**UPDATE** NBC News Statement
by PubliusAmericans for Limited Government has chosen to launch an outrageous, reckless attack and smear campaign against an NBC News employee. Faced with irrefutable evidence that our employee did nothing more than ask to be removed from an email mailing list, the organization has maliciously published a fabricated email.
Our employee never sent any such email.. She is completely innocent of the outrageous charges and is being used by an organization to make a self-serving point. This is a shameless, hateful and defaming act which should be roundly denounced.

NBC = epic fail
NBC should sue . I like to see all the emails that she has sent. Maybe this has happen before at NBC and this time it got posted on the interent.
Not for nothing, but the only "evidence" they presented was their assurances over the phone, from what I'm hearing. In that case, NBC never presented "irrefutable" evidence at all. Just a denial.
If it's defaming, as they claim, then they should file the defamation lawsuit and prove it.
They won't do it because they'll be proven to be liars and would be open to counter suits.
Where is CBS, ABC and Univision on this one?

Three scenarios.
1. The email was spoofed and the header information of the email would provide that information
2. The email was legit, but was created by someone who had access to here Blackberry Account
or
3. She did it and now they are making excuses for her.
Without the actual email with the header information, just looking at the posted email is not enough info. Anyone can spoof an email with whatever email address they want (E-mail spoofing is a term used to describe (usually fraudulent) e-mail activity in which the sender address and other parts of the e-mail header are altered to appear as though the e-mail originated from a different source. E-mail spoofing is a technique commonly used for spam e-mail and phishing to hide the origin of an e-mail message. By changing certain properties of the e-mail, such as the From, Return-Path and Reply-To fields (which can be found in the message header), ill-intentioned users can make the e-mail appear to be from someone other than the actual sender. The result is that, although the e-mail appears to come from the address indicated in the From field (found in the e-mail headers) it actually comes from another source.)
They have no evidence. And, I believe that the email from the Blackberry could have gone over NBCs IT servers, but it would have been routed there by the mobile carrier being used. NBCs servers would have been routed a copy of the email (if it was set up to do so), it wouldn't have originated there.

If NBC owns and manages their own blackberry servers, then they have probably already reviewed the logs and tampered with the evidence. If they do not own the blackberry servers and utilize a public one, then records should be intact.
Even if they (NBC) tampered with the logs, they (any Law Enforcement organization with a Computer Crimes Unit) can forensically retrieve all the necessary info they need.
Time stamps will also be very helpful.
If the email was from her blackberry and NBC does not own a blackberry server (managed by their IT Department) then the email would never have traversed the NBC IT infrastructure unless the lady has her outlook or other mail client on her work computer reveiving all her blackberry mail as well. Other than that, if the blackberry servers are not owned and managed by NBC, then NBC would hot have any evidence., unless whe has her BB mail forwarded to her corporate email

Either the original email was fake and NBC can hammer ALG or the original email was real and ALG can hammer NBC for saying that it was faked.

using an open mail server, I could create the exact email and send the exact info to the world. But as an ethical, yes ethical hacker (look it up), i would never do such a thing. If she didn't so this, then the person doing this is not skilled, just a little script kiddy getting his rocks off playing elementary hacker, I mean, Slacker games.

The email header can also be spoofed to a point. But in the end, the email header will give enough info that the email can be found real or fake. The payload of this communication can provide irrefutable evidence for either side. The questions is: Who will win?

The response is interesting, they aren't saying it's a mistake, they aren't saying they will look into it.

You know, this statement doesn't even read like it comes from an even mildly reasonable news organization. Look at all of the excessive and unnecessary adjectives:

It seems to me that NBC is protesting too much.
Set aside for the moment the absurdity that a NEWS producer would want to be off of the mailing list from any organization, this response is not what one would expect from a big media organization. The NBC lawyers must be breaking into a cold sweat. If that denial is wrong, the harsh language would move this into the realm of something that ALG could sue for.
Moreover, as I parse this statement, there is an admission that she did send them an email and no denial that she used the slur.
This looks fishy to me. Maybe President Obama can straighten it out. Let's send it off to Yourintroublenow.gov to see how quickly we can silence, I mean find the truth, in this sticky matter.

What's most fascinating is that James Crowley side-stepped an attack from the President and a Harvard professor – the public granting him the benefit of the doubt in large part because he taught classes on ethics and race. Otherwise, he would have just been another racist cop – an easy target. Obama and Gates failed to look before pulling their cards – and so we had our not-so-teachable-anymore moment at the Beer Summit.
In this case, we have the same situation in play – only this time, Jane Stone teaches ethics to aspiring journalists. I wonder if the public will give her the same benefit of the doubt?

Big difference: What Crowley did was objectively non-racist based on all the evidence in hand. It is only in Gates' fevered mind that there was any bias involved at all.
This email is bigoted and the only question is whether she sent it. When I first saw the story, I figured it was a he said-she said and was willing to give Jane Stone the benefit of the doubt.
After this irresponsible denial, however, I'm more inclined to think that the email was genuine than before.

Somebody is lying here. It seems to me that it should be a relatively easy matter for a third party to determine the truth. NBC has doubled down so the ball is in ALG’s court. This is going to be interesting.

I got an abusive email from the NYT for catching a star reporter in a fabrication, years ago. Not from the fabricator but from some flunky in the “pubic editor” office, or reporter’s representative or whatever they call the insincere hiney-coverer du jour.
Could it a case of fake-but-accurate? Whoops! Sorry, that was CBS. You need to be a highly trained reporter, insulated by layers of fact-checkers, to get this stuff right, and I'm only a guy in my pajamas.

Email resides on third-party servers. Either the email was sent as proposed or it wasn't. This is the sort of evidence that people go to jail over…it is irrefutable.
Let's see the server logs – they should prove NBC to be liars, again…

Just read the counter response from ALG which states 'This email has left a digital footprint that is undeniable.' It sure sounds like they read the headers. The diatribe from NBC sounds like the liberal boss of the lib reporter just sent off the typical kneejerk blowhard reaction without consulting anyone in IT. Some how I missed the "irrefutable evidence"… which means many of NBC's statements are also hyperbolic and many of the things they accuse the other side of being (re: since I doubt they're already sure they are right)….
IT people tend to be libertarians and conservatives. I doubt they'd just go along with it (without any leaks)…
But since the message in question was a reply it tends to point away from it being a spoof.

Just read the Politico story, and they have posted NBC's version of the original email, as sent, they claim. So the issue is that one or the other has been altered. The Politico points out that the only difference aside from the text in question is the length (as in number) of dashes in the signature line. I would suggest that the altered email, in the course of being altered, had some of the initial dashes inadvertently deleted when the original text was being deleted. So we just need to find out which one has the most dashes, and that is the real one.
Politico has only posted a screen shot of the one ALG claims they received, with the "Jew-boy" verbiage. It has 26 dashes/hyphens. I can no longer locate the screen shot of the one that NBC claims is the original – can naybody find it?
If it has less that 26 hyphens then it has been tampered with. If it has more than 26 hyphens then it is real.
I am an iphone guy, not a blackberry user. Is there a set number of hyphens that the BB inserts, or is that just in the user configured signature?
Addendum to the above: I count 26 hyphens in the screen shot of the ALG "Jew-boy" email, and although I cannot locate the screen shot for the one NBC claims is correct, the Politico story reproduces the contents of it – and there are 26 hyphens in that one two, assuming it is a direct text copy and paste.
Odd, since in the Politico story they note that there is a discrepancy between the two, as pertaining to the number of hyphens contained in each.

I would call on ALG to provide the header, but NBC could use that information to corrupt the audit trail. The sender of an e-mail doesn't get the full routing information that the receiver does in the header.
Absolutely correct. It is very easy to retrieve data sent over the internet. Of course that requires a court ordered warrant. While this is a very nasty thing to say, it is not a crime and the legal system will certainly not act to solve a 'pissing contest'. Even if it were a crime, I seriously doubt the political climate in our government would have any interest, desire, or initiative to do anything about it. Now, if it were someone from a conservative group who sent said email, there would be a rush to investigate and punish those involved.
