One could also argue whether or not the action in Libya is sound policy, but, it is currently, unmistakably, illegal.

In the administration's eyes, congress, the judicial and the constitution are irrelevant. The lawmaking and judicial systems can be replaced by regulatory fiat and "Permission from the UN". Checks and balances have been minimized or outright ignored in many cases. Winners and losers are decided by political donations like never before through tax code and "waivers" from following the law.

I'm glad that congress passed the resolution that this action is an illegal act of war. Are they going to have the cajones to take action against the administration? My guess- no. Why Libya? Why now? What is the strategy? What are the goals? All basic questions that are unanswered. Just more proof the MSM is in the tank for zero as I don't hear these questions being asked. The GOP contenders should unite and ask these questions often and loudly. As for the lack of protest perhaps we conservatives should have some fun. Let's tap our inner children and pretend to be lefties and start the protests. I'm embarrassed for Woods. He knows I know he's a propagandist on this issue. His misuse of the Constitutional Convention, the Federalist Papers, and other quotes here and there is politically expedient. There's nothing scholarly about it.
Of course it is wise politically and from a policy standpoint for a president to consult with Congress or even seek resolutions to support military actions. It also helps prevent Congress from cutting off funding down the road. In certain cases, particularly where military operations involve the very survival of the nation such as WWII, the president would be wise to seek a war declaration that informs the world of our nation's intention to destroy another society. In the few occasions Congress has declared war, most involved WWII. This is what the Framers intended. But it is not and never has been a constitutional requisite to making war. And Woods knows it.

Libya is just Obama's "Wag the Dog" strategy incarnated. If he makes himself look butch (as opposed to the metro-sexual femininity he usually portrays) he figures that will get him foreign policy points for next year. Same thing with going after bin Laden and other terrorist kingpins. If he wasn't on the ropes he would be inviting them over for milk and cookies instead of killing them.

They won't say it, but I think the goal simply is to get Gaddafi. He has billions in gold on hand, fueling a mercenary army. I think if Gaddafi goes, his "following" will crumble and Libya can begin the long journey to normalcy along with all the other countries overthrowing their corrupt leaders. even at tens of millions per month it could be worth it to drop Gaddafi.

Both Levin and Woods are correct in manner of degree because the last time I checked the War Powers Act is still the law of the land and the President is obligated as the Chief Law enforcement Officer compelled to follow it and implement it.
The War Powers Act is a bad law created by the Left to constrain Republican Presidents from active defense of the United States in the time of Communist low level aggression. The fact that a Leftist refuses to conform to their own law is proof of its illegitimacy.

The war on terror should have switched from an offensive action to a defensive action several months in (it's not our business to rebuild these cess pool countries to be thrice better then they origianlly were, with no compensation- even though these countries could have afforded it and more) and we STILL could have gotten Osama when we did. By "them" I assume you mean Congress, and by "to do", I assume you mean with regards to Libya, no? If so, I want our military presence 100% out of that region of the world immediately. We have no business involving ourselves in the civil war of another country. As bad and as tragic as that situation may be, we simply cannot liberate every oppressed country. At the same time, you cannot force freedom on people who aren't ready for it and who aren't willing to work to keep it.
Look, the wisdom in the Declaration of Independence and all of the underlying enlightenment philosophy tells me that humans all around the globe will be best served by liberal democracies. And cultures very different from yours and mine can most certainly form democratic institutions and free markets. And they will. The young people just need to be linked up to the global economy, something that the sclerotic dictators and extremists have fought hard to prevent. And a good first step in accomplishing that in the case of Libya is for Gaddafi to be out of power.
And the fact that I think the American military is uniquely positioned to make positive contributions to such a future would get nothing but scorn at the Huffington Post.
Time to start the impeachment proceedings.

You misunderstand the phrase "liberal democracy." See http://en.wikipedia.org/wiki/Liberalism for clarification. I used the lowercase "liberal" to denote classical liberalism, not "Liberal" in reference to American politics. Our liberal democracy is a resounding success, not a failure on paper. And our success really is a beacon for the rest of the world, and if we support the momentum behind the proliferation of free markets along the way, that's fine by me, so long as we do it carefully and transparently. I don't begrudge anyone who doesn't want to join the military, and I have the utmost respect for those who do volunteer their services.

Just want to say I'm not sure I've cleared up the liberal vs Liberal confusion. My references to "liberal" were shorthand for classical liberalism. But it's not like Congress didn't see this coming. You could tell the moment the President said he was getting involved with Libya that he wasn't planning on ever following the Constitution (which doesn't allow for this kind of military involvement) or the WPA (in which the 60 day limit already passed AFAIK).

Barack H. Obama II, aka Barry Soetoro have no justification whatsoever to have military hostilities with Libya. IMO, Obama is 100% in violation of the "1973 War Powers Act." Moreover, without Congressional authorization to use force, Obama may have, and could be charged with a criminal act by unilaterally attacking Libya.

"This was the sort of split-the-difference address that the president is now famous for — long on Icarus-like soaring phraseology, very short on down-to-earth realities.
The first third of the president’s speech was a good summary of prior (dare we say it?) neoconservative analyses: Middle East autocracies blame Israel and the US, and often manipulate terrorism as a way to divert attention from their own failures to provide freedom and economic security to their people. Evidently, they are unwilling to address their societies’ endemic cultural, economic, and social problems: tribalism, religious intolerance, gender apartheid, statism, authoritarian government, and on and on. Yesterday, that was a neocon fantasy of Wolfowitz, Perle, and Bush; today, it is apparently part of a landmark new diplomacy. And yet, in this comprehensive speech on the Middle East, the word “Islam” was never mentioned.
Then, in the second third of his speech, Obama constructed a false narrative that his modest efforts over the last 27 months on the diplomatic front marked a watershed in the history of American policy. In truth, Obama embraced democratic reform only belatedly (recall his advice not to “meddle” when Iranians protested Iranian theocracy in the streets, or the characterization of the creepy Bashar Assad as a “reformer,” or Joe Biden’s assertion that Mubarak was not a dictator), a fact well known in the Middle East. It is curious that Iraq serves as a success in this new narrative, given Barack Obama’s five-year rhetorical assault on the effort — e.g., his demands to pull out all troops by March 2008 and declare the incipient surge that saved democracy a failure. And given the manifest historical fallacies and inaccuracies in the Cairo speech, was it wise for Obama to reference it as a sort of didactic example?"
