Never in the history of the world has any man been so thankful for a U.S. trade embargo. Here’s hoping the U.S. trade embargo doesn’t extend to the afterlife, because Castro really needs to get what’s coming to him.

Marbury v. Madison establishes judicial review
On this day in 1803, the Supreme Court, led by Chief Justice John Marshall, decides the landmark case of William Marbury versus James Madison, Secretary of State of the United States and confirms the legal principle of judicial review–the ability of the Supreme Court to limit Congressional power by declaring legislation unconstitutional–in the new nation.
The court ruled that the new president, Thomas Jefferson, via his secretary of state, James Madison, was wrong to prevent William Marbury from taking office as justice of the peace for Washington County in the District of Columbia. However, it also ruled that the court had no jurisdiction in the case and could not force Jefferson and Madison to seat Marbury. The Judiciary Act of 1789 gave the Supreme Court jurisdiction, but the Marshall court ruled the Act of 1789 to be an unconstitutional extension of judiciary power into the realm of the executive.

In writing the decision, John Marshall argued that acts of Congress in conflict with the Constitution are not law and therefore are non-binding to the courts, and that the judiciary’s first responsibility is always to uphold the Constitution. If two laws conflict, Marshall wrote, the court bears responsibility for deciding which law applies in any given case. Thus, Marbury never received his job.
Jefferson and Madison objected to Marbury’s appointment and those of all the so-called “midnight judges” appointed by the previous president, John Adams, after Jefferson was elected but mere hours before he took office. To further aggravate the new Democratic-Republican administration, many of these Federalist judges–although Marbury was not one of them–were taking the bench in new courts formed by the Judiciary Act, which the lame-duck Federalist Congress passed on February 13, 1801, less than a month before Jefferson’s inauguration on March 4.

The new Democratic-Republican-controlled Congress easily eliminated most of the midnight judges by repealing the Judiciary Act in 1802. Based on GDP per capita, Cuba has fared much better by bending their "communist" roots and allowing foreign investment "capitalism" in resorts and other businesses. Haiti, for lack of better words, has no clue. How two nations can be located on the same island and have such a large discrepancy in productivity just doesn't make sense. At least the Dominican Republic has some attractions that take advantage of their climate… and they have exported some pretty darned good baseball players.

I got a call from NRSC (national republican senatorial committee) the other day. And I donated. I have donated to different republican committees in the past.
After the call was over, something didn't feel right. So I went and looked at their website ….. nrsc.org. Then I realized, that they support John McCain and Charlie Crist. I feel like I supported the enemy.
There is this mental shift going on inside me. Things have to be different. It wasn't a lot of money, but I should have given it directly to JD Hayworth or Marco Rubio.
So anyway, I am posting here to remind you of the change going on : the republican establishment is not necessarily your friend. I don't support splitting the party or anything, and good incumbents like Jim DeMint need our support. But we have to get the hosehead RINOs out. And I feel like I was taken.

If we were serious about applying pressure to Cuba, we would not have passed the wet foot/dry foot law. We would also not allow money to be wired from the U.S. to Cuba. Once our money leaves us and goes to Cuba, it never comes back as a result of the embargo, therefore, it only aids Cuba by boosting their GDP.

Ok, I'll be honest, I have less problem with Cuban relatives sending money back to family stuck there than I do with the idea of wholesale foreign aid. At least family moneys are targetted to small groups whom we hope do desparately need to cash to help themselves, like a private charity. Wholesale foreign aid only benefits the ones who "distribute" it.

Good question. I look to the example of West Germany / East Germany for some insight. The former East Germans, from what I understand, are still lagging. What was the former communist state is still not on par with the west. It will take at least a generation to purge the effects of the poison that is socialism.

I believe that Castro has been dead since August 2006. For a man, in reality a devil, who couldn’t shut up for 50 years not to have said a word in 3 1/2 years is suspicious. All the Cuban government and media (one and the same) have given us are still photos and op-ed pieces. Though the un-dearly departed has received guests, all of the guests have been fellow travelers. Castro lied to the Cuban people. He denied he was a Marxist. Then he came out and declared the fact. Obama has pretty much done the same thing only his actions have spoken out, not his words. He is not the brave man Castro is.
I grew up in South Florida when Macky Airlines flew people to Cuba just long enough for dinner and and a show. It was our backyard. I also remember wealthy Cubans after the revolution buying houses – perhaps 3 families in one house. They did this in my middle class neighborhood. They could not drive because they were used to chauffers. Were they the spoiled children of wealth. Not at all. They were hard working and strong and started over and thrived again. Cuba lost its most talented people. Castro's loss is our gain. However, with the rise in power and riches of his leftist allies in South America, Castro is more of a danger now than at any other time.

They are so happy and equal, all races are equally poor, except for the well-heeled government satraps. The rest live in divided up mansions in the city, or minimal cinderblock hovels in the country.

I beleive if we are attacked, The enemy would have already declared war on us so their is little need to have the Congress aprove a war as we would be on defence ( WW2 we never declared war on Germany as Hitler declared war on us I would view this the same as I do with Al Queda )..
As far as stagering out the congress, I would just go with 1 week to allow the new member to be sworn in and contested elections could be left until it is decided, it shouldn't matter if we have 100 senators or 75 seated if they are working for US and not their parties.. Theres never an urgent need for congress, remember they have VERY limited powers the states retained the power not granted to congress but courts have seen an end to that since the progressives moved in..

I've been waiting for that justice all these years. After seeing what Carlos and his family went through I have always despised Castro et. al. Now I realize from what you said that there seems to be a quasi-relationahip going on.

I would be all for the Trials of Justice for those monsters. I guess we can only hope that situations will align and a strong President in 2012 will see the value in Liberating Cuba finally. It may be late, but it's never too late. We are here and we remember.

I was born in Cuba and while I am not an expert in geopolitics I listen to those that are (from the left and right) and I have concluded that the future of Cuba is precarious at best.
I believe the U.S. State Dept will take the "realpolitik" approach and make nice with the commies in charge for the sake of "stability" and keep them in charge.
Cuba, much like China, will be allowed to still run you over with a tank when they feel like it, but there will be a Starbucks and McDonalds on every corner.
What should happen with Cuba is what happened to Nazi Germany. Justice.

Extradition of senior party / military members back to Cuba for trial

Our illustrious president limp- wristed his way into allowing the U.S.S.R. to establish a beach-head 90 miles south of Florida and then for he sake of "stability" condemned an entire country to life under a commie police state.
The seat of power hasn't really shifted at all — it simply went to Fidel's brother Raul. Raul Castro is pretty much in the position of a ventriloquist puppet — everything he says or does is dictated by his brother's hand up his ass… and now that I mention it, he'd probably enjoy a good fisting, if the stories in Miami about Raul being a particularly depraved homosexual are true.
