Democrats Make the Case for Jones Act Waiver
by Robert BlueyA congressional hearing on foreign ships in the Gulf of Mexico turned into a full-scale attack on the Obama administration’s response to the crisis — led by the committee’s Democrats.

Thursday’s hearing came as a growing chorus of critics has accused the Obama administration of unwisely turning away international help for the oil spill cleanup and failing to issue a temporary waiver of the protectionist Jones Act. The hearing came as Gov. Bobby Jindal (R-La.) criticized the administration for bureaucratic hurdles.
Witnesses from the Coast Guard and Maritime Administration attempted to rebut the claims, but their assurances fell on deaf ears. (Video of the hearing.)
At one point, Coast Guard and Maritime Transportation Chairman Elijah Cummings (D-Md.) became visibly upset and scolded Rear Adm. Kevin Cook. Moments earlier, the Coast Guard official came under fire from another committee Democrat for not having enough skimming vessels off the coast of Florida.
“I want to make sure we sense the urgency of this moment,” Cummings said. “We have a window of opportunity to save our beaches, save some of our birds, fish and wildlife. And I’m just wondering whether there is that sense of urgency. … When you say something like ‘We’re trying to make arrangements,’ I hate to say it, but that’s not good enough.”
Other Democrats were equally as harsh.
Rep. Laura Richardson (D-Calif.) stopped just shy of accusing the Coast Guard of incompetence. When Cook was unable to answer her questions about the number of skimming vessels available in the United States, she demanded he find out and report back to her.
“How many skimmers do we have? How many are assigned? How many have been offered? When and where? How many have been received and accepted? And how many are available and where? That includes the Coast Guard, private, National Guard and foreign. I mean, you’ve got to know what you have to do something,” Richardson said. “I don’t understand why you don’t have a database to know where your resources are that you can utilize.”
Rep. Corrine Brown (D-Fla.) said it was unacceptable that her state couldn’t utilize foreign vessels for skimming. She held up pictures of skimmers available in Mexico and Norway that could help.
“We are in emergency mode and we need skimmers,” Brown said. “We need the big ones. I understand they’re available in other countries, including Mexico and Norway. What is the process for the state to utilize these vessels from other countries? … We’re talking about protecting Florida’s coast.”
When Brown asserted there were only 30 skimmers working off the coast of Florida, Cook countered there actually 110. “We don’t have enough,” Brown responded. “What is the process for the state to take advantage of skimmers from other countries?”
At one point during the hearing, Democrats were making a more appealing case for waiving the Jones Act than their Republican counterparts. The 1920 law regulates movement on U.S. waters and between ports, restricting where foreign ships are able to dock. With the State Department acknowledging it has received more than 20 aid offers, critics have questioned why the administration simply won’t suspend the law in a time of crisis.
Deputy Maritime Administrator David Matsuda confirmed there has been one Jones Act waiver request for a foreign deck barge to operate within three miles of the U.S. coast. That request was denied because American vessels could perform the same functions. Matsuda defended the administrative waiver process, noting that case-by-case requests are handled within 48 hours.
Of course, the Obama administration could eliminate the bureaucratic delay entirely by simply following the precedent set by the Bush administration, which waived the Jones Act in the aftermath of Hurricanes Katrina and Rita in 2005 to transport oil and gasoline throughout the Gulf region. Homeland Security Secretary Janet Napolitano has the legal authority to suspend the law with Matsuda’s approval.
Matsuda and Cook’s reassurances about the situation in the Gulf left most members unconvinced. Rep. Howard Coble (R-N.C.) pressed the witnesses repeatedly on the Jones Act’s restrictions. Rep. John Mica (R-Fla.) read an e-mail he received from a U.S. vessel operator whose help was turned down. And Rep. Frank LoBodino (R-N.J.) said it was shameful the Customs and Border Patrol failed to show for the hearing.
The underlying message from members of Congress: The administration has failed to utilize all the resources — foreign and domestic — at its disposal. Unfortunately for Obama, the witnesses did little to dissuade them of that opinion.

The fact that they held this hearing and blasted Administration efforts immediately after his speech, and led by Democrats, is comedic. I wonder if they're finally fighting back after being pushed around like children for a year and a half?
I truly don't think that the world is aware of this problem … this oil will soon make it around the East coast and then over time over to Europe…. maybe not tons but some … Why are we blocking this? Why did we give Brazil 2 Billion to do deep water drilling off their coast? WHY?
What in the hell did anyone who voted for Barry expect, he’s a community agitator, college professor, he knows nothing about results. As he let slip the other day, this to him is a “college seminar.” All governors of the states affected by this, “take matters into your own hands,” Barry doesn’t care!

Isn't it funny that the administration is so quick to throw rules and regulations out the window when they're offering jobs in exchange for health care votes or going after BP's money for the $20 billion slush fund, but they become sticklers for rules law and protocall in this situation, or situations like the Arizona law? What a farce this is. I've seen this sort of manipulation from other administrations, but I've never seen one do it so brazenly. This overt scheme to find a means to an end, the end being cap and trade in this case, is indicative of how arrogant and self-assured the liberals have become. They are essentially saying, "We'll do whatever we want, and there's nothing you can do about it."
Obama just can't let a crisis come to an end.
The dems have seen what happens when their counterparts have come up for reelection, relying on Obama's agenda and support – they lose.
They are now looking ahead to November, and the movement to dissociate themselves from this administration is growing.

Quite simply, the Obama administration doesn't want to deal with the problem. They need the photo-ops of oil on beaches and oil covered pelicans to push their leftist agenda.
It is to the point now that even the Dem politicians are beginning to see that the administration is using the spill for political purposes. Obama doesn't give a rat's rear end about the effects of the spill, he wants it to get as bad as possible so he can use it to ram through more of his ill-conceived leftist policies to further cripple this country.
I see the Coast guard is running interference. There are 2 dozen agencies that can stop activity. I suspect the interference stunts will slowly diminish in 60 days. Oilblama needs to engage the finest choreographers from Hollywood to make this look good.

This is typical for the socialist progressives in charge. Why beat up on the Coast Guard. Their command CANNOT make decisions without the explicit approval from Napolitano who in turn gets the approval from Obama.
Since neither has given approval to start cleaning up, it shows one of two things:
1. Ambiguity and allowance of failure in order to point the finger at others and watch them take the heat/fall
2. Total and complete incompetence
I submit these are both happening simultaneously. Where there is this much ambiguity and failure, there is incompetence. I heard Obama say that government can fix all these problems. Even the morons in the media were touting him as their be-all end-all to the de-regulation problems from the Reagan years.

Let's postulate that the cleanup effort actually costs more than $5 billion per year (what BP agreed to pay). Who picks up the tab then? Who pays for the cleanup when this oil actually sinks into the soil along the coast? Then it's a nightmare to fix.

SUMMARY OF WHAT IS HAPPENING
The estimated super high pressure release of oil from under the earth's crust is between 80,000 to 100,000 barrels per day. The flow of oil and toxic gases is bringing up with it… Rocks and sand which causes the flow to create a sandblasting effect on the remaining well head device currently somewhat restricting the flow, as well as the drilled hole itself.
As the well head becomes worn it enlarges the passageway allowing an ever-increasing flow. Even if some device could be placed onto the existing wellhead, it would not be able to shut off the flow, because what remains of the existing wellhead would not be able to contain the pressure.
The well head piping is originally about 2 inches thick. It is now likely to be less than 1 inch thick, and thinning by each passing moment. The oil has now reached the Gulf Stream and is entering the Oceanic current which is at least four times stronger than the current in the Gulf, which will carry it throughout the world within 18 months..
The oil along with the gasses, including benzene and many other toxins, is deleting the oxygen in the water. This is killing all life in the ocean. Along with the oil along the shores, there will be many dead fish, etc. That will have to be gathered and disposed of.
SUMMARY OF EXPECTATIONS
At some point the drilled hole in the earth will enlarge itself beneath the wellhead to weaken the area the wellhead rests upon. The intense pressure will then push the wellhead off the hole allowing a direct unrestricted flow of oil, etc.. The hole will continue to increase in size allowing more and more oil to rise into the Gulf. After several billion barrels of oil have been released, the pressure within the massive cavity five miles beneath the ocean floor will begin to normalize.
This will allow the water, under the intense pressure at 1 mile deep, to be forced into the hole and the cavity where the oil was. The temperature at that depth is near 400 degrees, possibly more. The water will be vaporized and turned into steam, creating an enormous amount of force, lifting the Gulf floor. It is difficult to know how much water will go down to the core and therefore, its not possible to fully calculate the rise of the floor.
The tsunami wave this will create will be anywhere from 20 to 80 feet high, possibly more. Then the floor will fall into the now vacant chamber. This is how nature will seal the hole. Depending on the height of the tsunami, the ocean debris, oil, and existing structures that will be washed away on shore and inland, will leave the area from 50 to 200 miles inland devoid of life. Even if the debris is cleaned up, the contaminants that will be in the ground and water supply will prohibit re-population of these areas for an unknown number of years.

Actually I think what is waking people is the realization that Obama's MMS approved the doomed well design, and approved everything, every step, at every turn.
The early warning — On Feb 10, 2010 the Deepwater Horizon notified MMS they were having well control problems, gas bubbling up the drill stem, according to news reports. It took three trys to get the well under control. That really was the first clue that the well should be shut down.
So while BP is not without the major share of the blame, the overseeing regulators that the people were depending on to enforce their own rules, were as responsible for the disaster as anyone was.

It's actually a very interesting hypothesis. I'm no geologist, but I find it hard to believe that the temperature of the oil deposit is as high as this guy claims it is. Remember, BP is but one of 5 or 6 companies that do this kind of drilling. Not all of them play fast and loose with the law, and not every country cares about the environment as obsessively as we do (being a rich nation we can afford that luxury). Out of thousands of wells in the Gulf alone, this is one disaster in roughly 30 years.
As to why things are being blocked by red tape … well, I've seen various speculations including not wanting the Red state govs to look good, and jinning up the disaster in order to try to use it to piggy back cap and tax.

I'll admit to being of the camp that thinks this spill has been gradually worsening over time. It's the only logical way to explain how every successive estimate of the leak's output is much larger than all previous numbers. I've read from some credible sources that suggest that the deep structure of the well is steadily degrading over time allowing more oil to escape, and that at this point, it's really a race between the relief wells and how fast the substructure is falling apart.
I've read that the pressure of the well itself and the numerous corners BP cut have made the deep structure of the well dangerously unstable. The oil is actually leaking at ever increasingly rates from it which is why each estimate is bigger. Basically, at this point, what no one wants to admit is that this is really a race between the degradation of the deep well structure and the relief wells being drilled. If the deep structure collapses first, they have an open, ansolutely incontrolled and uncontrollable gusher that not even those wells will stop. If the relief wells win, there still is no guarantee that they'll work.
I've even read that should the well collapse, the only possible solution then would be to drop a nuke on it and hope that the nuke would create enough sea floor damage to plug the well. The problem is that such a tactic could also open other numerous cracks to the oil deposit.
I'm in the process of equipping a massive hot air ballon with a blast furnace and supercharged so I can get the hell out of dodge at the drop of a hat. You'll see the logo via Google Earth where it reads, 'Obama Can Kiss My Ass!'

Am I missing an important point somehow? The 1994 law said the feds were supposed to have a boom for containment and then burn the slick in case of a spill. Seems to me, they had no boom and did not burn when they could. Why is this not an issue? Someone should be liable/responsible.answerable for this. It has just been blown over in every discussion I hear. From a legal perspective, should BP sue the U.S. for damages caused by that inaction?

Now I hear he's giving out part of this slush fund to those other oil rig employees who are laid off due to his ill advised moratorium. This is simply a boneheaded move in that the moratorium is a self-inflicted economic wound. Don't get me wrong as I have nothing against the employees, in fact I support them. They should be working and allowed to ply their trade but instead the puppet masters have decided that this BP money goes to everyone. The money should be used to compensate those who are immediately affected by this unfortunate disaster, and to the States who are impacted for the clean-up efforts so they can compensate the contractors.

There are only two possible reasons for his blocking skimmer ships,: bad, and ugly.
The bad is that he put the interests of his union bankrollers above all else.

Just to play devil's advocate for a moment: Are we relying on the Obama Administration to oversee security on all these foreign ships so close to our coasts? What if OBL decides to ship us a suitcase nuke disguised as an oil skimmer?
I'm just sayin': it's not out of the realm of possibilities. I'm not real confident that this sock puppet of a POTUS can properly take care of ANY of our country's vital interests. Maybe we should blockade the Gulf and check everyone out before dropping our collective pants and bending over!

Obama's not incompetent — he just hates America.
This is only NOW coming to a head because oblahblah WANTED this to become a crisis. He WANTED to wait until the oil reaches our shores. He WANTED our Gulf economy to tank AND make an environmental statement all at the same time. He WILL use the unsuing catastrophy that HE caused by his INACTION, to attempt to pass "cap and tax". This man is virulently anti-American and is doing all he can to make as many people dependent on the government as possible, before he is thrown out. He should not JUST be thrown out, he should be JAILED for leaving America so compromised on so many fronts.
It's normal for oil to seep out of the ocean floor so why hasn't this happed in the past? Russia had a well blowout run for nearly years but somehow this well will destroy the entire Gulf?
Of course, you didn't explore the option of nuking the well. It's worked 80% of the times that it's been tried.
You know, I have thought the same thing. Some of the RINOs are secretly as ensconced in this agenda as the Dems. No wonder the Repubs consistently poll horribly within their own party. We can see through the RINOS…many of whom are at the top.

I read yesterday about several skimming barges that the Coast Guard is holding in port. They want to check for fire extinguishers and life vests.
