Another Week of Growing Opposition to FCC’s Internet Grab
by Seton MotleyIt must be getting a bit cramped in the office of Federal Communications Commission (FCC) Chairman’s Julius Genachowski, at least figuratively speaking. Every day delivers more and more people opposed to his “Title 1.5,” promises-of-forbearance laden Internet reclassification push.

The Chairman spent the first half of the year meeting incessantly with the Media Marxist likes of Free Press, Public Knowledge and the Media Access Project – those opposed to free speech, free markets and private property rights, otherwise known as Network Neutrality (NN) proponents.
Genachowski went out of his way – and outside the proscribed bounds of his and his Commission’s authority – to bend over backwards to do these Leftist groups’ bidding on over-regulating the Internet. Up to and including reclassifying broadband to the oppressive Title II.
Bipartisan opposition to Genachowski’s unlawful unilateralism continues to grow. There was the Clinton-appointed led D.C. Circuit Court decision against the Commission’s actions in the Comcast-BitTorrent case. There were the three separate letters sent to Genachowski by blocks of Congressmen and Senators – 282 in all, both Republicans and Democrats. And yet another letter was sent by seventeen minority groups who almost NEVER oppose anything proposed by any Democrat.
Perhaps the Commissioner has begun to hear the rising din. In the last month his staffers began to host what has become a series of meetings with Net Neutrality opponents like AT&T, Verizon and the National Cable and Telecommunications Association – along with the same old NN proponents.
At least both sides are now getting in the room. Another one of these meetings was held on Saturday, and two more are scheduled this week.
As it becomes clearer that a rational, reasonable Internet regulatory solution might be achieved, we will see more people rush to join the opposition to the FCC’s proposed “Third Way.”
A very warm welcome to the party to Democrat Congressmen Ben Chandler of Kentucky and Alan Grayson of Florida. Though both are supporters of Net Neutrality, they announced on Friday their opposition to the Commission’s move to reclassify.
Grayson is worthy of special note here. He is about as rabid a Leftist partisan as there is in Congress – who during the health care debate railed on the House floor and stood next to a sign that read “The Republican Health Care Plan: Die Quickly.” So if he finds the FCC’s push for Internet reclassification to be over the top, how far from the pack has Commissioner Genachowski strayed?
(Grayson’s Senior Policy Advisor is Matt Stoller, a vehement Net Neutrality proponent who used to be a consultant for Free Press and was once “physically removed from a meeting at the AFL-CIO for making a scene over the refusal of the Communication Workers of America to support net neutrality.” No word on whether he had to be physically removed from the Congressman’s office upon hearing word of his boss’s anti-“Third Way” announcement.)
Last week also saw bipartisan legislation filed in the House by Michigan Republican Fred Upton and Texas Democrat Gene Green that calls on the Commission to end its attempt at “Third Way” reclassification. It has 48 sponsors – 24 Republicans and 24 Democrats. This joins legislation that does the very same thing already filed in the Senate.
Here’s to checks and balances. Here’s to the Executive branch – of which the FCC is a part – properly yielding to the bounds and parameters of the Legislative and Judicial branches when overreach occurs.
Here’s to hoping it finally happens with the FCC’s unilateral Internet reclassification land grab.

Bureaucrats are quietly making the congress obsolete. Between Executive orders and increasing regulatory authority of the 'agencies' are doing to the country things that should be reviewed and voted on in the full light of day.
As bad as the FCC is,,,the EPA is worse.
Cut funding to these agencies and starve them out of existence. We do not want 'clerks' making policy decisions that impact the productivity of this nation.
EPA needs to be require to file "Economic Impact Analysis" of all actions they take and get the approval of the full congress before enacting ANY policy.
I prefer to suggest that if an agency has this kind of 'cajones' they need to be castrated.

If Michigan Rep. Fred Upton succeeds in halting "The Third Way" (sounds like the dangerous "Fifth Column" to me) it will be surprisingly good news. However, I think that Team Obama will do everything in it's power to prevent this fair Legislation from being passed. They want to control our Communications, badly! Dictators hate egalitarian justice! We'll see.
I would rather be governed by the first one hundred posters in this thread than the entire faculty at Harvard.

The FCC won't listen. Even though the court has ruled that it's unconstitutional to regulate the internet. The FCC has been working to find other ways to regulate it. Like Obama, FCC thinks that the rulings don't mean anything to them.
You know the answer to our economic plight may be easier than we think. Look at what Chris Christie has done in NJ by simply 'freezing' spending increases. If all we did was keep the bureaucracies from growing,,,our economy could catch up in short order. Additionally if we were to take a slightly more aggressive approach and actually CUT funding even nominally, untold billions could be saved.
We need to stop allowing the government employee unions from running the govt. and increasing their pay and powers. Simple answer: if the economy has an unemployment rate of say 10%, I say reduce the funding and staffing to the bureaus by that amount.
obama gave what these bureaucrat's have wanted all along, a free run into our lives and controlling everything. Yes, under this administration we have been on hyper-drive towards bigger, more intrusive government.
That is what woke us all up. It gave the bureaucrats the confidence to come out from the darkness and run freely. We have been traveling down this road for a long time. We know see their true intent.
All of this needs intrusiveness needs to be reigned in.
If it's defeated now, this thrust will be repeated — because only freedom of expression and the vote stand in the way of totalitarian power for the Obamunist Left.
If it should succeed, it will be time to take the musket down from the mantel and use it as our forebears did. They would approve.

Why's that? Well, their efforts to do so are obviously offensive on a bi-partisan level. Further, if they "succeed", it will be the technological equivalent to Benny Hill running around chasing bikini-clad babes. The ego on these assholes! At that very most, they might succeed in driving some traffic underground. I lived in the cyber-underground for a number of years – before the knuckleheaded masses showed up. That period of time had its merits.
If there ever was an entity that matches the simile of being "like dry sand", it is the Internet. You grasp it too loosely, it slips away, you grasp it to firmly, it also slips away. Delicacy and nuance are foreign terms to people like the ham-handed nincompoops in the FCC. Their failures delight me.

The FCC's crowning glory in the last ten years was being a contributing factor in Howard Stern leving free radio for Sirius-XM.
And the fall of all of the previously Stern-broadcasting partners is well-documented.
Since then, it has been out of the much-desired spotlight.
These guys are so out of touch that the simple fact that they know about the internet is surprising to me.
We need to put the FCC on our list of projects to Rehab! At the rate that The States are producing good Legislation right now, we may have that chance! Remove all Progressives from office! Restore the Republic.

Our infamous FCC really wishes to tax the Internet. If it can gain control through regulation, it can tax the living daylights outs out of it to procure more cash to further BO's spendthrift programs.
What I find alarming is the headline…"another week of growing opposition". This should have been a no brainer.
In this country the FCC SHOULD have been afraid to even suggest such a plan.

That's sort of the farce with just about anything that they try to do to the "rich"…tax and regulation-wise.
I mean, they implement some policy or tax, the people with money will either figure out a way to outright dodge it – they have the resources to do that – or they will simply hoard their money. They stop spending and they stop hiring…they stop paying for goods and services. Guess who gets hurt most? The working class…people who don't have teams of accountants and lawyers at their beck and call…people shoved out of work or whose goods and services are no longer being bought.

Progressives want a one-party system with a tyrannical leader ( won't be Obama…he's too weak). They want the 'government to 'run' everything. As for the 'internet guru', he has buttons in front of him, and thoroughly believes that he is in control of America's voice. I guess it's comforting that he and his fellow 'power gurus' are that uneducated and that out-of touch.

And our misguided 'hopes' and 'faith in checks and balances' are as useful as yesterday's newspaper soiled by my dog's poop. Name ONE thing he has wanted, has tried to get, and has permanently failed to get because of "checks-and-balances". Dear author, and readers, when someone is busy shredding the constitution, you can not stop him by merely waving your copy of the Constitution in his face.
NO. You can not stop him by any procedural, electoral, judicial, or such 'democratic' means. Not happened once in 20 months, and there is all the less reason for it to now happen. If you have alternative ideas of stopping the beast, I am listening.

They will need to get involved and STAY involved. There is some part of the human gene pool disposed to paternalism and control; freedom-lovers will forever have to keep beating back the nannies among us.
It's important that the government gets absolutely no control over the internet. Once the camel gets his nose into the tent, he will soon be in completely.
It is so predictable to see congressmen like Ben Chandler embrace this. Election time is upon us, and he has to clean up his act! Chandler, still flushed from his deciding vote for the DISCLOSE Act, is no proponent of free speech. Last January, he whined in a speech in Lexington about people being able to post anything on the internet, and not being held accountable. He has smash- mouthed Fox News as "getting people all whipped up". He has refused to appear in an open forum in his district since Obama took office, after an embarrassingly enthusiastic endorsement of the man. No proponent of freedom here!
What is entirely predictable is Chandler's run to the right at election time. He does this every cycle!
Ben Chandler presents himself as a moderate, but votes LIBERAL. He requires polishing up for the homefolk close to the rolling out of the ballot box, so he promises to let us have our free speech…for now. Until after the election.
(Comment continued – I've got a head of steam!) In 2008,Ben Chandler voted against the TARP bailouts right before the election, the vote he still points to today. Then he began his Obama/Pelosi binge, running up a tab of historic proportions on our account. Chandler now entirely skips over his record of the last year and a half, and points to the TARP bill as proof of fiscal conservancy. Yet less than a month ago, he said "Now is not the time for Washington to stop spending."
Ben Chandler is a bundle of contradictions, all politically motivated. His driving force is his own career. His pre-election behavior is disgusting! Today, he espouses internet freedom…but put him back in office , and he will reverse course the day after. He's done it before. Don't trust this guy….ever!
