Message to Feds: Enough! Remember the 10th Amendment
by Gov. Rick Perry (R-TX)As the federal government continuously churns out ideas and policies that drive our nation deeper and deeper in debt, citizens and taxpayers are right to be worried. From federal “stimulus” bills that force state governments to change laws, raise taxes and increase spending, to cap and trade proposals that will run our energy industry into the ground, to emerging plans for an unprecedented and unsustainable expansion of government health care, it is clear that the swollen river of our federal government has overflowed its banks.
Washington is increasingly out of step with folks out here in flyover country who do not share the inside-the-Beltway belief that a benevolent, all-knowing government can expand and encroach without limit, because individual Americans simply cannot be trusted to make right choices.

This mindset has driven the explosive growth of the size, spending and intrusiveness of the federal government. Our founding fathers would be appalled at the way their successors are ignoring individual liberties, contemplating more tax increases and interfering further into private enterprise.
Washington bureaucrats must be reminded that America is not some windowless laboratory where they can tinker with theories with no regard to consequences. Real harm is resulting from policies that are disastrous for America’s future, bankrupting our country, and mortgaging our children’s future. Fear of this emerging future and frustration with an administration run amok are fueling the resurgent interest in the 10th Amendment of the U.S. Constitution. “We the people” are standing up and demanding an audience.
It drives the talking heads crazy, but I’m proud of those level-headed Americans who are pushing back through the growing TEA Party movement. This groundswell of classic American activism is giving citizens a conduit for their beliefs and sending a clear message they will not stand idly by as Washington’s spends their tax dollars and limits their freedoms with increasing arrogance. I predict that our increasingly frustrated national electorate will look to the states for answers, starting with Texas.
The success of the Lone Star State has proven that the journey to a desirable future begins with fostering individual liberty and encouraging personal responsibility while celebrating the entrepreneurial spirit. Our relative economic strength is proof that people thrive when given the opportunity to strive with minimal government interference.
In 2003, our Legislature’s first order of business was tackling a $10 billion deficit. Fortunately, conservative leadership principles prevailed and we cut spending to right our listing ship of state. Six years later, Texas has a balanced budget with money set aside to cover contingencies and leads the nation in exports, Fortune 500 companies and economic vitality. At last check, our unemployment rate was nearly two points below the national average.
Because Texas leaders not only cut spending but also pushed through tort reform and began sensible investments in job creation, our state is in much better shape than just about any other. Our reformed legal system has not only protected employers from frivolous lawsuits, it has also increased access to healthcare for our citizens while lowering their overall costs.
This continued application of proven, conservative fiscal principles and unapologetic embrace of individual liberty has created a magnetic pull on business owners and citizens looking for a fresh start. We haven’t been adding roughly one thousand people to our population every day solely because of our great live music and barbeque. That certainly doesn’t hurt, but folks are more attracted to a climate where people know they can not only risk their capital with a chance for a good return, they can also enjoy a quality of life that is unreachable in most other states. People come to Texas for the modern version of the classic American dream.
Our success notwithstanding, you won’t catch Texas resting on its laurels or abandoning its principles. During our recent legislative session, we turned a few heads when we refused federal unemployment funds that would have mandated increased taxes over the long term and more government expansion. We also cut taxes for 40,000 small businesses, knocked out legislation that would have opened the door to frivolous lawsuits, and passed bills that will improve education by bolstering our universities and increasing accountability in our public schools.
I’m pleased that a number of other states are taking a similar tack by drawing clear lines and standing on proven conservative principles. Fortunately for their citizens, leaders like Bobby Jindal of Louisiana and Haley Barbour of Mississippi are also standing tall in the face of a metastatic federal bureaucracy. We can only hope that more states will follow suit and pursue reforms that actually work.
Barring the unforeseen and unlikely event that the powers-that-be in Washington wake up and change their approach, people will continue to press for limited government, endure in their belief in the power of the individual, and cast their lot with the protections of the Tenth Amendment. Hopefully, exercising our speech rights guaranteed by the First Amendment will finally rouse Washington from its slumber and bring our nation out of this recession, strengthen our Union, and chart a course to long term prosperity and opportunity for all.

Great post, Gov. Perry! Now, lead the way and send out a press release that
– Texas will go through its contracts and ensure those with ACORN are terminated.
– Do they have a license to operate in Texas, or are they flying under the radar like Maryland?
– Texas may not have income taxes, but did ACORN do any tax advising in Texas for state fees or taxes?

Not trying to say anything about Texas, because I loved living there, but there are 10 cities in TX with ACORN offices. There were three in OK. I'm not sure if the one that closed under strange circumstances is back open…I guess I have some work to do still. Like checking for a license to operate for Ok.

It is time to move our government back to smaller size and more manageable substance. It is time to remind those WE elected to represent us, just WHY we elected them. We hired them, we can fire them.
Governor Perry, hold the hard line, clean up your state. Show the rest it can be done, and then offer to help others to clean house, too.

As a proud Texan, I can honestly say that I haven't agreed with Perry 100% of the time. Only sheep agree with our elected leaders on every issue.
That being said, Governor Perry has been on the right side of issues more than any other politician (except for maybe Dan Patrick…Sorry Governor) I have had representing me in my adult life.
Now get ACORN out of Texas and keep fighting Washington so we can continue to grow as a sovereign State!!!

Keeping the pressure up on Washington is not enough…we must start to pressure state and local officials in every state to root out the corruption, not just ACORN. Let me join the others in not asking, but demanding that ACORN be investigated in the State of Texas. I am a supporter of yours Gov. Perry, but 1 ACORN office in Texas is 1 too many unless it can be shown that they are not a corrupt organization (good luck with that).
Then move down here! The state has so many different types of territory, I'm sure that you'll find one to your liking. From the Hill Country in Central Texas to the Mountainous Desert out west. There is the evergreen of the Piney Woods in the east and the unbelievable food in the Gulf Coast. There are the farming communities of the Valley in the south and the Panhandle in the north.
It's a big place. I'm sure we have room for one more!
I almost missed this article in the flurry of activity. It's an important one and I'm glad I caught it.
We must keep and eye on and remind the people we send to Washington that they don't work for the federal government and we don't send them there to consolidate power in DC. I don't think that the majority of our senators and representatives even pause for a second to ask themselves if what they're voting for or proposing is the proper role of the federal government.

While I don't agree with all of your policies (namely the Corridor), you are the reason Texas is in the shape that it is. We are at the top of more economic indicator lists than any other state. And that was your doing.
Which is why I am completely dismayed at Kay Baily's attack on you. Being part of the Washington problem, she has VERY little room to speak of shortcomings. Criticizing you for refusing to accept unemployment funds that we didn't want and that would have run this state into the ground, is repugnant.
So when she tells the people of this state that you haven't done enough, point to her and say one word: TARP. She voted for it and that is her legacy. She will never get my vote again. For ANY office.

I must post again. Speaking of Acorn. It was verying frustrating to watch them steal our last election. They infiltrated Ohio State Campus, refused to register non democrats and non Obama voting students. Drove bus loads of "drunk" college students to Veterans Memoral early voting, helped them open the doors as they were too drunk to do so on their own, and then assisted them with thier voting. My two kids were there and witnessed these events and other OSU parents relayed the same thing to me. My heart broke that nothing was being done to stop them. Our state was stolen by Barack Obama's soldiers "Acorn".
So governor, I agree, chase them out of your state and fast.

I'm so happy I moved here 25 years ago from Northern California. I was so proud of Governor Perry when he rejected the additional unemployment funds with their strings. Anyone who has operated a small business knows how something like this can sometimes be the difference between keeping the doors open or closing down. We MUST invoke the 10th amendment to fight the health care, cap and trade, and everything else they are cooking up in DC or we'll all end up as broke as my wonderful former state.

The funny thing is – I live in Upstae NY – near Syracuse – farming country. All our votes are made null by the NYC population of 8 million. But I figure if more of us are here – maybe we'll be OK. Plus – just bought a house. Good market for it. NYC keeps talking every few years that they want to Succeed (word spelling here?) from NY State. I say go for it – I'd vote for that. Then we would have true representation in the rest of the state w/out trying to out-vote a larger population of 90% liberals.

It's this kind of attitude that would get my vote if Perry, himself, believed it. Perry does not stand for conservative values despite the lip service found herein.
Mandating HPV for 11 & 12 year old girls, his efforts in the seeing the NAFTA superhighway come to fruition and what seems to be never ending corruption on his part (TXU anyone?) are all reasons Perry will not be getting my vote – nor should he be getting any other Texan's votes. The outcry from all of these actions surely proves that few (if any) of his constituents approve of these measures.
On the flip side, Hutchison does absolutely nothing! NOTHING. She is has one of the the worst attendance records in the Senate with 6.7% missed roll calls. She missed a vote on Tuesday, on yet another issue that is dear to Republicans (or conservatives in general) – an effort to strip “earmarked” spending from a transportation bill.

Great post Governor Perry, but it is hard to believe you are sincere when you pushed a disastrous gross margins tax on us, signed into law a bevy of nanny state laws regarding vehicle restraints and cell phones, tried to force us to vaccinate our daughters (of which I have four) with a new vaccine which had no long term study to back up its efficacy, tried to build a boondoggle super tollway, and continue to allow our TXDOT to strong-arm cities and counties into turning road after road into tollways.
Repeal the gross margins tax, apologize for the nanny state laws that you signed or supported, drop your goal of a super tollway, and support open carry and I will believe you are sincere and not just posturing for the primaries.

Well, Kinky always runs and the only reason Kay wants the Governor's seat is because she has aspirations for the White House. She was pretty miffed when McCain picked Palin instead of her. If she ever got elected here she would do one term and then start lobbying for a Vice Presidency. She might run in the primary for the top position, but she has to know the only way she would get there is serving as a VP first.
For my part I don't intend on letting her take control of our state. She has sold us out. However, I DO look forward to Kinky's campaign. He always makes the election fun.
I'm not a history buff but I have heard that when Texas joined the union that Texas reserved the right to revert to a Republic if it did not like the way the US was being run. If so, I would recommend that that right be exercised and Texas(and other like minded states) secede from the Union once again. I, for one will move there and I'm sure the population will EXPLODE!! What we have right now is another Civil War being fought without guns.

The ONLY reason you are hearing this from him is due to the TEA parties and the fact that it is an election year. Perry's record speaks volumes about his commitment to individual liberty. HPV vaccine mandate, Vetoes Texas Eminent Domain Bill, Signs Hate Crimes bill, are but a few of the many things that Perry has done that are counter to his rhetoric. What surprised me about this article and the profusion of response to it is the fact that nowhere is the 10th Amendment quoted. It bears quoting: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved for the States respectively, or to the people."
What does THAT mean? It means that, unless the original constitution specifically grants a power to the United States or specifically prohibits that power from residing in the States, then that power should be the exclusive power residing in the States.
The federal government takes a lot of power into its own that should really be left to the individual States.
It is a lesson that individual States can learn, too. Power that should reside in the individual should not be a concern of the State, either.

Funny, there is no mention in here anywhere of Perry’s Margin Tax of 2006. The only reason the new Margin Tax is not called a Business Income Tax is because it is in actuality worse than a Business Income Tax. Does Perry talk about the Margin Tax at the TEA parties?

OK this one really confuses me. Total Debt Outstanding for the State of Texas is as follows:
’04 19.96 Billion
’05 21.38 Billion
’06 23.32 Billion
’07 26.37 Billion
’08 31.25 Billion
If we have a balanced budget and debt outstanding keeps going up (11.29 Billion in 5 years), where is the extra money going? Do state officials all have secret Swiss bank accounts? Or is the truth that we are spending more money than the Tax revenue that is coming on, and we are making up the difference by pushing the burden on our children and grandchildren? Oh and by the way, we are getting ready to borrow $1.5 Billion from the Federal Government.

The great thing about his so public outcry about not accepting Stimulus money for unemployment benefits is that it is now being reported that Texas is getting ready to barrow 1.5 Billion for the Federal Government for Unemployment benefits.

I can add that the Texas Enterprise Fund you orchestrated to be in a position of doling out money to private interests is a shameful conflict of interest that no person of integrity serving the public interest would undertake unless they were DIRTY! Government is not supposed to be interfering with the free market or tipping the scales with their own hands. This is absurd. Do you even understand that corruption is bad? Do you actually think the public believes that all of your Public Private Partnerships where you dole out taxpayer money to buddies is actually in their best interest? The 10th ammendment to the Constitution is important as is the entire document. I am a patriot and support Gov. Perry over Kay Bailey-Hutchison. However, I do not agree 100%,with Gov. Perry. Especially about the Trans-Texas Corridor. I disagree there. What concerns me is our debt. According to the Texas Bond Reveiw Board (http://www.brb.state.tx.us/bfo/bfo.aspx), as of February 28, 2009 Texas had a total of $31.07 billion in state debt outstanding. That is a lot of money. Hopefully we'll pay our debts here in the state and not get in the shape of some other states. Texas is a great state, let's keep it that way.

Respectfully, sir, what's the course of action if the federal government does NOT recognize the 10th Amendment? The current administration, as well as its predecessor, violated the U.S. Constitution with the policies and legislation set upon us; so what in its actions gives cause to believe these events will be any different? Where is the investigation into Blackwater… People in this country would trust conservatives more if they would investigate all tax payer funded organizations… Why do we need Blackwater, what's wrong with using own troops. What a great story. Isn't this what America was before corruption took over DC? I wish that your article would somehow change the Obama agenda. Unfortunately, Obama is hell bent on bringing down our country first with bank bailouts, AIG bailouts, carmaker bailouts and privatization of indutries. If that doesn't kill our commerce, they will bring in Cap & Tax which will be the death knell for small businesses and will bring us to the point where the only jobs that will be available is government jobs. The housing market is getting ready for another jolt of foreclosures from the second sub-prime mortgages getting ready to reset. This will mean that pretty soon a very large percentage of homeowners will lose their home. We'll be renting from the government. Then they'll pass the healthcare reform and we'll be buried by the government. Unless the people band together to stop Obama and the thieves in DC, America will be lost forever.

Frankcollatt, I have no problem with asking the entire Obama administration resign. Along with all the Republicans, too — particularly those affiliated with George W. The 10th ammendment is dead as long as Perry is in office as stated by Dave Mundy you sir didn’t have the testicular fortitude to accept a petition signed by over a million Texans asking for sovergnty. But you can run your mouth about the 10th ammendment, but do nothing about it.
HCR 50 is dead, your legislature let it die because of the phrase “States Rights”. However you take credit for pushing State Sovergnty. You sir are a liar, and will say and do anything to get re-elected.

A few months ago I called your office to demand a spcial session of the legislature to settle HCR 50, but got a smart ass reply from one of your workers that it would cost a million dollars, and I should foot the bill.
I later called and emailed your office to obtain a count of communications on the exact number of Texans who wanted a special session of the legislature. Thank God I didn’t hold my breath it’s been 2 months with no reply.
As far as I’m concerned you can lead follow or get the hell out of the way.
