ACORN Document Dump: Trashing a Person’s Credit History
by PubliusBanks, businesses and organizations like ACORN who receive individual’s personal financial records are bound by strict federal and state laws to protect that information. The law is chiefly enforced through the Gramm-Leach-Bliley Act of 1999 (GLB), which was a previous attempt by Congress to restructure the financial sector.
While chiefly focused on banks and financial institutions, GLB also covers groups like ACORN who are “non-bank mortgage lenders, loan brokers, some financial or investment advisers, tax preparers, providers of real estate settlement services, and debt collectors.”
We know ACORN provide tax preparation and other financial counseling. We leave to others whether or not ACORN falls under the letter of GLB. They certainly fall under the spirit of what legislators were trying to achieve. At the very least, the were trying to prevent credit reports, for example, from being thrown away in a public dumpster:

Penalties for violating GLB are severe. In addition to possible criminal penalties, including jail time, organizations and institutions can be fined $100,00o for each infraction.
Keep in mind, there were many, many documents similar to the one above dumped in the trash. While we have redacted sensitive personal information, ACORN had not. Add up the hundreds and even thousands of such documents at a penalty of $100,000 each and ACORN ought to be facing very stiff fines. That is, if anyone bothers to investigate.

It would take a legitimate investigation with actual pressure put on whatever low-level scapegoat they name for ACORN to see any punishment. This is wonderful work, but pressure needs to stay on; once Congress is forced to put a serious investigation together, they can lean on the scapegoat. I'm betting that low-level workers aren't nearly as loyal as the top-level embezzlers like Langstein are. Once we get a few of them to come out and say, "This is standard practice," then ACORN can see some real punishment.

GLBA has weak enforcement. Enforcement rests solely with federal government agencies, leaving the individual no private right of action.

Where is the OUTRAGE?
The outrage is that there simply is no outrage.
Granted, there are those of US who are accused of wearing tinfoil tri-cornered hats, people who follow Breitbart and Big Government, a smatttering of folks who are followers of Glenn Beck, Bill O'Reilly and other from talk radio who follow Rush and Savage and a few other forums; but essentially the Liberal Fascist Left has relegated US into the :fringe" category. The true outrage, is that NO ONE in a position of power, has stood up and called not only ACORN, but the DNC and even Barrack Hussein Obama on this great intellectual fraud that THEY collectively have perpetrated upon America.

This is a problem clearly inherited by the Obama administration. Bush did nothing to deal with the prevalence of dumpsters throughout the country.
Speaking as someone who works in the credit card processing industry and is familiar with the regulations regarding the handling and disposal of sensitive personal information-i can tell you with 100% certainty that any BUSINESS that did this would be instantly shut down and would be facing a $10,000 fine PER INCIDENT (which in a class action suit would bankrupt them).
If the laws are enforced-then ACORN is finished and will have to fold and reorganize under a new name.
My question to Democrats is- what do you have to say if this is NOT investigated? Does the Democrat Party really believe that loyalty to your elected leaders trumps the law?

I love seeing all the complaints about the government a majority of voters chose with so much gusto. Now that their eyes are open they understand their ignorance. However, they still can't handle it. Well Folks, Why should the Democrats be concerned with what you think? They have majorities in both houses and the white house. This means that, in their minds, that the majority of the people are Ok with whatever they want to do. They can blow this off and they are comfortable that they WILL BE SUPPORTED AND RE ELECTED. Until they lose some power this is what you will get. Republicvans have their share of criminals too but when you have one party in control they have no checks and balances, very dangerous situation. I'm not sure America can recover from the damage that will happen under Obama. He cleary does not have the judgement to run the country. You can learn facts as you go along. Good judgement is something you have to develop. Obama, Pelosi, and Reid do not have it. (I am stunned that my fellow citizens of Wyoming elected this embarrassment).

This bothers me, a lot. My husband was a victim of identity theft and it's scary, horrific and any other frightening adjective you can think up. It took the effort of many agencies to get everything corrected after the VA and his employer lost his records. It's a nightmare to straighten out and you will be working on it full time for years. The people who have their information found should be informed, because you can be sure this is not the first time this office has done that. Being so cavalier with sensitive, personal information like that is like having your medical records left on a park bench.
What is law when investigation, prosecution, and penalty are all subject to the predjudices of its practitioners?

It really was $4-8 billion. The figure I had heard was $4.2 billion. All they have to do is close up shop and reopen under another name. The Dems need an organization such as Acorn in order to win elections. They've been rigging the vote for years all over the country. The key for them is winning elections for the Attorney General's spot in as many states as possible; someone willing to look the other way as they protest the election results and then manufacture votes to put their candidate over the top. Most recently, the Norm Coleman/Al Franken contested election in MN. Note that the NY23 election was protested by Acorn the day before the election. Coincidentally (or not), there were malfunctions with some of the machines. Acorn was protesting because they wanted a count to see how many votes they needed to put Owens over the top. Owens won due to confusion and some voting machine snafus. Don't know if there were any voting irregularities.
