Goldman’s Fall From Grace

John Paulson is an interesting guy: He was one of a handful of hedge-fund managers who bet the mortgage-bond market would decline beginning in late 2006, and made billions from that bet. Here is where the SEC charges get interesting: Goldman allowed Paulson to help create the bond and to put some of the most risky mortgages in the portfolio, or mortgages that were most likely to default and tank the investment.
The SEC’s problem with all of this is not that Paulson went to Goldman to create the bond (Paulson wasn’t charged) or even that Goldman even sold the same instruments to investors, but that Goldman didn’t tell investors of Paulson’s involvement. Remember, because of his short position he had every incentive to pack the bonds with the crummiest mortgages that would later default, which they did.
Goldman’s excuse for all this is that it somehow lost money on the whole sordid affair (not sure how that happened) and that the SEC’s case is completely unfounded in law and fact. It left out, of course, that in 2007 Goldman also shorted the housing market like Paulson, and that contributed to its massive earnings that year, not to mention Blankfein’s paycheck which nearly reached $70 million.
Let’s just say there is no securities law violation here. That a judge that gets this case (presuming Goldman won’t settle, which if it hasn’t probably means the SEC wanted a lot by possibly making investors whole or something along those lines, which means Goldman could end up paying $1 billion) and throws it all out because Goldman deals with sophisticated investors who should know better.
After all, these big pension funds and hedge funds all have the means to have done their due diligence on the mortgages imbedded in the bonds, and they could have seen the risk they presented.
That all may be true, but what this case represents (and it’s a pretty good read for an SEC legal document) is a clear and compelling road map into how a firm that was once considered the gold standard of Wall Street behaves like a two-bit thug when money is on the line.
And if that notion holds with its clients, Goldman Sachs has got bigger problems than a bunch of name-calling journalists.

As Big Government readers know, Paulson is the largest single donor to the Center for Responsible Lending, a leftist advocacy group that is part of a complicated web of non-profits and private investment funds. A leading executive of CRL is now at the Treasury Department, overseeing the proposed “Consumer Financial Protection Agency.” Paulson is becoming Wall Street’s Zelig, who keeps showing up in very interesting places.

It'll only take a generation or so for the damage to our economy to abate. Celebrate the brilliance of our system!!

Applying the Bush standard, anything that happened while obama was in office is obama's fault. Now we know how to assign blame.
More regulation will not necessarily work. Nor will less regulation. For example, if we made the regulation that every financial transaction required 10 Billion pages of forms to make sure it was safe, each one signed by at least three people and 12 witnesses, that will not work.
What we need is the right regulation in the right amount.

It was by no accident that they did the bail out package for the banks as fast as they did because if anyone had a chance to see what was really going on, would never have been allowed to happen. Goldman used it insider position with the Treasury and the Obama admin to not only enrich themselves but to kill their competitors at the same time. Lehman and Bear-Sterns failed through intentional neglect with the admin. With competition gone, Goldman is the only game in town. When it comes to profitability Goldman made a fortune just filling the trades abandoned by their now dead rivals. Goldman did not have to 'risk' anything, just collect the fees on the trades. When you control the whole trading market in debt instruments, just the daily volume of trading makes the few 'basis points' commission HUGE. WITH NO RISK!!!

Thanks for sharing this site. A very good explanation of what really happened. This is a carefully orchestrated plan by Obama & gang to gain support for their worthless reform bill. Sounds like the Sachs attorneys are going to make swiss cheese out of this case. The Obama administration are responsible for proliferating hate and distrust of Wall Street. We've got a fairly good regulatory system, unfortunately the SEC is not particularly full of crack lawyers….but then again they can act as political puppets. But because these folks make millions, they are considered "greedy" and "wreckless" by Obama. While I do recognize there are always some bad seeds in the bunch (which deserve the appropriate repercussions), the majority of Wall Street professionals are smart professionals that have created significant gains for everyday investors. The question we should all be asking is what Obama is going to do about Barney Frank & Dodd's involvement in the demise of Frannie & Freddie? The Goldman Sachs suit is a fraud. GS is embedded in the US Treasury and Central banks.
Robert Rubin and Henry Paulson are both former CEOs of GS, and former Treasury Secretaries. GS got paid by the government 100% of their losses on derivatives. TARP was designed to bailout Robert Rubin's Citibank, the other banks were forced to take money they did not need to hide the fact it was only Citibank that was 100 billion underwater.
While Robert Rubin (former GS-CEO) was Treas. Sec. under Clinton in 1998, he rigged the system to allow investment banks to act like commercial banks and and vice versa, and and allowed them to leverage up to 30X value on derivatives of the FMA loans using mortgaged backed securities.
FMA and FMAC are infested with crooked Clinton and democratic appointees cooking the books like Franklin Raines and Jamie Gorlick.

The suit is a show trial for Obama to act like he's tough on Wall Street. As the NY Federal Bank chair, Giethner was in charge of what was going on in Wall Street at the time and he let it happen.
Geithner not only knew, but was in up to his neck. The $4 trillion financial "reform" bill is designed to protect Wall street with more bailouts in the future. This is what crony capitalism looks like. We're doomed if they pass this.

Goldman Sachs was bailed out in October 2008 by Hank Paulson and the Bush administration. Remember where Hank once worked? That's right, he was CEO of Goldman Sachs.
There have been lots of mistakes made on this bank bailout. But let's not try and rewrite history to make some kind of political point. Your anger is understandable, just misguided.

Fall from grace? I do not think so. B_O is using this as a reason to pass the reform bill that will be submitted for a vote later this month, and as a show of his getting tough on the financial industry. After the bill is passed the SEC will find that GS did nothing wrong and at most some underlings will be blamed and fined. If anyone actually thinks that a system that is controlled by the regime now in power would actually find that those in Congress and surrounding the President are corrupt; they need to take off their rose colored glasses.

To me, that encompasses honesty and accountability, something we haven't had in great abundance since before I can remember. He didn't say anything outrageous. Capital markets need regulation or we would be no better than Somalia. There are no such thing as free markets without rules, and without oversight the rules are useless.

Nothing wrong with being a capitalist as long as you play by the rules. But right now there are no rules which means the systems is ripe for a criminal takeover. The derivatives market must be regulated in this financial reform legislation or we risk another financial meltdown.

When did I say I liked Clinton? It was on Clinton's watch we saw the removal of Glass Steagal, it was on Clinton's watch we got Free Trade, both Free Trade ,and the removal of Glass Steagal, are considered VERY RIGHT WING, and is part of the reason we are in the mess we are in right now!! Clinton is, and has always been a corporatist!!
The system is broken, no one party is going to fix it, it is not in either of their best interest to fix it. Until we remove the Corporatist who are now in control, and have been in control for about 30 + years, we will never see any real change.

America has never been a complete or true democracy, though it has achieved a large number of democratic features. A small group of wealthy people in America has always ruled the nation for its own benefit, not for the welfare of the people.
