A School Choice Triple Crown

As in the free marketplace, competition creates better schools, public as well as private, better teachers, and thus reforms education- unlike pouring billions of dollars of taxpayer money into public schools to get nothing in return, which is what we do now. School vouchers do not carry any additional expense for a state because they primarily transfer money between schools, a fact that worries most union-loving Democrats because taxpayer money would likely be diverted from failing public schools to charter and private schools.
Advocates of school choice had three good reasons to rejoice within the past week. As reported here, on Capitol Hill, while House Democrats voted to protect public sector unions, Republicans passed the SOAR Act, which followed through with their pledge to reinstate the DC Opportunity Scholarship Program, the hallmark school choice program for low income children in the nation’s capital. While it remains to be seen whether the Senate will vote to pass the SOAR Act and, if so, whether the President will sign onto it, the Republicans are sticking to their conservative agenda and using their constitutional authority to promote reform of education through an expansion of charter schools and private school vouchers.
Meanwhile, taking the lead among the states, Indiana’s Republican-led state House passed the most expansive school voucher program in the nation, pushing ahead with school choice not just for low-income families, but for those in the middle-income bracket as well. Parents earning up to $60,000 will be eligible for vouchers and, within several years, there will be no limit on the number of children who can receive them. Despite a five-week walkout to Illinois by Indiana state House Democrats, the bill is likely to pass since Republicans control both Houses and the governor’s seat.
The third portion of this triple crown lies in a positive, but painfully narrow, decision by the Supreme Court. On April 4th, the nation’s highest court decided, in Arizona Christian School Tuition Organization v. Winn, that tax credits that pay for children to go to church-affiliated schools cannot be challenged on constitutional grounds.
The 5-4 decision upheld Arizona’s dollar for dollar tax credit, up to $1,000 per couple, for those who donate to organizations that, in turn, pay tuition for students attending private and parochial schools.
According to the Wall Street Journal, a group of taxpayers sued claiming violation of the First Amendment, that religion was being supported with taxpayer monies. Justice Anthony Kennedy, writing the majority opinion, ruled that the litigants were not harmed due to the tax credits, because tax credits are not equivalent to spending programs. Justice Kennedy wrote that the litigants’ claim assumes “that income should be treated as if it were government property even if it has not come into the tax collector’s hands.”
While this decision is a victory for school choice advocates, what is disturbing about it, as the WSJ points out, is that four Supreme Court justices- President Obama’s two nominees included- do, in fact, believe that taxpayer income is the government’s property even as it is being earned! Justice Elena Kagan’s dissenting opinion states that there is no difference between appropriations and tax credits.
While the high court’s decision contributes in a big way to last week’s triple victory for school choice and, ultimately, education reform, it is also a jarring reminder that the Supreme Court is but one vote away from forbidding school choice where church-based schools are concerned, and from declaring that all money earned by taxpayers belongs, first, to the government.

"We just need some thought-control."
Remember this is a two edged sword. If the tax credits can be used in this manner then muslims can have madrassas and recieve credits also.
Education of any religous stripe should not be allowed period.(with public funding)
Education should be secular. And free of politics.
The madrassas in this country are already being fully supported by the government of Saudi Arabia, with the tacit approval of the U.S. government in spite of the radicalization of their students. Allowing U.S. citizens to attend schools which provide a Judeo-Christian ethic in their education is the only bulwark that will stand against muslim aggression; Western Europe is proof positive that pure secularism will fall before islam.
A mind is a terrible thing to waste…..in State-controlled, dangerous, dreary, socialist Public Schools.
I am sorry I have to vehemently disagree with your statement. Education should NOT be free of politics. We need to have every American UNDERSTAND the differences (pros and cons) of all political theories. We need to LEARN from history so that, if we are smart and lucky, we may avoid the pasts mistakes. Such as Lenin, Stalin, Hitler, Mao, etc.
We must put restraints on education that teaches people that they must KILL non believers. However, we must also teach that we have the RIGHT to Self Defense and the obligation to protect the innocent from destruction. In no way do I preach that violence should be avoided at all costs, but should be a measure of last resort. There are individuals in the world that will not stop their plans even if it includes killing innocents, unfortunately no one has come up with a solution other than violence.

The libs fight freedoms of all sorts, but this in particular. Why? Because it removes kids from their indoctrination centers. Simple as that. They can't point to a quality education, so this is the only reason.

And before you say no way. Yes way my greatgrandson told me what his teacher said about a local politician who happens to be his little league coach. When he asked why she told him that he should listen to her because she was the teacher.
That is how and partly the reason I hold that opinion.
I think this is more about the strict secularism of the 4 Justices. The basis of the problem was the sectarian private schools receiving monies demmed public. Honestly, for the first time in a while, I believe all sides had reasonable arguments to further their point. Kennedy said that there were other options to receive credits and therefore divert 'state funds'. Also one of those involved said it would have opened up challenges to many other state program recipients….that are religiously based. The point that it is a end around or backdoor route for state income is a rational one as well. However, of course the only credit being challenged is the STO. For reference the credit is $500 for single, $1K for joint filing.
In summary this is more of a fanatical secular position than anything. Which could be disproved if a non-religious oriented suit made it's way through and Kagan would use the same logic. Also of note, I'm agnostic, so I'm unaffected really, but I do recognize the attempts of stigmatizing….which is basically anti-Christian, as Judaism (which has low numbers) and Islam are exotic and neat.

The market is NOT about "solving" problems. Social problems are unsolvable, that is the flaw with social planning. All the market does is allow people to free will exchange goods and services. What they do with that is their business.

A couple points, Clockwise.
1) To be sure, there are plenty of "poor buying decisions" in the world of free-markets. And, I'm sure that truism would also exist in a school-voucher system. But, surely you can appreciate the "freedom" component of it all. So what, if I choose a school for my daughter, and it winds up not being the absolute best school?
It was my choice. It was my kid. I have the right to do that. And, under such a less-than-perfect free-market process, I would have the "freedom" to change my mind at any point. Freedom!
2) While there would be plenty of bad decisions, there would also be plenty of good decisions. When I have the choice, I always play the game of balancing "price" against "quality". So does everyone else. I am an eager parent just chomping at the bit to make some decisions about my daughter's education. At this point, I simply have NO choice.
3) It's important to remember that, whatEVER the funding and administrative model for public education might be… decisions are still being made, right? I mean, right now, someone in my daughter's classic, traditional, full-fledged public school system is deciding all sorts of things: class sizes, text books, pedagogical techniques, school hours/months, teaching staff, course structure, food served at lunch, recess details, staff pay, teacher-to-administrator ratios, teacher-to-student ratios, etc. These things are still being decided right now.
You might be willing to abdicate all of those decision-making opportunities to state employees. You might think they will make all (or mostly) the "right" decisions. I am not so generous. There is too much money in the public education industry. There is too much power in the hands of the teacher unions. There is too much collusion with the accredited higher-education entities. And, we have puh-LENTY of examples of kids being passed along without ever learning the basics, teacher misconduct, incompetent teachers being carried by the system, gifted kids being bored back into mediocrity, perfectly normal kids being misdiagnosed and mismanaged… all in our current public education systems.
No, the status quo is no bed of roses. I want that control over my child's educational future. And, that kind of control should not be reserved only for families who have an extra $10K per year in discretionary income to pay for private school tuition. I want my school voucher now.

Well the only way you are lacking that in regards to this issue is that you are taxed to pay for the public school system. You want control over money that has been taxed from you. That isn't the nature of the beast. If you want control, you need to lower or end the taxes. This VOUCHER scam is there to mollify those who would otherwise demand a proper solution. The government creates and issue and then offers a solution. But the real solution is to stop them causing the problem.

I've supported the notion of cutting the head off of this snake for a long time. But, my wife tells me I need to tone it down a bit because no one will take me seriously.
But, certainly, you are right: the best way to regain control is by eliminating the taxing authority in the first place. Boy, can you imagine what would happen to the world of privately-organized free-market education if EVERY child was a free-market customer!? If every parent was walking around with an extra three to four thousand dollars? It boggles the mind… the types of schools that could be devised… the new approaches… the new time-tables of school calendars… new courses… the sifting and separating of academic activities from non-academic… what teachers will begin doing in their classrooms to facilitate learning…! Yeah, get rid of wires so you can also do away with phonetapping laws. We can all talk on glorified walkie-talkies losing every third syllable and straining to understand the words – and there is no chance of capturing inflection or subtleties. They COULD make them work well – like they do in OTHER countries…..but why cast pearls before swine. Americans are mostly Walmart types now and they won't know the difference. They have been trained to feel they need to pay a tribute to the cell phone carriers to make sure they can have a conference call over what beer to buy – important things like that – as they waddle around in their $1.29 pair of flip-flops made in China. And then there is always the cancer…
