Judge’s Order Keeps James O’Keefe From Attending Conservative Conference in California

Young investigative filmmaker James O’Keefe has become a celebrity of sorts in conservative circles for his work exposing operations inside the group ACORN.  But a federal judge’s order is keeping O’Keefe from joining prominent conservatives like Andrew Breitbart and myself at an upcoming conference in California.

Federal judge Daniel E. Knowles III has denied a request by O’Keefe to travel outside the state of New Jersey.  Breitbart, O’Keefe and Michigan Congressman Thad McCotter are scheduled keynote speakers for the Eagle Forum Conference in San Diego, June 10th and 11th.

Conference organizers have said that Breitbart and O’Keefe are slated to teach conference attendees “How To Be An Effective Citizen Journalist.”  McCotter meanwhile, a favorite among grassroots conservatives, has been rumored to be considering a run for President.  It wouldn’t surprise me if he chooses the conference setting to announce his candidacy plans.  Yours truly, by the way, will be acting as emcee for the weekend event.

The judge does not detail his reasons for denying O’Keefe’s request and interestingly has routinely approved previous requests by O’Keefe to travel outside New Jersey.

‘Gulf Officials Hope Obama Speech Can Help Finish Katrina Repairs.’ Really?

President Obama should use the anniversary of Hurricane Katrina to inject new energy into the unfinished task of repairing New Orleans, according to officials from the region.

Obama will deliver a speech here Sunday to mark five years to the day that Katrina made landfall, devastating the city and tarnishing the presidency of George W. Bush.

Showcasing the progress in New Orleans under his administration could also help boost the president’s sagging approval ratings, and with it the fortunes of his party in November. His speech, officials say, should offer a way to find balance between further oil exploration and protecting the region’s sensitive coastline.

“We’re also going to impress upon him how difficult this recovery is going to be,” Sen. Mary Landrieu (D-La.) told The Hill. “We’re going to remind him about the importance of coastal restoration and accelerating revenue sharing.”

Senate Panel OKs Creation of Alternative Gulf Commission

In a rebuke to President Obama, a Senate panel last week gave a thumbs-up to the creation of an alternative Gulf oil spill commission to rival that previously announced by the President.

The bipartisan commission was approved by five Democrats and ten Republicans on the Senate Energy and Natural Resources Committee.

Its members would be determined mainly by Members of Congress, on a 50/50 Democrat/Republican basis, with President Obama retaining the power to appoint the Chairman.

The move followed intense criticism of President Obama’s own announced commission—composed in substantial part of anti-drilling members like Natural Resources Defense Council President Frances Beinecke, and several individuals professionally focused on environmental law— from Democrats and Republicans alike.

Sen. John Barrasso (R-Wyo.), one of those involved in the alternative-commission effort, said earlier this week that the Obama Gulf oil spill commission “appears to me to be stacked with people philosophically opposed to offshore drilling.”

BP Bailout: Heresy In Louisiana

The Louisiana oil crisis continues unabated. Oil continues to pollute the Gulf and the Obama Administration continues to fiddle while Louisiana suffers.

In addition to being angry with BP and the Obama Administration’s weak response, activists have taken to the street to protest Louisiana’s Senators’ support for a BP bailout. Apparently both Louisiana Senators decided to cater to the special interests and voted for the Durbin Amendment to the Financial Reform bill that would increase the profits of companies like BP by shifting the cost of credit transactions away from them and forcing consumers to pay for them instead.

Both parties are responsible for the passage of the Durbin Amendment to bailout BP and other big retailers.

Feds Scrubbed Video from O’Keefe’s Phone Used in LA Caper

Conservative activist-videographer James O’Keefe said video he shot of conversations with staffers of U.S. Sen. Mary Landrieu was deleted when his cell phone was returned after he and three others pleaded guilty to charges in a caper he orchestrated at the Democrat’s New Orleans office.

A spokeswoman for the U.S. attorney’s office said Saturday that U.S. Magistrate Daniel Knowles III ordered the footage removed. O’Keefe made the claim Friday in a posting on his Twitter social networking site.

O’Keefe, 25, and the others pleaded guilty on Wednesday to misdemeanor charges of entering federal property under false pretenses. They were sentenced by Knowles.

They were sentenced to probation, community service and fines. O’Keefe received the heaviest sentence, three years probation, 100 hours of community service and a $1,500 fine.

Did the U.S. Government Leak James O’Keefe’s Privileged Attorney-Cleint Emails to the Press?

Attorney-client communications are among the most sacred in the American system of jurisprudence, so when James O’Keefe’s lawyers noticed at least two instances of privileged communication between them and their client appearing in the media, they wrote to Assistant U.S. Attorney Jan Mann in New Orleans: “O’Keefe materials improperly provided to media.”

The information that I have confirmed was disclosed to the media appears to be intentionally calculated to foment negative public opinion against Mr. O’Keefe, presumably in an unethical effort to prejudice any criminal proceedings… a clear violation of Chapters 1-7.500 and 1-7.600 (E) of the United States Attorneys’ Manual as well as a prosecutor’s ethical obligations…

When O’Keefe and three others were arrested in January, his computer and cell phone were seized, under the completely false premise that they were surveillance devices, and it appears that the documents came from them. If true, as O’Keefe’s lawyers note, this would constitute an outrageous violation of law-enforcement ethics as well as “severe prosecutorial misconduct.”

NEW ORLEANS – Joseph Basel, age 24, Stan Dai, age 24, Robert Flanagan, age 24, and James O’Keefe, age 25, were charged in a one-count bill of information with entering real property of the United States under false pretenses, a misdemeanor, announced the U. S. Attorney’s Office for the Eastern District of Louisiana.

According to the Bill of Information, between January 20, 2010, and January 25, 2010, Flanagan, Basel, O’Keefe, and Dai met on several occasions. During their meetings, they discussed, among other things, possible scenarios in which they would talk with members of the staff of Senator Mary Landrieu inside of her New Orleans, Louisiana office, in the Hale Boggs Federal Building, and record the interaction using audio and visual equipment. As a result of this planning, on January 25, 2010, Basel and Flanagan entered the Senator’s office dressed as telephone repairmen, said they were following up on reports of problems with the telephone system, engaged in conversation with the staff members, and pretended to test the phone system. The horse trading went long into the night. In the end the House Democrats bought, cajoled, wrangled and bullied enough votes to pass the health care debacle. The battle is far from over and will range into next November and beyond.

As a far right wing nut job I will enjoy the coming downfall of the Democratic Party. I will enjoy the stunned looks on the faces of those who will lose their union and employer health care plans if this legislation stays around long enough to take effect. I will enjoy the coming revolt of the middle and upper class taxpayers. I could of course, be wrong. Maybe the American people are tired of being free and maybe rugged individualism is dead. Maybe the vast majority of my neighbors are looking forward to the never ending growth of the Federal Government. Maybe everyone except we gun owning, SUV driving, meat eating, smaller government, right wing nut job pro lifers want the nanny state.

So now that the first battle of the “health care reform” movement is over we need to ask some questions. Is that it from the left? Will there be no further movement to start a government option? Will there be no push to get to a single payer system? If you believe that you need to get in the line that starts right behind Rep. Bart Stupak.

Rep. Stupak has become the Neville Chamberlain of our time.

Congress is out of control.  The public overwhelming opposes a government takedover of our health care. But Congressional leaders are telling us they don’t care – that they know best, and they’re going to pass it anyway.

We are getting the same attitude on other issues, from global warming regulation, to taxes, government spending, deficits, federal debt, energy policy, welfare, corporate bailouts, and beyond.  Too many of our elected Members of Congress are making behind-closed-door deals and ignoring their constituents, calling them “yahoos,” “Nazis”,“and “tea-baggers.”

This isn’t American democracy — this is a shop-worn, elitist, authoritarianism closer to abuses we see in countries like Venezuela.

So, what would happen if the people could change this rotten situation?

It was, for new media, a defining moment. And while the historic implications of the O’Keefe/Giles expose are not yet fully understood, the media landscape was forever changed.

Despite this seismic shift in modern journalism, the mainstream media scornfully ignored the biggest story of the Obama administration. ACORN, Obama’s personal community organizing group, funded with taxpayer dollars, was shown to be a criminal, rapacious, and predatory organization. In clip after clip from O’Keefe and Giles, ACORN’s indecency became more obvious and outrageous, and the little remaining trust that the American people had in government/community service organizations morphed into outright contempt.

And the mainstream media yawned.

This past week marked one of the strangest periods of my life.  And yes, the arrest of my friend and colleague James O’Keefe had a lot to do with it. James found himself, once again, in the middle of a raging media battle all because he wanted to shine a little light on public corruption.  Let me tell you something, he certainly rang in the New Year with this one.  As James said:

My goal is to expose corruption and lack of concern for citizens by government and other institutions…

Target: Mary Landrieu. Why: she’s been taking legal “bribes” in the form of the “Louisiana Purchase” in exchange for her vote on Sen. Harry Reid’s healthcare bill, and ignoring phone calls from her outraged constituents.  Bold, dirty, rude politics at its finest.

Putting his head down, and plowing ahead, James was off to New Orleans working on a new project.  A project that would hopefully raise questions, demand answers, and spur people to action. (more…)

U.S. Attorney Steps Down From O’Keefe Case

The same day the man who first published James O’Keefe’s explosive videos exposing wrongdoing at community organizer ACORN came to his defense Monday, claiming the conservative filmmaker “sat in jail for 28 hours without access to an attorney” while the prosecutor made his case to the media, the U.S. attorney involved stepped down.

O’Keefe, accused of trying to tamper with the phones of Louisiana Sen. Mary Landrieu, was “framed” by the media and the U.S. attorney’s office, Andrew Breitbart, publisher of BigGovernment.com, told Fox News Monday.

Hours later, Jim Letten, U.S. attorney for the Eastern District of Louisiana, recused himself from the case.

Possible O’Keefe Explanation: He Was an ACORN ‘Secret Shopper’

The recent statement published on Big Government by James O’Keefe and the existence of videotape showing the full project intended for Senator Landrieu’s office should put an end to the irresponsible chatter about Watergate Jr. or any other slanderous attacks of wiretapping by the “objective journalists” of the mainstream media.

We’re not naïve enough to believe the attacks will stop, but there is something to be said about holding your fire until you have some clue about what’s going on. The Washington Post and other outlets have been forced to walk back their outrageous statements of wiretapping and apologize for their accusations of seeking to destroy a phone system of the federal government. As amusing as it’s been to see O’Keefe’s antics demonstrate media bias, there is the concern about an obscure portion of the United States Code about misrepresenting yourself to gain access to a federal facility.

According to O’Keefe, videotape of the event will fully exonerate him. If we take that at face value, then all that is left is the charge of misrepresentation to gain access to a federal office. This may be the cause of some squirming by the four young men, because the federal government and
its officers do not like to be trifled with, and the ability to bring punishment to US citizens for minor offenses isn’t limited to smoking a joint without the benefit of having a judge as a blood relative.

NEW ORLEANS (AP) – Four conservative activists accused of trying to tamper with a senator’s phones were just trying to record embarrassing undercover video of her staff ignoring phone calls from constituents angry that she supported health care reform, one of their attorneys said Thurday.

The four, including activist James O’Keefe, known for posing as a pimp and using a hidden camera to target the community-organizing group ACORN, were arrested Monday after targeting Democratic Sen. Mary Landrieu’s office in a New Orleans federal building.

Attorney J. Garrison Jordan denied they were trying to disable or wiretap the phones in Landrieu’s office.

“You’re dealing with kids,” he said. “I don’t think they thought it through that far.”

Instead, Jordan said, they hoped to get embarrassing video footage of Landrieu’s staff handling constituent calls. Her office received complaints last month that callers opposed to her health care stance couldn’t get through.

Landrieu was not impressed with Jordan’s explanation.

“Attorneys are hired to spin for their clients,” she said Thursday in an interview in Washington. “Good luck.” (more…)

Beyond a pleasing sight for the heart, what would Ted Kennedy’s seat going Republican really mean?

A lot.

First, there would be the psychological effect.

On Democratic donors — it would discourage them from opening their checkbooks. On Republican donors — the impact would be electric in kindling their interest and generosity. On Democratic incumbents seeking re-election — it would make the beaches and golf courses that await them in their Florida retirement homes (and the lucrative lobbying jobs in Washington) infinitely more attractive. On Republicans considering running for the House and the Senate — it will help them see the truth: That their time is at hand! (It might even help our esteemed Party Chairman Michael Steele, realize that we can capture both houses this year!)

But in the Senate itself, it would really signal the end of Obama’s legislative dominance. He’ll probably be able to pass health care either by Democratic dithering in certifying Brown’s election or by ramming through the bill while he’s en route to Washington on the shuttle.

But, beyond that, the prospects of getting 60 votes on the remaining items in Obama’s legislative agenda: cap and trade, union card check, and immigration reform would slip away with the Massachusetts result.

Landrieu: I’ll Vote for New Government Health Care, If You Fix Old Government Health Care

There has been a lot of talk about Sen. Mary Landrieu’s new-found 100 million reasons to support Sen. Reid’s health care bill. As she channeled her inner-Hamlet about whether or not she would support her majority Leader on a procedural vote today, Sen. Landrieu won language that would pump at least another $100 million into Louisiana’s Medicaid system.

Many have framed this as Sen. Landrieu “selling” her vote, which makes me think that she’s a pretty cheap date. When fully implemented, the Reid health care plan–under the most optimistic assumptions–will cost at least $200 billion a year. An extra $100 million here or there is a rounding error. $100 million is what you get to vote for the Postal Reauthorization, not the most sweeping revamp of our nation’s health care delivery system. If I were cast in the role of one of the “undecideds” on this bill, which to Sen. Reid is numbers one, two and three on his priority list, I’d hold out for at least $1 billion. But then, I’m from Illinois.
