Lawyer: Phone Scheme Meant to Embarrass Senator

NEW ORLEANS (AP) – Four conservative activists accused of trying to tamper with a senator’s phones were just trying to record embarrassing undercover video of her staff ignoring phone calls from constituents angry that she supported health care reform, one of their attorneys said Thurday.
The four, including activist James O’Keefe, known for posing as a pimp and using a hidden camera to target the community-organizing group ACORN, were arrested Monday after targeting Democratic Sen. Mary Landrieu’s office in a New Orleans federal building.
Attorney J. Garrison Jordan denied they were trying to disable or wiretap the phones in Landrieu’s office.
“You’re dealing with kids,” he said. “I don’t think they thought it through that far.”
Instead, Jordan said, they hoped to get embarrassing video footage of Landrieu’s staff handling constituent calls. Her office received complaints last month that callers opposed to her health care stance couldn’t get through.
Landrieu was not impressed with Jordan’s explanation.
“Attorneys are hired to spin for their clients,” she said Thursday in an interview in Washington. “Good luck.”
Protesters marched in front of Landrieu’s office in Baton Rouge in December to criticize her support for Senate health care legislation and complain that they couldn’t get through on her office phones. Landrieu said at the time that her office received a high volume of calls.
“Our lines have been jammed for weeks, and I apologize,” Landrieu said in interview with The Advocate of Baton Rouge in December.
Jordan said his client, Robert Flanagan, the 24-year-old son of a federal prosecutor in Louisiana, did not intend to break the law when he went into the office posing as a telephone worker.
No matter their intentions, the four face the serious charge of entering federal property under false pretenses for the purpose of committing a felony, which carries up to 10 years in prison. They are free on $10,000 bail.
Investigators are aware of Jordan’s explanation, but are pressing ahead to see if that was indeed the men’s motive, a senior federal law enforcement official said Thursday. The official spoke on condition of anonymity because the investigation is ongoing.
Charged along with O’Keefe and Flanagan were Joseph Basel, 24, of Minnesota and Stan Dai, 24, of the Washington, D.C., area. The four are due back in court Feb. 12.
O’Keefe, Basel and Dai stayed with Benjamin Wetmore, a friend of O’Keefe’s, while they were in New Orleans. Wetmore, a 28-year-old law school student, was O’Keefe’s boss when he worked at the Leadership Institute, an Arlington, Va.-based program that trains conservative activists.
Wetmore declined to discuss their stay at his house and what they did while there. But he praised O’Keefe’s work targeting ACORN on his Web site and said he hired O’Keefe in 2006, helping him hone his undercover camera craft.
In an Oct. 16 blog post, Wetmore criticized the Leadership Institute, where he no longer works, for not supporting O’Keefe’s budding activism. Wetmore said he was “nearly fired for buying the initial video equipment that James used.”
O’Keefe last year became famous for his videos about ACORN, the Association of Community Organizers for Reform Now, which has affiliates that register voters in urban and other poor areas of the country. He used a hidden camera to record as he brought a young woman posing as a prostitute to the group’s offices.

In Monday’s incident, authorities said O’Keefe used his cell phone to try to capture video of two of his fellow defendants in Landrieu’s office before their arrest. The two posed as telephone repairmen—wearing fluorescent vests, tool belts and hard hats, one equipped with a hidden camera—and asked to see the phones at Landrieu’s office. The fourth is alleged to have waited outside in a car with a listening device that could pick up transmissions.
O’Keefe has declined to discuss what he and the others were doing in Landrieu’s office. But late Wednesday he told his Twitter followers that the government “concedes no attempt to wiretap.”
Andrew Breitbart, whose biggovernment.com site launched O’Keefe’s ACORN videos and who has since hired O’Keefe as a contributor, also downplayed the federal case.
“Their uniforms were outlandish,” Breitbart said in an interview. “This was like ‘Hee Haw,’ a blatant clown-nose-on spectacle to make a salient political yet mildly humorous point.”
O’Keefe hinted last week that he had a new, high-profile stunt in the works. Four days before he was charged in connection with the Landrieu incident, he promised his audience at a conservative think tank’s luncheon they would be hearing about a project he was working on in New Orleans.
He wouldn’t elaborate, according to people who heard his speech at the Pelican Institute’s event last Thursday in New Orleans.

I don't know if that all makes sense to me. What would be the point of going into that office like that? I sure hope this isn't all there is to it. It's not news that these representatives ignore our calls, everyone knows this.
O’Keefe, most likely would have gotten some great footage if the scheme had been able to play out.
The down side is they got caught and are facing fines and possible jail time.

I don't see the humor in this incident. The best way to loose average Americans is to use tactics outside the law. A better approach is honesty at this point. If everything I've read thus far is accurate, I agree that they didn't think it through, I think that they were truthful in their explanation, but I also agree with Landrieu's being unimpressed.

I believe there's no law against entering a senator's office under false pretenses unless there is an intent to commit a felony. The prosecution will have to prove that O'Keefe went in to the office intending to tamper with the phones. well, in a way they do not represent the people of a state, originaly they were supposed to represent the state, and were appointed by their governor. one state started opening it up to a election, so eventually they all made their senators elected. but i would say she does not represent either her state or her people. but now it does make sense what they were up to, they were probably just trying to show that either they were blocking all calls, and using unlisted lines to call out, so the little peons can just eat cake.

Yes, it is a crime as defined in United States Code: Title 18 Section 1036.
Even if they didn't intend to commit a crime while inside the United States Senator's office, they still face six months in prison and a $250,000 fine for the crime of entering under false pretenses.

He was there videotaping the other two (who would be guilty if that statute was strictly enforced). So where is the statute of conspiracy to videotape someone who's entering under false pretense?

the real truth about Landrieu's phone system is that a lot of people including other legislators from Louisiana have received VOLUMES and VOLUMES of complaints about not being able to get through to ANY of her 4 offices (Shreveport, Baton Rouge, New Orleans and DC). No the other Senator and the Congressmen from Louisiana have not aired this dirty laundry. They are not like the Demoncraps. You're missing the point. Thanks to one of the Liberal trolls around here, we know what the actual wording of the statute is. There is no crime on the books for conspiracy to trespass. The only people who could be in trouble are the ones who wore the costumes and pretended to be from the phone company. They might have violated a misdemeanor statute that says you can't enter a Federal facility under false pretenses, although the language is so vague that it's impossible to know if they actually violated it or not.
The FBI did the right thing in arresting them. They were messing in the office of a Senator, which could go very bad depending on their motives. Now that the rest of the story is out there, all the charges will be dismissed with an apology from the group. If Holder really wanted to look like a maniac, he could try to prosecute the two impostors on a misdemeanor, but he can't touch O'Keefe (unless there is something else that hasn't been disclosed).

I know that reading isn't your forte, but if you look at the law (as posted by one of your fellow trolls), O'Keefe could only be guilty of the felony charge (with the 10 year possible sentence) if he gave a false statement to gain access to the building with the intention of committing a felony. There is no accusation of him lying to anyone (and authorities are now admitting there was no indication of them having the desire to commit a felony), so he's not guilty of anything. Likewise, the one in the car committed no crime whatsoever. The other two could be looking at the misdemeanor charge if the Feds were utterly desperate to prosecute, but if you knew anything about the law, you'd know that no one EVER gets sentenced to the maximum for a first offense on a misdemeanor. Most likely they'd have to apologize to have the charges dismissed with no finding of guilt.

A law enforcement official says the four men arrested for attempting to tamper with the phones in the New Orleans office of Sen. Mary Landrieu (D) were not trying to intercept or wiretap the calls.
Instead, the official says, the men, led by conservative videomaker James O'Keefe, wanted to see how her local office staff would respond if the phones were inoperative. They were apparently motivated, the official says, by criticism that when Sen. Landrieu became a big player in the health care debate, people in Louisiana were having a hard time getting through on the phones to register their views.
That is, the official says, what led the four men to pull this stunt — to see how the local staffers would react if the phones went out. Would the staff just laugh it off, or would they express great concern that local folks couldn't get through?

I am saying that O'keefe and crew would probably NOT have the knowledge to do anything meaningful to Landrieu's phone system; less than 1% of the population can look at a phone network and even differentiate the incoming service from the local network, let alone understand the cross-connects and interfaces. Additionally the phone systems themselves are as different as the many manufacturers – Nortel, Mitel/Inter-tel, Cisco, Lucent/Avaya, NEC, Toshiba, etc., etc., etc., and each utilizes different programming, requiring technicians to have programming manuals for each system on which we work.
And no, I am not suggesting that lines were programmed out of her system. The answer could be, and most likely is, that the volume of calls over-whelmed the number of lines coming into the system. As Citizen K describes, Congressman Cassidy apparently beefed up his phone bank of volunteers to deal with the volume of incoming calls and he probably added additional phone lines into his system, as well.
If there had been widespread complaining about non-responsive apathy in Landrieu's offices, it is not inconceivable that O'Keefe and crew set out to document it. O'Keefe is merely employing a version of the Alynsky method on the Alynsky acolytes – a delicious irony, if ever I saw one.
If the lines were disabled within the system, there should be a log that reflects any reprogramming; but these logs are deleted after so many days, so as not too become too large a file.

I would have become a volunteer for the senator to gain access to the office and then to document. Obama and Democrats are going to fully enforce the law so that these individuals not only serve time but have criminal records to further hinder their future employment. Contrary to what the lame stream media (LSM) portrayed the James O’Keefe/Senator Landrieu story to be, it turns out to be much to do about nothing. Although ill-advised what they were trying to accomplish was to show that Senator Mary Landrieu was not responding to her constituents so they were checking to see if the phones were working. Everyone should know by now that the Democrat/Statists were not responding or listening to their constituents. They could see it from the town halls. Therefore, it was a non-story.
However, it’s ironic the LSM did not really question or investigate the Senator about the 300 million dollar bribe she received for her vote on the healthcare bill or why her constituents were unable to get in contact with her. They also ignored and downplayed the ACORN story. Instead, they thought they had Watergate two and wiretapping. They were dreaming and hoping to take down some big time conservatives with this story and had to retract some of their over zealous reporting…

The LSM likes to be the FIRST to report a story even if they do not have all of the FACTS. I would prefer to have the facts right and not be so concerned with being the FIRST. When the story first broke these questions came to mind, which for the most point have been answered…

What were you doing in Senators Mary Landrieu’s Office? Was there an appointment made, and by whom?
Who was with you? Why were they with you? Were you taping and if so why? Did you seek permission to tape the interview? What were you trying to accomplish?

As stated James O’Keefe was trying to show Senator Landrieu was not responding to phone calls from her constituents. The means he went about it was ill-advised, because O’Keefe has a target on him. Therefore, when he tries to expose corruption and misdeeds his methods must be done way above board.

Win at all costs is the rule of the day on both sides…..hell Mass. just elected a pro-abortion GOP senator and people see that as a victory…..in Texas he would have been asked to leave the party. I am sick of having a choice between Tax and Spend or Tax-cut and spend. If Washington was my home I would get a bulldozer and start over. I now live in a country where corporations even foreign owned have the rights afforded until now by individual American citizens and there are people dumb enough to celebrate that…..wait till a corporation goes after the things they hold near and dear by tipping elections. No matter the motive, O'Keefe is an idiot for crossing the line. The Acorn tape publicity went to his head and he wanted back in the limelight. I cheered him when he exposed Acorn but now must render the boo's for being so dumb.
Perhaps O'Keefe and his buddies will have a greater appreciation of the justice system if they get off with a wrist slap, and maybe they will consider what would have happened to them if their names had been Mohammed, Ali and Salim (oh, it was just an innocent prank!!)–they'd be under the jail and in maximum security.
