Court Dismisses ACORN Suit vs. ‘Pimp’, ‘Hooker’ and Breitbart.com
by PubliusBen Sheffner, at Copyrights and Campaigns Blog, has the breaking story:
A state court in Baltimore has dismissed ACORN’s lawsuit against James O’Keefe, Hannah Giles, and Breitbart.com LLC after the plaintiffs failed to serve the complaint on the defendants within Maryland’s 120-day limit.
28218713-ACORN-v-O-Keefe-Docket
It was with great fanfare that ACORN, along with two recently-fired employees of its Baltimore office, sued last September over thesurreptitious taping of the employees advising O’Keefe and Giles on running a prostitution business out of a house. ACORN’s general counsel, Arthur Schwartz, told the Washington Post at the time that the defendants, young filmmakers O’Keefe and Giles, plus Andrew Breitbart’s Breitbart.com LLC, which disseminated the videos, had committed “clear violations of Maryland law” against audio recording without consent from all parties. But ACORN appears to have lost interest in the case since filing it, confirming my suspicion that it was little more than a press release on pleading paper.
Under Maryland Rule 2-507(b), “An action against any defendant who has not been served or over whom the court has not otherwise acquired jurisdiction is subject to dismissal as to that defendant at the expiration of 120 days from the issuance of original process directed to that defendant.” That’s exactly what the court did March 4, with no apparent notice from the media that covered the filing of the lawsuit. The court’s dismissal was without prejudice, meaning that the plaintiffs could theoretically re-file. But, as I argued shortly after it was filed, the lawsuit has substantive flaws that go well beyond the plaintiffs’ apparent lack of interest in pursuing it.

Bluff and fluff got stuffed.
I think it was more than ACORN losing interest, they realized they had a lot to lose through right of discovery.
Oh goody!
We await a statement from Bertha Lewis…………
Will they reimburse the taxpayers for this debacle? No, they'll get more of our money…outrage!
Because all the documentation produced by Acorn during the suit would have kept BigGovt churning for years to come…..And who at Acorn could hold up under a deposition?
AB was licking his chops, you are right Randy, this was going to open the lid of Pandora's Box for ACORN.
Once the Attorneys explained this to 'Bertha", they knew better then to open this can of worms.
They waited too late on purpose.
It was all a bluff.
No way would they actually take them to court and have more ACORN misdeeds brought up.
"There you go again, Cowboy".
Did anyone see that Judicial Watch stated that Eric Holder’s Justice Dept. will not peruse criminal charges against ACORN employees in this regard.
Let’s see, it’s okay now to show up at a polling place with Billy clubs, and child prostitution is cool…”Hope and Change”…barf!
More like opening a box of weasels…
And at the same time, a judge in NY tries to tell Congress whom they must fund.
Yes.
I read that article earlier today, and couldn't remember where I saw it. i thought it was on Drudge, but now can't find it. i wanted to link it here. Can you find it?
Darn. I wanted a front row seat for this ACORN self destruct. Wisconsin will have to do until other states get moving on ACORN charges and indictments.
Why not try to go after the union thug scum, the SEIU. After all, the SEIU is not a union, its a commie front org. Maybe we need to form our own conservative version. These punks understand only one thing, ha ving it crammed down there throats.
Media Matters, TheBradBlog, Eric Boehlert hardest hit.
Interesting that this comes on the same day Holder decides not to prosecute ACORN.
Although, I do believe that discovery process would have been 'bloody' for a bunch of people.

I LOVE this site!!
I have a feeling that Obama and Eric Holder will find away to file suit against James, Hannah and BG site. As we all know, Obama, his admin, and any group he organizes won't go down without a fight.
I've been getting virus alerts off this website. I'm thinking that the trolls may have infected it
Sounds like ACORN is being put out of business in Ohio.
http://www.washingtonexaminer.com/opinion/blogs/b...
Yeah, right. You are a virus!
or a box of bream hooks…..
Ya think Holder will find a way to file suit against the Obama administration for illegality regarding bribery?
In a major political scandal orchestrated by the Obama Administration, a popular Democratic congressman from Pennsylvania has revealed that the White House tried bribing him to drop out of the upcoming U.S. Senate race.
"Congressman Joe Sestak said in a television news show that the White House offered him a top federal job in an effort to keep him from challenging Senator Arlen Specter in the state’s Democratic primary."

Me too. The last three days.
It's uber-anitvirus that is capable of protecting national secrets on CIA servers installed on a Home PC.
If your antivirus is one that you pay for, then its your own problem. It thinks the twitter feed is a virus script.
Oh yeah, and if you're a lefty fixing to rant about something you have no clue about, please do not type in all caps so that we can read your rant and cut you off at the knees accordingly.
You should not be here.
You and your ilk are supposed to be bombarding talk radio for the next week. Didn't you get the memo? Damn youse people are stoopid.
Call your soopervisor and axe him what da game plan be……………
My concern for Hannah and James is that their address are published, makes it easy for the nut jobs…………
Gee, kinda sounds like the White House warning for government employees to avoid DrudgeReport due to virus dangers. You people are running on empty.
How'd you quess?
doesn't …….. dang it
Yuck. That's a good point. Hopefully those aren't current residences anymore.
Aren't they though?
But they sure are entertaining.
I figured Acorn was just bluffing. Perhaps they thought it would scare people. Guess they thought wrong.
I've got some heavy duty AV software installed 'cause of the nature of the work that I do. DARPA doesn't like people looking in their toybox.
WARNING WARNING – COWBOY LOGIC IS AN ACORN SPY
Me too….
My first thought too!
Yeah that discovery thing is a double edged sword, I imagine they hoped to bluff it out knowing full well they woudl never pull the trigger.
Personally I would counter sue for filing a frivilous law suit that they never intended to pursue and hammer everyone involved for legal fees etc.
You got me!
Busted.
I don't know what's uglier, Bertha Lewis or Bertha Lewis in drag.
I blame China.
What this really means is MORE WORK FOR RETRACTO …
There's a difference?
Finally some good news from our courts!
Thats funny.
I'd say the real Bertha is pretty ugly.
already are…a judge ruled that they can't be denied federal funds…stupid judge….
http://www.foxnews.com/story/0,2933,588802,00.htm...
The people I work for do not have a sense of humor.
I use it all the time thanks…
Yes….A honest statement would be great!
Like THAT is ever going to happen, Cowboy! LOL
Exactly !
And there'd be so much info, coming out during "discovery", that a normal Justice department would also be kept busy for at least a decade!
Yippee!! The bad news is that a court has ruled that ACORN must continue to be funded. What a taxpayer ripoff!!
The country is on the edge of financial meltdown. Acorn scandals at the top of the list? Common, it's not that important.
Rita, please loosen the band on your tinfoil hat………that's not going to happen.
absolutely correct. discovery would have been a picnic.
That IS what Hannah and James should do and they'd win !
How much do you wanna bet that the MSM will completely ignore this ? ;^)
Well at leastThe Parliamentarian today stuck it to obama/pelosi/ and reid! They can't reconcile the house and senate bills, while holding one unsigned.
The senate bill has to be signed first. That won't work with their devious plan. ha ha. It's about time someone slowed this dastardly triumverate down. I can hear them now: "someone has the power to foil our plan?" Uh yes- Its called Parliamentarian Procedure! but Socialists aren't familiar with checks and balances are they?
I'm shopping for one right now..any recommendations?
Randyl2, those were my thoughts exactly when ACORN first said they were suing. I just about jumped out of my chair in excitement. They'd get destroyed with the right of discovery.
I was just on MMFA providing some education and strangely enough, there is nothing mentioned.
Hmmmm, I wonder why that is????
"I did not have sex with that woman…" oh wait…that was another lier making a statement. They all look alike!
I'd check out Avira. Free downloads are available. Their premium stuff is spendy, but worth it.
"A honest statement would be great!" -not to mention a first…
What ACORN? Who's ACORN? I don't know no stinking ACORN? ACORN don't exist no more!
Hurray for the home team. Only fair since Holder dropped charges against the Black Panthers and punished the White guy who was working the case for the DOJ.
BTW, I'd like O'Keefe to undercover the Black Panthers. What are they really about?
.
Financial meltdown is a very huge deal. But it's all about the little things too.
When we get the government back there will be Draconian cuts made like Greece is doing, so we can survive, and ACORN and their minions just got moved to the top of the list. .
.
Even when we win a cause, we lose
In short they got away from stealing the election and placing morons into the whitehouse to steal us blind and sell us out.
This shows crimes pay and not even a slap on the hand
COLUMBUS, Ohio — The community organizing group ACORN has settled a lawsuit by agreeing to give up its Ohio business license and not return under another name.
ACORN was sued by the libertarian 1851 Center for Constitutional Law. The center alleged ACORN's voter registration drives amounted to organized crime because the group turned in fraudulent forms.
ACORN is the Association of Community Organizations for Reform Now. It has until June 1 to surrender its Ohio license. It has ceased state operations but denies wrongdoing.
The 1815 Center says other terms of the settlement are confidential.
ACORN chapters have disbanded in states including New York and California but have resumed operations under new names.
Videos filmed at ACORN offices last year nearly ruined the organization. One showed employees apparently advising a couple posing as a prostitute and her boyfriend to launder her earnings.
We see the virus alert and it is in ALL CAPITAL LETTERS.
StanH
Eric Holder is a waste of space, time and education.
Take deep breaths Liberal………relax……..the truth is not VIRAL!
Randyl2
You mean the WH does not know that Arlen is already Dead Meat?
Oh for sure banner headline at the NY Times,….and…
the lead story on all the networks.
Thanks. Using Zone Alarm Extreme security right now. Looking at Kaspersky and will look at Avira too.
They have been at the top of the list for a while.
Anybody hear what the NJ governor (Crist) is doing….Sending State Jobs to private industry….ha, ha Unions.
Not that important,… you say Johnny,….
I suppose when you isolate this one court ruling,….yah maybe you have a point, but than,….
Remember how we defeated Japan,…. island by island,….and than,……………….. the big one…….November 2010
Someone could still bring a qui tam lawsuit to recover federal funds that were obtained by fraud. Just a thought….
Delighted at the expected results!
We all knew they didn’t want to expose their politically/environmental corrupt schemes. Stop the funding until after the investigations! I volunteered at a real charity where we actually helped people get jobs, off welfare, thus restoring their human dignity. We’ve also gotten ACORN people jobs. Most don’t want to harass business’s – they’d rather be working in one of them. ACORN and other “community social justice” organizations use them as cheap PRN hires for their own nafarious deeds which affects all of us. The boss’ want to elect progressives, they select one, ACORN/SEIU are sent to ensure it happens by any means necessary. The big white fat cat ACORN/SEIU boss’ get their millions and the harassers get a few dollars. Whose using who…? When the UN NGO Wildlifer’s want a business to close. They also hire activist groups like ACORN/SEIU to harass. The business’s who submit to demands, most of them, are eventually put out of business because they can’t maintain the added expense(s). Their green rules are very expensive, such as, certificates/licencing involves a whole new department. They’ve recently upped green certification to twice a year now. When business/ close, towns empty, and the people are herded into urbania. Wildlifer’s buy up the land thus achieving their goal. These entities continue to pressure our farmers, loggers, fishermen…it’s reported in small-town newspapers but not picked up by the msm to my knowledge.
Obama and his Administration are the most corrupt gang ever seen. How is it that Obama, the Community Organizer is not tied at the hip in all of this corruption? It is staggering to see how wide this corruption goes, from the White House through Congress, and right into the media (for the best cover up they can give). When the Republicans gain enough power in Nov we need to demand that they investigate Obama's involvement in all this Treasonous behavoir.
Holder won't investigate anything. He is a complete stooge who is there to conceal all illegal activities by the far left.
OK this is good news so why do I still feel like we got ripped off
[...] neglected to to serve the complaint on the defendants, but did have a hoopla of a good time taking about it on the liberal news shows. [...]
Psst… Your username of "Virus" is a dead giveaway that you're a lying liberal troll. You should think about changing it to something with "patriot" or "American" in it to fool those silly conservatives.
ROFL
BTW – Daily Kos gave my neighbor congenital herpes when he visited the site. And I read somewhere that people who drink too much Obama Kool-aid become irreparably brain-damaged. Which explains SO much…
Great news especially since it was a bogus suit.
"Low hanging fruit", er, "Acorns".
Acorn is a vital part of the criminal infiltration of the US fedgov.
Okay, how would that work? Glow in the dark white guy James O'Keefe, already "tagged" as a racist to these idiots, "infiltrates" the Black Panthers! Dream much?
I thought it was a play on words, like "the REVEREND Al Sharpie Sharpton".
tisk-tisk?
Rats.
And by that I mean I would have liked to have seen what was disinterred during Discovery…an opportunity lost, I guess.
Could be sarcasm related to the Senate's notice not to look at the Drudge Report.
Some are Quick on the trigger.
Acorn waited to long, because, as the scandal broke, they thought it would just go away…classic head in sand tactics.
What will be even more interesting is watching the remaining footage air in the moths and weeks leading up to the election. Every politician that covered for and fought for the funding of ACORN will have much to answer for.
Premature flagellation……….

Keithy Olbermann will of course cover this in depth.
HAAA!!! Score one for the good guys! (and girl)
That is great for James, Hanna, & Andrew!!!
One battle won, but the war rages on!!
I have Kaspersky and it's pretty good. 3 computer license for like $90.00. I have mine set really tight. It updates all the time, but the tighter you make it, the slower it makes the computer run. That's the only thing I don't like about it. Other than that, It finds a lot more than McAfee that's for sure.
Cowboy… aren't you the guy on the 912ning site that someone gave you some heat for your upside down flag? If we aren't in distress, I don't know what this is.

Great. I dont think it's over yet though, at least in Chicago style politics.
We can walk and chew gum at the same time. Don't worry 'bout us.
Methinks Acorn did not want further inquiry and quietly walked away.
I know.
Thats why it's funny.
ACORN is the festering pimple on the ass-crack of America. Beat it, losers.
I would respectfully disagree.
Lets revist why we are here, and how this came about.
Breitbart launched this site in September, with the release of the first O'Keefe/Giles ACORN video. Five and a half months has now gone by. Breitbart, and this site has been instrumental in raising public awareness, and getting people aroused and passionate on a multitude of topics.
Granted, I would agree with you, that in the scheme of things, facing a multi trillion debacle with the Obongo Administration, ACORN isn't a blip on the radar screen. But look on the other side of that coin.
Why, has this absolute corruption been allowed to continue unabated now for the past 5 1/2 months. If Geroge Bush was in office, the liberals and the DNC would demand his head on a platter.
ACORN is a symbol, of a very sick system. The system is broken. It is sick. ACORN is simply one of the cancers that needs cut out………..
Is that legal and constitutional?
Happy for O'keefe et al. ACORN now has many names in different locations. No doubt this site will keep track of them, expecially since the spicket is open for them agian.
[...] . . . but with a wimper: ACORN in Baltimore lets its lawsuit of Hannah Giles, James O’Keefe, and Breitbart.com quietly die. [...]
I think ASCORNS tenticles lead all the way to the White House. I bet the word filtered over from Rahm – let it go.
You know, I saw an upside down U.S. flag off a highway in France and I almost swung around to tear it down (then decided a French prison didn't sound too good) but with your flag and our current circumstances are totally appropriate.
Vote theft empowers politicians who perpetuate the conditions CAUSING the meltdown
- like Al "Stuart Smalley" Franken.
Think about it.
And Charlie Gibson will help him.
If anyone seriously expected the 'democrat' controlled government to do something about this they must have been delusional. Political corruption "is" what the democrats are, it's what they stand for (when it benefits them) which this clearly does. There is no honor or integrity left in the world any more. This will stand and it will grow.
I use AVG Free edition and Spybot S&D.
Both available free of charge and adds via download.com
Any bets you won't hear about this SCUM dropping the case on any LAME STREAM media outlet? We need to pursue the acorn scum until they are all gone. Kind of like getting rid of cockroaches. You have to get rid of all of them!
I live in WI where several ACORN members are being charged with Voter Fraud. There's hardly no follow up in our Socialist Newspaper, Journal/Setinel News.
Six years ago, the TeenAge kids of Congresswoman Gwen Moore, flattened tires of Republicans who were attending a rally. She always votes for ACORN Support and funding. We have a good candidate running against her, Mr Terrence Wall.
Anyone know about the pending case of O'Keefe in Louisiana – The Telephone Tampering situation?
Does anyone know about the O'Keefe case in Louisiana?
We'll see. I hope it doesn't happen but I won't be surprised if it does.
Legal and constitutional from a NY judge? Did you seriously ask that question?

Hell and we thought ENRON was bad… dam, now it just rampant and we are allowing it to happen….
(snicker)
"Fat chance".
A.G. Eric Holder lets off The Black Panthers that the entire nation observed intimidating voters at the polling place entrance complete with their black billy club weapons… and Eric Holder refuses to indict ACORN for nationwide electioneering and voter fraud nor does he take action on a known and admitted but unprosecuted case of executive embezzelment of 1 to 2 million dollars of ACORN fund money…. which was mostly taxpayer money. HELLO?
so these people think they are so connected that they can let what they think is important to they slip by and that they are so connected that they can just walk in any time and claim they are the ACORNS and they want to continue with the case? amusing. and they almost got away with it. bet Gilibrant in new york would have forced a way for them to come back in…. just amazing what these people get away with being connected to this administration.
Charlie will first have to be reminded of what the whole thing is about. Wasn't it ole Charlie that had no idea of what the ACORN deal was about, or so he claimed?
You passed with flying colors.
These punks got off on a technicality. Now O'Keefe only has to worry about a possible 10-year prison term for allegedly tampering with a senator's phone system.
Rita, trust me……………………..IT WON'T HAPPEN ! Get a grip, President Bush, Cheney, and Rove weren't "frog marched" into some kangaroo court and the left was salivating for that, far more than having James, Hannah, and Andrew prosecuted. Besides which, that isn't "THE CHICAGO WAY".
This site I found has lots of great information on herbal teas and was really insightful. Its really difficult to find good info
The last thing ACORN wants is this case in court. The discovery phase would allow the world to see there books and tons of other documents that would not shed good light on them and would expose them to the world.
