Sen. Kirk Must Step Down; Brown Election To Be Certified Thursday
by SusanAnne HillerIn a previous post on Big Government, I questioned why Senator Paul Kirk has not stepped down as the Senator from Massachusetts, as he should have on January 19th. Today, the attorney for Senator-elect Scott Brown stated in a letter Massachusetts Gov. Deval Patrick that Brown wanted the results of the January 19 election certified by 11 a.m. Thursday, so they could be forwarded to U.S. Senate officials for immediate action.

Governor Patrick’s office also issued this statement via email today:
As the Lieutenant Governor stated earlier today, the Governor will convene the Governor’s Council at 9:30 a.m. tomorrow morning and certify the results. This will ensure that Senator-elect Brown’s request to receive the final paperwork by 11:00 a.m. tomorrow is fulfilled.
This stunning move by Brown and fulfillment by the governor’s office forces Kirk to resign his seat–presenting problems for the Democrats as they move forward with the current Senate schedule, which includes the controversial M. Patricia Smith nomination.
This reversal comes days after several inquiries with the Brown campaign, in addition to Senator Mitch McConnell’s office, as to why interim Senator Paul Kirk is still voting on legislation–providing the 60th vote in some cases–and preserving the Democrat supermajority in Congress.
I explained the Senate rules and customary application, including:
Many states limit the term of office for interim senators to the date set for the special election. In these cases, the term of the interim senator expires immediately upon the election of the popularly chosen successor, who serves the balance of the Senate term, whether it is a few weeks or several years.
Moreover, when an interim appointment is made late in the term, it is often customary for the interim senator to resign his or her seat immediately after the election, and for the governor to appoint the special election winner to serve the balance of the term. It is also customary, for the purposes of determining seniority, for the newly elected replacement senator to be sworn in as soon as possible.
Ignoring Senate tradition in order to prolong the power of a 60-vote supermajority, the Democrats continued to abuse their power and allowed Kirk to vote, passing controversial legislation, including raising the debt ceiling and the vote on cloture for M. Patricia Smith, to be Solicitor for the Department of Labor. The GOP has held up Smith’s vote due to contradictions in her Senate testimony; Kirk provided the 60th vote yet again.
GOP sources in the Senate told me that they didn’t press the timeline of Brown’s swearing due to recent problems with seating Senator Roland Burris and Senator Al Franken. However, the issues surrounding Burris were self-inflicted by the Democrats, while the Franken controversy continued for months through a recount until resolved by the courts. (Lest we forget Franken trailed Coleman by 725 votes on election night.) The GOP falsely equates the Franken election and his requirement of an election certificate to the Brown election, which was a clean win.
To summarize the facts, the Democrat Illinois Secretary of State would not sign the nominee paperwork for Burris, the Franken election ended up in court, and MN state law forbids the secretary of state to certify an election that is legally challenged.
Additionally, on the House side, NY-23’s Bill Owens was sworn in almost immediately following his election even though the vote was not certified until December 15, 2009. In fact, even though Owens was sworn in on November 6, election officials were still counting the votes on November 20.
The Democrats continue to strongarm the Republicans and manipulate the rules to their benefit, while the GOP on the Hill sits back out of fear of what the MSM or the Democrat machine might say about them. The GOP should realize that Americans are craving leadership–and saying “no” and “enough” is leadership. By their inaction, they sit quietly on the sideline allowing the Senate rules to be ignored and disrespect the customs, traditions, and spirit of the Senate–as does the parliamentarian in this case. It will be interesting to see what happens with the next vacancies, as there are sure to be plenty more.
Scott Brown only proves that a little bit of moxie goes a long way in DC.

I don't see how getting Brown in today, thursday next week will matter btwn now and Nov 2. Progressives could theoretically destroy the nation btwn now and then. Obama is clearly not a Muslim. He may be very sympathetic to Muslims, but if he isn't anything he is not a religious fundamentalist. Accusing Obama of something with substantial evidence, such as his being a socialist, is a different story.
Finally, if you are a birther, I have only one thing to say to that argument. I am a natural born American citizen and I am only 18, but I cannot get a copy of my birth certificate from the county where I was born. I've tried to get a copy multiple times over the last four years since it was lost when I applied for my passport, but it seems to have been lost by the courthouse.
Any vote the Kirk gave after january 19th should be declared null and void as if he was just sitting in an empty chair.

1redcent – The Drudge does NOT state that he is going to be seated – it refers to articles about Scott Brown's lawyers writing demanding that he be seated.
But, just think, if they had demanded this last week, the debt limit might not have been raised and that would possibly mean that Obama's budget could not be passed because of insufficient funding!
The questions still remain – why did he wait so late and why didn't the Republican Party raise hell about it? Is there anyway to rescind that vote raising the debt ceiling because it passed solely on the basis that it was illegal? That Democrat had no basis in law to be allowed to vote on that legislation.
Obama CAN get a copy of his longform birth certificate. It's sealed in the State of Hawaii. DIfferent circumstances and you aren't running for president anyway. BTW, you would need an original longform birth certificate to play Little League travel ball and my son couldn't even get his driver's license without his original birth certificate. The DMV would not accept a copy. What Obama showed online was a copy of his shortform BC, which does not show where he was born or who the doctor was.

It's me, again. The DMV would not accept a copy of my son's shortform BC, yet Barry's shortform was accepted as proof of his being a natural born citizen, which it does NOT prove because it doesn't give place of birth or presiding doctor's name. How can the president of the US not have to prove he's a natural born citizen? Barry is either native born if he was born in Hawaii (not eligible) or he is a naturalized citizen (born in Kenya). His dad was never a US citizen and his mother (according to Hawaiian law at the time) was not "of age" long enough to have conferred her US citizenship upon him, which if rumor serves correctly, she renounced shortly after the birth.
The Dems also needed 60 votes to reconfirm Bernanke. That vote should also be rescinded.

It ( the certification ) is a STATE ISSUE…………………………hellooooooooooooooooooooo…anyone to home out there? Mass. has a Dem governor and own the state Houses. I'm assuming that Brown waited a bit, so that he could get some kind of a staff together and be certain that there was no reason , none at all, for the certification issue to be denied on any grounds.

Hey Buddy — did you read my whole post? I said it was too late — The night Brown was elected, we were organizing a truck convoy to DC to show protest for any shenanigans of trying to delay seating. My circle of acquaintances has been calling the Minority Leader's office every day asking why he wasn't seated and to make some noise in DC.
We have been appalled at 99% of the votes that have been passed since the 19th and CAN"T believe the Repubs did not get out in front of the cameras and demand Kirk be sent home to MA. on the 20th. I think McConnell should step aside as Minority Leader — we are in a ideological fight for our liberties — time for the party manners and professorial tones ARE OVER!

Share your knowledge to educate others but, there is no need to "scold" anyone because you feel someone is making an effort to be more active and learn more now. From what I can tell, it seems like our whole county hasn't been in tune for a long time. I have always been supportive. When is the last time you have worked at a campaign to get the word out at a rally, mailings, etc.?

I've worked on political campaigns, local, state, and national, in one way or another, since I was a young teen, which may be long before you were born. The last time I did so was in '08.

Nobody wants to hear me wax lyrical on the ins and outs of politics or government. Everyone needs to do a LOT of research, learn as much as they can, and last, but most important, get out there and actually get involved, even if it just stuffing envelopes!

Individual Vigilance is Key. Absolutely. Scott Brown is simply a shaky 1% improvement. No one screams positive about getting a 1% raise, 1% off at retail, 1% better gas mileage, etc you get the point. This government entity has got to change. Like my avatar description says, we've spent the last 50 years (plus) laughing at government stupidity, yet doing nothing. To be fair, only in the last 10 years have we had more information with which to digest the hackism that surrounds us with government. But in large part WE caused the problem, not 'government'. In the fight for individual responsibility, it is WE that must fix the problem. One Scott Brown will not fix it – the continual force and will of informed voters only might do the trick, but it's currently the only and best trick we have.
For starters, I believe a first step is to require – even if only a simpleton test – but a required test in civics/government understanding to secure the privilege to vote in national elections.

They could have pointed this out every rollcall, but they let it go. Weekly Standard was pushing it too. Every time some pundit tweeted about the latest 60-40 vote several people retweeted them, adding that Kirk wasnt legally voting. There may have been other pressure as well. Who knows? We all know that the GOP let the Dems run over them, and I would like an explanation.

Good lord, Breitbart is a dolt. It isn't the Senate rules or "customary application" that apply, it is state law.
Massachusetts state law is quite clear that an interim Senate appointment expires upon the "election and qualification" of the person elected to fill the seat. Not simply after the election.

Brown's election was certified on Thursday, Feb. 4 and he was sworn in the same day.
