			<content:encoded><![CDATA[<p>I am proud to announce that Judicial Watch is representing Tiffany Hartley, the widow of David Hartley, who was murdered on Falcon Lake in Texas. The lake spans a large section of the border between Texas and Mexico. Hartley is believed to have been gunned down by members of the Mexican Zeta drug cartel, which has control of the lake.</p>
<p><a href="http://biggovernment.com/files/2011/05/20090108_102308_border1_300.jpg"><img class="aligncenter size-full wp-image-272040" title="20090108_102308_border1_300" src="http://biggovernment.com/files/2011/05/20090108_102308_border1_300.jpg" alt="" width="300" height="206" /></a></p>
<p>Nearly eight months after the murder, Mr. Hartley’s body has yet to be recovered and the federal government has ended its participation in this case. Mr. and Mrs. Hartley had been jet-skiing on the lake, which is a major tourist destination, when the attack occurred. Tiffany Hartley barely survived the attack by fleeing on her jet ski after trying desperately to pull her husband out of the water.</p>
<p>Judicial Watch is calling on the Mexican government and the Obama administration to thoroughly investigate the September 30, 2010, murder of David Hartley on Falcon Lake. We’ve also launched an investigation of David Hartley’s murder, and are moving to identify and obtain all government records pertaining to the September shooting, including Obama administration communications with their Mexican counterparts, as well as law enforcement officials, Mexican military authorities, and others.</p>
<p>Mrs. Hartley is owed a full and thorough investigation into the murder of her husband. She deserves accountability from both the Mexican authorities and the Obama administration. So far, the pursuit of justice apparently has been suppressed for political reasons on both sides of the border. It’s shameful and wrong.</p>
<p><span id="more-271464"></span></p>
<p>Our work with Ms. Hartley began full throttle last week. Ms. Hartley and Judicial Watch met with a number of congressmen here in Washington and participated in a press conference kindly hosted on the U.S. Capitol grounds by Rep. Ted Poe (R-TX). Rep. Brian Bilbray (R-CA) also took the time to participate in the press conference (which received a nice write-up <a href="http://www.thedenverchannel.com/news/27870547/detail.html">here</a>). Judicial Watch sure appreciates the demonstrated leadership of these two House members that is so sorely lacking from the Obama administration.</p>
<p>You may have seen news reports of President Obama <a href="http://www.judicialwatch.org/blog/2011/may/mexican-border-crime-underreported">dishonestly</a> suggesting this week that the border is “secure” in a campaign speech boosting amnesty for illegal alien lawbreakers. I’m convinced that one reason the Obama administration has dropped the ball on the Hartley murder is that the crime is at odds with the Obama administration myth that the border is secure and safe. In fact, there was — just last week — a <a href="http://www.cbsnews.com/8301-504083_162-20061463-504083.html">major naval battle</a> on the lake between the Mexican navy and drug pirates that resulted in 13 deaths!</p>
<p>I’ll close with a statement by Rep. Poe, who has gone the extra mile to help Tiffany:</p>
<blockquote><p>It has been nearly eight months since David Hartley was gunned down on Falcon Lake. His wife Tiffany is still left with no answers about the death of her husband. Mrs. Hartley is not alone. Last year 111 U.S. citizens were killed in Mexico, to this day none of those cases have been solved. In many of these cases the Federal Government has abandoned the investigations leaving it up to the Mexican government to solve, no questions asked. It is past time that the American government stays on top of the Mexican government for solving the murders of our own citizens.</p></blockquote>

<p>San Francisco has just decided that they will no longer cooperate with the feds when they arrest <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/05/11/MNH41JEDMI.DTL">juveniles who commit felonies.</a> This is being done in the spirit of their Sanctuary law.  Sanctuary for violent law breakers, that is.   San Francisco has always welcomed illegal aliens and provided them every service imaginable while thumbing their noses at the feds.</p>
<p>President Obama and his lame side-kick, otherwise know as Attorney General Eric Holder recently prosecuted the State of Arizona because Arizona had passed a law, with wording mimicking the federal statutes, to enforce immigration laws.  Holder claimed the state was precluded from passing these type of laws as the state was “pre-empted” by the feds.    However, Obama and Holder see no “pre-emption” policy violation when states and cities pass laws designed to defeat or circumvent federal laws. That’s apparently lawful according to the brain trusts that run the Attorney General’s office.   Do you need more evidence that we live in an Alice in Wonderland world, a world full of left wing rodents running the government?</p>
<p>Not all states are giving into the alien felons.   Utah recently enacted a law that would check the citizenship status of all those persons arrested for felonies.  This is what the feds want. They allegedly want felons deported.  However, this week a <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/05/11/MNHR1JEG2H.DTL">federal judge struck down Utah’s</a> attempt to identify arrested illegal alien felons because it’s too much like the Arizona law!     Excuse me your honor, but how exactly do we know which felons to turn over to the feds- if we can’t ask for proof of legal presence in our country?</p>

<p>A 1996 federal law, called the Illegal Immigration Reform and Immigrant Responsibility Act,  requires all local governments to cooperate with Department of Homeland Security&#8217;s Immigration and Customs Enforcement (ICE).   It’s hard to believe that such a law exists as there are dozens of cities giving the feds the finger. And the feds, under Obama’s strong and caring leadership, has sat on his hands while cities flagrantly violate the fed statute.  These cities have adopted the  &#8221;sanctuary&#8221; laws, a misnomer, to harbor alien lawbreakers and in many cases, even felons. If you and I harbored a felon, we&#8217;d be charged with &#8220;harboring a felon&#8221;. That is a felony.  Yet, sanctuary cities instruct their employees not to cooperate with the feds. Their laws forbid city employees from notifying the federal government of the presence of illegal aliens living in their jurisdiction even after they’ve been arrested. The policies also tend to conflate legal and illegal immigration. These policies give illegal aliens all the rights and social benefits of citizens; welfare, in-state college tuition, free schools and medical, the whole gravy train of the welfare state.</p>
<p>Don’t you love it when cities can simply choose which federal laws they can follow and a wimpy president and an even less effectual Attorney General look the other way?    However, if you try to comply with the federal laws, as both Arizona and Utah did, you’ll get the full smack down.  Go figure.  Why go to the movies to see the latest fantasy production when reality is so much better?</p>
<p>Texas is now trying to find a path that even liberal judges can live with. The Lone Star state now insists that its cities cooperate with the feds or <a href="http://www.foxnews.com/politics/2011/05/10/texas-moves-crack-cities-protecting-illegal-immigrants/">lose state funding.</a> Even big, red-state Texas has its share of loony sanctuary cities, but it pales in comparison to California, <a href="http://www.ojjpac.org/sanctuary.asp">the reigning leader of the hate-America, loony left.</a></p>
<p>When will the new GOP congress act? It’s unlikely any strong penalities against sanctuary cities will occur as long as we have the biggest advocate for law breaking sitting in the White House, passing his time listening to a cop-killer rap artist.   However, a rider in a budget bill that penalizes sanctuary cities is long over due.   Pssst, GOP, are you listening?  Obama said when he was a candidate, that he would fundamentally change America and unfortunately for us, he meant it.</p>

			<content:encoded><![CDATA[<p style="text-align: left">One pen stroke from <a href="http://azgovernor.gov/" target="_blank">Arizona Governor Jan Brewer</a> has given her state a no-nonsense immigration policy and given America yet another opportunity to see the full face of leftist hypocrisy.</p>

<p>First some key points of the policy-</p>
<p>As shown in the picture above (featuring MSNBC’s poster child of intelligence, Contessa Brewer) this bill essentially says illegal means illegal.  If you are in the state of Arizona illegally you are guilty of trespassing <a href="http://www.azleg.gov/legtext/49leg/2r/bills/sb1070s.pdf" target="_blank">(page 2 line 44)</a>, and if you are caught trespassing you will be transferred immediately to the custody of the ICE (Immigration and Customs Enforcement).  I will address the profiling allegations later.</p>
<p>This bill has teeth, and it puts the screws to employers who knowingly hire illegal immigrants (<a href="http://www.azleg.gov/legtext/49leg/2r/bills/sb1070s.pdf" target="_blank">page 6 line 7</a>).  The burden of proof of work eligibility is now on the employer since this bill officially makes it illegal for an undocumented alien to “<em>apply for work, solicit work in a public place, or perform work as an employee or independent contractor in this state.”</em></p>
<p align="center">
<p>Complaints can now be filed with the Attorney General of Arizona or with a county attorney when a business is suspected of employing illegal aliens.  After an investigation, if a business is found to be employing illegal workers charges are brought upon the business, and expedited court status is given to the case.</p>
<p><span id="more-112754"></span></p>
<p>1<sup>st</sup> Violation:</p>
<ul>
<li>3 year probationary period for the specific business location (5 years if the employer intentionally hired illegal employees)</li>
<li>Employer must file a signed sworn affidavit with the county attorney within 3 business days stating that all illegal employees have been terminated and that the hiring of unauthorized aliens will never happen again. If this is not filed in 3 business days all licenses for that business location are suspended until filed</li>
<li>Quarterly reports must be submitted documenting each new employee hired for 3 years</li>
</ul>
<p>2<sup>nd</sup> Violation:</p>
<ul>
<li>Permanent revocation of all licenses held by the specific business location which hired the employee</li>
</ul>
<p>With a system like e-verify available to employers there is no reason that the 2<sup>nd</sup> offense shouldn’t mean jail time, assuming the empl. Maybe next session…</p>
<p>Next the hypocrisy-</p>
<p>As expected and as usual, the left is crying foul at the top of their lungs and accusations of racism are flying aimlessly.  What is being largely &#8211; if not completely &#8211; ignored by leftist media outlets and especially by President Clinton is the nearly <a href="http://gatewaypundit.firstthings.com/2010/04/arizona-protesters-threaten-police-at-rally-photo/" target="_blank">immediate turn to violence</a> by those protesting the legislation.</p>
<p>Unlike the reason based protests by tea partiers, the Arizona protesters are acting solely on emotions stirred by a constant barrage of leftist demagoguery.  No civil rights have been violated, no racial profiling has taken place, and the motivation for this law was not racism. The motivation is completely founded in reason which is backed by facts and by a definitive understanding of the word &#8216;illegal&#8217;.</p>
<p>For example: <a href="http://pewhispanic.org/files/reports/107.pdf" target="_blank">A recent study</a> by the Pew Research center shows that in 2008, 10% of the Arizona labor force was made up by unauthorized aliens.  At that very time the unemployment rate in the state of Arizona was approaching the same 10% mark.</p>
<p>Couple those statistics with an increase in innocent lives being lost due to drug cartel violence and a federal government who refuses to adhere to the constitution and you have a  <a href="http://www.kvoa.com/news/arizona-taxpayers-owed-1-billion-from-illegal-immigration/" target="_blank">$1 billion crisis</a>.  The Arizona people knew something had to be done which is why <a href="http://www.rasmussenreports.com/public_content/politics/elections2/election_2010/election_2010_senate_elections/arizona/70_of_arizona_voters_favor_new_state_measure_cracking_down_on_illegal_immigration" target="_blank">a recent Rasmussen poll</a> shows that 70% of Arizona citizens approve of the new law.</p>
<p>As for the unfounded accusations of racial profiling, the sponsor of the bill Rep. John Kavanagh sums it up best:</p>
<blockquote><p><em>“This provision merely extends to immigration offenses a half-century-old tool called &#8220;stop and question,&#8221; created by the U.S. Supreme Court. To prevent racial profiling, the law states that in constructing &#8220;reasonable suspicion,&#8221; police officers &#8220;may not solely consider race, color or national origin.&#8221;”</em></p></blockquote>
<p>To understand the full extent of hypocrisy you must to understand that liberals are not subject to reality.</p>
<p>For example: think back to the liberal argument for Affirmative Action.  Liberals argued that the American people were inherently racist, bigoted, and oppressive towards minorities, and due to that fact, laws must be passed to give certain ethnic groups preferential treatment over others.  In their &#8216;reality&#8217; this was ‘righting a wrong’. In <em>actual </em>reality this was and is a flagrant abuse of the law which encourages racial profiling and discrimination.</p>
<p>In fact, the very tenants which serve as the enforcement mechanisms for Affirmative Action: racial profiling, discrimination, and one big equal protection violation, are the sole misnomers driving the left&#8217;s demonization of the Arizona Immigration bill &#8211; which contains none of these mechanisms.  Without the slightest clue, the left is demonizing Affirmative Action.</p>
<p>So before you think the immigration rallies scheduled for May 1st are a bad thing, remember &#8211; protesters will literally be screaming their admission of the unconstitutionality and purposeful racism which has been brought upon the American people through Affirmative Action.</p>
<p>This is definitely a net-positive since admission is always the first step.</p>
