Thursday Open Thread: Kyoto Edition
by PubliusToday, in 1998, Vice-President Al Gore signed the Kyoto Protocol (yeah, we don’t know where the constitutional authority is for that either):
Especially, since, by a vote of 95-0, the Senate had already rejected the Kyoto Protocols. Still, Al Gore has been able to parlay his work on the issue into a financial windfall.

Kyoto and its evil spawn are nothing more than opportunities for "poor nations" (Read: Those governed by dictatorial decree and charades posing as democracy rather than by accountable democracies) to throw up veiled barriers to trade, get money from productive nations, and ignore all the rules in agreements to which they fecklessly subscribe in signing Kyoto and any other environmental agreement to curb the pollution they create (Read: China and India).

Our Founding Fathers warned us about making treaties…This particular treaty needs some attention if really wasn't approved. I'll have to google it and see what's up.
Before any treaty of this kind can even be considered, the"poor nations" that would benefit need to demonstrate political reform is established and coruption is removed. Then again, we would fail on those terms too…

A few details. Gore "agreed" in Kyoto in December 1997 on behalf of the U.S. to the Kyoto Protocol despite unanimous Senate instruction not to (Art. II Sec. "advice" of "…and consent"). That is a gesture carrying only political meaning.
The signature was delegated to Acting U.S. Ambassador to the United Nations Mission Peter Burleigh, who signed Kyoto on behalf of the U.S. in New York on this date in 1998. That is a gesture carrying legal meaning, if not quite to the level of ratificaton, very close: "international law" says until you communicate (formally) an intention to not become a Party a signatory must not violate the signed pact's object and purpose. U.S. courts already have said we're as good as ratified parties to the Law of the Sea Treaty, though we'll only know for sure when that pact's tribunal tries to exercise jurisdiction over us.
But the U.S. never unsigned Kyoto like it did the International Criminal court. The Bush administration decided not to inflame certain people a second time by actually doing what they already thought we did. Don't ask.
