Congress Tinkers with Withholding Tax Tables for 2010
by SusanAnne HillerRecently, retired military have received e-mail messages notifying them of a withholding tax increase. The email states:
NO ANNUAL COST OF LIVING ADJUSTMENT (COLA) WILL BE ADDED TO MILITARY RETIRED PAY IN 2010.
DUE TO RECENT LEGISLATION YOUR FEDERAL WITHHOLDING TAX HAS CHANGED.
After much investigating and several discussions with the IRS, it appears the Democrats have played a “cash-flow trick” on working Americans and are taking more out of American’s paychecks across the board–all the while touting the Making Work Pay tax credit.

The trick, when looking at the new withholding tax tables for 2010 as compared to post-stimulus 2009, buries an increase in federal withholding taxes–for all income categories–basically giving the government an interest-free loan until current year taxes are filed next year. Some would blame the increase in withholding on the Making Work Pay tax credit being spread out over 12 months as compared to 2009, which was only over 9 months, but this would be impossible as some middle class wage categories carry an increase in the withholding tax of over $200 per pay period.
Unlike the middle class wage earners, who are going to see huge amounts taken out of their paychecks, unless they increase their exemptions on their W4 form, it’s an increase that most wouldn’t even notice–$10 or $20 in some cases. Here are some of the “highlights” of the new 2010 withholding tables:
1.) Congress has lowered the threshold to capture more wages that qualify to owe taxes–across the board. For example, in 2009 the withholding tax threshold began at weekly single wage levels of $138. In 2010, that same wage is lowered to $116. In short, instead of the taxable wage starting at $138, it is now down to $116–which changes the income threshold and taxes even poorer Americans.
For married couples, the change in the weekly base taxable wage changes from $303 in 2009 down to $264 in 2010. These lower wage thresholds can be seen throughout the new withholding charts for weekly, biweekly, semi-monthly, monthly, quarterly, semiannual, and annual, as well as daily and miscellaneous pay periods.
This across-the-board reduction in the initial wage threshold increases the number of wage earners who would have to pay taxes.
2.) Instead of seven (7) wage categories, there are now nine (9) wage categories. The new structure allows for direct taxation on the middle class with these wages broken out into smaller categories. The direct hit on the middle class withholding taxes can be seen on all of the new tables. Additionally, the IRS could not explain these changes.
Let’s look at the actual numbers for one category and compare them from 2009 to 2010:
2009 Biweekly, Single, Payroll Period, after subtracting withholding allowances
Not over $276: $0 in taxes
Over $276 – $400: 10% payroll tax
Over $400 – $1,392: $12.40 plus 15% of excess over $400
Over $1,392 – $2,559: $161.20 plus 25% of excess over $1,392
Over $2,559 – $6,677: $452.95 plus 28% of excess over $2,559 (Notice the large salary range)
Over $6,677 – $14,423: $1,605.99 plus 33% of excess over $6,677
$14,423: pays $4,162.17 plus 35% of excess over $14,423
Let’s look at the new numbers for 2010 Biweekly, Single, Payroll Period, after subtracting withholding allowances
Not over $233: $0 in taxes
Over $233 – $401: 10% payroll tax
Over $401 – $1,387: $16.80 plus 15% of excess over $401
Over $1,387 – $2,604: $164.70 plus 25% of excess over $1,387
Over $2,604 – $3,248: $468.95 plus 27% of excess over $2,604 (Notice the large salary range is gone)
Over $3,248 – $3,373: $642.83 plus 30% of excess over $3,248 (Notice the substantial increase and 30% tax rate on these wages)
Over $3,373 – $6,688: $680.33 plus 28% of excess over $3,373
$14,450: pays $4,169.99 plus 35% of excess over $14,450
These patterns of additional withholding can be seen throughout the new charts for the 2010 tax year for single and married persons. It appears that everyone earning a paycheck is affected, not just retired military; social security payments will remain the same.
Why would the Democrats tinker with the withholding taxes and, ultimately, cause more stress on Americans and businesses? Why would the Democrats create more wage categories and deliberately target the middle class with a huge withholding increase and 30% tax rate? Are the Democrats trying to backfill the deficits they created in 2009? Because taxpayers will have overpaid the federal government payroll taxes, will they be eligible to get back this additional withholding money in a tax refund when filing in 2011? Do taxpayers in the hardest-hit wage categories even realize that their paychecks are going to be significantly lower, unless they make the necessary changes?
Maybe there is a good explanation for the increase in the withholding taxes from 2009 through 2010, but I remain skeptical, because inherently, Democrats do not have the capacity to reduce taxes and typically make up the revenue somehow.
Get your calculators out and you do the math. Go here for 2009; start on page 4. Go here for 2010; start on page 39.
And you should remember this and the fact that House and Senate Republicans united against the stimulus bill, which may have been the trigger to all of this. And Obama and Congress should remember this from December 21, 2009:

My husband is retired from the railroad…they informed him there would me no COL this year, because there was no inflation!!! Are you kidding me! I go to the grocery store and have to pay triple what I paid last year, and they say no inflation??? wtf???

If elected President I would pardon all taxpayers until the Congress passed a law that made the form one page and taxed citizens via the same rate divided by consumption and income – no deductions or exemptions. I'm a pretty smart fellow but I'm no longer able to accurately create a payroll check. This system is absolutely nuts and must be put out of its misery as rapidly as possible.
This is another shining example of how politicians will say ANYTHING to get elected, then once their in, the do whatever they want. They will slip in their pork projects, conduct closed door negotions all while promising "transparancy", change laws when no one is looking, and screw the American people just because they can. I will make sure I put a note in my employees paychecks next week letting them know about the tax increase. I should also compare the amount based on last years taxes so they really know what is going on. I'm sure they wont believe it! I also will make sure they know that their health insurance will be going up at least 25% as the Gov. of Colorado (Ritter) took away any discount for a healthy group. Sorry, I won't have the pleasure to vote him out.

Sam – we each can find our different ways and accumulatively make an impact. I made some life-changing decisions that help with my share. Probably the two that have the largest impact are getting out of debt and not using credit (huge) and finding alternatives to buying new/taxable items. I also made some changes others will not, like deciding to leave the human ant-hill system and start a business that earns less and is seen to have much less prestige than my worker-ant position provided. — if we each look and commit, we can have an accumulative effect.
just increase your your # of exemptions on your W-4 form (i.e from 4 exemptions to 6) that way less is withheld from your pay. your exemptions on the W-4 does not have to agree to the number of dependents you file on your tax return. problem solved.

I told my relatives 2 years ago in Pgh to expect tax increases if Obama and the Dems got elected. Things got pretty testy before I returned to Ok. Now I have a strong urge to send them this article and say "I TOLD YOU SO".
I am afraid we are not enough to vote them out in 2010. They are already working on an immigration bill and I read that Shumer is going to introduce a bill that anyone who receives any welfare benefits at all (food stamps, medicare,etc.) will already be able to vote without normal voter registration. And is not Acorn also receiving money again? This is so scary. What can we do? So many people don't even know what is going on.
With the amount of withholding less in 2009 due to stimulus there will be less refunds for lower and middle income wage earners. This will really make people understand what they pay in taxes. In 2010 the extra withholding is a way to withhold more money and increase refunds in 2011. People that don't understand that a refund means the government had your money interest free for a year will be happy. People favor refunds and don't know what taxes they are paying.

I advocte everyone, (Married, Single, Head of Household) should increase their withholding to 10+ keep all the money you can in your check and let the government fight to get it back on April 15. Deduct everything you can. Maximize your retirement funds, prepay college tuition, give to charity. Take control of your money and stop the government and it's leaches from sucking your life away and that of your children. A strike as many talk about sounds good but cutting off the cash flow is the best way to go.

Do a little analysis before taking the max exemptions on W-4 as there are IRS penalties if your withholding does not cover 90% (I think) of your total tax liability.

This is par for the course for this administration and Democrats in general. Again, they show their arrogance for the will of the American people, and what they perceive as our stupidity. Taking more in taxes now will not decrease the budget, but it will create a great deal of unnecessary work for payroll departments to process the exemption changes. Increasing the size of the government will do nothing to stimulate the economy. For every addition to the government payroll, how many private sector jobs are required to generate the tax revenue to pay for that government employee?

Its going to get a whole lot worse, the government is flat broke, nothing left but the printing press. If the history of socialism/communism is an accurate indicator of our future, they'll start going after private property and other concrete assets owned by the citizenry. Remember the communist philosophy of the "Year Zero". Everything that came before them is the product of an unfair society based on a privledged class gaining unequal advantages. They feel its their duty, and right, to seize what was gained during the period before their benevolent rule.
One thing I'm not clear about is whether this just reflects a change from the reduced withholding that the Dems put through in their stupid stimulus last year. Is this just an increase over the reduced withholding that went into effect in 2009 or is it indicative of a larger increase in withholding? There doesn't seem to be much info available online other than "withholding is bigger than last year."
I had no idea that I wasn't getting my COLA increase in 2010, I know that Social Security recipients where not getting one and was pissed about that now I'm really pissed! I wonder how much the parasites in D.C. are giving themselves? Must be nice to vote your own pay raise! Term limits or we are doomed! No retirement checks for elected officials anywhere any time, medical coverage only while they are in office. And a thurough independent investigation of all elected officials 5 years after they leave office to assure the citizens that all laws are followed.

All you brilliant patriots might want to put down the muskets and get a calculator instead. I did, and calculated that my 2010 biweekly witholding according to the tables linked is exactly $1.69 LESS biweekly than my 2009 at $92,000 a year.

I noticed this, too, a month ago when I got the tables from irs.gov and put them in a spreadsheet that I use to calculate my taxes. I had never seen a tax table where the rate increased, then went back down (the 25%-27-30-28 brackets). I figured it had something to do with the Make Work Pay thing, or whatever it's called, since I've been hearing since last year that there was some trickery involved in that whole scheme.

You must have failed your math class. Check your numbers , a retirement of 45,000 has a change of $20, so you have more than that my friend, and if you did not want that money in the first place why didn't you voluntarily give it away or more. little by little your $92,000 will turn into $30,000

I followed your links and I did the math as you suggested, using the semi-monthly tables for 2009 and 2010, excluding exemptions and other modifications to the base tax witholding. I got this:
2009: Per paycheck tax = $932.28
2010: Per paycheck tax = $931.78
Then I tried again, same salary, using the bi-weekly tables:
2009: $954.22
2010: $953.68
What am I missing? This seems to invalidate your argument, at least for the “Over $3,373 – $6,688″ bracket.
Then explain why retired military and everyone here has confirmed differently and the number on the charts are signficantly higher…especially for singles.

Federal Government Employees are NOT eligible for COLA increases this year! Their COLA is based the same as the Social Security. NO COLA for either!

Step 3 Increase your number of withholding allowances. This is done on line 5 of the W-4. (TAKE THE MAXIMUM) FEDERAL AND STATE
Step 4 Understand that less will be taken out of your check each pay period, so you'll get a smaller refund (or no refund) when you file your tax return.
Step 5 Sign the W-4 form and give a copy to your employer.
Step 6 Monitor your future paychecks to make sure the change has been made.

Maybe I'm doing something wrong but I charted out the dollar amounts being withheld between $1 and $15000 (for the single, bi-weekly chart) and the biggest difference that I got per pay period was $4.75 per pay period. People making more than $2944 actually had less withheld in 2010 than they did in 2009 (very little but still negative).
But….the numbers on the charts are not significantly higher. They just have different break points so the numbers seem radically different when they are not.
Tthey create 2 new wage brackets and take much more out…how do you not see that? But in reality, if 20 million people have $20 taken out that's how much money to the gov't? Don't you see this is a bit of a tax hike–Obama promised not to raise taxes at all. My calculator shows a $227 difference between some brackets…and a 30% tax rate for singles.

Wait till you do your 2009 taxes and find out that you have to give back the tax break Obama gave you and bragged about giving you. That $13 dollars a week will cost you about $500 at tax time. They are hoping that you, like most people, have over payed what you owe in taxes and will not notice. Democrat lies again.
They create two new wage brackets but the first one only takes out 27% as opposed to 28% so the numbers go negative. The very narrow 30% bracket that follows isn't big enough to make up for the dollar difference lost by the 1% difference in the much bigger preceding bracket. The 3rd bracket in the breakout is back at 28%. Normalizing the numbers to the amount that would be withheld at the breakpoints for the 2010 chart yields the following:

You're missing the bigger story. A portion of the withholding taxes have been made regressive (or rather, there is a select income range where people with higher incomes will have a lower percentage of their taxes withheld compared to those who earn just below that income range.) Here's a graphical comparison of the annual withholding rates provided in the original 2009 IRS Employers Tax Guide (Publication 15, before the March 2009 revision that you've linked) and the version for 2010 that was released on December 24, 2009.

I only had time to examine 4 scenarios. Income (after deductions) of $5000 for single+biweekly, married+biweekly, and of $3525 for each of: single+semimonthyl, and married+semimonthly.
Hopefully that's enough for anybody to recreate my process, but I'll try to follow this thread in case there are questions.
At each income level and payment frequency (I suppose the payment frequency shouldn't matter at all), the taxes were reduced for single people, and went up for married people.
Single, $5000, biweekly, 2009: withholding = $1136
Single, $5000, biweekly, 2010: withholding = $1098
Married, $5000, biweekly, 2009: withholding = $865
Married, $5000, biweekly, 2010: withholding = $881
Single, $3525, semimonthly, 2009: withholding = $702
Single, $3525, semimonthly, 2010: withholding = $699
Married, $3525, semimonthly, 2009: withholding = $449
Married, $3525, semimonthly, 2010: withholding = $512
Why did I pick $5000 and $3525? $5000 seemed like a nice round number to work with. $3525 happens to be my income after subtracting for the number of deductions I'm claiming.

With higher withholding and no increase in tax rates, you'll see people get bigger refunds or have to pay less additional funds come tax time. People will (wrongly) equate bigger refunds to paying less taxes and be happier.
All the while their taxes haven't dropped and all that's happening is they get money back the government shouldn't have taken in the firsat place.

Multiply the 27% – 30% by the delta of the excess and add that to the 2009 tax and you will see that it is a wash.

I'm not sure if this makes things worse or better: I wrote a quick computer program to compare the new tax rates (for a single wage-earner, biweekly paycheck) v. the old ones. The results were interesting (assuming no mistake on my part):
If you make less than $2950 every two weeks (~$74,000/year), then your withholding rates go up.
if you make more than $2950 every two weeks (~$74,000/year), then your withholding rates go down.
That would make this a "withholding tax break for 'the rich'"!!! Interesting.
It's difficult when looking at an actual paycheck, but based on the tables, the new withholding is higher for everyone except those making between $145054 and $381394 (married) in taxable income. Between those levels, withholding is lower. In other words, higher taxes for everyone except those making between ~$250,000 and $500,000 a year gross.
Aside from the individual states collectively banding together and filing for NULLIFICATION from the feds, the ONLY way to stop this insanity is;

I agree with the sentiment of the article. I am not a fan of taxes in general nor of lending money to the government through the withholding process. However, the article's MATHEMATICAL analysis of the change in withholding tables is totally misleading. In fact there is no MEANINGFUL change to the withholding tables. Using the same example that the article uses of bi-weekly single withholding rates, someone earning $8 per hour for 40 hours per week will have $52.65 withheld in 2010 for every 2 week pay-period as compared to $48.40 in 2009, a difference of $4.25 every 2 weeks This isn't a zero difference, but it's not worth getting too worked up about. For someone earning $24 per hour (roughly $50,000 per year) the bi-weekly withholding will be $297.95 in 2010 compared to $293.20 in 2009 (a difference of $4.75). Someone making $100K per year will have their bi-weekly withholding change from $813.31 to $812.77 (a decrease of a whopping 54 cents), while someone making $200k will see a drop of a little over a dollar per pay period. Finally, the change from 7 to 9 brackets is also meaningless, but I leave the analysis to some other intrepid wonk.

We should rightly be complaining about actual tax increases whether through a raise in the tax rates, or the addition of various "fees" such as the fines proposed in ObamaCare. However, a nominal change in the withholding tables is not in fact an increase in taxes.
Needless to say, this accounting trick has NOT worked in California and the state government is back in session looking to fix the same 20 billion budget gap they had 2 years ago.

Something that has not been well addressed is the fact that the revised withholding for 2009 could result in

I ran the numbers for the single, bi-weekly withholding charts and the numbers aren't that different between 2009 and 2010. The biggest differences were that the first bracket started lower and there was a weird breakout of the ~2500-6500 bracket. It had been broken into 3 pieces with the first piece being at a lower withholding rate, the second (smaller range than the first) being at a higher rate and the third being at the same rate. Because the first piece (which is 1% lower) is larger than the second (which is 2% higher) by more than 2X the net is actually negative.
Overall the most that you'd have withheld more in 2010 (using the single, bi-weekly numbers) is $4.75 per paycheck. That doesn't seem big enough to get really excited about….
If you are looking at the single, bi-weekly numbers that were posted originally….the biggest difference you can have is $4.75 per paycheck. You may want to check your math.

I am retired military. I got the E-mail noting we were not, unlike federal employees, getting a bump this year. I never received anything about more withholding…sounds like stealing, but we are talking about government.

Thank you for this concise article. We just loaded the 2010 Tax Tables to our Payroll system and indeed noticed across the board reductions for employee net pay. These are hard working people who can BARELY get by today. I hope citizens will not stand for the arrogance any longer. I'm also told that some of the increase is related to previous Tax Credits not being renewed and thus sunsetting in 2010.

In California it took me nine dependents to undue the Tax Acceleration (Tax withholding increase) implemented in November. So who came up with idea first the FEDS or CA???

Not only are they not giving a COLA to the military, those on Federal pensions and Social Security did not get a COLA for 2010 and probably won't get one for 2011. (Although congress will get a nice raise this year and in 2011.) I noticed that my Federal pension payment (small as it is) will be larger this year. I called and found that they had REDUCED the withholding, but the representative could not tell me why. Go figure!

Notice that the "higher" range are much narrower than the "lower" ranges. I don't see where your numbers are coming from at all. Running some comparative withholdings for the single, bi-weekly (which were the rates that were displayed in the original post).
If I was making $2,913 in 2009 and 2010 I would have 452.95+.28*(2913-2559) or $552.07 withheld in 2009 and 468.95+.27*(2913-2604) or 552.38 withheld in 2010 for a difference of a whopping $0.31 dollars more withheld per paycheck.
If I was making $3,617 in 2009 and 2010 I would have 452.95+.28*(3617-2559) or $749.19 withheld in 2009 and 680.83+.28*(3617-3373) or $749.15 withheld in 2010 for a difference of a whopping $0.04 dollars less withheld per paycheck.
If I was making $4,771 in 2009 and 2010 I would have 452.95+.28*(4771-2559) or $1,072.31 withheld in 2009 and 680.83+.28*(4771-3373) or $1,072.27 withheld in 2010 for a difference of a whopping $0.04 dollars less withheld per paycheck. (it makes sense that the difference in the amounts is the same because the dollars are being withheld at the same rate as the previous example. 28%)
$5,579 will have the same $0.04 difference as the dollars between 4471 and 5579 are withheld at 28% in both 2009 and 2010.
If I was making $8,331 in 2009 and 2010 I would have 1605.99+.33*(8331-6677) or $2,151,81 withheld in 2009 and 1608.53+.33*(8331-6688) or $2,150.72 withheld in 2010 for a difference of a whopping $1.09 dollars less withheld per paycheck.
Those are some numbers to get really excited about, I guess…
run the numbers; this makes almost no difference to withholding amounts. difference for WEEKLY witholding totals no more than $2.50 under any of the tax brackets. the increase is skewed toward the lower tax brackets, with any increase at all phasing out at a salary higher than $1250 / wk.

Why are you minimizing what others are saying on the comment thread. You have one guy who's got an extra $399 taken out, retired military being taxed more on their pensions. If it goes up and down, that's the tinkering, but you can't just keep ignoring the other posters here. Are you from Media Matters, because you really are trying to make the point that there is no increase when there is. Glad you're not an accountant.
I suggest that all American workers adjust their withholding with a new W-4 form filed with their employers. Have the employer take out as little as legally possible, even if it means owing some taxes on April 15, 2011. Then take the additional money from each paycheck and put it in the bank. If it is needed next April 15, you'll have it. if not, you'll still have it! In the meantime, you have starved the federal government. To Hell with the big spenders in Washington.

I'm not ignoring what people are saying. I'm simply saying that looking at the tax rates published in the original article…the differences are very minimal (a maximum of an extra $4.50 withheld per paycheck on the single, bi-weekly rates) and usually negative year over year. Perhaps the married rates are different and do have larger withholdings…but that is not what the article was touting.
I'm as conservative as they come…but I was also a math major and the math in the original article was off. Someone saying "I have an extra $399 being withheld" doesn't give me enough data to work with to check their numbers. All I am checking are the numbers posted in the original article and they just don't work out.
The reason I did the analysis was that I was going to post a link to this article on a forum that I frequent to point out to the liberal (er…progressive I guess they want to be called now) members of the board (it's a mixed group as it's a game forum and not an ideologically based forum). I wanted to call out where there was the biggest difference in $ so I ran (in excel) the taxes for every bi-weekly income from $1 to $15000. When the biggest difference in weekly withholding was $4.50 I rechecked my numbers several times and then came back to let people know that this really wasn't an issue (at least for the withholding table that the original article was showing).

While I appreciate the math, Obama said that he would not raise taxes for anyone making under $250,000/year. Period. THAT was his entire campaign. Even if one person's withholding goes up, even by a dollar, it's a broken promise. From the comments, it appears that it goes up more than that–and people don't like it. You can try to work the math, but the people are already seeing the difference in their checks. I did, too. The article states the tables and there indeed clear increases, even in the lower thresholds as stated, and they will see taxes taken out–even if they are small. This isn't a secret conspiracy by the Democrats, but it is a signal of governmental incompetence. The Treasury Inspector General for Tax Administration ("TIGTA") conducted a review of how the IRS was implementing the the Making Work Pay Credit. The issued a report showing that the tax tables for 2009 Making Work Pay tax credit were incorrectly structured. As many as 15.4 million tax payers may have not had enough money withheld from their paychecks.
This change in the tax tables wasn't due to an act of Congress. The IRS accepted a recommendation from the Treasury Department to change the withholding schedule. Increased withholding requirements is not a tax increase.
It's time for as many as wllng to stop paying. Send a message.
SusanAnne Hiller simply does not understand what is happening with the tax tables and it amazes me that the IRS could not explain it. Last year, Congress passed the American Recovery and Reinvestment Act of 2009 and that caused new withholding tables to be issued for April through December 2008. That allowed employees to receive the Making Work Pay Credit of $400 through reduced withholding from their paychecks. When she refers to the weekly single wage level of $138 falling to $116, she is measuring that change from the modified withholding tables (which were only good from April through December) rather than the original withholding tables issued at the start of 2009. The higher earning level of $138 was necessary to achieve a reduction in withholding of $400 from April through December (only 9 months). The 2010 tables allow for the same $400 reduction in withholding except it is averaged over the entire 12 months of the year so the weekly single wage level has to be less or the reduction in withholding would result in more than $400 reduction in withholding.

There is no misinformation here, she raises questions about the tabes, the NEW wage categories and higher percentages, and also how do you explain the withholding increases on some people–that are actually happening Mine increased and nothing changed and I don't qualify for making work pay. They can't start this up all at once. It is too big of a program, so they will phase in many types of coverages and groups of peole to be covered. They will force doctors and patients and others to front the money by delaying and denying payments. This alone can be good for another year additional collection of taxes before having to absorb costs. High inflation between cost and payment can further reduce their apparent costs. Part two of my too long comment: As for the two additional withholding categories, that is necessary to phase out the higher income individuals from receiving the $400 reduction in tax – basically single earning over $75,000 per year are not eligible for the reduction. Once your income exceeds the AGI limit, the making work credit is reduced by 2% of AGI which exceeds $75,000 until $95,000 when it is completely eliminated. The only stress put upon Americans and businesses is mis-information from Susan. There is no middle class tax increase.
Three years ago when I started my new job, I put the word EXEMPT on my W-4 form. My company doesn't take any money out for taxes. Then I saved up during the year so that I would have enough money available to pay the tax. I don't let Big Brother keep my money for me. And I haven't been bothered by either my employer or the IRS.

Have you actually read the tax tables? I just did, and they RAISED all the thresholds. My paychecks for 2010 will have $160 less in withholding taxes. That's pretty nice if you ask me.

The optional sales tax tables on Schedule A have been tweaked also. The amount this year that you are able to deduct is lower. Check it out!!

If anyone takes the time to load the withholding tables into a spreadsheet and compare 2008-2009-2010 withholding schedules, they will see the 2009-2010 adjustment is a very small adjustment accounting for the 400$ credit being withheld along a longer (full vs. partial year) schedule. Further, it is a mistake to compare only 2010's schedule to 2009's, since the REAL 2009 schedule was ~1/4 2009 original (essentially 2008's) and ~3/4 2009 adjusted (by the stimulus legislation). The 2008 withholding schedule was much more aggressive than the 2009 withholding schedule when the 2009 schedule is adjusted for the changes being made partway through 2009, and 2010's schedule is even less aggressive than 2009's. The bottom line is that anyone who takes the time to analyze the data will come to the same conclusion that 2010 has a more generous federal income tax withholding schedule than did 2008 or the aggregate of 2009-original & 2009-adjusted.
I am no fan of Obama's, but this blog post was much ado about nothing … which is a shame, considering there are so many other valid points to go after thanks to the current and past administrations. I know many people who do NOT qualify for making work pay tax credit–working students, retired military–and their withholding went UP. How can they have more withholding taken out of the tables when they dont qualify. It just doesnt make sense that their withholding and frankly mine was increased. MWP didnt qualify everyone. And why the email, why the new wage categories, why lowering of the threshold, etc. Clearly, there are questions that need to be answered by the IRS and not posters in the comment feed. While I'm totally against any tax increases,and most social programs I do beleive they are quietly stating saving billions in the long run because they will be able to reduce the interest owed to the International bankers running the Federal Reserve(Government needs to start buying back debt).
An easier way to free the people is to end the Federal Reserve system by Congress buying it back from the International bankers for a few million USD.
Buying it back would allow the U.S taxpayers to use the $250 billion in interest payments paid to the Fed Reserve bankers every tax year (they get tax free)to go directly to paying down the deficite.
This quick paying down will allow the Treasury to buy back bonds held by other countries including the largest holder China.
Once out of debt and a few other changes such as preventing the sell of U.S Treasury notes it will prevent inflation,as the amounts of Treasury in circulation could be reduced,and the personal income tax would no longer be needed.
Do a little research on how the Federal, Reserve was created,who was/is responsible and you'll discover that it was the same people that helped create the Federal Reserve also introduced the legislation that created the IRS and personal income tax,they had to because they needed a machine to generated revenues to pay the interest on the notes being printed,the sad part is the Federal Reserve never risk a single cent to print the notes because the notes are based on the national GDP,but they have been destroying that with unfair global trading such as NAFTA.

Congress put a pretty big "HUMP" in the middle of what used to be the 28% tax bracket in an effort to hit the upper middle class extremely hard. Thanks to my Congress my Fed taxes jumped more than $280/pay period..

If you go back to 1970 and look at the tax tables and look at them for each year after that you will see that they have been rising ever since then and before. There is an alternative but the average person won't do it. That is to go back to the dusty roads that existed before they started taxing people. Back then people mainly walked where they went or rode horses. We could have millions of people starving like in Africa. Mark- while I would agree the federal reserve and world bank are a joke, it is obvious you do not have a good understanding of our obligation to repay debt owed to China. It has very little to do with comparing the value of the yuan (actually yuan has been replaced with Renminbi and prices are quoted using the abbreviation RMB) and the US $. The current exchange rate is approximatley RMB 6.83 per US $1.
The fact is that the USA sends billions of US $ to China as payment for goods- think Walmart, etc., each month. The Chinese loan these same dollars back to our government in various ways. They currently hold almost one trillion US $ in their treasury. We borrowed US dollars from them and our obligation is in US dollars and not RMB.
The 2009 tables were revised to give folks $400 over the rest of the year, but didn't account for the fact that the "making work pay" credit phases out when you get to a higher income. The tables were intended to be used starting April 1, so this $400 had to be compressed into 9 months.
The 2010 tables account for the phase out of this $400 credit, and lower the tax-free threshold to spread the $400 credit over 12 months, not 9. Let me know when you find something more insidious
When will people understand that NOT EVERYONE qualifies for making work pay. And for all you brilliant ones who use this as a reason, please explainthis to the guy who wrote in that his withholding WENT UP by $280 per pay period and another guy by $399 per period. When it hits your wallet, then you'll scream.
Remember that incentive check we got, well, they are taking it back, PLUS. Being Retired Military and a Civil Servent, both my incomes came down. So you figure, no pay increase for 2010, plus the increase in taxes per person. Now we understand how Mr Obama and his Co-harts will stick it back on US. So, the tax threshold is lower, but still better than before the making work pay credit went into effect, yet you still think this is a tax increase. As you surmised, the reason the threshold is lower, the credit is spread over a full year instead of the 9 months after the tax change was made last year. $800 for a married couple spread out over 52 weeks is going to be less than spread out over 40 weeks. It really is simple math, but the writer thinks this is a hidden tax increase. It's no wonder given the bias she is coming from.
As for the change in the tax rates at the 28% level, this is to account for the phaseout. Notice the tax goes down to 27% then up to 30% for small range and then back down to 28%. Again, not that hard to understand.

That is just not true. There is no increase in taxes this year. The Making Work Pay Credit caused the change in the tax thresholds. I can't comment on the COLA because it doesn't effect me, but I do know that the CPI has gone down, so the prices, in general, of things have come down, so the COLA should be needed. The writer of this article is using smoke and mirrors to deceive people. Let's do the math: If I'm single making $3373 per bi-weekly pay period (which I am not, but it is the top of the new 30% range, my withholding will be $680.33 per pay period. ($3373-3248=$125 x 30% = $37.50+$642.83= $680.33). This is an effective tax rate of 20.17% not including possible deductions or other income that would change for the taxpayer. The old withholding for the same tax payer comes to $680.87 per pay period. ($3373-2559=$814 x 28% = $227.92+$452.95 = $680.87) This is an effective tax rate of 20.19%, which is actually higher. So how is this a tax increase?
If you don't qualify for the making work pay credit, then you are withholding too little. The withholding tables are based on the taxpayer qualifying for the credit, but the tax tables are based on without. On the 1040/1040A, taxpayers have to apply for the credit so that they will get it. Additionally, if you are single and the credit doesn't apply, the increase from the withholding tables to the actual tax tables is $400 ($800 if you are married).
As for the people saying their withholding went up $280 or $399, there must have been a change in exemptions claimed or they saw an increase in income because it is not in the tables shown in the article above. If you can find it in the tables, please show me the example. My example below shows that an individual making $87000 who is in the new 30% tax bracket pays an effective rate of 20% on their income before deductions and their withholding per pay period is down 54 cents from 2009.
Please explain how you did your math? If your withholding went up that much, chances are your employer is using the wrong tax table or they changed your exemptions. The only other explanation would be if you are making considerably more money and are in a higher tax bracket. If you look at the tables there is nowhere that a withholding increase is calculated at $280 per pay period.
As for the "HUMP", I assume you are talking about the 30% increase. If you notice, below that range (which is incidently only $125 at the 30% rate which equals 37.50 of additional withholding per pay period or only $2.50 above the 28% for the same range last year) the tax rate is reduced from 28% to 27%. This range of $644 is now taxed 1% lower, or $6.44 reduction per pay period. The purpose of this "HUMP" is to account for the phase out of the MWP Credit. It is disingenous to point out the "HUMP" without mentioning the comparatively large "DIVOT" in front of it.
Oh, of course it had to be THEIR fault and they changed their exemptions. Uhuh. Sorry, my income went down, my exemptions didnt change and neither did the employees that work for us–all saw less take home. ALL WENT DOWN. USE YOUR HEAD, dear.
I showed you the math. You show me where it is anything more than what I said it was. Of course their take home went back down because the MWP Credit is spread out over a YEAR instead of 9 MONTHS. I never said the take home wouldn't go down. So, look at the tables in the article above and show me where someone is going to see an increase of $280 or $399 in their withholding. The only explanation is less exemptions, more income, or the payroll department is using the wrong tax table.
BTW, make sure you tell your employees to claim the MWP Credit on their 2009 Income Tax Return because they won't show up in the tax tables. It's an extra step, but it could be worth as much as $800 on their returns.
well, i foun d it interesting that the "making work pay" section of the return asks if you received a social security economic recovery check this year. i recived 250.00 and was not elligible based on other income for this "special" program. the fact that i entered the 250.00 lowered my refund by 420.00 !! since social security was already part of my gross income it was essentially taxed twice by this wonderful benefit and for reasons that are inexplicable. please gov't, don't do me any more favors with special checks that cost me twice what they total when all costs are figured. only gov't would see this as a great deal. no new taxes under 250K my arse..

You gripe about a $10 withholding increase (that you'll get back anyway), while credit card companies arbitrarily increase rates and payments (that cost you thousands), and that's acceptable. The government is dealing with problems CAUSED by trans-national corporations and bankers, and you believe it's "over regulation" that has caused it. I, too ,believe we MUST, I REPEAT, MUST, change the dynamics in Washington. They are becoming richer every year they are in office, to the detriment of the average citizen. Taxes ARE NOT going up. Withholding is higher. The reason the Withholding and 941 payment liability is higher is because the Making Work Pay Credit is spread over 12 months instead of 9 months like last year. If withholding is kept the same, taxpayers will withhold more than the $400 for single, $800 for married that is allowed with the MWP credit. Look at the tables and compare the numbers.
It really is simple. For the life of me I can't believe how many people are unable to grasp this concept. Of course, articles by the likes of the one above and the one you posted do little to INFORM the people who read them.
Brian, they are going up and I don't qualify for making work pay and I had more money taken out of my pay. So did my retired military family member who doesnt qualify for making work pay. Can you explain that.
The withholding table changed. Everyone uses the same withholding tables. If you don't qualify for the credit, it's still just an adjustment to withholding because the withholding was lower over the final nine months of last year to make up for the three months before the credit was implemented. Use the tables in the story above. Pick any biweekly gross pay figure you want and calculate it out and show me where the tax increase is. I did it for the top of the bracket which doesn't qualify for the credit either, $15,000.00, and it actually shows lower tax withholding. This would be someone who makes $390,000 a year, single, and they aren't even seeing a tax increase.
If you don't qualify for the credit this year, but did qualify for it last year, you will see an increase in your tax.
If you didn't qualify for it this year or last year, you will see an increase in your withholding, but your tax will be the same.
Just because someone writes something on the internet DOES NOT MAKE IT ACCURATE OR TRUE.
I am tired of uninformed trash – the businesses withhold taxes from pay so that it will be there when you file your income tax return and THEN you will know what the government will keep – Has anyone ever gotten a refund? As the article states, the increase in withholding can easily be offset by simply changing your W4 form, which every worker has the right to do every year. The marginal tax rates between '09 and '10 are virtually unchanged.

This article brought up some red flags for me. My husband is a salary employee. His first paycheck in 2010 was decreased by almost $5. The increase in Federal Income Tax on his pay stub was increased by that exact same amount. I called his employer to see why the increase in the tax because like others, I was under the impression that there was to be NO tax increases for 2010. The employer had no idea, but promised to look into it. I then called my payroll dept. where I worked (my department has since been eliminated and as of Feb. 8th, I will be another statistic) to see what they had to say.
A few days pass and my husband's employer called me to say there had been a tax increase. She didn't know a specific amount or percentage, but the company that produces the software they use for payroll had told her this. In the meantime I finally get a note in my paycheck that eluded to tax tables being REVISED – REVISED??? What in the name of all senselessness does that mean?? Money is being taken out of our paychecks and no one knows why or what percentage, etc. How can you keep books when you don't have formulas, percentages, etc. Do you just say we'll take $5 out of this paycheck, $20 out of this check, etc.? It seems to me that these figures have to be set pretty far in advance because companies that write payroll software have to know what to input – or do they?? I realilze that $5 isn't a lot of money to most folks, but that's $260 over the year. It could amount to much more for others. The amount isn't really the issue – just the fact that more money is being taken out of our paychecks when we were told that would not be the case is maddening to me.
My company is a large private company and usually encloses explanations of changes in taxes with our final paycheck of 2009. We did not receive that notification. When I called to speak with them, they didn't have a clue as to why the change. I didn't want to do it, because I knew it would be quite the hassle, but I did end up calling the IRS here in Grand Rapids, Michigan. There was a number given specific to Individual Federal Income Tax. I called and spoke w/a lady who didn't know anything but she was glad to pass me on to another person. This person said, "I don't keep up on those things, but I will put you through to someone who can help you." Keep in mind that this is a number given SPECIFIC to Individual Income Tax questions. The third person too about 15 min. to tell me that the amount was PROBABLY the end of the making work pay tax credit. She really didn't know, but that was her best guess – my words, not hers.

The increase in withholding is not a tax increase. As has been pointed out in the comments several times, but is pretty much ignored by the author, the increase in withholding is to make up for the Making Work Pay Credit. Withholding was lowered starting in March of 2009 to allow for this credit. Since only about 9 months were left in the year, withholding was lowered even more than what would have taken place if the credit were started at the beginning of 2009 to "catch up" for the full $400 for singles and $800 for married couples. Now that it is the new year, if the withholding tables did not change, you would be withholding less than you should and would owe tax for 2010 when you file.

There is no tax increase. A withholding increase does not equal tax increase.
Taxes have been reduced for 95% of americans since Bush left office.
If your income is the same and your deductions are the same, I 100% guarantee you will pay the exact same Federal Income Tax when you file in 2010 as you will when you file in 2009. And if everything is the same, there is a 95% chance you will be paying less than you paid in 2008. Now your local and state taxes I can't say the same thing.
What i find interesting is that we have yet to pay for the two wars we are fighting…i never heard a republican attempt to pay for it. It's just interesting to hear all the screaming about increased taxation. We've known the day would come to pay back the record deficit that Bush left our country, so why such shock now?
If this is a way to drive people into a forced savings program, I am all for it. For someone with a stable income and known deductions, its not that hard to predict the tax liability that will be owed at the end of the year. Divide that by the number of pay periods and adjust withholding accordingly. See IRS PUB 15 for withholding tables for the tax year to figure out how many exemptions you need to claim. I own a home in CA so I have a lot of mortgage deductions and do this every year. I usually get a refund less than $50, but my paycheck every two weeks is a couple of hundred extra. Penalties start applying if you owe more than $1000, I believe. I always shoot for a small refund as a cushion
I'm not really sure what games are being played with the withholding tables this year, but the actual tax tables are essentially unchanged from 2009. Though the inflation adjustment from 2009 to 2010 is much much smaller than for 2008-2009. If you don't like the additional withholding, just adjust your withholding exemptions. 2010 tax tables and withholding tables are available at irs.gov. Educate yourself on how taxes work, it is eye-opening. The withholding tables are gamed so that most people grossly overpay. Imagine agreeing to pay $15000 for a $10000 car, and the dealer will pay you back the $5000 sometime after April 15 the next year, after you fill out pages of forms based on documents you have to wait to receive for each bank account, investment account, and each employer. Nobody would ever take that deal. Figure out your tax liabiltiy for 2010 now, adjust withholding, get a small refund.
Is Steve from FatWallet? This is one of the few comments that is worth reading. There is no tax increase, just an increase in withholding. It would appear to be a way to get an interest free loan, all the while giving the consumer a bigger tax refund at the end of the year. After all, if most Americans won't save their money, at least Uncle Sam can help with that.
