped trying to figure it out after that.
Then we end up with Obama and his czarist administration and a socialist congress.All of these people are there because people put them there.I know that there are a lot of angry people out there right now.But are they angry enough to want to take responsibility for themselves and decide to vote out all career politicians and put the screws to special interest in the process.
Past history doesn't bode well for that scenario.

In some states school districts are going to court to fight education budget cutbaccks. We will need to force education to take a smaller piece of the economy. Jails are also going to court to get money to expand.
While I agree in large part, a word of caution also. Without knowing the details of any specific case, it can't be said whether the problem is judicial or legislative overreaching. Often meritorious constitutional arguments are not advanced, placing the court in a position of merely having to enforce atrocious laws. So, it is not just a problem of the courts, it's a problem of the federal government.

Don't forget that liberal utopia called Detroit, the once prosperous city that the unions and environmentalist and democratic welfare whores destroyed. If we are not vigilant the country will soon look at Detroit as a model for the rest of us.
Good point. For 45 years almost every major city in America has been run by social wefare Democrats, I wonder, are the poor in those cities any better off than they were in 1965? Less crime? Higher standard of living? Better educational system? Maybe Lincoln was right:
"You cannot help people permanently by doing for them, what they could and should do for themselves."
My question is why do we listen to the Federal Government on this issue? If anyone including our Governor had even a smidgen of a backbone, he would simply turn the water back on and then do the American thing: Fight it out in court – eventually end up in the Supreme Court where they will overturn the idiots who call themselves judges in the CA Federal Courts.
This isn't a hard problem to solve. Is anyone listening in our CA goverment?

The numbers speak for themselves: since its launch the african american family has skyrocketed in the number of single parent families, and with their 'war on poverty' they have managed to accomplish NOTHING. Demand a timetable and an exit strategy for this insidious war that is destroying american families and our economy.
With regard to our prison population, do you have any idea how much it costs to keep even one prisoner? The avergae annual expense is more than the average annual income per family in this country. Why do these violators our our laws deserve anything, for free. I believe that these prisoners should be required to pay for their keep. MAKE THEM WORK. Sheriff Joe here in AZ has them living in tents, eating baloney sandwiches, the only cable they get is the disney channel and they have to work on chain gangs cleaning our road ways. Just think what a burden this would relieve on our budget if they did not cost us so much. In regard to those many thousands of prisoners who are not even citizens, ship them home.

Not only would it reduce the burden, there would less recidivism. I have always wondered why they do not work for their keep. I have to work to eat, why do I feed those bums. But you do know that the Obama organization, (I can't call that branch of gvt administration) is going after Sheriff Joe. Can't have a guy do his job and not be punished can we?
It is past time to tell these Federal Judges that if they persist in illegally (not constitutional) interfere with State Laws they will not just be ignored, but arrested and held for trial. I’m sure the smart lawyers can come up with a big list of violations. That would throw down the gauntlet. I would say that unless the Feds could come up with Constitutional language permitting the Federal Judges to take over States Rights, the issue is of no substance and the state WILL NOT follow the out of control Federal Judges illegal order.
Now all we need is a Governor with the cahones to make the call and see it to it’s end…what is the Federal Judge going to do, arrest the entire State Govt.?
That is exactly who I was thinking of when I wrote that, but I must say I think she has been Alinskized and will have a stigma that may make her ability to win just out of reach. I hope I am wrong…

Make it illegal for anyone who has ever earned a law degree to be a legislator or a judge (Since it's a conflict of interest for lawyers to make law and judge law, which obvious to all but lawyers). Free juries so that they can decide whatever they agree upon, including that the law in question is fundamentally flawed and should be stricken from the books (As they were able to do before the system was corrupted by lawyer-lawmakers and lawyer-judges so that juries could only decide what they were instructed to decide). Have all of the resulting non-lawyer judges and legislators answerable to their constituencies through elections equally, including the Supreme Court.
Problem solved.
Lawyers should be limited to the adversarial part of the process only, where there necessarily evil profession actually has a place.
There're many of us who've sacrificed and bled in service to our Country while bearing witness to the horror of true patriots agonizing in death at a young age. We won't allow this grand experiment to be stolen in the night without a fight. Hopefully this battle will be won at the ballot box. An honorable citizen serves the Country first because of a sense of duty to protect the institutions of freedom established by our Founding Fathers and documented within our Constitution. We swore an Oath before God to protect and defend the Constitution, against enemies both foreign and domestic. Our Oath covers the entire Constitution, not just segments thereof. Service members fight and die if necessary to uphold the obligations of that sacred Oath and to protect brothers and sisters who are fighting and willing to die with you. There are many of us who didn't take our Oaths lightly and those in Washington who did, should rightly fear us. Sorry for the lengthy rant. I pray it offends those who belittle and ingnore our Constitution……….
