DeMint Proposes Constitutional Amendment Targeting Career Politicians

Charles Rangel (D-NY) was first elected to the U.S. House of Representatives in 1970.
Sen. Jim DeMint says Washington politicians are like fruit on the vine: the longer they hang around, the more rotten they get.
The South Carolina Republican – hearkening back to the days of the party’s “Contract with America” – on Tuesday offered a fix to the corrupting influence of “permanent politicians,” introducing an amendment to the Constitution that would limit Senate members to three six-year terms and House members to three two-year terms.
“As long as members have the chance to spend their lives in Washington, their interests will always skew toward spending taxpayer dollars to buy off special interests, covering over corruption in the bureaucracy, fundraising, relationship building among lobbyists, and trading favors for pork – in short, amassing their own power,” said Mr. DeMint, who is running for a second term next year.
Senate leaders and longtime Washington watchdogs said Mr. DeMint’s bill had a zero chance of becoming law, mostly because of a general lack of interest and the high hurdles to amending the Constitution.
“It’s a great issue to talk about, but it’s not going to happen,” said Sen. Richard J. Durbin of Illinois, the Democratic majority’s second-highest ranking leader.

Sen. DeMint is tackling a tough issue. He has his work cut out for him. Both sides of the aisle are so self-serving that they will never go for an amendment that would benefit the hard-working taxpayers.
They feel they are royalty. Only way is the voters shove them out the door.
The STATE LEGISLATURES can amend the U.S. Constitution. Two-thirds of the state legislatures ask Congress to call a national convention to propose amendments. Ratification would require 3/4 of the state legislatures to approve the amendment.

I'd love to see it happen but it won't happen anytime soon. There are just too many career politicians in place now as well as aspiring career politicians just starting out. They'd can the proposal before it got any chance of building up some steam. It's up to us to weed these career clowns out of office and soon.
Good luck Sen. DeMint…how about we also get rid of their nice retirement and healthcare. They should be treated as leaving any other employer and not be guaranteed these things for life. I bet that would save the taxpayer some money and bring down our national debt.
I think this is posturing on the part of DeMint. He knows it won't pass in the current congress. But he also knows that more and more people want this and might tend to elect people who pledge to support this kind of reform.
I agree that 2 terms for the senate is better. They also need to repeal the 17th amendment and allow state appointment of senators again. That is how it is supposed to work. The senate represents the states interests and the house represents the peoples interests. When the states interests and peoples interest agree then the laws would pass. Right now we are close to pure democratic rule by the people. The Founders didn't want this. They called it mob rule where 51% of the people could override the rights of the other 49%. That's why they gave us a senate to represent the states, a house to represent the people, and a Declaration of Independence and Constitution that spelled out the inalienable rights that couldn't be taken away by act of the senate or house.
They suck @ the trough too much to let this pass…. Pelosi loves sucking on the American nipple …. she will never release this but hey glad he broguht it up….
When election time comes around we need to ask the peole runnign do they agree or not agree in term limits….
Sounds like a common sense approach. Therefore there is little chance of it becoming law.
We as voters can limit their terms serving in office right now. We are becoming informed and active as never before and need to continue this course while motivating others to do the same as we get closer to elections of 2010 and 2012. I expect that we are about to see an unprecedented amount of incumbents looking for a new job.

I used to be opposed to term limits … I didn't want to see good guys like Ron Paul forced out.
But its clear to me that the damage done by the career politicians is just too great … its worth sending the good guys home too.

I agree James, our founders had good reason for the provisions that were ratified. That also includes the electoral college that has been assailed as long as I can remember, but it is an important provision balancing states and federal rights.

I think it could if it were done at just the right time, it would take an asymetrical assault on a number of levels but 2010 would be the moment that it could happen, people are waking up to the corruption and getting tired of it. A few scandals at the right moment would push it along, and their are always scandals to be had.
General dissatisfcation with the economy could also play a role, it's not hard to tie corruption to the so called stimulous plan, if they refuse to provide details on where the money went in tarp and the stimulous then they have something to hide, if they give an accounting they will have to personally hide, peoples BS detectors are becoming more finely tuned.

Jim DeMint is becoming more visible and vocal about promoting true conservative principles. I like what I hear from him. He might be posturing for a run at the presidency in 2012 or 2016.
My thought's exactly why 18 years for a Senator? That is a lifetime for some of them.
I think it would be even better if you could force all politiicans to live under they same legislation as the force us to live under, that alone would kill 1/2 the bills they propose.
Call it the Leadership Accountabilty Ammendment and frame it so they would have to be against honesty and accountability to vote no, and then never stop reminding people that they were against honest government.
Throw in a few scandals, tie it to the bad economy (not hard to do) and this might be plank #2 after jobs for the 2010 elections, needs to be war gammed out but I think it might actually be doable for the first time in a long while.
Only problem is that DC has been ignoring calls for Constitutional Convention for some time. There's been enough requests from the states several times over. DC just does the blank look every time.

I think the time might be right if the GOP is not completely corrupt, the Dem's of course are corrupt to the core no question about that, but it could be used as political whip against them easily enough if the GOP takes off it's kitchen mittens and is willing to fight it out.

I don't think this is actually true. There has never been a 2/3 call for a convention and some states have actually rescinded their call.
The fear of the convention is that a whole new Constitution will be proposed. Even if that didn't happen do we want Nancy Pelosi and Harry Reid et. al. anywhere near this process?
My only problem with term limits is that it throws the good out with the bad. It won't make a difference without changes in the way congressional gerrymandering is done. The Dems can always find another pig-at-the-trough slug to seamlessly waste our money. To me gerrymandering is the bigger issue.
Not saying you are wrong, but 2010 has the potential to use this issue as a whip against carreer corrupticians if nothing else, the scandals are starting to pile up and can get much worse with a little tactical release, the grass roots woudl have to push it as an agenda though.
I also think you need to tag on an accountability clause that makes them live under the same legislative laws that we live under, like health care etc. not sure about mixing language in an amendent but I am sure it can be done.

I had long considered this topic…
To me, you could do three terms as a Congressional Representative, two terms as a Senator, and two terms as Vice President, then two as President. None have to be served consecutively, but that is all you get, period.
There are no exemptions to any bill the Congress passes and is signed into law. You do health care, you do it for yourself as well as the people. Go sit in a free clinic with miserable sick kids, not at Bethesda with everyone waiting on your every respiration cycle. Sit in the traffic with everyone else, not sped around in your own limo with driver. Want to have a fact-finding mission in Europe during Christmas? Book with your buddies and pay with your own money. Want a raise? Better have done a great job, because you only get raises, voted on by the people, at your next election for office; that is, if you win.
Congress was meant to be where common people passed the laws they would live under in the future, not a good 'ol boy network country club.
And no benefits. Learn to save your money for things, like a pension…

Most on her have good reasoning, I don't know what Demint's end game is, hopefully not just meaningless posturing.
I think jobs and corruption could be two of the hottest issues in 2010, and those two problems will allow a lot of options for getting people that might be wishy washy or even intolerant of change to play ball, as well as pushing other things through that would expose progressive thought for the corrosive ideology that it is.
I think an accountability ammendment that limited terms, made them live under the same rules that we do, eliminated life time perks, and handed out a life sentence for accepting payoff would play well to a whole lot of people on both sides. The jobs thing is number one and a whole other opportunity but it coudl be tied in easily enough with the Tarp and Stimulous fiascos.
It would mean the GOP would have to take the mittens off in this fight, it would also have to be driven by a grass roots campaign to force the issue, and of course be taken up by a media outlet and given air time.
What we need is an amendment to the constitution
We need a national organization to lobby each state government to call on congress to convene a Constitutional convention. Modifications to the Constitution, the document that defines Congressional limits, cannot (in practice) come from Congress itself. You can never expect the police to police themselves, nor the the watcher to watch themselves. It's the responsibility of state legislatures to hold Congress responsible.
Well I didn't mean meaningless posturing. I really believe he wants to get it done, but I think he is trying to set a tone first. As I said, I believe he knows people want it and they will lean more towards candidates that will get it done. Candidates such as those as DeMint's Senate Conservatives Fund is endorsing.
Their term limits expire 2010 or 2012 depending. Either way these clowns are gone!

Great idea, but focus on the House. It would be easier to get through. Three terms is not enough. I would double that. The problem is not twelve years, the problem is thirty.
We could let the senate be the senate, and make the house more immediately representative, as it was intended to be. The house members that are forced out would go on to challenge the senators anyway.

I've been resistent to term limits, because the voting public ALWAYs has a vote and can vote the bast@rds out, but as NY23 shows, they can only vote for whomever is on the ballot.
Right now, between gerrymandered districs, and overreaching control by buffoon's leading the DEM and GOP parties, we often don't truly have a choice.
And NO, Third party is NOT an option. Simpoly look to Merkel in Germany having to ally with the Nazi party in order to form a coalition that would allow her to actually govern.

This is the plan. We write a small bill of rights to bring the progressive era to an end.
#1 Repeal the 16th Amendment. The federal government can no longer issue income taxes. All federal taxes will be limited to consumption taxes.
#2 Repeal the 17th Amendment. States retake control of the Senate.
#3 Amendment to protect marriage as between sexes and only for Humans.
#4 Amendment limiting Congressional terms to 10 years.
#5 Congress will make no law regarding health care of citizens.
We take our new bill of rights to the state legislatures. Ask each state to form a delegation for a constitutional convention authorized to vote for the above 5 Amendments. 3 weeks after enough states have formed delegations
we meet in Dallas to amend the constitution. The hyper-spending federal government will be brought to heal and the Progressive era will be over.
The three ways to fix Congress. First, repeal the 17th Amendment and make the Senate represent the states and state legislatures rather than the people, as was originally intended by the Founders and it would remove a lot of the money from Senate elections, since they'd be elected by state legislatures and wouldn't have to run expensive campaigns to win. Second, remove the limit on Representatives that keeps the number at 435 and restore them to one per every 30,000 people or 10,000 Representatives. While this may sound insane, I believe that it would solve many of the problems with the House (e.g., gerrymandering, safe districts, unresponsiveness to constituents, the difficulty of electing third party candidates, etc.) and that modern technology would make it workable. Yes, it would be hard for a Speaker to pull together 5,000 votes to pass something but that's a good thing. Finally, term limits as described here — three terms in each house or at least three consecutive terms. This would go a long way toward restoring our government to what the Founders intended.

Call me callous if you like and I rather like DeMint's "platforms". BUT… How many times have we heard this style of rhetoric a few years ahead of a presidential bid. Just more talk. When I SEE support from his Congressional associates then I will take notice. In the meantime…just more rhetoric. Any Congressional member can introduce a Constitutional Amendment. It is a very long and arduous effort.

Just imagine we had term limits today. The Blue Dogs are crapping themselves over Health Care "Reform." They know if they vote for it they could possibly get voted out. What would hapen if they were in their last term of the term limits…. they may be more inclined to vote for this POS bill without the fear of any further repurcussions. Just my thought…..
That won't fix anything. Outlaw gerrymandering increase the House of Reps to 10,000 1 congressional district 30,000 as outlined in our constitution. You are right James. If a Constitutional Convention happens, they are not bound to the topic at hand. They can ratify ANY part of the Constitution and the corrupt Congress Critters who have already shown they have no respect for it , would demolish it! As much as we need this, and as unlikely this would pass in Congress through those means, A Const. Conv. would do us much more harm than good (atleast until we can vote in honest representatives who are there as a "service" and don't want to be a lifetime politician).
I feel I must applaud Senator DeMint for his courage in proposing such an amendment to the Constitution, particularly in light of the fact that there is no way a majority of our career politicians will ever vote for something that is detrimental to themselves. This fact does leave one to wonder what Senator DeMint's real objectives are.

I agree! But we, the people, have had this power all along. Just don't vote the bums in! And while we're at it, make sure that they insurance plan they are forcing down our throats is the one they have to purchase too. No more separate health insurance plans for federal employees.

This is one of several I'd like to see but will never happen:
The Brevity Amendment (from Big Hollywood) – No bill shall be longer than the Constitution and it must be hand-written.
The Independence Amendment – if you make 51% or more of your income through your own work then your vote is counted as normal. If you make 51% or more of your income through welfare, entitlements, or handouts then your vote is only worth 1/4 of a standard vote. (or something similar)
Repeal the 17th Amendment – that takes care of term limits for the Senate quite well.
Revise the 14th Amendment so anchor babies only gain their citizenship when they reach 18 years of age and their familes cannot claim them as dependents, and/or clarify it so that 'jurisdiction' specifically means people who were in country paying taxes and following the law.
Fair Tax Amendment – repeal the 16th Amendment, enact the Forbes/Boortz Fair Tax, adjust the IRS so that it can handle the reimbursements to low income families and audit the government for inappropriate use of funds.
I hereby propose the following as the 28th Amendment to the United States Constitution.
1. No citizen of the United States shall be elected to the House of Representatives to more than four (4) consecutive, two (2) year terms to office.
2. No citizen of the United States shall be elected to the United States Senate for more than two (2) consecutive, six (6) year terms of office.
3. No citizen of the United States shall receive any retirement benefits from serving in either the United States House of Representatives or the United States Senate.
4. Congress shall not exempt itself from any laws of the United States of America, in whole or in part.
And let's not forget their healthcare benefits for life once they leave office.

I'm not normally a fan of term limiting most politicians, but I'm all for this one. The greatest effect of this proposal would be to eliminate the senority system that now exists in the Congress. Getting the likes of Dead Ted and Methusalah Byrd out of the cadre of decision-makers would be a tremendous advantage. I can't stand to look at the mental illness on display when House Speaker Crazy Aunt Nasty Rictus Botox talks about things like the CIA not telling her the truth.
Together with term limits there should be a requirement that Congress govern most of the time from offices in the respective state capitols, travelling to DC only for final votes on passage of legislation. The rest of the time the congressional committees would teleconference and use the internet for their meeting. Just think of how they would reduce not only their 'carbon footprint,' but also their access to lobbyists!
I'm in favor of term limitations for Congressional politicians. It's high time. I prefer a limit of 4 terms for 2-year Representatives and 2 terms for 6-years Senators. No career politicians hanging onto Congress for way too long.

Senator DeMint is a lot closer than anyone realizes. The states have already asked for such controls in applications for an Article V Convention. All 50 states have submitted 750 applications for an Article V Convention. The Constitution mandates a convention call if 34 states submit 34 applications. The texts of the applications can be read at http://www.foavc.org. In short, all Senator DeMint has to do is his constitutional duty and he will succeed in his amendment.
We already have term limits its called democracy, say a leader comes along one day who cuts govt. down to size,knows how to grow an economy and makes America respected worldwide, why do we have to give him only a limited time in office?
THINK, THINK for God sake! Don't jump to "Term Limits" because it sounds good. Ask yourself "what can go wrong?" During his last term, knowing he isn't going to be elected, he will only think and vote for what is good for him not the people who put him in office—–he is going to rape the system and make himself rich. Term Limits sound like a good thing but it isn't. The best thing to do is be active in the political process and hold his feet to the fire every time he is up for reelection. If term limits are good enough for the presidency then they should be good enough for the legislature. Looking at thieves like Rangel, Dodd, Frank, Pelosi etc. has to make the majority of Americans sick. They go into the Congress and Senate as mostly middle class and come out filthy rich. How about calling it "Cap And Trade". When an elected official makes their first ill-gottten million while in office they get"Capped" and then get "Traded" for a new one!
How about 2 — 4 year terms maximum for House and Senate and have their elections coincide with the presidential elections…so when we have a really crappy government, we can vote them out all at one time!!! I think that is a great idea!!!

It's a waste of time. We shouldn't plead with the wolves whom are the guarding the chicken coop to stop eating the chickens. We should take our future into our hands. We must impose term limits on Congress without their permission or consent, during the next election. Then they will listen.
