Crowe</a> (R, Slidell) is introducing a bill for the 2010 legislative session in Baton Rouge that would <a href="http://www.nola.com/politics/index.ssf/2010/01/health_care_overhaul_violates.html">make Obamacare illegal</a> if it violates state laws, effectively making Obamacare null and void in the Pelican State.</p>

<p>Senator Crowe states that his bill &#8220;provides that no law or rule shall compel, directly or indirectly, any person, employer or health care provider to participate in any health care system or health insurance.&#8221;</p>
<p>Crowe&#8217;s proposed Senate Bill (download <a href="http://www.publiusforum.com/pdfs/crowelouisiana_healthcare_freedom_act.pdf">.pdf file</a>) begins as follows:</p>
<blockquote><p>HEALTH CARE.  Prohibits state or local governmental coercion of any Louisiana employer, health care provider, or individual to compel participation in any health care system or health insurance plan.</p></blockquote>
<p>Crowe insists that Obamacare violates Article I, Section 8 of the Constitution and &#8220;is therefore unconstitutional.&#8221; He also feels that the president&#8217;s plans violates the 10th Amendment among others.</p>

<p>In addition to the proposed legislation nullifying any possible federal healthcare laws, Senator Crowe has asked Buddy Caldwell, the State Attorney General, to determine if, in his opinion, Obamacare would violate any state laws, the Constitution, or would pass onerous unfunded mandates on the state. <p>Senator Crowe has been involved in many conservative projects including the <a href="http://www.tenthamendmentcenter.com/2009/06/24/louisiana-7th-state-to-affirm-sovereignty/">2009 State sovereignty resolution</a>, a Tenth Amendment policy project. Also in 2009 Crowe introduced a resolution proclaiming April as &#8220;<a href="http://www.christiannewswire.com/news/9478910009.html">Abortion Recovery Awareness Month</a>&#8221; which was signed by Governor Jindal.  Crowe also became a signatory to AFP&#8217;s <a href="http://www.americansforprosperity.org/042909-americans-prosperity-applauds-us-representative-steve-scalise">No Climate Tax Pledge</a>. <p>Senator Crowe is part of an increasing push by state lawmakers to affirm state sovereignty and Tenth Amendment rights, laws that will likely come before the U.S. Supreme court in short order once Obamacare is passed in D.C. According to Michael Boldin&#8217;s <a href="http://blog.tenthamendmentcenter.com/">Tenth Amendment Center</a> some 25 states have introduced state sovereignty resolutions or bills that would nullify federal laws that the state legislature feels violates their laws and those of the U.S. Constitution.</p>

<p>As of Nov. 11 the exact figure was $2,328,596.95.</p>
<p>ACORN owes money to the IRS, Arkansas, California, Delaware, District of Columbia, Indiana, Iowa, Kentucky, Louisiana, Maryland, Michigan, Mississippi, New Mexico, New York, New Jersey, Ohio, Oklahoma, Pennsylvania, South Carolina, Texas, Washington, Wisconsin, and to the cities of New York and Philadelphia.</p>

<p>I first uncovered ACORN&#8217;s massive tax debts <a href="http://spectator.org/archives/2008/10/28/lien-on-me">last year.</a></p>
<p>A detailed list of the tax liens is <a href="http://www.capitalresearch.org/blog/wp-content/uploads/2009/11/copy-of-acorntaxliens_masterlist_nov2009.xls">available here</a> as an Excel spreadsheet. Data was obtained from Nexis and the Pelican Institute.</p>
<p>The liens are grouped according to the addresses against which they were filed. In New Orleans 2609 Canal St. is functioning as ACORN&#8217;s headquarters in that city. That office was raided a few days ago by Louisiana Attorney Buddy Caldwell, whose investigators seized computers and documents.</p>
<p>Elsewhere in New Orleans, the old headquarters at 1024 Elysian Fields Avenue reportedly stands empty. The property, which was previously a funeral home, has been on the market for months.</p>
<p><span><a href="http://www.fqr.com/index/listings/multi-family/details/795504" target="_blank">French Quarter Realty</a> is asking $835,000 for the property, which is now encumbered by $1,278,862 in tax liens, </span><span>$619,271 of which is owed to the IRS. It&#8217;s unclear why the Obama administration&#8217;s tax enforcers haven&#8217;t seized the property yet. Perhaps the president is extending a courtesy to his former ally and client.</span></p>
<p>Liens were also filed against ACORN offices at 16 W. 25th St. in Baltimore, 209 W. Jackson Blvd. in Chicago, and 846 N. Broad St. in Philadelphia.</p>

			<content:encoded><![CDATA[<p>For decades the Crescent City has played host to one of the most feared and revered political organizations in America, the Association of Community Organizations for Reform Now (ACORN). Today, the Louisiana Attorney General’s office executed a search warrant on ACORN’s National Headquarters at its Canal Street address.</p>
<p>“We’re looking for corporate records and financial documents” states Investigator Scott Bailey; which are essentially the same things the ACORN 8 sought nearly 18 months ago. “We also wanted ACORN real estate records” states Marcel Reid, President of ACORN 8.</p>

<p>“We sent letters to the entire ACORN Board of Directors nearly a year ago, stating that it was either provide this information through the ACORN 8’s Writ of Mandamus (request for books and records) or we were going to go to the Police” continues Reid.</p>
<p>“It could not have happened at a better time” states Michael McCray, National Spokesman for the ACORN 8. “We believe that ACORN is trying to flee this jurisdiction. Since Louisiana seems to be the only government agency that is seriously investigating ACORN.”</p>
<p>“If ACORN hopes to survive then the know nothing, see nothing, do nothing board of directors must by replaced by individuals with the strength and capabilities to fulfill their fiduciary obligations and the courage to reign in corruption within ACORN’s senior management ranks” continues Reid.</p>
<p><span id="more-26710"></span></p>
<p>“ACORN as we know it today is finished.  It’s a 40 year old business model that never adopted to changing political times or new technology” McCray continues, “and a do nothing board of directors can not operate such a high-profile multi-national corporation.”</p>
<p>ACORN is still reeling after a barrage of bad press and negative government reaction following undercover videos of “pimps and prostitutes” seeking ACORN assistance; and is desperately struggling to remove itself from this legal imbroglio.</p>
<p>In a letter that ACORN Attorney Schwartz sent to “ACORN Friend’s in the Legal Community” stating, “We need some top-notch bankruptcy advice and maybe representation. The reorganization may involve the creation of new nonprofit entities in each state where ACORN functions, as ACORN considers moving from a centralized corporate structure to a decentralized federated structure. ACORN will need help from people who have handled rebranding …”</p>
<p>“That’s like putting lipstick on chitterlings” states McCray, “If ACORN was afraid of the independent audit and forensic examination which  eight ACORN board members demanded; I can’t imagine what they will do once a U.S. Bankruptcy Trustee is appointed to investigate ACORN.”</p>
<p>“The ACORN 8 have always sought a forensic examination and an independent audit of ACORN and its related entities. And we were thrown off the board for attempting to investigate a $1 Million embezzlement” continues Reid.</p>
<p>Recently, Eric Eve senior vice president of Global Consumer Group, Community Relations, at Citigroup also unexpectedly resigned from the ACORN Advisory Council. The “new” board charged with assisting Bertha Lewis, ACORN Chief Organizer to investigate and reorganize ACORN. This advisory council includes John Podesta, head of the Center for American Progress, a liberal think tank; Andrew Stern, president of the Service Employees International Union; and former Maryland Lt. Gov. Kathleen Kennedy Townsend.</p>
<p>“ACORN’s organizational structure and management culture creates real conflicts for anyone who truly seeks to exercise their fiduciary obligations for the benefit of the membership and not just to appease management” concludes Reid.</p>
<p>While not everyone has always approved of ACORN&#8217;s confrontational tactics, many know some of the impressive results achieved for poor people over the years. Living wage laws to fight poverty. Partnership with unions to assist workers. Housing programs to get Americans one step closer to the American dream. Those are real, tangible victories that improve people’s lives.</p>
<p>“We just only hope and pray that ACORN’s  mission to serve the underserved, and give meaningful voice to low and moderate income families can continue” states McCray. The ACORN 8 is dedicated to doing just that. Quoting the late Senator Edward Kennedy, an ardent ACORN supporter, McCray concludes “the work goes on, the cause endures, hope still lives, and the dream will never die.”</p>

<p><span style="font-family: 'Trebuchet MS', Helvetica, sans-serif; font-size: 10px; line-height: normal; color: #0d014d;"><span style="font-size: medium; padding: 0px; margin: 0px;"><img class="aligncenter size-full wp-image-26930" title="IMG_0097" src="http://biggovernment.com/files/2009/11/IMG_00971.JPG" alt="IMG_0097" width="437" height="345" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />“Regarding the federal grand jury subpoenas, ACORN does not object to the provision of information and documents to the federal government…” reads a letter from Abbe David Lowell of the Washington law firm of McDermott, Will &amp; Emery. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />The letter was included in court filings from ACORN explaining the legal basis for why they weren’t complying with a subpoena issued by Louisiana Attorney General Buddy Caldwell, which seeks a wide range of accounting information regarding the group’s many affiliated agencies. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />Lowell disclosed the federal investigation as he was writing to a New Orleans lawyer representing ACORN’s local outside accountants. The accounting firm of Duplantier, Hrapmann, Hogan &amp; Maher was served with a subpoena from Caldwell, and, apparently, at least two from federal officials. In the letter, Lowell said ACORN was asserting accountant-client privilege, which is recognized in Louisiana, but not at the federal level. </span></span></p>

An official with the office of Jim Letten, the U.S. Attorney for the Eastern District of Louisiana, said the office couldn’t confirm nor deny any investigation. The letter from Lowell does not make clear where the grand jury was convened. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />After learning ACORN was not going to comply – and hearing that two former ACORN employees had cleared their offices of everything, including computers – Caldwell’s office executed a search warrant Friday and seized more than 100 computers and other records from the activist group’s New Orleans headquarters. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />“We were not in the mood to sit around and wait a whole long time,” said David Caldwell, the assistant attorney general over Public Corruption and Special Prosecutions and son of the attorney general. “Now we don’t have to worry about anything walking off…unless it’s already gone.” <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />As he spoke outside the ACORN headquarters at 2609 Canal St., investigators inside continued to load up scores of seized desktop and laptop computers, as well as other evidence. Caldwell said his office would copy the hard drives and return the computers to ACORN, perhaps within a week. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />He said attorneys representing ACORN alerted him to the fact that two employees, whom he did not identify, removed computers from the offices. ACORN national officials recently fired longtime local ACORN leader Beth Butler, the common-law wife of ACORN founder Wade Rathke. <br style="padding: 0px; margin: 0px; border: 0px initial initial;" /><br style="padding: 0px; margin: 0px; border: 0px initial initial;" />Caldwell credited ACORN and its attorneys for calling the computer removals to his attention and said they acted in good faith. <p>In a fast-breaking development comes word that agents of the Attorney&#8217;s General office in Louisiana have raided ACORN&#8217;s offices in New Orleans. ACORN&#8217;s New Orleans was, for decades, the headquarters of the national community organizing association. News of the raid comes from Marcel Reid and her colleagues at ACORN 8, an association of former ACORN leaders and board members. Many of the individuals involved with ACORN 8 were fired from ACORN for demanding a forensic audit following an embezzlement scandal involving Dale Rathke, brother of ACORN co-founder Wade Rathke.</p>

They are also carrying records out of the building on handcarts.</p>

<p>The subpoena, released this afternoon, says, &#8220;It is still unclear if some of the monies embezzled are from state, federal or private funds.&#8221;</p>
<p>Caldwell issued subpoenas in August seeking documents related to Acorn International then-President <a href="http://www.nola.com/politics/index.ssf/2009/09/former_acorn_organizer_worries.html">Wade Rathke </a>and his brother Dale Rathke, who kept the group&#8217;s books. Those subpoenas were focused on possible Acorn violations of state employee tax law, obstructing justice and violating the Employee Retirement Security Act.</p></blockquote>

<p>Update: According to the new subpoena issued by the Louisiana Attorney General, it seems ACORN leadership was aware of the full extent of the embezzlement. That they have covered up the true figure cast doubt on their ability to truely reform the organization. In other words, they will only admit to what they get caught at.</p>

<div>The Pelican Institute for Public Policy began investigating ACORN in July of this year.  Our investigative reporter, Steve Beatty, quickly discovered that ACORN and its related groups owe more than $1 million in state and federal taxes.</div>
<div>According to Orleans Parish court filings, ACORN had failed to pay federal payroll taxes on time, even as it was accepting grants from the federal government.  The ACORN family was responsible for at least 75 tax-related filings since Jan. 1, 2008.  Most of these were liens.</div>
<div>Then, on September 3, the IRS filed a $548,000 lien for two years worth of unpaid payroll taxes.  This was on top of the existing IRS bill of more than $1 million.</div>

<div>To add to the organization&#8217;s troubles, Louisiana Attorney General Buddy Caldwell confirmed that his office was conducting &#8220;a full scale investigation of ACORN and all of its subsidiaries.&#8221;</div>
<div>On September 23, the Pelican Institute reported that the City of New Orleans had two contracts with Acorn Housing Corp. for $625,000.  Acorn Housing was to be paid $250,000 for providing home repairs under one contract, and $375,000 to develop homes in areas hit by Hurricane Katrina under the other.</div>
<div>Although the city claims to be monitoring these contracts, it has not explained what monitoring procedures are in place.  The city has also failed to provide any information clarifying how Acorn Housing was selected to do this work.</div>
<div> And neither the city nor Acorn Housing has confirmed that any work has actually been done.</div>
