			<content:encoded><![CDATA[<p>What does the Persian Gulf emirate of Dubai and ACORN have in common?  Both of them have some bankers on Wall Street worried.  When brokers and traders returned to work after the Thanksgiving Holiday, the Dow Jones Industrial Average went on a wild rollercoaster ride dropping as much as 233 points during the trading session due to an announcement that Dubai would be rescheduling the repayment of $3.5 billion in bonds.  This unexpected announcement was not what Wall Street wanted to hear on Black Friday when retail sales were already down by 8% compared to the prior year and Cyber Monday sales were less than robust with individual online purchases being 2% less than they were last year.  All of this at a time when brokers, traders and economists across the country are watching to see if cash strapped consumers are going to bailout retailers from what is shaping up to be a dismal retail Christmas season.</p>

<p>It is understandable why Wall Street would be concerned about Dubai.  Why would they be concerned about ACORN?  On October 24, 2009, Biggovernment.com revealed that the San Diego office of ACORN dumped thousands of documents into a dumpster in advance of an investigation into the organizations activities by California Attorney General Jerry Brown.  I retrieved the documents from a shared public dumpster located behind the local ACORN office.  The documents that were retrieved filled the back of my Suburban.  Much of what was retrieved was truly trash, items such as banana peels, coffee grounds and marketing materials. After sorting through the documents, though, the 20,000 documents that were retained included sensitive personal information, financial records and documents outlining the internal and political workings of ACORN.  One of the documents obtained by Biggovernment.com shows that ACORN had business relationships with 28 major financial institutions for the purpose of assisting homeowners whose mortgages were in foreclosure.</p>

<p>Citigroup was one of the 28 financial institutions with which ACORN had a business relationship.  ACORN operated a Citi Outreach program where employees of ACORN were provided personal information for Citigroup’s customers and would make contact with borrowers who fell behind on their mortgage payments.  The objective of the program was to get homeowners to contact ACORN Housing Corporation (AHC).  Testimony provided to members of two congressional committees, the House Oversight &amp; Government Reform Committee and the House Judiciary Committee, revealed that ACORN used the Citi Outreach program, as well as a program operated on behalf of Bank of America, as a membership recruiting tool where homeowners where expected to pay monthly membership dues to ACORN prior to receiving assistance.  Testimony provided by Anita MonCrief, a former ACORN employee turned whistle-blower, sated that ACORN had quotas for membership recruitment.  Documents provided to Biggovernment.com show that regardless of whether the homeowner was assisted or not, ACORN was paid by Citigroup as long as a current phone number was obtained.  The document also shows that ACORN employees were well aware of the need to keep these documents and records private due to state and federal privacy laws.  The document reads, “People on this list have their privacy protected.  Keep the lists private.”</p>

<p>The reason Wall Street lawyers and board rooms are concerned about ACORN beyond the current political and public relations drawbacks, ACORN’s actions of throwing sensitive private information into a public dumpster containing bank customer records begs the question, is a class action lawsuit in the offing?  One document obtained by Biggovernment.com shows Citibank customers names, addresses and mortgage loan numbers were illegally disclosed, not to mention the very fact that these individuals are on this list reveals their credit worthiness since they are in a default status with regards to paying their mortgage loans.</p>

<p>Wall Street certainly has enough to worry about with a weak U.S. economy and uncertainty in global financial markets.  But thanks to ACORN, there is now more to worry about.  Citibank&#8217;s cavalier treatment of its customers sensitive, personal and financial information is potentially a serious breach of state and federal law. As the depth of the San Diego ACORN office data breach becomes more clear, Citigroup and possibly more banks, will have to prepare for the inevitable onslaught of low-income homeowners lining up to take advantage of what is truly to be a cash bonanza for the poor.  Be assured that there will be many law firms willing to help “spread the wealth” to these economically disadvantaged individuals whose personal information was treated with careless disregard.</p>

			<content:encoded><![CDATA[<p>Have you heard the one about the pimp, prostitute, politician and the community organizer?  Well, thanks to San Diego private investigator Derrick Roach, Californians are not laughing at what is turning into a political nightmare for California Attorney General Jerry Brown and ACORN.  <a href="http://biggovernment.com/2009/11/27/calif-attorney-general-offers-incoherent-troubling-answers-when-asked-about-acorn-doc-dump/">On Tuesday, November 24, Attorney General Brown appeared on KABC’s &#8220;Peter Tilden Show&#8221;</a> after it was revealed that some 20,000 documents had been thrown into a National City dumpster by ACORN employees.</p>
<p>The documents were thrown out in advance of state investigators arriving at the local ACORN office to conduct an investigation resulting from national media attention.  ACORN employee Juan Carlos Vera was videotaped giving advice to two individuals posing as a pimp and a prostitute regarding underage prostitution and human smuggling.  Without admitting any wrongdoing ACORN terminated Mr. Vera, or so they said.  Documents provided to BigGovernment.com show that Mr. Vera was not terminated but was simply laid off, implying that Mr. Vera is also eligible for rehire. (The document also notes that Mr. Vera was laid off due to &#8220;restructuring&#8221; related to &#8220;videotaping incident.)</p>

<p>Other documents provided to BigGovernment.com show that in the wake of the national scandal involving underage prostitution and human smuggling, ACORN employees were communicating with media, law enforcement and internally among ACORN offices as to how to develop a storyline that could explain the undercover videos taken of Mr. Vera.  One of those documents with San Diego television station 10News is shown below:</p>

<p>As a result of the undercover videos surfacing and the national media attention that followed, internal documents that were thrown in the trash and recovered by Derrick Roach reveal that ACORN was well aware that personal information for individuals who have applied for services and individuals on so-called “yes lists” needed to be secured under lock and key.</p>

<p>Ironically, the only part of this tumultuous episode that may in fact be a joke is that California Attorney General Jerry Brown is running for governor, again.  At age 71, California’s top cop and erstwhile Gov. Moonbeam might benefit from a refresher course in current law.  Attorney General Brown cited a case from the 1960’s where items placed in the garbage were considered private; however, in 1988 the United States Supreme Court ruled in a case, <a href="http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=US&amp;vol=486&amp;invol=35"><span style="text-decoration: underline;"><em>California v. Greenwood, 486 U.S. 35 (1988)</em>,</span></a> that there was no expectation of privacy when items are thrown in the garbage since it is common knowledge that plastic garbage bags are readily accessible to animals, children, scavengers, snoops, and other members of the public.  As for the local National City ordinance prohibiting scavenging through garbage that the ACORN office and its supporters cite, that law was enacted in 1984 and was nullified by the United States Supreme Court ruling just four years later.</p>

<p>In seven out of eight offices, ACORN employees attempted to aid and abet O&#8217;Keefe and Giles&#8217; illicit “scheme” to establish a brothel for underage illegal-immigrant prostitutes from Central America. .</p>
<p>That phase has been tabled for a future date, as I forthrightly stated last Thursday evening to Attorney General Eric Holder on FOX NEWS&#8217; <em>Hannity</em> show.</p>

<p>The next phase will be the evidentiary phase.  Starting with, but not limited to an extraordinary document dump at the San Diego office that was one of the offices  O&#8217;Keefe and Giles exposed, causing the firing of a single employee.</p>

<p>On October 1, California Attorney General Jerry Brown, who once again aspires to be the state&#8217;s governor, announced that he was investigating  not just ACORN in California, but also the truth tellers who exposed the alleged corruption and illegality.</p>
<p>Last night, I hosted a three-hour show on KFI 640 AM, the largest radio  station in the country, and use the opportunity to announce the  existence of 20,000 deeply sensitive and highly political documents  discovered in the dumpster behind ACORN in San Diego on October 9,  nine days after ACORN was announced to be under state investigation.</p>
<p>Some might call that &#8220;obstruction of justice.&#8221;</p>

<p>We are a nation of laws. The Attorney General of California and the attorney general of the United States have made a solemn oath to  uphold these laws. Attorney General Holder and Attorney General Brown are arguably the two most powerful law enforcement officers in the  country.</p>
<p>We are willing to facilitate copies being sent of all the documents recovered from the public dumpster outside the ACORN office and forward these to Attorneys General Brown and Holder.
