Feds Sue Arizona…But, What About Rhode Island?
by PubliusMichael Graham in today’s Boston Herald:

Anyway, if enforcing immigration law is a bad thing for local cops to do, as Holder claims, why pick on Arizona? If he’s really upset that the same laws he has taken an oath to enforce might actually get (gulp!) enforced, why isn’t he suing Providence instead of Phoenix? They’ve been doing local immigration enforcement for years now.
As The Boston Globe-Democrat reported yesterday, “From Woonsocket to Westerly, the troopers patrolling the nation’s smallest state are reporting all illegal immigrants they encounter, even on routine stops such as speeding, to U.S. Immigration and Customs Enforcement.”
Even liberal Providence, where politicians long opposed any local enforcement efforts, changed its policy in 2008 after the infamous Marco Riz case.
Riz was the illegal immigrant arrested by Providence cops twice while under a federal deportation order but released both times. He was then charged with carjacking a woman in Warwick and raping her in Providence.
Rhode Island cops now routinely contact ICE when they suspect they’ve come across an illegal immigrant. Since 2006, the number of contacts they’ve made to ICE’s Law Enforcement Support Center in Vermont has nearly doubled, the Globe reported. How is this significantly different than Arizona’s proposed law?
Families who fear running into the next Marco Riz might think Rhode Island is onto something. But not Team Obama.

Rhode Island and Arizona are states that are doing the jobs that the Federal gov't won't do.
We, the People, are under attack.
We, the United States of America is under attack.
The individual States, solely and seperately, as well as collectively are under attack.
All under attack from a bloated, behemoth, out of touch, tyrranical Federal Government.
Something has to give, and soon.
We should all pay attention to, and be watchful of the Arch Duke Ferdinand Moment, or Burning of the Reichstag Incident. That will be the tell………….
Who wants to bet the Holder has never even read the Constitution, let alone the Arizona law that he claims that it violates?
Who wants to bet as to whether Holder can even read?
I have to say that I am wondering if they intend to lose?
Win/lose they look like "Heros" to the illegal's who's votes they need desperately in 2012 to even have a chance with the way things are going. Sure they look like incompetent fools for even trying but that ship has already sailed.
If they win then they enrage the American people even further and I don't see the end game here that makes any sense. I suppose it's possible that they think if they force the issue they can get the amnesty thing done as the only "Viable" alternative but I don't see that happening with the way 2010 is shaping up.
Eric Holder can't read this post!
Well, for one, Rhode Island is a Democrat heavy state, so you can't go and aggravate your base. And two, this really has very little to do with law, and has everything to do with politics.
Holder probably already knows he will lose the lawsuit, but Obama needs the lawsuit, and he needs it to be against Arizona since he's already set the world against them with his misleading and lies about the actual wording of the law and forgetting that the federal law already states the same thing.
It's just his doorway into the amnesty legislation he's been planning the whole time, and he's trying to control the narrative, as usual.
Better be careful!
Janet "The Bull" Napitalano will read it to him, and together, they will come after you, with a well written writ……….
Of course the regime would challenge a CONSERVATIVE leaning state rather than a LIBERAL state. It isn't difficult to see how the regime works; They don't even try to conceal their contempt for conservatives anymore, whether it be an individual or a state. Take a look at what they are doing to the gulf coast states. They have unleashed every federal agency on the states' clean-up programs in an attempt to slow down or even stop them from collecting the oil before it hits the shores. AMERICA, WE MUST PUSH THE REGIME OUT OF POWER BY FIRST ROUSTING HIS POSSE IN NOVEMBER AND THEN PUMMELING THE anointed one IN 2012.
"The boarders too big. The gulf's too deep".
I've got a couple more 'toos'.
The democrats are too crooked. The administrations heads are too dense.
I am sure she is already directing the DOD and other government agencies to ban this site as a potential threat to the stability of the Obama regime … and she would be right
Ah, but you don't understand… go read the Filing for the Arizona suit.
Its basic premise is that the President of the US has the discretion to enforce, or NOT enforce Federal Law, and thus Arizona forcing the enforcement of Federal Law, intrudes upon his Powers.
This has more to do with having a President who is not accountable to the Law, States, Constitution, or people, than it is about immigration. He is setting the PRECEDENT that he is not accountable FOR the Law, and is thus ABOVE the law.
This is about an imperial Presidency, not about illegal immigration.
You're right and this trial is going to bring this to the spot light.
Yeah Cowboy Logic is right we better be careful or there will be jack booted thugs knocking our doors down with rams and throwing tear gas and flash bang devices in our houses. This administration doesn't like any opposition.
I know the TSA already backoff of banning sites. http://www.washingtontimes.com/news/2010/jul/6/su...
It's all about division. Obama just can't have Americans looking at each other as JUST AMERICANS. That would defeat his purpose which is to destroy America not unite it. He knows that thinking Americans see through his facade and cannot rely on them to follow him blindly off the cliff of division and destruction. He needs the illegal vote to garnish the plate of his illegal presidency. He needs to be impeached but will get that affirmative action pass all for the sake of keeping the masses in check. Order trumps truth unfortunately.
[...] BigGov: …if enforcing immigration law is a bad thing for local cops to do, as Holder claims, why [...]
Constitution
It's such a big word…. all those consonants and vowels and the like.
yep absolutely….it's been done before….
Off topic: that ex-DOJ attorney will be back on with Megyn Kelly to detail the DOJ plans to influence the next election…this should be interesting….
Picking and choosing what laws to uphold or not uphold… Wow, try that one in your local city picking or choosing which laws to obey or not obey and see how free you remain.
I have a feeling that the SCOTUS is going to make Obama and Holder look foolish. =^)
What about Illinois? They deport Mexicans everyday out of a place in Woodstock Illinois. Oh, Illinois is a Democratic (blue) state. It seems the Democrats don't want Mexicans in their states. But it's racist if its a Republican (red) state.
^This^
Xoros has clearly pointed out their goal by not pursuing the other states that have this law in place.
Well, I hope they can read this and Obama hasn't used the "kill switch" yet.
Two words: Sanctuary City.
When the Feds did not put the reigns on the public announcments of sanctuary city status, they set the stage for the breakdown of the rule of law…
Let's hope you're right.
Isn't there 10 other states following in AZ path? Is BHO going to sue all the states? Holder needs to be fired after the new vid surfaced of that racist animal ranting in South Philly, because its quite simple either you support the Black Panthers or you don't. This admin has clearly demonstrated it is radical and supports the dark side. BHO wants voter intimidation, wants the border unsecured, wants the gulf completely destroyed. No you say? Well his actions are clear indicators instead of securing the border he is suing AZ. We the people are allowing the admin and its lackeys to control the narrative, instead of it being about people breaking the law, thus the title "illegal immigrants" they changed it into "undocumented workers" and a human/civil rights issue.
Take a step back and look at what this radical unexperienced pres is doing to the country. He promised fundamentally transforming the United States of America is more like systematically destroying the United States of America!
Let's take immigration out of this debate and examine the superficial aspects of this lawsuit. We have federal authorities attacking a state law. So much for the "great uniter."
wow……just frikkin wow
That on top of Soros's Secretary of State or SOS project should have EVERYONE'S CRAP DETECTOR BLASTIN LIKE THERE A NUKE HEADED OUR WAY.
Cowboy nailed it…..this is a FULL FRONTAL ASSAULT on the people of the United States of America. And flash point or not………
WHERE THE HELL ARE ALL THE FRIKKIN LAWYERS WHO HAVE SO MUCH FAITH IN OUR SYSTEM OF JUSTICE?
WHERE ARE ALL THE CONSTITUTIONAL SCHOLARS WHO BELIEVE IN THE RULE OF LAW?
WHERE THE HELL ARE THE PATRIOTS IN GOV'T. THE LAW OF AVERAGES SAYS THERE HAVE TO STILL BE SOME PATRIOTS. WHY AREN'T THEY RAISING HOLY HELL?
WHERE THE HELL IS THE CAVALRY????
OH WAIT…… NEVER MIND.
I KNOW WHERE THEY ARE AND THEY DO KNOW WHAT'S GOIN ON.
BELIEVE IT.
Hopefully we won't need proof. But push come to shove, they KNOW who the rotten apples are and they won't be lookin for them on your block.
after Arizona wins, it should sue the fed gov't to pay its legal expenses. Frivolous lawsuit.
No SCOTUS won't do that. obama and holder are already doing a great job of looking foolish and don't need any help.
Last Friday a federal investigation terminated with the arrest of 10 Mexican-born men, seven of whom are associated with a dangerous street gang known as the Sureños. Where did this happen? How about Bozeman, Montana not Phoenix Arizona. Nine of the men are awaiting deportation and the tenth man will face federal charges in Montana of reentering the United States after having been previously deported "multiple times,"
How come the feds are enforcing immigration laws in Montana, but not in Arizona? I'll bet it's because lawbreaker illegals are easier to spot (no racial profiling needed) and there's not that many of them to deal with in the wide open spaces of Montana. Yippee-Ty-Yo, get a long little muchacho.
Virginia is soon to follow with adopting this law. Welcome to the South baby but not if you illegal! Illegal actually means illegal, got it! Can someone explain this to the O-Team.
He can read. He just choses his own interpretations. He has had an agenda since day one and before that. Because our laws ARE so fair, bend SO FAR backward to give the accused the benefit of the doubt, and strive in every wording to protect the innocent….there's just a lot of "play" in the way folks can and do interpret them.
That said…..my money's on the SCOTUS still pissed over Obama's highly public, highly inappropriate finger waggin lecture during the last SOTU address. Believe me Roberts is STILL HOT over that one and one does have to wonder if that has played any role in the fact that OBAMA and Holder have lost every damn case and ruling brought before the court, lolol.
Be careful who you piss off. Paybacks can be hell.
The point isn't the trial, "Coward" Holder and Professor 0 have to know that they have no shot. The idea though is to try and get lucky and get a judge to put a stop to this law before Arizona can begin enforcement. Even if the Fed's suit gets ultimately thrown out by the USSC, if they can get an injunction now they should be good for this year's coming elections.
It's been shown that Arizona, due to its geography, is the easiest entry point for Latin American illegals and the Islamists who blend in with them. Obama wants both these groups in the country and needs them to vote en masse in November as he has hemoraged support from the white voters who wanted to assuage their ancestoral guilt by giving him a chance.
What's that you say? Illegal immigrants can't vote so that can't have anything to do with it? Lest we forget, a third of the 9/11 hijackers were registered voters. The Community Organizer is assuredly aware of this as well. Looks like they got a Clinton appointee to review the suit so they're off to a good start…
Pick on AZ as there are more potential votes their than in RI.
Missouri has stricter laws than 1070, so does California (oops… now about those boycotts…) but like the federal law it is enforced at whim.
Mexico has stricter immigration laws and makes no bones about profiling suspected illegal immigrants. Obama's smarter twin Calderon said so on CNN ( http://www.youtube.com/watch?v=AraSpmCoxcM ).
It's time to impeach this moron before he succeeds in bankrupting America and making the whole country look like the democrat stronghold of Detroit.
This administration reminds me of a toddler driving a bulldozer. Completely out of control and in way over their heads on many levels…..
well sure,
and all that boring legal thingie….courts, briefs, arguments, juries, congressional votes. So much easier to just write it on a post it note and call it law….like Obama did the day congress left for their summer break.
Just appointed someone. Bam. See……saved a ton of time with that one. Constitution be damned. Congress be damned. Ya want somethin done right or at least fast, do it yourself.
Course there is a definite down side to that…..as I expect Obama's gonna discover. Now if he'd been SMART he'd have got himself another Czar…a "court jester" Czar. That way he could have avoided the coming shit storm……… or at least weathered it intact.
This administration has an inexhaustible urge to be on the wrong side of things.
The Feds will lose their case against AZ because they're wrong, and because they're feckless, and they'll have wasted taxpayer money in exchange for yet another drop in approval ratings.
You don't challenge the AZ law because you can't win a case by arguing in essence that a state has no right to protect it's own citizens and businesses. That may seem like a great idea if you're a stellar legal mind like Steadman- I mean, Eric Holder- or if you're a brilliant orator/Nobel Laureate and demigod like His Regal Awesomeness, but in the real world, to people whose brains are not clouded by fairy-tale rainbows and residual tar from bong hits, it's so stupid it's unbelievable.
If the money were to come directly out of team Obama's pockets I'd be with you. But you just know that they'd find a way to squeeze it out of us…
Obama and Holder have already shown their true colors (commie red), they are more interested in supporting Mexican criminals, shielding Black Panther thugs, and aiding Palistinian terrorists than protecting the Americans they have taken an oath to serve!
BARACK OBAMA IS A TRAITOR! KICK ALL THESE ANTI-AMERICAN TRAITORS OF OFFICE!

Obama Giving $400 Million to Palestinians… http://usataxpayer.org/htm/vids.asp?A=11815095
A very apt description…Thanks!
The Constitution becomes a "living document" only when leftists use it for toilet paper.
"This administration has an inexhaustible urge to be on the wrong side of things."
That sums them up rather nicely. I can imagine them when presented with an issue, asking what the founding fathers would do, then doing the exact opposite….
I just got my temperature back down from an article on Tuesday, and now it's right back up.
This article is what has the blood shooting out of my eyes: http://www.azcentral.com/news/articles/2010/06/27...
To summarize, this article documents the family of illegals that flee Arizona and take a hard journey across the country to Pennsylvania (MY STATE) . The freakin' reporter and photographer followed them on their journey. I call it aiding criminals, but of course that is not how the media portrays it. They make it like Arizona is Stalin's Russia, or Hitler's Germany, and they are escaping over the mountains like in the "Sound of Music" or something. So if you think to yourself… Oh that's just the border states problem. WAKE UP!!!
THEY ARE IN THIS COUNTRY ILLEGALLY!!! Is the sky still up? Am I still living in the United States of America?
I forwarded this to my House Rep. in an e-mail. Didn't bother with my Senators… they are part of the problem. (Arlen "Lame Duck" Spector (D), and Robert Casey (D)). Everyone should be getting on their States to pass Arizona like laws.
They don't care if they win or not. Come election time, they can say how they stood up for the Hispanic voters. That's all this is about, 40 million or so Hispanic voters.
People with attack rifles are walking in across our borders daily and all they care about is the vote and continued power. I say it is a failure on this administrations part to "Protect" this country and should be an impeachable offense!
Michelle is too… never mind
Oklahoma does far more than both states, they are ignored, which is a good thing I suppose. Nicest people in the country are in Oklahoma, too. Still don't think I could live there, though.
Foolish isn't enough. What we need here is some deep and meaningful humiliation.
we already are paying for them to sue AZ, its ridiculous.
Counterfeiting is a federal crime, as is kidnapping. If the DOJ is going to be suing Arizona for enforcing federal immigration laws, shouldn't they also be suing all sorts of local and state police agencies for going after kidnappers and counterfeiters?
Also, it is about the Supremacy Clause…they are looking for a precedent that will allow them to negate the 9th and 10th Amendments for all time…So long state's rights…if Arizona can't write state law to support federal law, then how can the states sue over health care? If "federal law & enforcement trumps state law & enforcement," then the states are REQUIRED to go along with anything the feds decide !
So they say …

Off topic breaking news….Chris Adams, former DOJ lawyer… testified DOJ supervisor held a meeting telling 40-50 people to ignore cases in violation of Section 8 of the Motor Voter law….that's the part to prevent dead people from voting and such…… Supv. Fernandez said it would discourage voter turnout ????
Best part….there is a record of the meeting.
Okay, I'm confused…it will "discourage voter turnout" among the dead? Does this mean that they are admitting that "dead people" are their largest constituency ?
It's my state too, and it's getting them to actually enforce the laws is the problem…. We've had too many lame ducks representing us. What needs to happen is a crime against one of these lame ducks committed by an illegal. Something to bring it home for them.
Nothing new about AG Eric Holder's crap…His BS goes back to the days when he was involved with and being mentored by Janet Reno's ruthless killings in Waco, Ruby Ridge, and Elian Gonzales return to Communist Cuba. Once a thief gets away with something big, they're emboldened to try again, and again, such as we're now witnessing with Jokester Holder!
An illegal alien is occupying the white house…
What amuses me is when they WANT to do the wrong thing (close Git'Mo, stop fighting terrorists in Afghanistan), but out of sheer bumbling or maybe a rare bout of re-examination, it doesn't happen.
Of Gitmo, I like to think that they're still trying to appease the Left, but they've really just come to the conclusion that George Bush was right all along. And regarding AfPak, I think Obama just likes to bomb those guys with the drones 'cause it's like "Call of Duty", only super-cooler.
They must've forgotten about the law-abiding, hard-working Hispanic voters who care about the quality of their kids' schools and the safety of their families.
But at least a toddler driving a bulldozer has some entertainment value.
Hell, why don't they sue "sanctuary cities" whose laws actually run contrary to, instead of in parallel with federal law?
Who knew?!!! I love it.
The reason Lord O and his band of thugs are going after AZ is….. Janet "the system worked" who hate sheriff Joe.
Now that Lord O has given her a little power, she will blow her/his chest out and walk cocky ( like a corn cob misplaced. Come Nov. these clowns are out the door. Lets see what Lord O and "the system worked" can do with thier hands tied by the Rep controlled house and senate
It is impossible for their heads to be too dense since it is empty space which by definition has no density component.
Not anymore, they are moving to nearby states with higher Hispanic populations like CA, NM, TX, & CO.
At least the toddler wears a diaper to contain the excrement.
Right, until it starts heading for your house….
I know! It's as if they have absolutely no idea what they're doing. Scratch that, it's EVIDENCE that they have no idea what they're doing
If it works, it works. Who cares about the rest.
The south is worse than Mexico. I'm sure they'll be happy to leave.
Yea, good luck with impeachment. I'm sure it will work out for you.
Rhode Island is a Democrat state, Arizona is Republican. Duh!
you have never been done by a real southerner, souths gonna rise again. We have all the guns and gut, unlike your yankee ass. Have fun padding your puss.
I wonder if Las Vegas is giving odds on which state will be the first to secede. It's bound to happen at some point. There's only so much folks will put up with when it comes to an out-of-control government.
The reasons for the American Revolution are beginning to seem frivolous in comparison to what's going on today.
Very interesting perspective!
You're not confused. It's not just dead people either…..illegals, prisoners, cats, dogs, you name it. Not worth prosecuting, though. Another tidbit: it's been going on at the DOJ since the Bush administration.
Same thing in Colorado. Recently a large drug ring was busted in Denver. The ringleader was Mexican, as were most of those arrested. I can't remember which gang/cartel/species they were a part of.
Also, lots of public land in CO is being used by illegals to grow MJ.
Did someone say that Arizona is a Republican state? Then how did they elect McCain all these years. Maybe I am not a Republican.
Unless you tucked it in the pages of Rules for Radicals, I doubt he has even seen it.
You are so right. That is not a conservative dig.
Here in the lovely and ultra liberal state of La La California, we have a similar law on the books. The mayor of the City of Los Angeles ( La La Land central) is pushing a boycot of the state of Arizona. I wonder if he will also boycot the state of California. Any bets?
He is setting the PRECEDENT that he is not accountable FOR the Law, and is thus ABOVE the law.
That is why he is "The One".
If the administration is really concerned about the constitutionality of anyone other than the federal government "making up their own immigration laws", they should go after all of the "sanctuary cities" in California. These cities are openly stating that they will not honor federal immigration laws.
I can see a law suit coming out this as well. I think they backed up because of the ALCU.
stop looking back,……….
we can't afford it,…..
look forward,….McCain is the failed past.
obama campaigned on fundamentaly transforming America, the walking skidmark won because of other walking skidmarks and now people seem surprised that the greatest enemy to our nation is doing his best to destroy the greatest nation on earth.
"You have never been done by a real southerner." Yea, I don't plan on living out the plot of Deliverance in real life. You have the guns but I have the money and the votes. Have fun with your session. I'll be proud to wave you goodbye.
Can someone explain this to the O-Team.
There is no splaining anyting to these people. They know it all. Just ask them.
So why are they giving the feds their money?
What is really ironic is that RI is where the immigrants first came to the n amer continent from Europe, but now you get arrested by the "we must all get along" democratic party! Insanity!
Humorous cartoon titled "Acting Stupidly" on the Arizona lawsuit at http://drawfortruth.wordpress.com/2010/07/07/acti...
Holden is a black racist……………….period
Gentle Readers,
The unspoken problem is that there are political factions in Mexico which view AZ as Mexican territory. ( They don't claim RI. )
They also view Guatemala as Mexican territory: It is one reason Guatemalan's are treated so poorly in Mexico: some Mexicans consider them to be rebels.
It seems so silly: But the Mexican government has an internal political problem issuing passports to Mexicans wishing to travel to AZ. They will issue Matricular Cards, but not Passports, using the logic that AZ is part of Mexico
to appease some political factions internally.
Gen. Holder is trying to prevent a diplomatic row, but the only real solution is vigorous enforcement and an unqualified demand upon the Mexican Government to accept all internationally recognized borders – including the Guatemalan/Mexican Border.
Kindest Regards,
J Lepant Brighton CO
This ought to get your blood boiling….there is no mention of racial profiling and when asked about those patchwork immigration laws—like sanctuary cities now have— Gibss said UHHH I will have to get back with you on that. I couldn't fine the sanctuary city question, I saw it on Fox, but I am sure it will pop up here before long.
Q Quickly on the DOJ lawsuit, the President has spoken in the past a couple times about his concerns that it might lead to racial profiling, although he didn't use that exact phrase. Is he disappointed that this lawsuit makes no legal arguments in that regard?
MR. GIBBS: No, again, the President, rightly, believes that what has been filed relating to — and he was obviously briefed on this prior to the Department of Justice filing — that the President believes that we filed a strong case based on the fact that you can’t have — and he’s said this and I’ve said this — you can’t have 50 states making a patchwork of immigration decisions. That's not going to work for anybody.
Q Is the omission of that, though, an acknowledgement that that's a weaker legal claim?
MR. GIBBS: I’d point you to DOJ.
The Constitution of the United States – Amendment XI – The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State. "Arizona Wins"
And what about California? California Penal Code 834B is identical to Arizona's law and forbids any sanctuary city ordinances. Please see: "IS SAN FRANCISCO VIOLATING STATE LAW?" here: http://ning.it/bXax4l
[just viewed this on the web]
Obama's Re-Election Promise
The promise of "a chicken in every pot and a car in every garage" can be traced to Hoover's 1928 Presidential campaign.
Well, Obama has twisted these words and is promising that if he is re-elected there will be "a chick in every car and some pot in every garage!"
To see some forbidden views inside King Barack's monarchy, Google "Obama Supports Public Depravity" and also Google "Obama…destined to become a black-slavery avenger."
I am an Arizonan and despise that rag called the Republic. Any liberal slant they can lend to a story will be included. You're right the reporters were aiding the ILLEGAL aliens…but I'm sure the paper supported them in that mockumentary.
