Why Is Senator Kirk Still Voting on Legislation?
by SusanAnne HillerThe Senate has voted on three pieces of legislation today that required 60 votes–to raise the debt ceiling to $14.3 trillion, to reduce the deficit by establishing five-year discretionary spending caps, and Ben Bernanke’s confirmation–all of which interim Senator Paul Kirk (D-MA) has voted on. In addition, there have been other Senate votes since Scott Brown was elected as Massachusetts senator that Kirk cast a vote.

The main question here is: why is former Senator Kirk still voting on these legislative pieces? According to Senate rules and precedent, Kirk’s term expired last Tuesday upon the election of Scott Brown. Furthermore, Massachusetts law can be interpreted, according to GOP lawyers, as:
Based on Massachusetts law, Senate precedent, and the U.S. Constitution, Republican attorneys said Kirk will no longer be a senator after election day, period. Brown meets the age, citizenship, and residency requirements in the Constitution to qualify for the Senate. “Qualification” does not require state “certification,” the lawyers said.
Additionally, as reported in the Weekly Standard and investigated and confirmed by GOP lawyers:
Appointed Senator Paul Kirk will lose his vote in the Senate after Tuesday’s election in Massachusetts of a new senator and cannot be the 60th vote for Democratic health care legislation, according to Republican attorneys.
Using this interpretation, Kirk cannot vote on any other legislation. Moreover, further analysis by Michael Stern concludes:
The Senate subcommittee and committee concluded, based on its hearing and review, that “the term of service of a Senator appointed to fill a vacancy in an unexpired term ends on the day when his successor is elected by the people.” 1939 Congressional Record, p. 998. There was evidently no controversy among either the subcommittee or full committee regarding this legal conclusion, and the committee then presented a resolution to the Senate for adoption, expressing the view that Berry’s term of service expired on November 8, 1938, the date of the special election. As Senator Connally, a member of the subcommittee, explained to the Senate, the fact that the Tennessee statute purported to extend Berry’s term until the qualification of his successor was of no force because the statute was “plainly in conflict with the provisions of the seventeenth amendment.” Accordingly, the Senate adopted the proposed resolution without dissent. 1939 Congressional Record, p. 1058.
Based on this authority, it would appear that a valid point of order could be raised as to Senator Kirk’s participation in Senate proceedings after January 19, 2010.
Why is the GOP allowing the Democrats to blatantly violate Senate and election rules and laws? Where is the GOP leadership? Will Kirk’s votes stand? Massachusetts voters deserve an explanation as does the rest of the country for this blatant abuse of power.

If this precedent is allowed to stand radicals in the Democratic majority can continue to delay the seating of Scott Brown and push through anything their heart desire's including Obamacare. I do not know how disputes of this nature are handled, but something must be done to stop these illegal acts. I think the only solutions is a lawsuit in federal court.
What we need is a march on congress. 10, 000 patriots should have a congressional "sit in" and provide a teaching moment about not fuc*ing with our Constitution. Every one of those demoncratic bastards should be tarred and feathered.
I wonder if the Republican leadership is looking ahead to when they have the majority, and allowing a precedent to be set? I also look forward to that day, but that is a piss-poor reason to allow the law of the land to be ignored. That sets an even bigger, and more dangerous precedent!
I am coming around to the "nuke all incumbents" point of view. As they say, these people apparently could not figure out how to pour piss out of a boot, if the instructions were written on the sole!

Scott Brown needs to fight for his vote to be heard !!! The votes that have been cast so far since the election should be vetoed and re-voted on.. Sadly the only thing I heard today on FNC is they passed the bill 60/40 with no mention of the non senator voting !! I do wonder if the only thing that will stop this is for a few thousand or a few million Americans surrounding the capital and not letting anyone in or out until they see the light and remember who they are there to serve..
Thank you for this piece. I've spent the past few hours tearing my hair out over the debt ceiling vote. The Republicans had a REAL chance today to curtail all this spending by refusing to raise the debt limit.
I am now more convinced than ever that ALL of these politicians have to go.

Five observations from last night's speech:
I don't fake outrage. I observe things and then make certain judgments based on what I see. Here's my reaction.
1) I don't care, you are the president, and you are the executive branch. You do not, ever, call out the Supreme Court of the United States in front of the other branch of government.
2) Lecturing Republicans was the wrong way to go, and George Bush is evil, I got it… I heard this in 2008. I'm sort of over it.
3) Nice to hear that he is willing to discuss nuclear energy and domestic drilling, but this is all a ruse… and here is why.They can talk about nuclear and oil, but we know that the EPA can stop development at any time, espeically under the new regulations… and that Sierra Club will block development in court and hold up projects infinitely. This is what made Lindsay Graham look so bad when he reached across the aisle. Republicans need to demand language that prevents useless lawsuits and see if the Democrats block it. If they do, you'll see that this was all talk.
4) You cannot, cannot CANNOT, say that we are going to double exports and then demand economic and energy policies that will make that goal impossible. Cap and trade, EFCA and the healthcare bill will not make this possible. You need to address corporate taxation, lending practices, the need to eliminate subsidies, unionization issues and the water laws of California if you are serious. If you look at what the EPA is doing to the strawberry and olive trade in California, you would know that we are now going to go from an exporter of these goods to an importer because we are so very concerned about a bait fish. The Southern California farm trade is being destroyed by liberal environmentalist policies. Environmental policies that put fish over man do not accomodate expansion of exports. And, I hate to break it to people, but we are never going to be the largest exporter of Windmills.
5) He repeated about 10 campaign promises and demands of things that he himself have broken on a regular basis in the past year… Lobbyists, earmarks, transparency are the three big ones. I don't think that people are fooled anymore, and even the AP came out this morning and showed "Obama's view" and "Reality"
I thought it was a mediocre speech, and that is saying something considering that I respect the presidency and give him a lot of rope. I'm tired of words. I'm tired of promises. I'm tired of blame… But what can you do when the GOP is puttering along like clowns as well.
If the GOP had a great speechwriter and someone who could talk on the fly, they could have really hammered him and showed his empty rhetoric last night. Start with the exports issue first, since this is the easiest one to address.
"The president took a significant step in the right direction tonight, stating that we need to increase manufacturing, but Mister Obama needs to understand that the United States is not able to compete because of antiquated tax laws that are not enabling us in today's globalized economy." Discuss the fact that 40 percent corporate taxes are the highest in the world and make it an unfriendly business environment.
Then talk about how cap and trade, health care and EFCA are all unfriendly to business, especially to manufacturing… will lead to more outsourcing and layoffs and then amke it virtually impossible to reach that ambitious goal.
And then just hammer on jobs and centralized planning. Public sector making so much money vs. Private sector failing. Use history as a guide.
Then… address the hypocrisy… Republicans are catering to special interests? They are being given money by the banks and corporations? What about the Democrat healthcare bill? What about the 14 million that Wall Street gave Mr. Obama during the election? A populist vernacular coming from a corporatist President is a great act, but once again he is failing to live up to the standards that he wishes to impose on everyone else.
Seriously…Where the hell is the GOP and how is this so difficult? This was on my mind the entire speech and I feel like they are afraid to go on the offensive.
The minority is supposed to be on the attack… The minority wants to give ideas and to help the country. For as many times as McDonnell referenced Thomas Jefferson, how does he miss:
"All, too, will bear in mind this sacred principle, that though the will of the majority is in all cases to prevail, that will to be rightful must be reasonable; that the minority possess their equal rights, which equal law must protect, and to violate would be oppression.
The measures are not reasonable now, so the minority should be diligent.
This is why I am not a Republican, because they have no teeth… They just sat there last night and agreed that America is great and puppies and rainbows are things they too can get behind.
Someone help me out here !! The US Constitution Sates >> All bills for raising Revenue shall originate in the House of Representatives<< So how can the Senate create a bill to raise revenue ( From what I heard today ) the house still needs to vote on this bill..
I just emailed both of my Republican senators asking them to please stand up for the voters of Massachusetts, the American people and the rule of law and stop this blatant disregard of the rules of the Senate and the election laws of Massachusetts.
Here is what scott Brown is up to instead of pushing to be seated. I campaigned and voted for him along with many people I convinced to vote for him also. I am beginning to wonder if I have been duped yet again. This is an article from todays Boston Herald. For cripes sake he isn't even down there yet, letting a lame duck empty suit vote for stuff that I certainly don't believe in and thought Brown didn't believe in. He doesn't seem to care. I thought I voted for someone that was going to fight for us, evidently not. I appreciate his independent thinking but he is going down with some kind of chip on his shoulder against Republicans which is his party affiliation. I guess he has Obama-idis. He is going on Leno tonight.

Brown even lampooned his fellow Republicans at the State of the Union address for not clapping during more of the president’s speech.
“That’s typical, that’s typical stuff. I would have stood up for probably more things than the Republicans did,” said Brown.
but said Republicans looking for an automatic vote against the Democrats should look elsewhere.
“I’m going to look at each issue, I’ve already made my intentions very, very clear,” Brown said. “I don’t owe anybody anything. There will be times when I will be with the leadership and there’ll be times when I won’t.”
Brown, who said he’s focused on getting sworn in by Feb. 11, also said it’s unlikely that he’ll help the many mid-term Republican candidates who have approached him due to his national appeal.
“A lot of people have approached me, but I told them, ‘Listen, with all due respect I don’t know you. I need to learn, we need to have a cup of coffee.’ I know people are trying to latch on to the popularity and notoriety, but I need to do my job first,’ ” Brown said. “On the scale of 1 to 10 it’s like a 20. It’s not even on my radar screen. … I’m going to be very particular as to who I help.”
i was also thinking how can that be, but then i remembered being a democrat means never having to apologize, or have any morals. also when i max out my credit, i wish i could call up my bank and say, hey mr. big bank up my credit limit. who cares how or if i ever pay off the credit card, as long as i can just keep calling the bank when i reach the next arbitrary credit limit? wow i could be just like the house and senate, i would have a rolls in every color, and a house in every state, it would be so cool.

The GOP is waiting on We the People and Fox News to force them to take action. They are, by and large, lazy and spoiled. They have had a free ride for way too long. I'm sure with all the eyes laser focused on them they are working harder than they ever intended to. They need to hear loud and clear that we will NOT continue "reminding" them of what they were elected to do. I know we need to stay informed and continue to be be diligent, but this has become like bugging teenagers to do the dirty dishes.

By not opposing the vote of this non-Senator they are approving the Bill they are able to stop.

Let me tell you, at the end of the day, the (R) & (D) Congresscritters have far more in common with each and they are one another's social circle. I'm sure Mitch McConnell attended Harry Reid's son's wedding. Nancy Pelosi probably invited Mr. & Mrs. John Boehner over to her private compound in Hawaii last Christmas and and all this back and forth is nothing more than theatre to keep We the People distracted from what's really going on. Their fortunes are tied to one another and not to us. PERIOD.
Episode of Frontline this week was on credit card abuses and the Senate Banking Committee Chair, Chris Dodd. (In the end, the limits placed on credit card companies were very weak and don't amount to a hill of beans for consumers.) The interviewer pointed out to Dodd that the credit card lobby had donated over $30M to the campaigns of all committee members (Rs & Ds).Dodd got $7M from them. He laughed that they didn't get very much for their money because he did legislate (weakly) against them. But the real money contributed? Oh…that is sitting in an off shore bank account, a hooker provided…you get the picture.
Don't let the Rs fool you, they are just as dirty and corrupt. Vote them all out. Our mantra should be "If you're in…you're out in 2010".

I believe Brown is the Real Deal but articles in the local Boston paper's quoting him on various things has me very concerned. I one of the few (R) in Mass so I didn't have to many options. I guess he was able to kill the Heathcare bill in its current form without being in DC. Yet this vote to increase the debt ceiling is estimated to cost every American $45,000. Un believable.

Once again the Congress is showing its contempt for the laws of the United States and the citizens of the United States. This is both Republicans and Democrats. This makes it most imperative to remove most if not all long term incumbents in the next 3 Elections.
This contempt for the law is a very dangerous trend in our government.

Yes, sadly, we are surrounded by a bunch of thoroughly ignorant idiots, who not only have NO idea how our government works, but want and expect politicians to do things that are perhaps not illegal, but impossible for them to do and yet, haved no respect for those doing the right things.
They either voted for Obama or voted for some fringe party candidate who had less than no chance of winning. Perhaps they just stayed home and didn't vote at all, since nobody is perfect enough for them to vote for.
And the guy who claims to have WORKED and voted for Brown appears to have never bothered to pay any attention to him, his record, nor anything else. As of last Tuesday, Kirk is ineligeable to vote on any legislation whatsoever. The results of the vote should be disallowed. I doesn't matter what the bill was about. The vote was illegal.

Why is he still voting? Because he is a Democrat. Why don't the Republicans contest this? Because most of them are Democrats also.
If you are from Massachusetts than you should know he has to be certified after all the votes are tallied which takes approximately two weeks. (Of course, the Democratic machine that has ruled Massachusetts allowed Kennedy to be seated the next day after the election.) Sen-elect Brown has to be sworned in before he can vote. So if you are really disappointed, then you should address the Massachusetts congress (with the help of the Democratic Party) on why they are delaying this process.
Refusing to support people he does not even know sounds like a good answer to me. I can't even think of more than a couple who should be reelected in 2010. Tea partiers are not Republicans…they are conservatives. The Repubs and conservatives are rarely the same anymore.

“I’m going to be my own person,” Brown told the Herald in his State House office today.

I may be way out in left field here, no pun intended. What are the statutes on enactment of legislation? Is it possible that the GOP is keeping quiet to avoid bribery w/ the intention of eradicating these results at a later date? I'm going to be very cynical here. The only vote that required 60 votes that would not have passed without him was increasing the national debt. The Republicans knew this had to be done or their would have been a giant fight and the government could be shut down and of course they would be blamed, similar to what happened to Gingrich in the 90's. They did not want that fight but they wanted to be able to say they voted against raising the limit. The Republicans are not putting up a fight because Kirk's vote on that allows them to vote no without actually stopping it. If they objected and he was kept from voting (which he should be) some Republican would have to fall on his sword and vote for an increase which is not politically popular. This gives the Republicans the best of both worlds-it's politics, everything else he has to vote on makes no difference.

I volunteered for Scott Brown because a friend convinced me too, but I stopped when I read an interview that he gave Roslindale's local paper. He was very arrogant. If you notice, everytime he says that he's an independant thinker, in the next breath he'll mention that the RNCC didn't give him any money. I believe he's independant for the rigfht price! He is allowing Kirk to vote to spite the GOP for not giving him money. He is in many ways just like Obama: he refuses to move on from the campaign, continuously complaining about not receiving any money, spending more time excersing than doing the people's work and last he's doesn't seem to understand the single most important reason people donated time and money to his campaign-to vote AGAINST the democrats. There are rules in the Senate where just one Senator can delay a vote on legislation, and whether ultimately the vote takes place the Republicans could still point out that Kirk is no longer eligible to vote. Have you heard this anywhere but here?

Believe me, I do understand your point … but you did NOT understand mine…I listen/watch news coverage 4-5 hours a day (I know, I know … I probably need to get a life … ha!) … and my criticism was stemming from the FACT that I have yet to see/hear any GOP figure EVEN MENTION THIS FACT and voice their own concerns! The Republicans are being smart here. The fact is this bill to raise the debt ceiling had to be passed. What are we going to do, default on what we owe? It is much better to have only Dems voting for it though. Letting them have their 60 votes lets them own it entirely, as someone has already pointed out. The Republicans aren't going to be against spending caps and Bernanke passed with 70 votes, so Brown's vote wouldn't have made the difference there.
I don't think the Dems are going to take any meaningful votes until Brown is seated (scheduled for Feb. 11), and the Republicans are playing it smart by not making a big deal out of nothing. I agree that ideally the law should be followed, but what are the Republicans options? Take the Dems to court? That has little chance of success because the courts try mightily to stay out of congressional procedure. About the only thing they could do is appeal to the public, but there will be no wide-spread public rage over these votes. The Republicans just won Ted Kennedy's seat for heaven's sake! There is little need whine unnecessarily now.
The Senate didn't raise revenue (raising revenue is a taxation bill) – they raised the amount of money we're allowed to owe.
Kirk is still voting because Harry Reid said he could. Reid has decided that he is Lord Master of the senate, and to hell with rules, laws, or the Constitution. I am from Massachusetts. One only needs to look at how it is Kirk got into the temporary position in the first place to answer the question on this op/ed. In short, the law on the Mass. books in 2004 was that an empty senate seat could be filled by a Governor appointee. The Governor then was Republican Mitt Romney. When Sen. Kerry made a run for the presidency the Mass. Democrat Senate went, uh oh, this means Romney can appoint a Republican if he wants to so they changed the law to make a vacant Senate seat filled by a general election. Flash forward to 2009. Kennedy is about to leave this earth from illness. The Mass. Democrat Senate went, uh oh, we don't want to wait for a general election to fill his seat if he dies so we will change the law to allow the Governor to appoint someone to fill hi seat. The Governor is a Democrat Gov. Deval Patrcik(Coupe De'Val as I call him). So, just flip flop 180 degrees when the situation could go against you in this one party state. This is why Kirk is still there. Nothing to see hear, move along.

There is a tricle down effect to all the flaunting of laws, contracts, rules and fixed practices lately in evidence. We see an increase people and organizations squirming shamelessly out of their obligations to others. jar – I think or I would hope it is more about violating the rules of the state of Mass., rules of the Senate, and violates the 17th amendment of the Constitution. I also suspect that had everything been reversed – with the Republicans holding the super majority in both houses and a Democratic candidate pulled a similar upset, we'd likely see the SAME scenario being played out.
I've questioned this of my Senator as well and waiting for an answer. If one does not come I'll be voting for someone else in the primaries In Utah. I would agree with others that this is absolutley Bull**** and needs to be addressed and challanged.
Err, it's called a "Point of Order" and it would have put the issue on hold until the Senate ruled on the issue.
It's quite clear; Senate rules, as the article points out, mean that Senator Kirk is no longer Senator Kirk, and wasn't the moment Coakley conceded on January 19th.
For him to still be voting on legislation frankly puts everything currently voted on in jepoardy — IF the Republicans grow a pair and actually do something about it.
The fact, however, is this: Republicans didn't want to stop the debt ceiling limit from being raised, but they DID all want to say they were on record as voting against it. Allowing non-Senator Kirk to continue voting simply gave them cover, but I GUARANTEE you if he wasn't there, at least one Republican would have voted for it.
This is politics at its worst, and yes, I know precisely how the Government is currently working, and I also know precisely how it is supposed to work — and they are NOT the same.

The issue isn't Scott Brown not being seated; the issue is that former Senator Kirk's interim term ended on the 19th. His term was not contingent on either Brown being seated, or his election being certified. His term has ended, but he is still voting.

My family and I have noticed the interim Senator Kirk of Massachusetts, is continuing to vote on legislation, after having been replaced by Senator Brown. Our understanding of the 1939 Congressional Record, p. 1058, is that after the election date, in this case 19 Jan 2010, the seated Senator may no longer cast a vote on Senate considerations. The Congressional Record explicitly refers to a special electionm such as the recent election in Massachusetts. Senator Kirk has voted 6 times since 20 Jan 2010. Please provide a response as to why this is allowed in the Senate, and if your office will so anything about it. Respectfully, XXXXXXXXXXXX
Get real people – and read your Constitution while you're at it. Until Brown is recognized and seated in the Senate he isn't officially a Senator and he doesn't get to vote. Don't blame Kirk – don't blame the Democrats – blame Brown. It's his choice as to when he shows up and becomes a Senator. And MASS gets to keep their representation whether he's there or not – so Kirk gets to vote until Brown does show up.

I have noted that most nominees have been confirmed after it has been shown that they have a clean record. Those nominees that have been held up have been among other things tax cheats and various kinds of felons.

You do not waste any opportunity to negatively impact the Dimocrat machine…I assure you, they are making every effort to do the same to the conservative revolution headed for them…
Brown won this seat with national support from people who want something DONE…so DO something; or it can be expected that the support will go elsewhere…

I am extremely happy that Mass. has elected Scott Brown. My wife, daughter and I all held signs went to his rally in North Andover and are huge fans of his and hope he could become the next President of the US. I understand that it is up to the Mass (Galvin) to certify the election and reid (twit) to seat him. I am frustrated though, that with all the power or political stardum that he gained he did not use it to push his seating or make it aware to the public that this POS Kirk is still voting on major legislation that will affect this country. For all the hard work that he di to get elected he could go a little bit further and say something on Leno, instead he is on the defense about being bullied by his "Republican" colleagues. I have voted Republican my whole and will continue. I have never seen a democrat I could vote for and believe i will. That is all I am saying.

I just learned of it 1/31/10 and dang well believe that I posted this to Steele's FB page, am alerting others of this, going after my local DC Talk radio hosts and some national ones who are sick of the Dems and trying to get people to raise heck. Maybe it is not that we do not care so much as there is so much going on that enough of us who need to be alerted are not getting the info. Budget items require 60 votes for cloture the same as anything else. Just because it's a budget item doesn't change anything.
What you are referring to is reconcilliation, that can only be applied to items that negligibly affect the budget in a negative way.
Oh, and reconcilliation can only be used ONCE per budget cycle. I very much doubt Reid & co. would blow their reconcilliation wad on raising the freakin' debt limit.

Reconcilliation is the ONLY way 51 votes are required, either as reconcilliation of a House-Senate conference where the House adopts a Senate bill with ZERO changes (even a single word required a cloture vote first), or through budget reconcilliation which, as I pointed out, can only be used once in a budget cycle.
