Committee Confirms: Comply With Pelosi-Care Or Go To Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
n response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”
Key excerpts from the JCT letter appear below:
“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

“Criminal penalties
Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:
• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]
When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.
“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.
According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

Don't worry, the Senate has gutted this part of their bill. They even included language to make SURE the tax policy punishments would not apply and lowered the fine to $200. Certainly not a mandate to buy health insurance, maybe a "suggestion" would be more appropriate.

This bill is not even "Constitutional"…. The government can't force this on it's citizens. Where are the Constitutional challenges? Class action lawsuit on changing the Medicare laws, conditions, and procedures. The US Government "stole" monies from me for 34+ years out of my paychecks, in turn to provide healthcare without limits when I turned 65. The Government should be taken to court in a fight for what we paid for.

Don’t start shoving all your poker chips on the “Senate has gutted that part of the bill” square just yet. Consider: the Senate would be unlikely to include such language in its original bill because of a filibuster threat and the difficulty in mustering 60 votes to break it. HOWEVER! If the House bill *does* contain that language, then the two bills (one with, one without) go into Conference Committe, where a simple majority vote is all that is needed to pass a unified bill including the draconian language with no filibuster allowed. It’s a backdoor way of getting it in by pacifying the masses with soothing words of “See! The Senate didn’t include that language in their version of the bill! You little worry-wart, you!” Meanwhile, in Committe, it gets slipped in from the House bill and there’s nothing we can do to stop it.
Except the "treatment" would be End of Life Counseling" untill you submit too voleenterily too end your life. At which time they "harvest" Federal Property (your organs) to sell (tax) to those awaiting transplants. How Barbaric is that?

Ok, let me get this straight. They are going to pass a bill that will lower health insurance premiums. I called my Rep. (Gary Peters) and his office could not tell me what my premium for the government option would be, but did acknowledge that if I didn't pay my premium that their would be a fine that would get rolled into my income tax bill and failure to pay that would fall into the criminal realm for tax evasion.
The office associate could not explain how much the premium would be and said that it wasn't reasonable for him to be able to tell me that now. I asked for an estimate of my premium, he said he didn't know.
When I asked how he knew my premium would be lower even though he didn't know what my premium would be, he didn't have a response.

It's time to peacefully resist, because Pelosi is claiming "essentially unlimited" power over us (in a recent press release) in the same style as England's Declaratory Act of 1766. So let me get this straight. The Democrats won’t deport illegal aliens who get virtually 90% of their healthcare for free at our emergency rooms for the last 30 years BUT they are going throw US citizens in jail and fine them $250K because they won’t pay for Obamacare.
AND BY THE WAY IDIOTS the Democrats will continue to allow illegal aliens to scam our healthcare system and get FREE healthcare via our hospitals but the illegals will NOT be required to pay for anything still. The arugument that illegals are being excluded from the new healthcare plan is a bogus lie. We all know that if illegals are allowed to join the system at any time the Democrats will come in later and make free for them based upon their low income.

I'm fascinated by such comments from those who say or indicate in some way that the jail threat is not enforceable. What I believe you're missing is that the enforcement part of these provisions will fall to the IRS. That agency will simply take away your property, and that is how Pelosi and crowd will gain compliance from most everyone.

A better solution is to take the situation in hand and institute a truly free market solution so the market has a chance to work.

I think it is time for a bureaucrat registry. This registry should contain the same information about any bureaucrat that is published about sex offenders. This information includes Name, date of birth, picture, vehicles owned, physical street address, and offense (or position in government). Doing this will instill the fear of the people into the hearts of any elected or appointed person who makes decisions that affect the lives of others.
Will a bureaucrat make actually put a person in jail for not buying insurance if his or her name is on the registry so that family members or neighbors will be able to look them up? I know it would make me think twice about it if I worked for the government. In fact, I would likely quit my job. The government cannot put people in jail for not having insurance if every cop or solder was afraid or simply refused to do so.

I suggested the bureaucrat registry. I say it should be run much like the sex offender registries, but I think more information should be published than is for sex offenders. I believe that the bureaucrats’ telephone numbers as well as Social “security” numbers should be posted for all to see. While we are at it, any private medical information should be posted as well. In fact any information about a bureaucrat should be posted in the registry. If this happens, maybe they will think twice about messing with peoples’ rights, property, and lives. I would also say that I have more contempt for bureaucrats than I do for sex offenders due to the fact that I have never been harmed or had any of my property or earnings stolen by a sex offender. Seems like a no-brainer to me, you can save a bunch of money by having no health insurance and paying the 2.5% fine every year. If someone gets sick, buy some insurance that month and drop when they are better. According to the chart if your family makes 102K you'd pay $15K for insurance. (we purchase a middle of the road plan for a family of 5 for about $6K now, and one kid has asthma). 2.5% of 102,000 is $2550, leaving almost 12K in medical expenses before it makes sense to have insurance. I don't know what dream world these people live in but an income of 102K isn't enough for a family to be able to afford $1250 on health insurance and that's if you live in a smallish city and don't have a fancy house, go on vacation or have nice cars. You think forclosures are bad now?

Can anyone clarify "section 7203" and "section 7201". I really want read the text in HR 3962, but these sections do not exist in the versions I've downloaded, nor is there mention of the term "prison" in regard to anything other than persons currently in prison. Basically I search the entire bill as passed and could not find reference to this penalty. Can anyone clarify this?

If the majority of the citizens of the United States care about our country, we need a 90% Republican vote in the elections in 2010.
I tore up my AARP card and mailed it back to them when they started saying “All of our members are in favor of . . . ” I told them that since they were a political machine they no longer represented me because they never once asked my opinion but kept stating that I was FOR whatever they wanted to get passed.
It’s time REAL Americans do two things.
Demand that the electoral college be done away with and voting is done electronically (if you can elect your favorite movie on line, why not) and the votes of the people who pay the taxes these people are playing with elect our chosen officers, not some committee of 200 people who only CLAIM to represent the millions of their state.
Demand that all Senators and Congressmen serve two four year terms and get out. If it is good enough for the Commander in Chief (who is too busy making friends of our enemies to get us stabbed in the back) it should be enough for any of them to make their lobbying money and get out.
I believe that honest congressmen will approve of both of these measures. The electoral college is outdated as it was set up when there was no viable way to get everyone to the congress and supposedly it would represent the people. Voting this year was absolutely shaped by the local people in charge to their choice not ours. Call your congressmen and tell them work towards those two goals or “So long! It’s not been good to know you.”
