Coast Guard to Protect Ship from Unions, Occupy Movement
by PubliusThe U.S. Coast Guard will escort the first ship coming to the EGT grain terminal at the Port of Longview this month, and the Occupy movement and local labor groups say they are planning to greet the vessel with a massive protest.
EGT officials say they have not scheduled a date for the ship’s arrival. The freighter is expected to haul thousands of tons of grain to Asia, but opposition groups are already marshaling their forces to support the lengthy protest by union dock workers at the grain terminal.
“We just want to swell the population of the city to show there are people behind us,” said Jeff Washburn, president of the Cowlitz Wahkiakum Central Labor Council, which passed a resolution calling for a protest this week.
He added that the labor council plans no attempt to stop the ship, a sentiment echoed in a similar call for protest by leaders of the International Longshore and Warehouse Union.
However, the Occupy movement it taking a more aggressive stance, calling for members nationwide to gather outside Port of Longview gates and thwart efforts to load the ship, said Paul Nipper, an organizer for Occupy Longview. The group shut down the ports coastwide, including Longview, Dec. 8.

Could be they think there will be some trouble…. Pretty bold move using the coast guard to "Protect" against protesting American citizens. This is what would be called a trial balloon…Just for Obama and the admin to see how they could use the military against the populous, when the true uprisings start to happen as we loose more, and more rights along the way. I am not for the OWS, but I think this is a bit of overkill and not the best use of military resources. Aren't there UNION port guards that can do this?

I've said it all along, we will be sorely disappointed in those whom we have thought would protect OUR right to FREEDOM, when the time comes. During peacetime the Coast Guard is under the control of the Secretary of the Treasury. It is a unique service. There are every bit military, in fact the first Medal of Honor at Guadalcannal in 1942 went to a Coast Gardsman.
They are charged with life saving activiites (maritime rescues), the prevention of smuggling (in the old days the smugglers were attempting to avoid tarrifs that were collected through the Treasury Department), oversight of fishing off the coasts of the US, etc. As for ships docked at American ports they are charged with the protection of port and harbor facilites and under the idea of promoting sea commerce the safety of ships and their crews and cargo while in port.
They'll soon be out in full force…

Do you really think that the Coast Guard is there to do anything other test the waters to see if we react to a MILITARY force enforcing law within our borders? I'd love for the Coast Guard to consider any acts agains commercial shipping in US waters acts of piracy, treat them as such, and prosecute with extreme prejudice.

This treads dangerously close to the provisions of the Posse Comitatus Act, and carries a whiff of the various instances of the militia and other forces being used for union busting.
Mind you, I think the Riot Act should have been read out against the OWS idiots months ago, and I do not think those Coast Guardsmen would deliberately violate the intent or spirit of the Constitution and law casually, but until it is, and direct and public authorization and commands given, this is way too close to a line that must not be crossed.

The Coast Guard is doing what's required of it by law since 9-11.The coast Guard boards all foreign shipping as they enter American waters well out to sea.All American flag vessels entering American waters get boarded as well.Smaller shipping can proceed to the dock but they're held in quarinteen until they clear Coast Guard,customs and immigration.
Now the parasitic union scumbags have to have a TWIC card {transportation workers identification Card}issued by the Dept of Homeland Security in order to work on maritime shipping docks.Now if these Occupy squatters get inside these shipping terminals there doing so illegally.That's federal law.

The USCG has not been in Treasury since 1967. Actually the US Coast Guard is in the Department of Homeland Security and has been so since DHS' inception. Prior to that they were in the Department of Transportation and prior to that they were in Treasury. The rest of your post however was fairly accurate..
The Coast Guard does not fall under Posse Comitatus while conducting Law Enforcement operations. Although they are a Military service IAW 14 USC 1 they also have the authority to enforce federal law under 14 USC 2.
14 U.S.C. § 2 authorizes the Coast Guard to enforce federal law. This authority is further defined in 14 U.S.C. § 89, which gives law enforcement powers to all Coast Guard commissioned officers, warrant officers, and petty officers. Unlike the other branches of the United States Armed Forces, which are prevented from acting in a law enforcement capacity by the Posse Comitatus Act and Department of Defense policy, under 18 U.S.C. § 1385 the Coast Guard is exempt from and not subject to the restrictions of the Posse Comitatus Act.
Further law enforcement authority is given by 14 U.S.C. § 143 and 19 U.S.C. § 1401, which empower U.S. Coast Guard active and reserve commissioned officers, warrant officers, and petty officers as federal customs officers. This places them under 19 U.S.C. § 1589a, which grants customs officers general law enforcement authority, including the authority to:
(1) carry a firearm;
(2) execute and serve any order, warrant, subpoena, summons, or other process issued under the authority of the United States;
(3) make an arrest without a warrant for any offense against the United States committed in the officer's presence or for a felony, cognizable under the laws of the United States committed outside the officer's presence if the officer has reasonable grounds to believe that the person to be arrested has committed or is committing a felony; and

The USCG is also law enforcement agency. It falls under a different section of the US Code than the DoD.
Okay, if they are explicitly exempt then they are explicitly exempt.
That leaves the question as to whether breaking up union or OWS protesters falls under federal power.
The scenario you present is too broad to give you an answer. The protesters or unions would have to commit a crime in order for them to be detained. Simply protesting will not get you there. Now if you want to interfere with safe navigation or cause the hazarding of a vessel by your actions you will most definitely find yourself in the detention by a Boarding team.

The ILWU is pissed because they weren't given the job from EGT. The jobs contract went to another union and it's members. The occupiers have no clue. So far, ILWU has been fined for their interference to the tune of $250,000. EGT lived up to the requirements levied upon them by hiring union workers as agreed. The union workers just didn't happen to be the ILWU.

It all depends on whether or not they present a legitimate threat to shipping. In this case, they very well may. We've already seen the destruction that OWS and unions can cause when left unchecked and there's nothing like flexing a little military muscle to get viiolent bullies like our friends on the Left to back down.
I don't think anything will come of this except for a handful of arrests, and I view this as an absolutely appropriate use of the Coast Guard. Personally, the several states should've called in the National Guard at the first sign of violence or crime at OWS rallies.
No government would let a bunch of protestors disrupt their economy. There are 8 million American jobs that depend on the freight that comes through those ports and the president is right to protect it. Against occupy or any other groups who can't win at the ballot box and decide to stage "uprisings".
