Executive Order: International Police Granted Full Immunity in US and Not Subject to FOIA Requests
by Larry O'ConnorIn 1983, President Ronald Reagan issued an Executive Order which gave permission to the International Criminal Police Organization (INTERPOL) to operate within the boundaries of the United States. Reagan’s EO put INTERPOL under the same basic guidelines as the CIA, FBI, ATF and other Federal law enforcement agencies.
Two weeks ago, without any announcement, debate, discussion or inquiry from journalists charged with “speaking truth to power” President Obama issued an amendment to this EO. The amendment removed part of Reagan’s order that kept INTERPOL from having full diplomatic immunity while operating within the United States. In other words: Under Reagan and right up until two weeks ago, INTERPOL was authorized to operate within the USA but they did not have full diplomatic immunity and had to adhere to certain laws set forth for investigative agencies. Laws that prohibit authorities from violating our constitutionally protected rights.
This story has begun to make the rounds at some other blogs and web sites. Some scream about the on-set of the New World Order, some merely question the timing, motives and logic behind such a move while we are still fighting foreign wars and under threat of attack from Al Qaeda and other international terrorist bodies. I certainly don’t walk down the New World Order/One World Government path, I don’t look good in tin-foil hats… but, I do wonder why this move was made so quietly and why the White House Press Corps has not made any hay about it.
I also wonder why my friends on the left, who screamed from the rooftops about phone companies conducting analysis of phone calls made from the US to known over-seas terrorists, about members of the Saudi family being allowed to leave the country in the days following 9/11, about the EVILS of the Patriot Act and how it would lead to the stripping of basic civil rights to anyone checking out a book in a library. I wonder how they feel about the President granting permission to an international organization to operate within our borders under full diplomatic immunity.
One other tasty tidbit: Due to the amended language created by President Obama, INTERPOL is now, no longer subject to Freedom of Information Act Inquiries.
I wonder if during his vacation in Hawaii if one of the intrepid reporters could ask the President:
“Mr. President, is it true that due to your amendment to Executive Order 12425, INTERPOL may break into a home without a warrant, seize private property of a US citizen, hold a citizen for questioning without the right of legal representation and not be subject to any legal or criminal repercussion?”

I read about this last week .. this amendment was signed into law on Dec 17th. Main stream wont touch it, I havent even seen Beck or Hannity say peep about it either. It needs to go mainstream and fast. The fact that interpol can kick in someones door an answer to noone is very frightning

Chilling. What's so scary is the muted sound of crickets about this act. Where's the outrage? Surely tax-paying, law abiding Americams deserve clarification and some details about the reasons for this immunity. Given liberals lack of concern for individual rights versus collective rights, it's fair to question this order and it's potential for abuse.
Where are the attorneys to challenge all these things going on? They all can't be liberals, there have got to be some common sense folks out there in the legal field that have a problem with this, signing away our sovereignty, let alone the rest of the garbage coming out of DC. Agree about the tin foil hats. I honestly don't know why people are so willing to deny their own minds! The worst that can happen is that one must admit to being wrong about something. On the other hand, if one isn't wrong, one is forewarned and able to warn others to imminent danger. We've been twittering about this all week long, and no one from any news organization has touched this story. Jake Tapper asked a couple of questions about it to the WH and was ignored, then after that, Tapper wrote a fluff piece saying this was no big deal. Tapper is a closet commie like the rest of the news agencies are. I'll be very disappointed if Beck, O'Riely or Hannity don't cover this story. If they don't, we'll know that they are going along with this agenda also and can't be trusted.

I think Axelrod/Emanuel/Obama's primary motivation is to open the door for the "world court" to go after the Bush Administration as an alleged war criminal. I think they really don't care that it subjugates us all to an aspect of global governance in the process, because it is entirely consistent for them to go after what they immediately want without considering future ramifications to US citizans.

It's a hard concept for some people to grasp, and I'm being honest when I say that. They have been taught since grade school to respect authority.
So it's hard for some people to understand how police officers, which are given a monopoly on force, often times abuse their authority or that the executive in this country, wether it's Bush or Obama, might abuse their authority.
I don't see that big a difference between the treatment of Obama and that of Bill Clinton at this point. However, one point missing from this article (and I'll admit that the point may not be true, but it was mentioned in another article elsewhere): American federal agents are often temporarily assigned to INTERPOL. The temporary assignments often are years-long. The implication is that, during their attachment to INTERPOL, American federal agents enjoy the same diplomatic immunity as do all other INTERPOL agents.
If this is true, the executive order is even more disturbing. I've never liked the idea of walking amongst people who aren't in any way bound to the same legal and other strictures under which I operate.

Why do you think they took GPS coordinates of your house? Interpol enforces international law and could care less about our constitution. If Obama signs an international treaty that includes a gun ban, you are an international criminal if you own guns. Interpol established an office in 2004 in NYC, but it was not a US office. It was a UN office. The US already has an office within the DOJ. Interpol works with federal police and intelligence agencies to issue warrants and enforce law. As far as I can tell, Interpol agents working in the US office would likely be a FBI agent or something. However, the UN office would be staffed by UN folk, but still reside on US soil. The EO amendment relaxes Interpol/UN restrictions on info gathering and even arrests. The UN does have a peacekeeping force of member nations that have authority under international law to arrest people, right? This makes it so the Interpol/UN can bypass DOJ and other federal agency. Before the amendments, Interpol/UN has some checks/oversight, now they have none. So, the problem isn't with the Interpol offices within the DOJ in DC, it's the Interpol UN office in NY.

The timing makes me wonder one of two things:
(1) Interpol is onto something big within the US (and/or multinationally); they need to go a little (or a lot) beyond the the laws that govern our own law enforcement; before they act, they want assurance they won't be subject to those same laws; and whatever the planned action is, it's important enough for the President to amend the EO to allow them to act; or
(2) US law enforcement is onto something big that needs handling, but we can't do it ourselves because the limitations on our own LE won't allow it;, so we've turned it over to Interpol and said, "Hey, here's what we've got and we need you to handle it since our hands are tied; we'll amend the EO so you won't face any legal fallout." That way the job gets done and our hands are clean.
I imagine it wouldn't go over too well if our own LE were given the same leeway. Not well at all! I just wonder if this is a way to get done what needs doing without conceding that our own LE at times needs the same leeway in order to pin down and act on terror threats.
We have to protect individual citizen rights, of course, but the overall agenda should be doing whatever it takes to quash terror threats without regard to potential political fallout.

Well…INTERPOL agents don't carry weapons unless granted specific authority to do so by host nation authorities. INTERPOL is an administrative and coordinating agency designed to coordinate the actions of law enforcement agencies across international borders. INTERPOL does not itself have search warrant authority but may request such arrest and search warrants from host nation courts; and in coordination with host nation governments, INTERPOL executes arrest warrants issued in signatory countries of the International Police Treaty (the long and proper name of which I've forgotten). FOIA applies only to departments and agencies of the Executive Branch of the U.S. government…it never applied to INTERPOL or any other international organization operating under treaty or contract or convention in the U.S. (Comment continues below)

As a result of Obama's decision regarding INTERPOL, we now have a situation where a foreign entity can indeed come kick in doors, confiscate property like personal affects and not only can we not attempt to redress such a grievance, we do not even have standing to require INTERPOL to share documentary information about what doors they kick in and what property they confiscate.
Nothing Obama has done rivals the magnitude of this Executive Order in terms of the ongoing assault upon Individual Liberty itself. This is an impeachable offense because it is, without a doubt, a high crime against not only the American people, but against America herself.
This is an example, one could say a touchstone, of corruption.

A lawyer who actually read the bill, wrote his findings on Nov 21, 2009, almost a month before the INTERPOL EO! In addition towhat he wrote above he also stated that the (paraphrasing) 4th, 5th, 9th and 10th have been trashed. Congress and the Senate chose to sell the Constitution and us down the river by signing the bill. Ultimately it'll go to court but the final decision lies with us – we the people. Nothing that new per se but his whole opinion is written in a very easy to understand way. I've always felt Obama was nudging toward a Civil War and thusfar I've seen nothing that would make me change my mind.

I just read the original parts of the EO amended by Obama. Although I'm sorely disappointed by his performance, he actually took away some privileges of INTERPOL, all having to do with exemption from income and property taxes, as well as removing their immunity from search and seizure of their property if done legally. Whomever wrote the article you linked, must have expected no one to actually read the original executive order to see what was really changed.
It gave them no extra immunities or powers. It just made them subject to our search and seizure laws as well as our tax and customs laws.
In light of Chairman MAObama's fervent want of a 'National Police Force' – a la Adolf Hitler's idea of a militaristic police agency loyal ONLY to him during the early stages of his delusional, wholesale slaughter – it's completely irresponsible for Mr. O'Conner to suggest that, while he has no idea as to the rationale behind such an idea, it couldn't possibly be because Chairman MAObama wants a 'New World Order', despite his deep hatred for this country and it's principles and Constitution, backed up with MULTIPLE EXAMPLES OF DOCUMENTED PROOF.

My comment was made in jest as it seems most of our elected officials consider it little more than a guide and so many citizens have never even read it. I marvel at how few pages it and the bill of rights along with the Declaration of Independence are written on. I keep a copy on my desk. If our congress were today to write a constitution I'm sure they would struggle to keep it less than 10,000 pages.

McCarthy declared that an “international police force” could now operate inside the United States “unrestrained by the U.S. Constitution and American law.” He also suggested that the order created in the Justice Department “a repository for stashing government files” beyond the reach of Congress and the public.
And an editorial in The Washington Examiner this week declared that “this new directive from Obama may be the most destructive blow ever struck against American constitutional civil liberties.”
Obama administration and Interpol officials say the fears and accusations are based on ignorance about how Interpol works and about the context and impact of the order, which was issued on Dec. 17 without any statement.
“There is nothing newsworthy here,” said Christina Reynolds, a White House spokeswoman.
Contrary to its portrayal in some movies, Interpol has no police force that conducts investigations and makes arrests. Rather, it serves its 188 member countries by working as a clearinghouse for police departments in different nations to share law enforcement information — like files on wanted criminals and terrorists, stolen cars and passports, and notices that a law enforcement agency has issued an arrest warrant for a fugitive.
In the United States, a bureau at the Justice Department staffed by American officials transmits information between law enforcement agencies and Interpol. If a foreign country issues an arrest warrant for a person inside the United States, it is up to the United States government, based on its own laws, to decide whether to apprehend the suspect.
“We don’t send officers into the field to arrest people; we don’t have agents that go investigate crimes,” said Rachel Billington, an Interpol spokeswoman. “This is always done by the national police in the member country under their national laws.”
When public international organizations are operating on United States soil, a law allows the president to grant them certain rights and immunities, just as foreign embassies receive privileges. More than 70 organizations — including the International Committee of the Red Cross, the World Bank and the International Pacific Halibut Commission — receive those rights.
In 1983, President Ronald Reagan extended some rights — including immunity from lawsuits or prosecution for official acts — to Interpol, which was holding its annual meeting in the United States. But Mr. Reagan’s order did not include other standard privileges — like immunity from certain tax requirements and from having its property or records subject to search and seizure — because at the time, Interpol had no permanent office or employees on United States soil.
That changed in 2004, when Interpol opened a liaison office at the United Nations in New York City. The office consists of five staff members, Ms. Billington said, and they have access to law enforcement information submitted by other countries with restrictions on who may receive it.
“When the office opened in 2004, we said look, we’d like to have the Interpol staff working in the office in New York afforded the same immunities as other international organizations,” Ms. Billington said. “It’s only for the New York office.”
The State Department recommended approving the request, but the Bush White House did not complete the matter before its term ended, and so it rolled over.
The White House said it put out no statement with Mr. Obama’s order because it viewed the matter as uninteresting.
LaTonya Miller, the spokeswoman for the Justice Department’s Interpol bureau, said the order would have no effect on the bureau. It routinely receives and responds to Freedom of Information Act requests, she said, and will continue to do so.
“Nothing has changed,” she said. “We’ve been really concerned about all the misinformation that has been out there on the blogs.”

Mr. President, You are stating Interpol now has diplomatic immunity. Explain to me without lying how this does not constitute the creation of a legalized private assassination squad to eliminate your political enemies just like Hitler created the SS. Make sure you have your camera ready.

This article is complete BS. On 2 major points:
1) Interpol does not have field officers. They are an information organization, they facilitate the distribution of information to police organizations in 180+ countries. They themselves are only like 600 employees, mostly book keepers, techies and translators. They do not raid houses, investigate crime, detain suspects, or anything else police-like.
2) They have not been granted "diplomatic immunity". They were already classified as an International Organization with Immunity*. The * is because when Reagan gave them that immunity he exempted them from the immunity to property search and liability and of specific taxes.
So what does this mean? It means that the US government can not raid Interpol offices and that Interpol properties can not be sued. Individual members of Interpol who break the law are fair game to our legal system. But if you slip, fall and crack your head on the door step of an Interpol office, you have no standing in court to sue them for not salting their walk way.
It also means that no longer must Interpol pay federal income taxes nor social security.
This executive order puts Interpol in the same context as International Pacific Halibut Commission, or even the Red Cross. This change is so entirely non-news worthy it's laughable that you have worked so many sheeple up over it.
To your readers, PLEASE, we need informed intellectuals to debate the future of our country. Not arm chair idiots who can't even be bothered to read the actual context of the executive order. If you want to be politically active, I beg of you, be informed, be critical, and be objective. I'm all for chastising Obama for the mistakes he's made, but this is just silly.

InterPol – International Police – definitely not a "force whose sole power rests in the hands of the president ." No, this is above the president. So the president is accountable to them.

They will be used to neutrilize political opposition. The Republicans with dirt on them will just lay down. Very similar to how J.Edgar Hoover had so much power.

My heart literally breaks as I learn more about President Obama's executive order for Interpol. Ok enough tears and now I'm at the stage of RAGE and conern. Is this part of the President's desire for a civilian national security force…just as stong and just as well funded as the military (his words/not mine)? Write your congressmen, senators, governor and state legislature regarding this executive order and DEMAND an explination. Tell all your friends (Ds, Rs and Is) about this…this is wrong!!!
