FCC Chair Genachowski Blinks on Internet Regulation
by Seton MotleyYesterday Federal Communications Commission (FCC) Chairman Julius Genachowski issued a statement on Network Neutrality and Internet reclassification that is difficult to interpret in any way other than “I’m not interested in walking the Media Marxist Net Neutrality plank.”

Chairman Genachowski has called for another round of public comment on the two contentious components of Net Neutrality – and how they should be applied to both wired and wireless Internet. And did so in such a way as to make it very difficult for the pro-Net Neutrality Media Marxists like Free Press to raise any objection. After all, who can protest more input from the American people?
He made it difficult – not impossible. For no amount of Reality is insurmountable for the Media Marxists. These are the folks who continuously called for us to “Listen to the People” – until it became exceedingly obvious that the people weren’t with them.
So now their rallying cry becomes “Overregulation by Any Means Necessary.” They are demanding the FCC reclassify the Internet under ancient 1930s land line telephone rules – and that they do it immediately.
And that they do so against the will of 299 members of Congress, from both Parties, more than 150 organizations, state legislators and bloggers, seventeen minority groups, and the Washington, D.C. Circuit Court – led by a Democrat-appointee.
Free Press Research Director S. Derek Turner today said:
“Today’s announcement does nothing to change what the FCC must do next. The crucial first step for the agency is to reassert its authority and reclassify broadband access services under Title II of the Communications Act.”
Public Knowledge Co-Founder and President Gigi B. Sohn:
“Nothing in this public notice prevents the FCC from taking prompt action on its ‘Third Way’ proceeding.”
Media Access Project Associate Director Matt Wood:
“The record also shows that the Commission must retain authority over specialized services.”
Translation: “Forget what the people have to say! Overregulate – NOW!!!”
How very populist of them.
Another possible factor in Chairman Genachowski’s wise decision is the series of apparently productive stakeholder meetings currently underway. He may be curious to see what these multi-billion dollar investors in the industry come up with.
The Chairman indicated receptiveness to this sort of input in the opening line of today’s statement:
“Over the past months we have worked to preserve the freedom and openness of the Internet, based on the conviction that an open Internet is vital to innovation and private investment, competition, and free speech.”
Not to mention job creation. The communications industry is, after all, one of the few operational segments of the economy – it is hiring while most others are firing. So it would seem worthwhile to let the stakeholders contribute to the discussion in the same way they are contributing to our fiscal well-being.
The Media Marxists’ tiny Net Neutrality “coalition” continues to shed members. And the American people – and two branches of government – vocally oppose their agenda. So they are forced into their last refuge – unilateral regulatory fiat.
Thankfully, it appears Chairman Genachowski isn’t prepared to provide them safe harbor. Here’s hoping he never does.

Every regulation put in place with the commerce clause precedent as its base is one that infringes on Individual Liberty.
People are not states and the words "interstate commerce" do not appear in the Constitution.
Genachowski has that look about him that says "if you give me a hard time I will cry".
Why isn't there a "3 strikes, you're out!" rule? It's amazing that they just keep coming back until they get what they want.
If these leftists would stop hugging trees long enough to get a real job, they would realize that it is actually rewarding to take care of themselves instead of taking (stealing) handout after handout from the taxpayers to support their unlimited amount of "causes."

It doesn't matter what everyone else wants or doesn't want. It only matters to the progressives so they can control free speech and tax the Net into oblivion. They can't stand the exposure that the Net gives to their nefarious actions.
Listening to the people? And which people would that be? Is he talking about us (the majority) or them (members of the Borg)? Its best to let the lie that is "Net Neutrality" die.
I read this morning that Larry Sabato said the Republicans were expected to pick up 46 seats in the House. Every time this guy opens his mouth I think to myself, "that's good for two seats". Now is the time for the Republicans to use this issue to divide and conquer. Ms. Fiorina is facing Barbarian Boxhead and should use this as the means for scraping off some more votes. It's the gift that keeps on giving. Use it and destroy these people. Next spring pass a new law as an amendment to the education spending authorization that eliminates any framework for regulatory oversight and that will be the end of it.
If it was not so close to the elections would this guy even have had another hearing? If he just simply instituted the NN like the progs want it would be very damaging to the prog dems campaigns.
Until reading that last sentence, P2O, I was going to say the exact same things could be said about Obama.

This is a good thing. I wasn't too concerned about the pure net neutrality question — that's just different big firms fighting about who gets to put the boot to us, but I am concerned that it was a trojan horse to start regulating the internet.
This thing died a well deserved death. . . for now.
Speaking of the Federal Communications Commission (FCC), I think it is high time that they looked into Al Gore. They badgered Howard Stern for years. What is good for the goose, should be good for the Gore.
His hand is on a switch none-the-less. If he flips the switch, he knows that he will bear all of the weight as the one who did it. He also knows that if challenged it won't hold up against the Constitution. This would mean that he as the lightening rod will have to take the full charge. He isn't strong enough for that, nor does he think that "the oligarchy" will support him if he is charged.

Until we restore the validity and sanctity of the two party contract, the private property that such a thing is, government overstepping will continue. They don't care if the Constitution is in the way, they will wipe their feet with it if it suits them at the time.
Maybe two more years of that being demonstrated daily would actually be a good thing in the long run?

FCC Chairman Genachowski, Commissioner Michael Copps, Diversity Czar Mark Lloyd, former Internet Czar Susan Crawford, Science and Technology Czar John Holdren, along with BO have all played key roles in promoting this vile unconstitutional Net Neutrality campaign of Government control of the internet. They are the foxes in the hen house for sure. If they succeed in this we are all doomed.

Removing Obama from office due to his (at best) dual citizenship status, installing Biden in the Oval Office for the remainder of the term – with a Republican majority, lead by the Tea Party minded Liberty based newbies, in the House and Senate- might well be enough of a Moment of Insight to overcome that century of misdirection.
A legislature that will put the hammer down on a runaway Supreme Court would do this country some good. Requiring an enumerated power citation to accompany all legislation passed is a good start toward that end.

Brother I don't think I can weather another two years of watching them desecrate our Constitution, my head may explode. It has to stop in January and we have to start shifting this Marxist state back to the people. It is imperative that we take every law for the last 100 years and test it with the Constitution. If it doesn’t pass, repeal it or defund it. There are some great think tanks out there to help with the process. Good people in the government will make wise decisions with the support of the constituency. The 20% statists can just go back to eating their cheetos and wait for another 200 years or so.

Why limit it there, most state govt have the same type of people in them. If some one stands up in front of the American people and tells them exactly what he thinks the truth is and what his intention are if he is elected, I bet he would get elected by a landslide.

It is happening as we watch. This has been a great awakening and the progressives are doomed. We are witnessing the death throws today. They aren't finished kicking yet however and the worst is yet to come. Good people are taking back local, state and federal positions. It will be up to us to keep them honest.

I want so much to believe that P2O. I want to believe that people, the majority of people, have had enough of this. But the fact is this, a great many, even among those trying to stand up today, are still so afraid to fight the good fight. Far too many are still bowing to their fears instead of refusing to stand down.
Unfortunately, I think it still has to get worse before it will get better. You lay out the way forward nicely in short order, I agree those things must take place but I don't see enough ready and willing to bring that about.
Case in point-
Over two years ago, SCOTUS defined the Second Amendment. Months ago, SCOTUS made it clear that states must respect what it defined. Yet here we remain alone, in Illinois, as felons if we exercise those rights. The only state in the country where carrying a firearm is 100% illegal.
I've contacted the County sheriff, the Attorney General, the Governor, the Secretary of State, the Speaker of the House, the President of the Senate, My legislators, lobby groups and even the NRA lobbyist here and the states oldest newspaper and nobody will answer this simple question:
How can I lawfully exercise my Second Amendment rights?
None will answer.
Not even the editor of this site, one of the best and most openly truthful on the net, is interested in spotlighting this issue of the clearest case of government intentionally violating the individual, inalienable, enumerated, fundamental, incorporated civil right to bear arms by criminalizing its exercise entirely. I have an email exchange demonstrating that this state's AG takes the position that a right of even this magnitude and definition is non-existent outside a person's front door. but nobody cares. It is just ignored and buried like it doesn't matter.
Peers in the Second Amendment advocacy fight beg for a permit to carry bill, and when I ask them if they would also accept a license to pray, they ignore that question just as much as elected officials ignore the question posed about how to exercise a right.
Hard to have faith that so much will change, when even something this cut and dried remains unchanged and ignored.
It's appalling to know these insurgents populate our Government. i have but one request, "All you czars, CommiePinkos and Maoists….GET OUT OF MY HOUSE!"

Bravo to Chairman Genachowski. He is up against goliaths’, huge organizations who want continued control over 21st century communications and this too will go by way of the dodo bird. Chairman Genachowski understands that this is the only industry that has the capability of rapid sustained growth for America. If put into the hands of the ILECS and other huge monopolists, that takes away immediately this opportunity. Not only this but as being in the telecommunications field, I travel globally and we, the United States of America have yet to perfect a 1Gbps end user circuit feed. Why? because the ILECS have this on a shelf much as they did with DSL until the Telecommunications Act of 1996 forced the ILECS (Verizon, AT&T) to open tax payer paid networks hence markets which created huge strides in this industry. If this control defers back to the ILECS including Google, you can bet you won’t see 1Gbps end circuit speeds for 20 years. The ILECS don’t want wireless because they have no control whatsoever in that last mile. Bravo Chairman Julius Genachowski !!! Stay strong and we're behind you.

so far so good but we have to keep the pressure on. however, i am glad that my scattered emails to the FCC and through proxy groups like Americans For Prosperity were not so far invain. small actions by all of us create ripples. ripples of liberty.
I totally agree 110%, it's high time we stop writing any new legislation until Congress as well as all State Govt's go thru at minimum the last 50 yrs of legislation and repeal where necessary, re-write, or de-fund anything & everything that doesn't or never did apply. Then after that our Congress needs to restore the powers that have been stripped away from our respective states and fully restored to the states ASAP !!
By the year 2016, Congress so long as were in control will have by that time restored a good majority of progressive legislation that should have never been allowed under our Constitution. It's not rocket science never was but the People were the dumb ones in believing all these idiots that were elected and believed every word these elected officials spewed for the last several decades. I'm all for revamping the wrong's done to the American people and there's no time like the present to start, no more mandates, no more dangling carrot's in front of Governor's to take Federal Money !!!
