Louisiana Legislature Floating Bill Making Obamacare Illegal in State

Louisiana State Senator A.G. Crowe (R, Slidell) is introducing a bill for the 2010 legislative session in Baton Rouge that would make Obamacare illegal if it violates state laws, effectively making Obamacare null and void in the Pelican State.

Senator Crowe states that his bill “provides that no law or rule shall compel, directly or indirectly, any person, employer or health care provider to participate in any health care system or health insurance.”

Crowe’s proposed Senate Bill (download .pdf file) begins as follows:

HEALTH CARE. Prohibits state or local governmental coercion of any Louisiana employer, health care provider, or individual to compel participation in any health care system or health insurance plan.

Crowe insists that Obamacare violates Article I, Section 8 of the Constitution and “is therefore unconstitutional.” He also feels that the president’s plans violates the 10th Amendment among others.

ACORN Still Owes $2.3 Million in Overdue Taxes

ACORN and its affiliates are content to impose crippling big-government laws, regulations, and taxes on Americans, but when called upon to obey those same rules, ACORN’s network of scofflaws and deadbeats simply refuses to comply.

ACORN and its affiliates currently owe more than $2.3 million in long overdue back taxes to all levels of government.

As of Nov. 11 the exact figure was $2,328,596.95.

ACORN owes money to the IRS, Arkansas, California, Delaware, District of Columbia, Indiana, Iowa, Kentucky, Louisiana, Maryland, Michigan, Mississippi, New Mexico, New York, New Jersey, Ohio, Oklahoma, Pennsylvania, South Carolina, Texas, Washington, Wisconsin, and to the cities of New York and Philadelphia.

Louisiana Attorney General’s Office tells ACORN – Show Me The Money (the books and the corporate records)

For decades the Crescent City has played host to one of the most feared and revered political organizations in America, the Association of Community Organizations for Reform Now (ACORN). Today, the Louisiana Attorney General’s office executed a search warrant on ACORN’s National Headquarters at its Canal Street address.

“We’re looking for corporate records and financial documents” states Investigator Scott Bailey; which are essentially the same things the ACORN 8 sought nearly 18 months ago. “We also wanted ACORN real estate records” states Marcel Reid, President of ACORN 8.

“We sent letters to the entire ACORN Board of Directors nearly a year ago, stating that it was either provide this information through the ACORN 8’s Writ of Mandamus (request for books and records) or we were going to go to the Police” continues Reid.

“It could not have happened at a better time” states Michael McCray, National Spokesman for the ACORN 8. “We believe that ACORN is trying to flee this jurisdiction. Since Louisiana seems to be the only government agency that is seriously investigating ACORN.”

“If ACORN hopes to survive then the know nothing, see nothing, do nothing board of directors must by replaced by individuals with the strength and capabilities to fulfill their fiduciary obligations and the courage to reign in corruption within ACORN’s senior management ranks” continues Reid.

Federal Grand Jury Seeks Information from ACORN

Amid the paperwork associated with a search warrant served on ACORN’s New Orleans headquarters Friday is a one-sentence acknowledgement by the embattled activist group’s attorneys that it is has been subpoenaed by a federal grand jury.

“Regarding the federal grand jury subpoenas, ACORN does not object to the provision of information and documents to the federal government…” reads a letter from Abbe David Lowell of the Washington law firm of McDermott, Will & Emery. 

The letter was included in court filings from ACORN explaining the legal basis for why they weren’t complying with a subpoena issued by Louisiana Attorney General Buddy Caldwell, which seeks a wide range of accounting information regarding the group’s many affiliated agencies. 

Lowell disclosed the federal investigation as he was writing to a New Orleans lawyer representing ACORN’s local outside accountants. The accounting firm of Duplantier, Hrapmann, Hogan & Maher was served with a subpoena from Caldwell, and, apparently, at least two from federal officials. In the letter, Lowell said ACORN was asserting accountant-client privilege, which is recognized in Louisiana, but not at the federal level.

In a fast-breaking development comes word that agents of the Attorney’s General office in Louisiana have raided ACORN’s offices in New Orleans. ACORN’s New Orleans was, for decades, the headquarters of the national community organizing association. News of the raid comes from Marcel Reid and her colleagues at ACORN 8, an association of former ACORN leaders and board members. Many of the individuals involved with ACORN 8 were fired from ACORN for demanding a forensic audit following an embezzlement scandal involving Dale Rathke, brother of ACORN co-founder Wade Rathke.

Breaking: Louisiana Attorney General: Rathke Embezzled $5 Million From ACORN

An internal review by the board of directors of the community organization ACORN determined that the amount allegedly embezzled from the community organization was $5 million, well more than the previously reported amount of nearly $1 million, according to a new subpoena in an investigation by Louisiana Attorney General Buddy Caldwell.

The subpoena, released this afternoon, says, “It is still unclear if some of the monies embezzled are from state, federal or private funds.”

Caldwell issued subpoenas in August seeking documents related to Acorn International then-President Wade Rathke and his brother Dale Rathke, who kept the group’s books. Those subpoenas were focused on possible Acorn violations of state employee tax law, obstructing justice and violating the Employee Retirement Security Act.

Update: According to the new subpoena issued by the Louisiana Attorney General, it seems ACORN leadership was aware of the full extent of the embezzlement. That they have covered up the true figure cast doubt on their ability to truely reform the organization. In other words, they will only admit to what they get caught at.

ACORN’s Tax Problems

The Pelican Institute for Public Policy began investigating ACORN in July of this year.  Our investigative reporter, Steve Beatty, quickly discovered that ACORN and its related groups owe more than $1 million in state and federal taxes.
According to Orleans Parish court filings, ACORN had failed to pay federal payroll taxes on time, even as it was accepting grants from the federal government.  The ACORN family was responsible for at least 75 tax-related filings since Jan. 1, 2008.  Most of these were liens.
Then, on September 3, the IRS filed a $548,000 lien for two years worth of unpaid payroll taxes.  This was on top of the existing IRS bill of more than $1 million.
