Why Obama Officials Had to Lie to Congress About Fuel Economy Standards

Republicans were in an “Internet uproar” last week over a false report that EPA Administrator Lisa Jackson had called them “jack-booted thugs.” Meanwhile, deeply troubling statements that EPA officials did make have hardly stirred a ripple in the blogosphere.

At a recent hearing before a House oversight panel, three Obama administration witnesses — National Highway Traffic Safety Administration (NHTSA) Administrator David Strickland, EPA Assistant Air Administrator Gina McCarthy, and EPA Transportation and Air Quality Director Margo Oge – denied under oath that motor vehicle greenhouse gas emission standards are “related to” fuel economy standards. In so doing, they denied plain facts they must know to be true. They lied to Congress.

House Government Oversight and Reform Chairman Darrell Issa (R-Calif.) put it more diplomatically: “Your statements under oath misrepresented the relationship between regulating greenhouse gases and regulating fuel economy.” By “obstinately insisting” that regulating greenhouse gases and fuel economy are “separate and unrelated endeavors,” the officials “impede the Committee’s important oversight work.”

Why did they “misrepresent” and “impede”? Had the officials answered truthfully, they would have to admit that California’s greenhouse gas motor vehicle emissions law, AB 1493, which EPA approved in June 2009, violates the Energy Policy Conservation Act’s (EPCA) express preemption of state laws or regulations “related to” fuel economy. The officials would also have to admit that EPA is effectively regulating fuel economy, a function outside the scope of its statutory authority.

That greenhouse gas emission standards implicitly regulate fuel economy is evident from the agencies’ own documents. As EPA and NHTSA acknowledge in their joint May 2010 Greenhouse Gas/Fuel Economy Tailpipe Rule (pp. 25424, 25327), no commercially available technologies exist to capture or filter out carbon dioxide (CO2) emissions from motor vehicles. Consequently, the only way to decrease grams of CO2 per mile is to reduce fuel consumption per mile — that is, increase fuel economy. Carbon dioxide constitutes 94.9% of vehicular greenhouse gas emissions, and “there is a single pool of technologies… that reduce fuel consumption and thereby CO2 emissions as well.”

When Dwayne Whitney started his trucking business decades ago he had only one truck. Today he has eighteen and 20 employees. But that’s about to change.

“The State of California says my trucks are killing people,” says Whitney. “What do you say to that?”

In a few years, new air quality regulations approved by the California Air Resources Board will render Whitney’s entire fleet illegal.

“New CARB rules are putting me out of business,” he says.

CARB claims that diesel particulates, a type of pollution emitted from buses and trucks, contributes to 2,000 premature deaths in California each year. But UCLA epidemiologist Dr. James Enstrom says the number should be closer to zero.

Judge Halts Implementation of California Cap and Tax

Thanks to Ronald Reagan’s legacy and a legal miscalculation by leftist environmentalists, this week a California judge stopped the implementation of California’s Cap and Trade law: better known as Cap and Tax. This is the same type of carbon trading that Al Gore has hawked for years, but failed to get through the most radical Democrat Congress in generations. That’s how bad it was. Of course, that didn’t stop whacked out California from passing a Draconian version of the same job killing scheme.

To add insult to injury, the so called “republican” Governor Schwarzenegger signed the bill into law in 2006. It was opposed by the Chamber of Commerce and most sane taxpayers (admittedly, CA doesn’t have enough of those). The opponents claimed that the law would drive out business to other states and dramatically increase the cost of energy. Energy costs would, of course, be passed on, driving up the cost of everything else-in the midst of the nation’s worst recession.

The voters of California even had an opportunity last year to put the brakes on it at the ballot box with Proposition 23, but the environmental left spent millions fighting the proposition. It wouldn’t even have scrapped the whole law, but only would have suspended the Cap and Tax until state unemployment dropped below 5.5% for four consecutive quarters. The proposition was defeated overwhelmingly. Considering our unemployment rate is well over 12% here, the California voters essentially supported assisted economic-suicide of their own state.

It took two forces working together to finally defeat Cap and Tax: a group of radical Lefties and Ronald Reagan to put the brakes on this law.

Have A Very Merry Efficient Christmas

A video is circulating online that imagines what modifications the infamous California Air Resources Board (CARB) would make to Santa and his traditional reindeer-drawn sleigh if they had the ability to regulate Christmas, with hilarious results:

CARB and the far-fetched ideas they frequently propose are a frequent target of scorn, but they really make it easy.  When it comes to unintentional humor, CARB is the gift that keeps on giving.

Included in CARB’s re-fit of Santa’s sleigh:

•     Changing the sleigh into a bobsled – much more aerodynamic.

•     Ditching the gifts in the back; they’re really cutting into the sleigh’s “miles per hoofbeat.”

•     Red might be Santa’s traditional color, but according to CARB darker colors attract too much heat.  Pale pink is just like red…almost.

•     To reduce horse- (or in this case reindeer-) power, at least four of the Dasher and Prancer crowd would find themselves unemployed come Christmas.

•     Rudolph is allowed to stay on the team, but only if he swaps his glowing red nose for an energy efficient light blub.

•     Santa should really skip the cookies and milk so he can shed a few pounds.

California Air Resources Board Spends $800,000 to Bolster Latest Pet Initiative

California’s Air Resources Board (CARB)—long considered a foe of conservatives nationwide— has shelled out close to $800,000 to bolster its latest pet “green” initiative, Capitol Confidential has learned.

A study released last month, which draws positive conclusions regarding CARB’s favored “feebates” program, cost a whopping $796,641 according to a document found at CARB’s own site.  That has some observers scrutinizing CARB’s activities thinking it could come under renewed and sustained criticism.

California is currently mired in a fiscal morass that seems almost intractable, with many in the Golden State blaming overspending by government for the state’s fiscal woes.  Assembly Democrats have proposed plugging the state’s budget hole via $9 billion in loans, whereas Senate Democrats want to suspend $2 billion in corporate tax reductions, among other measures; the state budget deficit, meanwhile, is reportedly as big as $19 billion.

The “feebates” program is a CARB priority, however.  The agency sees slapping a tax on new, higher-emissions cars purchased by Californians, while offering a rebate on new, lower-emissions cars, as a key to combating climate change.

California Regulators: Climate Change a Bigger Threat than Felons

The California Air Resources Board (CARB) is known for its relentless pursuit of initiatives to combat pollution and emissions it deems harmful, including carbon dioxide. However, one of its efforts designed to counter climate change has the agency attracting incoming fire, with critics charging that CARB is more concerned about the prospect of global warming than protecting the public from felons.

At issue is a CARB measure known as the “Cool Cars” rule that requires the application of certain additives to window glass. The theory behind the mandate is that reflective windshields will prevent cars from overheating, and thus reduce reliance on air conditioning, which affects how much fuel is burnt by a car. Proponents of climate change theory attribute changes in temperature to human activity, including the burning of fossil fuels, whereas skeptics charge that such theory amounts to a load of hot air.

What is certain in the debate over this mandate is that CARB’s action has a lot of people hot under the collar: While the glaze ostensibly prevents excess solar heat from entering cars, critics say it also seriously degrades the signal sent by a whole host of electronic devices, including GPS navigation systems, cellular phones and—perhaps most critically— ankle monitoring bracelets worn by felons, which utilize GPS technology.

The Fascist Green Police Super Bowl Ad Is Stuck In My Head

And that’s the point, I guess. Watch this ad for a “clean diesel” car by Audi, and good luck getting this slightly modified version of the Cheap Trick classic “Dream Police” out of your head. I couldn’t get it out with a lobotomy. It’s been playing off and on in my brain since it first aired during the Super Bowl.


But beyond the diddy, I also can’t get the vision of a fascist “green” future out of my head — even if it’s portrayed with a heavy dollop of of “Reno: 911“-style cop-show parody. Good comedy has to have a grain of truth in it to work, and this spot has plenty. It’s not just a peek at a ridiculous future, but a look at our “be green or else” present. An overreaction? Tell that to the chief of America’s Green Police, San Francisco mayor Gavin Newsom, who Tweeted:

“Ok .. That ‘green police’ Audi commercial hits home..”

‘Cool Cars’ Guaranteed To Make You Hot Under The Collar

I admit it.  I like electronic gizmos.  When I’m not driving (and even sometimes when I am), my BlackBerry is never more than an index finger away.  In the car, I can’t go a mile without scanning for an Old Gold hit that takes me back to the “Good Old Days” on my Sirius-XM satellite radio system.  I use my GPS system a lot (though less often than my wife would like me to, but I’m a man and I hate to admit I don’t know where I’m going).  I pay for all these gadgets, and woe be unto the person who tries to take them from me.

The California Air Resources Board (“CARB” to those folks who love acronyms) is considering regulations that would cause serious disruptions to electronic devices being transmitted from a vehicle, and for devices in the vehicle trying to receive electronic signals. The regulations that would do this are included in a program cleverly called “Cool Cars,” which would require all cars sold in the Golden State starting in 2012 to have their windows coated with a metal-oxide based glazing.  It is this process that would wreck havoc with electronic devices in those vehicles.

All this is the result of California’s fixation with so-called “global warming” and the state’s obsession with attempting to reduce carbon emissions.  Obviously, these folks at CARB haven’t seen the scientific evidence that carbon dioxide makes up at most 4% of the entire “greenhouse gas” layer in our atmosphere; and of that 4%, all of mankind’s activities (yes, including operating internal combustion engines) accounts for only about three or four percent.  This means that mankind is guilty of producing only between .12 and .16 percent of greenhouse gasses.  Not the dire emergency the greenies would have us believe it to be; but then again, why let scientific facts serve as a speed bump on the way to the complete Nanny State.
