Free Speech Vindicated
by Paul A. RaheTowards the end of the post on Wednesday in which I attempted an assessment of George W. Bush’s two terms as President, I took Bush to task for betraying his oath of office and signing McCain Feingold — a bill restricting freedom of speech that he rightly regarded as unconstitutional.

“It was,” I wrote,
President Bush’s hope and expectation that the Supreme Court would declare McCain-Feingold unconstitutional. Thanks to Citizens United v. Federal Election Commission, which is now before the Supreme Court, his hopes may — as Bradley A. Smith suggests in the current issue of National Affairs — soon be vindicated. But nothing can excuse Bush’s failure as President to do what he knew to be his constitutional duty and veto the bill.
What I did not know on Monday, when I drafted that post, was that the Supreme Court would issue its decision one day after the anniversary of Barack Obama’s inauguration. I merely argued as follows:
The first and most important of our liberties is political liberty. All of our rights depend upon its being sustained. It is essential that American elections be free and open. That is why we have the First Amendment to the Constitution. It is the most important item in the Bill of Rights. Those who framed this amendment were not concerned with artistic freedom and with freedom of expression; they took moral police and moral censorship at the local level for granted — and rightly so. They stipulated, however, that political speech be free and that the press be free as well, and they did so because they recognized that, in the absence of this freedom, if there was not free and open political debate, we would cease to be a self-governing people.
McCain-Feingold is an attempt on the part of progressives to introduce “rational administration” into the messy realm of politics by empowering an appointed commission of putative experts — in no way accountable to the American people — to decide who can say what, when, and where in the political arena. George W. Bush understood this; he expressed his misgivings; then, he signed on. For this, he cannot be forgiven.
Today I would like to be able to report that the Supreme Court banned the Federal Election Commission and by a unanimous vote reaffirmed the right of all Americans to engage in public debate concerning policies and characters and to spend their money in complete freedom to promote policies and candidates they favor without governmental interference of any kind. This it did not do. But — by a slender majority of five to four — it took a step in this direction; and, speaking for that majority, Justice Anthony M. Kennedy wrote, “If the First Amendment has any force, it prohibits Congress from fining or jailing citizens, or associations of citizens, for simply engaging in political speech.” For this, we should all be thankful.
The fact that the majority was in this decision so slender should, however, be a warning to us all. Political liberty is always and everywhere fragile — and at this point in American history, given the size and scope of the administrative apparatus in Washington, it would not be hard for us to lose it. In the next two electoral cycles, it is vital that we choose a Congress and a President who understand the principles of limited government and American constitutionalism and are firmly committed to them. In 2008, neither of the presidential candidates could have been so described

Bush signed on to a lot of crap he should have vetoed. Having said that, unlike Obama, he actually had to get bi-partisan consideration to get his agenda passed.

The most stunning part of this decision to me was the that there were four hold-outs against freedom of speech. ALL were LIBERALS! Why should we be surprised?! Those of us who value the Constitution aren't surprised at all that the LIBERALS on the court are the ones who are anti-free speech!

This ruling overturns three decades of established case law and is hanging by a 5-4 thread. Expect this to be re-visited when the complexion of the court changes. People die and retire. This ruling became possible when Sandra Day O'Connor retired and will be undone when one of the five conservative justices passes on.
The fact that the Supreme Court decision was only 5-4 when it should have been 9-0 merely reinforces the importance of putting in as many conservative senators in the Senate.

As a true conservative, this SCOTUS decision is not something to celebrate. McCain-Feingold's ban on corporate contributions to the political process in no way restricted the free speech of the citizens. Business and the indivitual are not the same, and should not be treated as such. Does the bill of rights apply to a business? No, it does not. The entire constitution concerns only three entities: the Federal Government, State Governments, and the people. The individual citizen can vote, but not a business, PAC, or other organization. These organizations also should not be allowed to contribute money to campaigns. That is the job of the individual citizen.

Banning organizations is not about the message getting out to voters. It's all about the influence that is created on the candidate who gets elected. When an organization supplies 80% or of the funds for a campaign, or spends the money to air aids against and opponent of that campaign, that organization builds a lot of influence on that candidate. This results in the candidate supporting or proposing legislation that is beneficial to that organization. Avoiding this type of corruption is what those limits are all about.

It's my understanding that it is not the president's duty to weigh the constituionality of legislative bills. I am actually glad he signed it into law so it's constitutionality could be determined in the proper fashion. It's nice to see that the system works every once and a while.

We have to stop judging a policy or position based on who supports or opposes it and which label (Democrat, Republican, Liberal, Conservative) is attached to them. If we are to have any hope in returning this country to the principles on which it was founded, we must educate ourselves as to what those principles are. I encourage you to read John Locke, Adam Smith, and Montesquieu for starters. Once we have a solid understanding of the founding prinicples, we will be able to judge any issue based on those principles, rather than who supports or opposes them.

To this republic there is nothing more sacred than individual freedom, for it was individual freedom an individual sacrifice the sacrifice of blood, body, and life that gave meaning and birth to a nation before a single word on a piece paper was written. Our sacred documents our soaked in the blood of individual sacrifice and thus it is individual freedom that must have priority over the money of business.
Business has no vote and thus no voice.
Business is a creation of government and thus part of government and thus no voice.
Business can not exist with out government, only trade between two individuals can and thus no voice.
Government can not exist without individual sacrifice and thus individual freedom has top priority.
When a business can bleed and die for this country then they should have a voice. Freedom has died today in dramatic fashion. The government parties have officially silenced the voters and declared this republic dead.

I don't believe that Bush started this depression, rather it was the housing policies of the Clinton Administration that created the sub-prime mortgage crisis. Supposedly there was some effort by the Bush administration to make inquiry into Fannie and Freddie, which was stonewalled by the democrats like Bawney Fwank.
So I don't lump this all on Bush ….. however, the massive medicare prescription drug entitlement …. I have had a hard time reconciling that one. And allowing Ted Kennedy to write the education bill …. no child left behind …. *sigh*
But for the record, I have been consistent in favor on Iraq the whole way : I believe it was the right thing to do and the right decision was made (yes, I may be in the minority on this one). Afghanistan was clearly the right thing to do — though something has gone clearly wrong in defining the mission statement now. I believe that he will be on the right side of history with these decisions before all is said and done.

How interesting that Obama would immediately decry a decision by SCOTUS concerning the particulars of a law in regards to constitutionality. Of course, his statement expressed deep concern for the American people having their voices drowned out. So long as the corporations were stuck on "mute", he could tune out the people, but he can't tune them both out all of the time.
