In exchange–and yes, that is how it was framed–taxpayers in the other 49 states will forever pay the costs of Medicaid expansion in Nebraska. Oh, and non-profit insurance companies in Nebraska will be exempt from a new tax imposed on insurance companies in the rest of the country.

Apparently this is the way business is done in Washington now. Aren't most ear marks merely bribes by another name? I see no difference in the legality of trading votes for favors whether they be in the name of a state or an individual, whether the source of funds is private or the public purse. These people are so used to breaking the law they forget that others than their peers and a corrupt judiciary are sitting in judgement of them. For some reason they are not taking the electorate seriously. Perhaps that is because they have been assured that the electoral process has become so much under the control of the liberal voting fraud machine that there is no longer any threat of government of and by the people.
This is emblematic of Washington as a whole. A seething gaggle of idiots who have over promised Social Security and Medicare, to the tune of a 55trillion in unfunded mandates. They are in the process of saving themselves, as the baby boomers retire in the millions, and this isn’t the Greatest Generation but the gimme-gimme generation, and they want their stuff, even if they have to sacrifice their children, and the future. We can all watch for immigration reform (amnesty) to return, we can’t have that 16million uninsured, don’t you know. Pay attention America, we have much work to do starting in 2010!
The vast majority of Americans know that this sort of "deal making" is part of Washington, find it immoral and despicable, and question how they get away with it. When citizens make these same sorts of deals, they are often prosecuted, along with those who were bribed. Why are elected officials immune? They no longer even try to hide their corruption, and even boast about it. If some one would take a stand to see that a few of these people are prosecuted for their crimes against the American people, then perhaps the rest would toe the line.
As soon as I heard that Nelson was voting yes, I called Reid's office (couldn't get through to any of Nelson's offices). I told the guy who answered that I wanted to know what my family's liberty was worth to Sen. Nelson. That's exactly how I worded it. The guy's answer: Sen. Nelson wasn't bribed. Funny how that denial was the immediate response. In our current world where reality is the opposite of what the Democrats are saying, Reid's office admitted Nelson was bribed.
Bribed he was, bribed with money that doesn't exist, won't exist for years, and will instead need to be printed by the Treasury. The old lawyer joke about "what do you call 100 dead lawyers laying in the street" could be applied here. This is the kind of tyranny is what started this country. The INNER PARTY in Washington better heed the wishes of their constituents and quite worrying about making history. They don't want to REPEAT this nations EARLY history. They govern by the permission of the governed. DON'T TREAD ON US!
It has come to the point that they do NOT need to hide out right BRIBES anymore… This is sick .. Wait till it goes back to the House.. Do you not think they are going have thier hand out too? Now that anyone can ask for money at the risk of being let go cannot and will not stop them. My house member John Tanner (Blue Dog) is not running again so he for sure will ask for some perks for his state… He has nothing to lose and a PENSION and HEALTHCARE FOR LIFE to boot !!!!

I'm sure that AG Holder is now aware of the above cited statute in the US Code and will initiate an investigation forthwith. Nelson and Landrieu will spend Christmas in DC being interrogated and they will be removed from the Senate and fined/imprisonedremoved from office.

We as the employers have a decision to make. Do we again shrug off our money being used as bribary, completely discarding the Constitution, as unavoidable politics as usual or do we get serious and force DC to behave in a Constitutional manner? We are the employers and the atmosphere they operate within is ours to determine, not theirs to shove down our throats. Let's get serious and remind them and all future office holders of this and sue every one of them that has ignored their oaths of office! Ignoring that oat is breach of contract at minimum. I choose to pursue charges of TREASON though.

There are few things more sacred to a republic than representation. The one man one vote and all it’s citizens are represented equally promise. Why isn’t voter fraud hounded out of existence? Voter fraud is a direct assault on our republic, it can kill a nation. There is nothing more fraudulent than gerrymandering and it’s creation of an artificial majority based on party affiliation not representation to silence the dissention of we the people. It is one of the reason our congress does not listen to we the people. Gerrymander is a creation of the government parties to protect their power and to turn representation into re-election.. The parties can not speak of freedom until districts are based on representation not party affiliation.
Ben Nelson deserves nothing less than to fear for his life from his constituents. We'll have many opportunities to publicly flog him over the next 3 years.
So, all I need to do is make of list of which states get which benefits, who has the sweetest deal, and the next time I move, move there. Thanks guys.

The first property tax stated we only rent our land from the government.. The HC bill states we are only property of the government.. One small step for government one giant leap towards slavery.
you might want to reconsider the logic there MD.. take a look at some of the statistics showing the most socialized areas of our country have the highest crime rates, lowest avg income, most dense populations, highest unemployment, etc… no thanx – I'll continue to reject their 'handouts' and struggle in a region that still values liberty. Being dependent on handouts is not an option for me, especially government 'handouts'. I'd rather be poor and hungry.

Considering that the "rulers" have exempted themselves, their friends and families, and selected others from having to actually live with these new rules it makes me wonder how the apparatchiks (sp) will know how to identify the privileged class. Is there a list, a code word, secret handshake?

And so it goes, despite what the majority of Americans want the democrats continued to push for, and have passed, what they have labeled "health care reform". This should be a clear message to the voters that the democrats do not care a wit about what the American citizens want or need. Instead for the sake of less than 5 percent of the population they are willing to increase costs, premiums and taxes to provide free health insurance (not health care) to a few million people. What's more is they will force everyone to carry insurance regardless whether they want or need it, Finally, despite all of this, of the 12 million or so that are not currently insured, they predict 10 million of them will remain uninsured after it is all said and done.
That does it. I'm boycotting Nebraska as a vacation destination. Like I boycott watermelon at Christmas, but hey, what else can you do?
Just couple of days ago, I ran across a couple of posters who were basically busy spitting on our troops for serving.. This is not new.. One in ten harbor some hatred towards those who serve. Now I feel the number is a lot higher. Yes these posters were in semi lib land, but they only received a -6.. I have received on the same site -20 for pointing out Reagan did amnesty.. Been overseas two weeks, so apologies for my absence. Upon returning I was greeted with the news that our legislators have stopped pretending to be conflicted about consigning the U.S. citizenry to a lifetime healthcare indenture. After looking at the CBO score last night and the text of the Patient Protection and Affordable Care Act, I am left with a feeling of shock and awe. It seems like Ashton Kutcher was hired to write the economic analysis.
Is it coincidence that the amount of ‘deficit reduction’ is virtually the same amount as the expected revenue from the excise tax on premium health plans? The CBO projects a declining revenue stream even from this bit of confiscation in later years. I would suspect that there will be zero revenue from this tax as employers and individuals eliminate these programs to avoid the 40% tax on amounts over the limit. In other words, this revenue assumption smells like bad fish. Anyone suprised? In any case, it is good to be back; even if our constitution was torched in my absence.

barbarian – you're correct in pointing out that the pub party has not fulfilled it's proper role in the 2 party system. neither of the 2 does these days. dems have been hijacked by the most radical 60s survivors and Soros – they are not anything close to the JFK days, which was much more appropriate than this. This bunch is not going to be satisfied if the Constitution has one thread of integrity left. the pubs? – well, most of them don't even understand that the Constitution is important now. I remember recently a federal prosecutor stretching a computer hacking law beyond credulity to punish a woman for the death of a teenager, even though there was no law to cover the action. He just made one fit.
I also remember two Border Patrolmen unjustly prosecuted using a firearms law which was originally designed to target violent criminals who use firearms in the commission of a crime.
When they want to prosecute, they'll find a way. Reid has handed them an open and shut case of influence peddling and bribery. God luck doing anything about it.
There have been plenty of examples in recent memory of elected officials being above the law, but this is a direct, in your face, f*** you to every citizen in the country. There are no defenses to prosecution contained in this statute that exempts congressional deal making as we've seen here. I might argue, this is exactly why this law was written.
The Republicans should take out a full page ad in every major newspaper reprinting 18 USC 201 in its entirety asking the public to decide if it applies and then ask the electorate to pass judgement in the booth in November.

TAX REVOLT!!!!! No taxes paid….no money to spend. Are they going to put all tax evaders in jail? If so, then why are the tax evaders in Washington still walking around? File for extension (just have to estimate what you think you will owe) and send in that amount. I might be able to come up with an amount of $25 that I owe. The extension now goes until October. Washington might have trouble spending what they do not receive. Just a thought.

No, the bill was written behind closed doors, along with the bribe planning by a few. The bribe announcements were public for them to make a statement to the people that "Ha! Looks like one possible opening the opposition to this mess can use once these scum are voted out of office in 2010. Start now promising to repeal the law that prevents inter-state purchase health insurance. All the insurance companies can open an office in Nebraska and presto, you have untaxed full competition in health insurance.
In general, I just don't get this lament that once passed this thing can't be reversed. If the State can think up endless legal loopholes to pass it they can think up ones to reverse it.

My understanding is the general concept of an earmark is a "public" request of a senator for his constituent. Perhaps I am parsing this too tightly, but these bribes are direct inducements from senate leadership. They are top down not bottom up.
I am sure there are constitutional lawyers sharpening their quills for the battles ahead but there seems to be an astounding lack of enforcement or redress of any kind in the judiciary. Lastly I am tired of senators ignoring their oath of office, is this not a binding contract with the American People and as such are we not entitled to take civil action against these individuals for civil damages??

The Republicans who voted "no" did their job – in part. Why are they not screaming "unconstitutional" at the tops of their lungs? They are supposed to represent us! The people do not want this, and it is not legal!
In response to Dana above, I personally know of a person who did not file their taxes for over 15 years. He never got one phone call or threat from the government. Last year he finally filed and got back over $5000…no penalties.
Go figure.

It can be a case for the Supreme Court — after all, since nothing like this gross bill has been passed before, it is an open field, Constitutionally speaking. In a bill of this type, some States getting more than other States may well be a Supreme Court issue.
I agree, in a sane world 2/3 of these clowns would be best tossed out of office at best.
Something has gone terribly wrong with the system, we need to correct it, and we need to punish the people that abused it, in office or not.
If they broke the law, or their oath of office then the very least that needs to happen is that we need to get every cent back that they were paid, damages would be better to bankrupt them.
Personally I would like to see them hung for sedition, but that's probably a pipe dream since the constraints on that are too tight, maybe we should loosen them up a bit to keep the current type out of office.
This forgive and forget stuff is what we always do and the other side never even considers, we need cage fighers that wont quit or give in and that destroys the ideology of the other side whenever possible.

Nelson, Landrieu, Dodd, Lieberman, etal., are all guilty of receiving a bribe and Harry Reid is guilty of offering one. In my state, you would go to jail for doing this. They didn't even use THEIR money! It seems Nelson's abortion issue died a sudden death, once he was bought off. As for Dodd, why is he still in the senate. He is sooo ethically challenged, but then I get it, he's a privileged democrat. Kent Conrad is in the same class. To Landrieu, how many times are the taxpayers going to be required to bail out Louisiana, and watch our tax dollars go to graft and corruption????? I'm so disappointed in Lieberman and Nelson. I didn't think they were in a class as these others are.

This is BLATANT criminal behavior, publicized over every media outlet and endorsed behavior by the President of the United States. Where are the lawyers on this issue? Regardless of any opinion on the health care reform issue, this behavior alone is grounds for dismissal, or impeachment, of any and ALL public officials that received ANY "special" attention and ALL who supported this. If the President was truly acting in good conscience for the American people, this bill would have IMMEDIATELY been scrapped on criminal behavior / immoral grounds alone. I feel like i'm living in the Roman Empire where we pay so the elite can play. 30% to the Empirical State, another 30% to the local gov. Does anyone else see the correlation?
These actions to buy votes are nothing but giving bribes and taking bribes, using OUR tax dollars! Since most pols are lawyers, lawyers are a protected group. Tort reform would have gone a long way to improve healthcare, but it wasn't even considered. Gotta keep those lawyers raking it in, while punishing doctors who are trying to take care of us. Doctors take it in the pocketbook, getting pennies from medicare/medicaid for that care. I'd love to see a private policy, affordable to seniors, with the government out of the picture. Remember, what the government giveth, it can take away and seniors are going to be the first to told to just accept their health situations and be more accepting of death. This is what is in Daschle's book, the very politician who threatened seniors, telling them that republicans would take away their medicare and social security, thus stealing their votes. IF you have an elderly parent, you will be in for a lot of angst and disgust. This healthcare bill will do to the people under 65 what it has done to seniors. You will have no choice but to buy the government plan, you will be forced into it, because insurance plans will no longer offer you coverage. You will be totally controlled.

So the question is can we sue for proffesional malfesence? Consider the fun of discovery. It could be the greatest corruption fishing expedition of all time. Unfortunately I have no lawyers for friends but i am sure there are a few about here. We need a way to air our grievence. Quite frankly the ones in power need to give us a path to air those grievences for their own sakes. The mood of the country is becoming less and less tolerant of these bombastic fools.
I think only the congress and senate can really do this to it's members outside of gross malfeasance (and I mean huge like caught with money in your freezer)
As it stands they won't do it to themselves of course, therefore we need to reform a majority of its members before punishing its abusers.
Catch 22 in way, but I agree with your last sentiment, they have no idea of the whipping they are setting up for themselves if we do put in honest men and women that have to fear of the system.
