Time to Pull In the REINS on Executive Power?
by Rich MunyExpressing disapproval with some Obama administration actions, many on the right — and some on the left — are complaining that the executive branch wields far too much power. Similarly, when President George W. Bush was in power, many on the left — and some on the right — complained that the executive branch wielded far too much power. Seeing this bipartisan concern for unbridled expansion of presidential power and wishing to start restoring the office to its Constitutional limits, Congressman Geoff Davis (R-KY) has introduced the Regulations from the Executive In Need of Scrutiny (REINS) Act.

The REINS Act would require Congressional authorization for any new Major Rule proposed by the executive branch. It now has now has 57 cosponsors, including noted Constitutionalist Rep. Ron Paul (R-TX). It also enjoys the support of the Chamber of Commerce. Under REINS, the numerous proposed regulations pertaining to health care, climate change, energy, financial regulation, and our economy would have to be submitted to Congress for approval. REINS would continue to allow the executive agencies charged with writing rules to propose draft rules, but would end the delegation of Congressional authority that has enabled these agencies to enact them unilaterally.
Our Founding Fathers recognized the pitfalls of an all-powerful chief executive. Fearing tyranny, our nation did not even have a president until 1789, preferring instead strong states, a weak Congress operating under the auspices of the Articles of Confederation, and no executive branch at all. As this proved to be too weak for national cohesiveness, our founders drafted the Constitution to provide the nation with three co-equal branches of government: legislative, executive, and judicial. All three were to operate within the limits defined by the Constitution.
Our founders took great care in limiting presidential power. Presidential power is limited to the powers granted by Article II of the Constitution. As further protection against tyranny, our founders created a system where the president is chosen by the Electoral College rather than via direct election. This was partly to keep the president from exceeding the authority granted by the Constitution by claiming a popular mandate. The Constitutional system kept presidential power largely in check (temporary wartime expansions under President Lincoln and President Wilson being very notable exceptions) until the election of President Franklin Roosevelt.
President Roosevelt greatly expanded the power of both the presidency and the entire federal government. He was the first president to submit legislation directly to Congress. When much of this was overturned by the Supreme Court as unconstitutional, FDR reacted by bullying the Court with threats to pack it with New Deal supporters. Once the Court started upholding New Deal legislation, FDR used this green light to expand the office of the presidency well beyond its Constitutional bounds, shifting federal power from Congress and the Supreme Court to the executive branch in the process. Most presidents since FDR have sought to further expand the power of the office.
President Obama has continued this expansion of executive power. He has given a great amount of power to unelected bureaucrats within the executive branch and has then, in effect, created law via the regulatory process. No Congressional approval was sought for any of these actions.
Congress is finally fighting back. When introducing the REINS Act, Congressman Davis shared this disturbing information:
Last year, the federal government issued 3,316 new rules and regulations. That is roughly 1.6 rules per working hour or 12.8 rules per working day! In many instances, federal rules impose substantial compliance costs on individuals, businesses, and State and local governments. Rules with at least $100 million of annual compliance cost or effect on the economy are classified as “Major Rules.” In 2009, federal agencies issued 78 Major Rules.
The regulatory process has increasingly ceded power to unelected bureaucrats for major decisions that can affect all Americans. Take for example the Democrats’ government takeover of health care. This poorly drafted legislation repeatedly requires the Secretary of Health and Human Services to create regulations in areas ranging from what is required for “qualifying health plans” to the determination and disclosure of nutritional information for standard menu items in restaurants.
The American people agree. In February, a CNN poll found that 56% of Americans believe the federal government is so large that it threatens the freedoms of ordinary citizens. It is time for Congress to assert its Constitutional role in federal governance.

I am frighted for the future of our children is these people are not stopped and replaced in the next 2 election cycles. I think this is one on the reasons for not sealing our borders and the push for amnesty by both parties. Eventually the only way the people will be able to take their country back is by revolution and we would not stand a chance against our own armed forces and the MSM. Obama would make Chavez look like a dove if he was ever given absolute power over the people of the USA.

How would be go about restoring balance to the universe, or at least to Washington. FDR created the expansion almost 100 years ago, how can we go back in and fix it? It's about time! I was beginning to wonder why we even both to elect members to congress. They don't listen to the voters. They don't write most of the bills. They don't read the legislation, anyway.

I completely disagree. I think Obama should have more power. In fact he should have so much power that we no longer need elections, freedom of expression, right to bear arms, and free exercise of religion. Maybe then "We the little people" will come to understand the undeniable greatness of our dear leader – then and only then – will our nation truly be healed from our mistakes of the past.
If you believe I believe this you are in need of medical attention from a mental health professional. You see we are nation of free people, and as tough as it is to earn the respect and vote of those people, when it happens, we call that LEADERSHIP. Obama will never have that, save some drastic intervention by either his conscience or God.

No way. Even the Founding Fathers didn't believe that. Their answer to the problem was to divide the powers among competing branches of government. It's not a perfect solution, especially if all power resides with one party, but we will soon correct that little problem. This legislation would just restrict some of the centralized power out of the executive branch. It's a good start to a very big problem.

The Constitution ONLY grants power to CONGRESS to make the laws and absolutely no one else. The way it is now, its totally un-Constitutional because we have dozens of executive agencies making the laws (regulations that have the force of laws to be exact) — such as the EPA, the IRS, and FDA just to name a few.
These agencies need to go away all together, but in the meantime this proposed legislation would at least slow the bureaucrats down. No one can possibly know what the law is anymore and if anyone tells you they know what the law is they are lying.
Congress doesn't even read the bills, Congress doesn't know what the law is and the are the ones charged with making the laws.
If Congress itself doesn't know what the law is, what possible hope does the average citizen have of knowing the laws? The average citizen doesn't have dozens of paid and waiting Philadelphia lawyers on the other end of their speed-dial, like Congress does. It's all out of control.
Obama will have to bring in the Mexican military and Nato troops to quell the violence, or more likely he will tell them to just shoot as many Americans as they can.

Indeed. But it is a sad day when we have to pass a law to remind us to follow the Constitution! If Congress actually performed its duties as mandated, this would all be unnecessary in the first place. Our world is upside down and this is just one more piece of evidence of that.

You know what. It already has. All that is left is the paperwork. This guy has proven himself combat ineffective as President and we are wise to it. You can't take the tapestry of America, walk all over it, use it as toilet paper and then ask America to like you. That tapestry must be handled with the greatest of care and love because the history of the world has shown that a world without that America is a dangerous and terrible place that future generations of human beings, not just Americans, will suffer immeasurable harm without.

That is the beauty of our Constitution (well, one of them, anyway). All our nations mistakes are indelibly recorded there for posterity so that we might later see where we went wrong and correct it.
First, we must all acknowledge and agree that the New Deal WAS a mistake. Until we do that, nothing will ever be fixed. Departing from Constitutional Law and relying on case law was another major pivot point in our decline. That, also, needs to be rectified.
The power needs to be taken back by the States. Our founders believed government power should be held close to the people. State and local government have the power to react to the needs of it's population in a timely fashion, not so with the federal government. Case in point, the gulf spill and cleanup.
How do we take power back from Washington? The solution to that problem has to be the States. State governments have to find the strength to refuse federal funding and reject federal mandates. Very shortly they will have to do so in order to save themselves from the lefty states like California, Illinois, New York, etc.
A good first step is the repeal of the 17th amendment so the U.S. Senators become responsible to the states instead of whatever PAC or Lobby pays the most in bribes. After that we can remove all federal funding of non-government organizations. If you remove the funding the corruption will die. Very few of these lefty activists are motivated by the cause. Most are motivated by public dollars.
OP misses the primary problem. The ONLY arbiter of Federal Power, is the Federal Government itself. Once the Senate became popularly elected, AND once the Federal Government decided that you could not sue the Government itself for not dong its job, then we the people lost control.
Once you have a Congress, and President, working on an agenda, there is no longer anything there to stop it.
Heck, look at the UnConstitutional mandate in Healthcare… its there, everyone knows it, States are trying to sue, but it sure does not seem to be going anywhere…. AND it will ultimatly be decided by a Supreme Court, which is CHOSEN by those same politicians…
We need a Mechanism for our Right to Petition for Redress… but notice there just isn't one? Heck, no one can even seem to get standing to look at the President's Birth Cert! (leaving aside the validity of the question, its a travesty that no one can even ask their Government that question in any meaningfull way).
After November I will be expecting many more bills like this one to pass in Congress. That obama will veto anything that restores sanity to government is a foregone conclusion. But at least we will have him on record acting against the interests of the American People.

Bear in mind that survey was for the federal government as a whole, not just the presidency. The people rightly fear an overreaching Congress, too, especially when there is a president who abets their worst instincts, rather than exercising his veto power to check them.
Also, when the Left complained about a too-powerful executive, they were usually whining about Bush acting within his constitutional powers under Article II. The secret communications surveillance of terrorist calls exposed (criminally) by the NYT was wholly legal under the President's powers as commander-in-chief, since intelligence is a vital military function in war. The Left's complaining wasn't so much about a grasping executive as it was a petty, partisan attempt to weaken a president of the other party.
Getting back to the REINS act, the real problem is that Congress has been too willing to cede portions of its power to technocrats, a bad habit the progressives began and encouraged. This bill sounds like a good start at reversing that trend.

Well put. My fear, however, is that these vermin have infested evey facet of government and society, and it will take more than two elections to clean house. We need to purge the Progressives out of the GOP or we'll still be going down the road to serfdom, just a a slower speed. The destination will still be the same. I understand that it's a drug cartel holding a piece of a national park but they're still armed Mexican nationals. How does this not constitute an invasion by a foreign nation?

Excellent comments. I agree completely. I've always said the only way to defeat the beast of out of control government is to starve it. That is, defund it. The same is true for non-government organizations. If you haven't seen it, planned parenthood, who received 2.6 Billion dollars in federal funding, can't account for hundreds of millions of that money. It's totally outrageous that they receive even one dime in federal funds. But being unable to account for those funds is one more reason they must be defunded.
We don't need this law. More grandstanding by the people we elected to follow our constitution. They don't have the stones to do what they are legally obligated to do to stop this run away govt and BHO so they pass a law they know will never be enforced ( If you can't enforce the constitution already…)

This article misidentifies the problem, which is pretty usual for most people. The problem isn't the power that Obama has, he (and every president) was handed that power by a congress that exceeded it's authority by passing laws to regulate things it has not authority to regulate. If congress doesn't want a strong executive then they should repeal and stop passing laws that allow the executive branch to control things the federal government has no business controlling. Of course that would never happen because it would require congress to give up it's power to pass laws controlling the country. Congress is a legislative branch, it's only function is to pass laws. The executive is the implementor of said laws. Put the blame where it is due.
It all gets back to the same thing; whenever you create some power so that you can control people you oppose you are creating a power that they can use against you as soon as your group gets voted out and their group gets voted in. How about if everyone stops trying to control others? It's the only safe bet.

Also have you noticed over the years that it's FAR EASIER to launch an impeachment proceeding of a president than to expel or even "impeach" or the congressional equivalent a SPEAKER? In my lifetime two presidents have come within a hair's breadth of impeachment….but no speaker, no matter how awful has ever been expelled or even threatened with prosecution. Wow.

Wow. Just listening to Fox and Senator Kyle from Arizona said that Obama told him "that if we secure the borders, then the people will not vote for comprehensive immigration reform" Holding the people hostage!!
The problem with getting rid of Obama is that that doofus Biden is next in line and after him Darth Vader Pelosi. How in the h–l did we get to this point?
