O’Keefe Owes His Supporters an Explanation

by Andrew Breitbart

I proudly stood behind James O’Keefe on his groundbreaking ACORN investigation. I also defended him when the media, including CNN — during a previous regime, “the Rick Sanchez era” — falsely reported the Sen. Mary Landrieu story as a “wiretapping” plot gone wrong.

In all these cases the left-leaning media exposed its obvious bias against James because of his contrarian point of view and because the targets of his investigations are protected institutions of the Democrat Media Complex.

However, in my dealings with Ms. Boudreau, she and her producer, Scott Zamost, conducted themselves professionally, and I believe James owes them a candid and public explanation.

From what I’ve read about this script, though not executed, it is patently gross and offensive. It’s not his detractors to whom he also owes this public airing. It’s to his legion of supporters.

Court Document Reveals Government’s Admission That It Lacked Evidence O’Keefe, Others Intended to Commit Felony At Landrieu’s Office

by Patterico

The U.S. Attorney’s Office for the Eastern District of Louisiana has filed a court document admitting that James O’Keefe did not intend to tamper with the phones at Mary Landrieu’s office, or commit any other felony.

Oh — and the good folks at the Department of Justice don’t particularly want you to know that. This post reveals that, at O’Keefe’s hearing, the Assistant U.S. Attorney tried not to read that part of the document in court. What’s more, the U.S. Attorney pointedly omitted this critical information from their press release.

The news of the Government’s admission broke yesterday, when Big Journalism’s Larry O’Connor reported that a court document filed in James O’Keefe’s criminal case bearing the title “Final Factual Basis” contains the following language:

In this case, further investigation did not uncover evidence that the defendants intended to commit any felony after the entry by false pretenses despite their initial statements to the staff of Senatorial office and GSA requesting access to the central phone system. Instead, the Government’s evidence would show that the defendants misrepresented themselves and their purpose for gaining access to the central phone system to orchestrate a conversation about phone calls to the Senator’s staff and capture the conversation on video, not to actually tamper with the phone system, or to commit any other felony.

This news, which O’Connor relayed at the end of a post about Media Matters’ dishonesty, is a significant piece of news that deserves its own post. It is especially noteworthy because this paragraph comes from a version of the facts that the Government has agreed to by way of stipulation. The document contains the following language showing the Government’s agreement: (more…)

James O’Keefe Pleads Guilty to Misdemeanor in Sen. Landrieu Phone Stunt

by Publius

UPDATE: O’Keefe promises more undercover investigations.  Full update after the jump.

NEW ORLEANS (AP) – Four conservative activists accused of trying to tamper with the phones in Sen. Mary Landrieu’s office have pleaded guilty to misdemeanor charges of entering federal property under false pretenses.  The most prominent activist, James O’Keefe, was sentenced to three years probation, 100 hours of community service and fined a $1,500 fine. The 25-year-old is known for wearing a pimp costume in a video that embarrassed ACORN.

Magistrate Daniel Knowles III sentenced the three others to two years probation, 75 hours of community service and fined them $1,500.

The FBI has said O’Keefe used his cell phone to try to capture video of two men who posed as telephone repairmen and asked to see the phones. O’Keefe spokesman Denis Calabrese disputed an earlier allegation that a fourth suspect waited in a car with a listening device, which was not mentioned in court records.

The O’Keefe Affair: Obviously a Media Malfunction

by Andrea Shea King

Okeefe

When the Christmas Day panty bomber was arrested for trying to blow up himself and the plane he rode in on, he was questioned for approximately 50 minutes before an attorney was brought in to advise him.  What happened next?  Mister Burning Briefs clammed up.

Contrast that with James O’Keefe, American citizen, who was denied an attorney for 28 hours after he was arrested and accused of trying to tamper with the phones of Louisiana Sen. Mary Landrieu.  During that time, the FBI issued a press release on the arrest and leaked the criminal complaint.  The mainstream media salivated, while ACORN’s Bertha Lewis scambled to appear before TV cameras.

The Christmas Day bomber was given Constitutional rights and Miranda’d within an hour of his arrest but a U.S. citizen was not given a lawyer until more than a day had passed?

Crime-Tolerating Left Pounces on Apparent New Orleans Stunt

by Kyle Olson

Let me first say, if what is being reported in the media is accurate, a dumb prank was attempted in the New Orleans office of Sen. Mary Landrieu by James O’Keefe and his comrades.

Senators Office Arrests

There should be zero tolerance for crime, regardless of who does it.  If O’Keefe is guilty of what the FBI is alleging, he should be held accountable.  The Left believes that now, but where were they six months ago?

It’s interesting to observe, and personally experience, the hypocritical way the Left is treating this situation. Consider two unsolicited e-mails I received Monday night from a few liberal wackos with too much time on their hands.  Here’s the first, which was accompanied by the subject line, “Republicans are As—-es!”:

Hey as—-e, why don’t you talk about the son of a bitch who broke into Senator Landrieu’s office in LA? Yeah, scumbags like you don’t care about the law.

The other, titled, “James O’Keefe is going to jail! YOU FAILED!”:

MSM Leaping to Conclusions — While Big Government Waits for Facts

by Andrew Breitbart

Wait until the facts are in.

Mainstream Media, ACORN, Media Matters (all the supposed defenders of due process and journalistic ethics) are jumping to conclusions over the arrest today of James O’Keefe, with the clear intention to smear and, if possible, convict O’Keefe and his alleged co-conspirators in the court of public opinion in order to taint the “jury of their peers.”

The ACORN story was a huge black eye for the organized left and their allies and cohorts in the mainstream media. So they are relishing every minute of this breaking story, making it their top story – while they ignored the initial ACORN story until they no longer could.

MSNBC and other “news organizations” are even billing this developing story as “Watergate”. What do  Keith Olbermann and Rachel Maddow know? And when did they know it?

James O’Keefe Arrested in New Orleans

by Publius

Statement from Andrew Breitbart:

“We have no knowledge about or connection to any alleged acts and events involving James O’Keefe at Senator Mary Landrieu’s office.  We only just learned about the alleged incident this afternoon.  We have no information other than what has been reported publicly by the press.  Accordingly, we simply are not in a position to make any further comment.”

From the Associated Press:

A conservative activist who posed as a pimp to target the community-organizing group ACORN and the son of a federal prosecutor were among four people arrested by the FBI and accused of trying to interfere with phones at Sen. Mary Landrieu’s office.

Activist James O’Keefe, 25, was already in Landrieu’s New Orleans office Monday when Robert Flanagan and Joseph Basel, both 24, showed up claiming to be telephone repairmen, U.S. Attorney Jim Letten’s office said Tuesday. Letten says O’Keefe recorded the two with his cell phone.

Candidates Who Invoke ‘Climate-gate’ Could Get Boost in 2010

by Kevin Mooney

Climate-gate could further complicate the re-election prospects of congressional representatives from industrialized states who are already playing defense over the economic costs of climate change legislation.

junkscience

Thousands of  emails leaked to the Internet from the Climate Research Unit (CRU) of the University of East Anglia in the United Kingdom appear to substantiate a growing body of research that questions the idea of man-made global warming. Climate-gate has the potential to emerge as an unexpected gift to Republican candidates in this year’s midterm elections. But there’s the rub.

With the exception of Sen. James Inhofe (R-Okla.), and a handful of other elected officials, Republicans have been reticent to engage and debate the dubious claims of human induced global warming, laments Steve Milloy, editor and founder of JunkScience.com.

“Too many of them don’t understand the issue and the extremism that stands behind green activism,” he observes. “They are afraid of being labeled as anti-environment and are just not well-equipped or well informed enough to confront policies that could result in an unprecedented expansion of government power.”

At the very least, 2010 Republican challengers could invoke the email scandal to demonstrate how research has been falsified and distorted to advance a political agenda at odds with the economic well-being of many Americans. This in turn could open the way to a larger discussion of global warming science and the role of the United Nations.

To Understand ACORN, Look To the Early 20th Century

by Kyle Olson

There was one man who paved the way for ACORN, its agenda and its tactics, and he rose to prominence a good twenty years before Saul Alinsky. His name was Arthur Townley.

Please bear with me for a bit of history.  A.C., as he was more popularly known, was a member of the Socialist Party in North Dakota.  At the time, grain prices were manipulated, in his view, in Minneapolis, Minnesota.  What put him over the edge was when he overextended himself in an attempt to reap a hefty profit on flax, only to have the price drop, along with a bad crop.  He lost a substantial amount of money.

As a socialist, he naturally blamed the out-of-state capitalists and sought to do something about it.  His solution: A state-controlled grain industry.  According to “Political Prairie Fire,” written by Robert L. Morlan in 1955, Townley had a multi-point list of demands, including “State ownership of terminal elevators, flour mills, packing houses, and cold-storage plants,” as well as “Rural credit banks operated at cost.”

When his Socialist Party wasn’t interested in his plan, Townley set out and created The Nonpartisan League in 1915, a mode for organizing farmers into a political constituency to be reckoned with.  See, Townley lacked one key ingredient: power.

His theory was that in order to enact his plan, he needed to create the sufficient pressure on elected officials in meet his demands or face the consequences.  His group also worked to elect candidates that agreed with its views.
