ACORN Document Dump: Trashed Documents Are Relevant to Investigation

Well, thanks to San Diego private investigator Derrick Roach, Californians are not laughing at what is turning into a political nightmare for California Attorney General Jerry Brown and ACORN. On Tuesday, November 24, Attorney General Brown appeared on KABC’s “Peter Tilden Show” after it was revealed that some 20,000 documents had been thrown into a National City dumpster by ACORN employees.
The documents were thrown out in advance of state investigators arriving at the local ACORN office to conduct an investigation resulting from national media attention. ACORN employee Juan Carlos Vera was videotaped giving advice to two individuals posing as a pimp and a prostitute regarding underage prostitution and human smuggling. Without admitting any wrongdoing ACORN terminated Mr. Vera, or so they said. Documents provided to BigGovernment.com show that Mr. Vera was not terminated but was simply laid off, implying that Mr. Vera is also eligible for rehire. (The document also notes that Mr. Vera was laid off due to “restructuring” related to “videotaping incident.)
Other documents provided to BigGovernment.com show that in the wake of the national scandal involving underage prostitution and human smuggling, ACORN employees were communicating with media, law enforcement and internally among ACORN offices as to how to develop a storyline that could explain the undercover videos taken of Mr. Vera. One of those documents with San Diego television station 10News is shown below:
As a result of the undercover videos surfacing and the national media attention that followed, internal documents that were thrown in the trash and recovered by Derrick Roach reveal that ACORN was well aware that personal information for individuals who have applied for services and individuals on so-called “yes lists” needed to be secured under lock and key.
Ironically, the only part of this tumultuous episode that may in fact be a joke is that California Attorney General Jerry Brown is running for governor, again. At age 71, California’s top cop and erstwhile Gov. Moonbeam might benefit from a refresher course in current law. Attorney General Brown cited a case from the 1960’s where items placed in the garbage were considered private; however, in 1988 the United States Supreme Court ruled in a case, California v. Greenwood, 486 U.S. 35 (1988), that there was no expectation of privacy when items are thrown in the garbage since it is common knowledge that plastic garbage bags are readily accessible to animals, children, scavengers, snoops, and other members of the public. As for the local National City ordinance prohibiting scavenging through garbage that the ACORN office and its supporters cite, that law was enacted in 1984 and was nullified by the United States Supreme Court ruling just four years later.

I actually thought Gov. Moonbeam had rehabilitated himself as an honest, thoughful liberal independent.

Here was his chance to show the public that he cared about the law and the American political system. So, let me get this straight, when a CEO of a company has an agreed upon amount he/she is supposed to get and it is in their contract that they will receive this amount as a bonus, severence, etc…that is irrelevent because the Obama Gov't wants to punish those evil greedy CEO's. But when ACORN has an agreed amount that they are supposed to get from the Obama Gov't, there is nothing that can be done, even when they are continuing to get caught as the fraud's that they are?

ACORN is a criminal organization and everyone knows it. The problem though is that they got Obama elected by activating black voters, and most of all, was able to pursuade very young white voters to vote for Obama using tactics that were found to be illegal and totally misleading. This, along with a very active NY/Hollywood media supporting Obama, gave ACORN the cover to support their corrupt activities. For this reason, Obama and his cohorts in the Atty Generals office, as well as the national media not covering the story, will protect ACORN from the punisments they deserve.

Without having seen the authority Brown tried to rely on, it is hard to justify any legal opposition to the "dumpster diving." There certainly wouldn't be any Fourth Amendment issue, because there is no state action. Roach, as a private citizen, is not constrained by a limitation on GOVERNMENT conduct. Sounds to me that he's just trying to obfuscate and confuse.

I would assume that for every person who got on the yes list, that person recieved some sort of entitlement.

So our U.S. Attorney General declares that funding for ACORN can continue. Gotta love this administration. They have no shame in promoting their agenda at the expense of the American people and at the expense of our grandchildren and children. I never imagined that our country could become a third world nation, but we are now well on our way thanks to Obamantaion and his corrupt regime.
Just for clarification: The Greenwood decision applies to the government, e.g. the individual has no expectation of privacy in the context of a government investigation. As Derrick Roach is not the government, the Greenwood decision does not have precedential value in this case. Fortunately, California case law and Health and Safety statutes tend to hold that there is no privacy right to one’s trashed possessions.
Just to clarify: The Greenwood decision held that an individual does not have an expectation of privacy regarding trash discovered by the government. Thus, the precedent only holds during a government investigation. As Derrick Roach is not the government, the Greenwood decision is wholly inapplicable here. Fortunately, California case law and the relevant Health and Safety codes seem to hold that an individual has no expectation of privacy regarding thrown-out personal information.
What is so hard to figure out? ACORN is corrupt and misusing tax payer’s money. Pure and simple. Jerry Brown is finished…damn, I hope so.

I once upon a time thought of our President as kind of like, Superman, to protect us from the evils of the "world at large". Since I grew up in the 50's and 60's it was a comforting thought. Now days, I feel like we have been overtaken by the evil that the President was trying to protect us from! I guess what makes me feel comfortable now is the fact that I grew up this way and can distinguish evil when I see it. I am confident that we can defeat this evil and continue to live as the free country our founding fathers created and provided us with the means to do so.

I noted the instructions on what to do around protesters. When ACORN was picketing in front of and inside banks, insisting that housing was a right (especially for those who couldn’t pay for them), did the tellers have a directive telling them what to do?
