Shame on Big Labor Bosses! For years they have used the tactic of “shame” in an effort to pressure, bully and demonize employers who might stand against their efforts. They have used “shame” in their efforts to misinform the public – to create a misperception that their target is guilty of an unconscionable act and should bear the scarlet letter of these acts. These attacks have been not just against the targeted employer, but against anyone who might oppose them, including the employer’s customers and advertisers, non-union employees, even their own membership if it suits their purposes. Recently, Big Labor has taken the weapon of “shame” to the political arena, both in Wisconsin and now in Indiana.

“Shame” was the word of the day when the SEIU ran one of its Corporate Campaigns against EMS across the Midwest in 2005-2007. The Big Labor bosses never shirked from using the phrase to intimidate loyal EMS employees and customers as they attempted to cross SEIU picket lines. With banners in hand they would publicly attack EMS with incorrect statements and half-truths.

“Shame” was on display constantly last year when Big Labor bosses poured millions of dollars and thousands of foot soldiers into Madison, Wisconsin in an attempt to intimidate Governor Walker and the General Assembly into withdrawing the needed measures to restore fiscal responsibility to a state deeply in debt (see America at a Crossroads! As Wisconsin Goes, So Goes America!). Now, as we approach The Most Important Non-Presidential Election of the Decade, Big Labor bosses are at it again, attempting to “shame” the electorate into replacing Governor Walker via a recall election and then reversing the bills that have arguably put Wisconsin on a path to solvency.

We have just passed through the Stop Online Piracy Act (SOPA) brouhaha.

A bill intended to stop theft – an important goal, and a necessary function of government.  But SOPA was overly broad, and deserved in its most recent iteration to go away – which it did.

Because of a bipartisan oppositional uprising – but the two sides arose for very different reasons.

The Theft-Left is vociferously opposed to private property rights.  SOPA is aimed at protecting private property.  So the Left said No.

The Right is loathe to grow government control of anything – including the Web.  And having just witnessed the recent Big Government Network Neutrality Internet power grab, their antennae were highly sensitized – and they said No.

Now, Washington is talking cyber security.  Where there is, again, a legitimate role for government – but we have, again, a bill that defines said role much too broadly.

I attended Wednesday’s 8:00am (8am?!?) House Oversight and Government Reform Committee hearing entitled:

Volt Vehicle Fire: What Did NHTSA Know And When Did They Know It?

The witnesses were killer:

National Highway Transportation Safety Administration (NHTSA), Barack Obama-appointee Administrator David Strickland.

And General Motors (GM), Barack Obama-appointee CEO Dan Akerson.

The scope of the hearing was a bit too narrow – leaving out some fairly important attending facts.  Like, say, the (at least) five other Chevy Volt fires that have occurred besides the one being discussed.

This hearing was all about a single June Volt blaze.  The battery burst into flames about three weeks after a test crash at and by the National Highway Transportation Safety Administration (NHTSA).

A fire about which Obama’s NHTSA did tell the Obama White House.

But a fire about which neither Obama’s NHTSA, the Obama Administration nor Obama’s GM told the American people for nearly six months – and then did so only when forced by a looming Bloomberg news story.

But:

The White House had no role in the decision to delay disclosure of a fire that broke out in a crash-tested Chevrolet Volt, the Obama administration told Congress on Friday.

Of COURSE not.

Labor union membership continues to be blind to the fact that the support of its “leadership” to President Obama and his political allies is coming at the cost of the members. Big Labor bosses and their political allies are happy to continue to throw the membership under the bus for their own personal gain. For President Obama, this is the prospect of re-election; for the labor bosses, this is the survival of their “way of life.” This can be seen through the President’s actions and comments over the past three years.

Early in his presidency, President Obama made disparaging remarks about business owners whose companies had corporate jets. This was done in a blatant attempt to incite class warfare, despite the fact that the country was in a deep recession. By his words, the President willingly sacrificed the jobs of the very people who supported him through union dues. He knew the liberal media would not expose the tragic result his words would have on the private jet and airplane manufacturing industry.

In Wichita, Kansas, the home of private aircraft manufacturing has suffered tremendously, as thousands of union employees employed by Cessna and Beechcraft have been laid off, not to mention the thousands of jobs affiliated with general aviation lost across the country including manufacturers, part suppliers, fuel, pilots, mechanics, FBO services and insurance providers. Additionally, due to the loss of significant sales, use, income environmental and aviation tax revenues, thousands of local, state and federal employee positions, many of which were union jobs, have disappeared.

Adding insult to injury now the White House Defends User Fees of $100/flight on general aviation and corporate aviation to raise revenues in Obama’s continued class warfare and redistribution of wealth scheme in his effort to bring down America. Ironically this will cost more jobs, many of them union, as revenues ultimately will be reduced as fewer aircraft are purchased and general aviation travel is curtailed due to the added expense. The vicious cycle will continue to perpetuate itself at the expense of American jobs!

President Barack Obama is in full 2012 reelection mode.  Part of that process is preparing to possibly take on Mitt Romney – whom (it appears) he thinks has the strongest chance to be his Republican opponent.  Which he and many Democrats think is very good news.

Romney fits right into the Left’s absurd anti-capitalism, “robber baron,” Occupy Wall Street anti-1%-er, scorched earth storyline.

Romney is very wealthy, which for Obama and his Democrats is the height of eee-vill (except – these Donkeys are mostly rich…).  Never mind that Romney’s wealth is right in line with many past Presidents and candidates – including 2004 Democrat nominee John Kerry.  (The difference?  Romney earned it, Kerry married it.)

And as Romney recently told us, he these days pays the 15% capital gains tax rate – rather than the (absurdly) higher income tax rates those of us receiving salaries do.  Never mind that this is perfectly legal (and good fiscal policy, and “fair”) – it is culled right from the Leftist, Warren Buffett “I pay less in taxes than my secretary” fraudulent script.

The Stop Online Piracy Act (SOPA) (and its Senate alternative, the Protect Intellectual Property Act [PIPA]) have been taking a bipartisan beating.  Conservatives have joined with Leftists to savage the bill and thus its chances for passage.

I too am opposed to this iteration of SOPA – it remains too overly broad.

But something similar and more finely, sharply crafted – must become law.  And conservatives will need to reorient themselves when a better version of the bill comes along – and support it.

We cannot look at the SOPA debate without putting it into the broader context of the immediately preceding Network Neutrality debate.

Conservatives rightly became highly tuned to Internet censorship as a result of the Left’s drive to impose the truly censorious Net Neutrality by any means necessary.

Following so closely on Net Neutrality’s heels, SOPA got swallowed up in this righteous protect-free-speech verve.

But there are some fundamental differences between SOPA and Net Neutrality that must be acknowledged.

What’s an absurd Leftist policy without an agitprop song to accompany the inanity?

The attempted spoonful-of-sugar to help force down the bad Progressive medicine they are pushing.

Which brings us to General Motors (GM) and one of the Leftist ideological windmills at which they tilt – the Chevy Volt.

We the Taxpayers have spent billions subsidizing the Volt.  And continue subsidizing it still.

We bailed out GM ($50 billion) and Chrysler to the tune of $83 billion.  On which the Obama Administration now admits we’ll lose (at least) $23.6 billion.  (President Obama once upon a time promised us we’d actually make money on the deal.)

We the Taxpayers are still stuck holding 500 million shares of GM stock – on which we are poised to lose tens of billions of dollars more.

But you know what makes all of this terrible-ness so much less worse?  GM spent some of our money on – the Chevy Volt official song and music video:

I’ve written several times about a proposed IRS regulation that would force American banks to put foreign law above U.S. law. I’ve repeatedly warned that the scheme, which would force financial institutions to report the deposit interest they pay to foreigners, is bad economic policy, bad regulatory policy, and bad banking policy.

My arguments have included:

• Explaining that this onerous regulatory scheme will result in capital fleeing to other nations, needlessly harming the financial sector and putting American banks at risk.
• Explaining why the proposal is a threat to human rights since many foreigners keep money in the United States because they live in nations with unstable and/or repressive governments.
• Explaining that the IRS action is a gross abuse of the regulatory process since an executive branch agency does not have the authority to overturn laws enacted as part of the democratic process.
• Explaining that this proposed regulation is just the beginning, and that proponents hope to issue follow-up rules that would cripple policies making America a haven for global capital.

But these points don’t seem to matter to the Obama Administration, which is ideologically committed to the anti-tax competition agenda of Europe’s welfare states. This is why the White House supports all sorts of destructive policies, including not only this misguided regulation, but also the creation of something akin to a world tax organization that will have power to block free-market tax policy.

Earlier this week, I explained why Mitt Romney is a Republican version of Barack Obama. His transgressions include being open to a value-added tax, a less-than-stellar record on healthcare, weakness on Social Security reform, an anemic list of proposed budget savings, and support for reprehensible ethanol subsidies.

Now we can add something else to the list. He wants to cut off the bottom rungs of the economic ladder and hurt low-skilled workers.

Here are a couple of passages from a report in the Oregonian.

Mitt Romney…continues to be a supporter of indexing the minimum wage for inflation. Oregon and Washington were among the first states to index their own minimum wages to inflation – nine states now do so – and it’s a favorite of liberals… Romney campaigned in favor of indexing the minimum wage when he ran for governor in 2002.  However, ABC News noted in 2007 that he wasn’t sure he supported indexing the federalminimum wage (which is lower than the minimum wage in several states).  In this new video, you could quibble that he doesn’t explicitly say he’s talking about the federal minimum — but that sure seems to be the tenor of his comments.

In other words, Romney is willing to condemn lower-skilled workers to unemployment, in hopes that he will gain some sort of short-term political advantage. In this regard, he will be just like Bush.

Newt Gingrich has had his ups and downs lately in the Republican Presidential primary. Though much of the setback has been due to his own miscues, he recently hit the nail on the proverbial head when he proclaimed that the National Labor Relations Board (NLRB) should be defunded. There is no doubt that Obama’s recent recess appointments to the National Labor Relations Board were motivated by his desire to bring Big Labor on board for the 2012 Election run as recounted in last week’s blog Will the NLRB Decide the 2012 Presidential Election. Newt was correct in stating that defunding the NLRB is the right response to an imperialistic President who intentionally circumvented the spirit of the law for personal gain and philosophical ideology.

Besides legal measures, the only current means to defeat The Cold War Within: The Fight for America’s Future is for the Republican dominated congress to utilize its budgetary power and defund the Rogue NLRB. Such action is even more imperative now, according to Phil Wilson in his latest issue of Union Bailout Update, where he expresses that the two new Democratic appointees, Sharon Block and Richard Griffin, are even more radical than Craig Becker, which is unimaginable. Additionally, Mr. Wilson expressed that Board Chairman Mark Pearce is the true engine behind achieving Card Check, and that the recent appointments provide Pierce the radical majority he needs to achieve Obama’s and Big Labor’s coveted goal of an Employee Free Choice Act (EFCA) style regulatory scheme, aka “EFCA Through the Backdoor,” in time to support Obama’s 2012 Presidential run.

The goal is to implement new regulations such as the “Persuader Rule,” “quickie elections,” and the Posting Rule,  as described in Phil Wilson’s 2012 Predictions that will allow Big Labor to utilize the Persuasion of Power to prosecute brutal Corporate Campaigns against employees and employers in time to raise money, register voters and put union foot soldiers on the ground for the 2012 Election. Message to my fellow conservatives: Please don’t blame the mainstream media for the improvement in jobs, unemployment, and economic growth. Reporters are not making this up. The economy is better. It’s going to give President Obama a leg up on the election. GOP beware, and come to your senses.

Take Friday’s jobs report from the Bureau of Labor Statistics. Nonfarm payrolls gained 200,000 and the unemployment rate slipped to 8.5 percent from 8.7 percent. It may well be that a seasonal quirk added 42,000 messengers and couriers to the totals, but that will be lost in the headline reporting. It will be given back next month. It’s inconsequential to the overall story. Likewise, a normal labor participation rate would yield much higher unemployment. But that’s academic.

Like any president, Mr. Obama will take credit for these economic gains. He’s doing that right now. And he has a case to make: A year ago the unemployment rate was 9.4 percent, and in 2011 it fell almost a percentage point. In the twelve months through December 2011, the economy produced 1.64 million new jobs, while in 2010, only 940,000 were created. On a monthly average basis, 137,000 new jobs per month were created in 2011, compared to only 78,000 a month in 2010. Things are getting better.

The Barack Obama Administration has, since its inception, been moving the United States dramatically leftward, trying to (at the very least) make us a western European socialist entity. Ideologically, a full-on participant in – rather than a rational outlier of – the patently absurd United Nations (UN).

Perhaps the greatest – and worst – example of President Obama’s UN-ing of America was his Federal Communications Commission (FCC)’s December 2010 illegal Network Neutrality Internet power grab.

The Administration going to these unlawful lengths to commandeer control of the ‘Net makes it a little more difficult to persuade international autocrats and dictators to leave alone their portions of the World Wide Web.

Or ours.

With the Iowa caucuses kicking off the primary season to decide the Republican presidential challenger, it is important to reflect on what President Obama will be doing to secure a second term, as he has no Democratic challenger. As Obama basks in the warmth of Hawaii for 19 days after three years of failed leadership, political game playing, lack of work ethic and historical divisiveness, he must use this down time to repair strained relations with big labor and pull some magic rabbits out of the hat to have a chance at re-election.

Enter the National Labor Relations Board and its radical Obama appointees Craig Becker and Mark Pierce, as well as proposed appointees Sharon Block, a former liberal NLRB attorney, and Richard Griffin, General Counsel for the International Union of Operating Engineers (IUOE) and a member of the AFL-CIO Lawyer Coordinating Committee. The Senate has declined to vote on approval of the two appointees or on the reappointment of Craig Becker, whose term mercifully ended December 31, 2011. However, it remains to be seen if Obama will use his Rule by Fiat mentality in an attempt to recess appoint them as he did with Craig Becker during a Senate recess in the spring of 2009. If he does, it will be obvious payback to AFL-CIO President Richard Trumka and former SEIU President Andy Stern, both Obama cronies and admitted frequent White House visitors.

Under the regime of Becker and Pierce, the NLRB wreaked havoc on the business community in 2011, as highlighted in The Cold War Within: The Fight for America’s Future. The fallout is still being felt as two of the principal regulations implemented by the Becker-Pierce NLRB are set to take effect in 2012. The first of these, the “Posting” rule, requires employers to post information apprising employees of their right to organize in accordance with the National Labor Relations Act.  Implementation has been delayed until April 30th, 2012 due to legal challenges, while the even more controversial “Quickie Elections” are also scheduled to go into effect April 30, 2011 (see NLRB Adopts Quickie Election Procedure, Sets Start Date). (Reuters) – President Barack Obama plans to use a recess appointment to install Richard Cordray as head of the country’s new consumer financial protection watchdog, sidestepping Republican congressional opposition to his pick.

“Today in Ohio, President Obama will announce the recess appointment of consumer watchdog Richard Cordray,” White House communications director Dan Pfeiffer announced in a tweet.

The Consumer Financial Protection Bureau was created by the 2010 Dodd-Frank financial oversight law to police the market for consumer products such as credit cards and mortgages.

Senate Republicans have been holding up the confirmation of Richard Cordray to head the new Consumer Financial Protection Bureau until changes to the agency’s structure are made to provide oversight and accountability at the agency. But sources from inside the Capitol tell Capitol Confidential that a recess appointment of Richard Cordray to head the unconstitutional CFPB could come as early as tomorrow.

“We have been hearing consistently from the Senate offices that the President is considering a recess appointment of Richard Cordray along with a slew of other controversial nominees in the brief period between the two sessions of Congress,” a key Senate source said. “Now we are hearing from Senior Democrat staffers that something big is coming tomorrow [Jan 4].”

Article II, Section 2 of the Constitution provides the president with the power to “fill up all Vacancies that may happen during the Recess of the Senate.” The problem for the president and his liberal allies is that the Senate has not recessed and technically remains in session. However, liberal groups are pressing the White House to invoke the “Roosevelt Option” to stack key government positions with radicals ready to carry out an anti-business, pro-big labor regulatory agenda. The Roosevelt Option is coined from the actions of Teddy Roosevelt who in 1903, in a split-second between two congressional sessions of Congress, made more than 100 recess appointments. In 2012, Congress will need to move from the First Session of this current Congress to the Second Session. Liberals claim the fraction of a second between the sessions is enough to trigger presidential power.

The United States is at a fork in the road regarding which way we will go as a people. The 2012 election could be the most important in our lifetime, and conservative leaders have reached a consensus on how to channel the energy and concerns of the American people to realize historic change this year.

The status quo will not survive the year. Our debt and spending have reached catastrophic proportions in the context of global financial difficulties and political upheaval. Consequently, by the end of 2012, America will either have taken a decisive step toward socialistic collectivism in the name of “equality” and “social justice,” where businesses and owners are punitively taxed to “pay their fair share,” or America will take a major step in the direction of returning to our Founders’ constitutional government, restoring the rule of law, federalism, free enterprise, and individual initiative and responsibility.

The American people will decide which path to take in the 2012 elections, not only in the general election on November 6 but also in the nominating process in primaries over the next several months for all major offices, including the presidency. Conservatives must act in a concerted and informed fashion in all of these contests to shape the public dialogue and thoroughly vet the candidates.

To achieve these ends, top conservative leaders acting under the umbrella of the Conservative Action Project have released “A Conservative Consensus for 2012” announcing agreement on major policies. These issues span all three wings of the conservative movement: economic, social, and national security.

The Federal Register is the daily depository of all proposed and final rules and regulations, as well as presidential documents, executive orders, agency internal directives and other notices.

This morning’s edition topped out at a rather incredible 81,245 pages for the year, with three days left for Uncle Sam to rack up still more mandates in 2011.

This is notable, because nominally, tomorrow’s Federal Register stands to surpass last year’s all-time high of 81,405. Each year I assemble such facts and figures about the regulatory state in Ten Thousand Commandments, and nothing is improving, at a time in our economic history when things need badly to improve.

It was supposed to be a “slice of Americana and of childhood dreams,” says U.S. Army Specialist Mark Grapin, who lives in Fairfax County, Virginia. He’s talking about the treehouse he built for his two sons after returning from his latest tour of duty in Iraq.

What Grapin didn’t expect was that Fairfax County’s zoning board would demand he tear down the treehouse after an anonymous complaint, thus launching the family into an eight-month legal battle.

Grapin went to the local media for help and public outcry turned into an online petition. A neighbor donated trees to cover the treehouse, and the family even received a pro bono lawyer to help win over board members.

Just days before the treehouse was to be torn down, Grapin was able to convince the board to let him keep it on the condition it be removed after five years. Plenty of time, he says, for his sons to enjoy it.

What’s a Barack Obama Administration multi-billion dollar boondoggle without a Czar to oversee it?

For the automobile industry bailout, the Lord Overseer was Car Czar Steven Rattner.

This is the same Steven Rattner who late last year reportedly paid a $6.2 million Securities and Exchange Commission (SEC) fine and accepted a two-year ban from associating with broker-dealers or investment advisers.  For an alleged “pay-to-play” New York state pension fund kickbacks scheme he orchestrated after leaving Washington and his Czar-ship.

DC-Wall Street nexis, anyone?  Crony Socialism, anyone?

His current gig – besides being a (shocker) MSNBC Morning Joe “Economic Analyst”?  Managing New York Mayor – and 1%-er billionaire – Michael Bloomberg’s personal and philanthropic assets.
