Our Broken Immigration System – Penalizing Those who Follow the Rules

A couple of years ago, I wrote about the case of 41-year-old Anatolie Vartosu. Born and raised in Moldova, Vartosu was required to serve for two years in the former Soviet army. He went on to graduate from Romania’s Sport University with a Master in Sport and went on to teach physical education, ballet and track.

A former Olympic marathon qualifier, Vartosu was invited to the US in 2003 to compete in a marathon in Clearwater, Florida and arrived on a six-month tourist visa. Later that same year he ended up in Stamford, Connecticut, where he received immigration sponsorship and a job working for Jack Rabbits Gym in nearby Greenwich. Fellow Romanian immigrant Nicolae Piperea and his business partner, John Schwartz, the owners of Jack Rabbits, were looking to build their gymnastics program to an elite level, making the addition of Vartosu to the staff a natural fit. He received a three-year H1B working visa and his wife, Maria (also from Romania) opened in 2007 what has become a very successful day care program with a business partner.
In March 2006, when he and his employers went to renew his visa, Vartosu was told that he had to wait until October, when he would have to file additional documentation to justify the renewal, which he did. At that point, the 60 days he was told he’d have to wait turned into six months. After placing a call to US Citizenship and Immigration Services (USCIS) in April 2007, he was instructed to further file the I-29 (an internal status query) and told to wait another 60 days, which turned into yet another filing of the I-29 and a further 60 day wait.
Finally, after over a year of waiting, Vartosu and his employers were told in July 2007 that his application had finally been processed. He received a work permit, but his visa was denied on the grounds of Vartosu being “overqualified” for his job as a gymnastics coach. The kicker is that he was granted the original H1B for the very position for which they now claimed he was overqualified! The work permit was then nullified. Obviously the left hand does not know what the right hand is doing.
And if Vartosu cannot stay, neither can his wife Maria, whose visa status hinges upon his.

According to Jack Rabbits co-owner John Schwartz,
They’re saying that since we’re not a high-level gym, we don’t need someone with his expertise. But my point is, we are building our program up to an elite level, and so we do need his expertise. Frankly, it’s difficult to find qualified instructors. And since we are a USAG-member gym, qualified instructors are essential.
He added,
They delay and delay and delay and have people on a string. And then they say 60 days and it takes six months. They take as long as they want, and when they make a decision, he has only 30 days to appeal or leave the country.
Vartosu and his employers managed to secure an additional review. Fast forward to 2009. They have exhausted their reviews and are awaiting final word on Vartosu’s case – and if he is denied a final time, they are prepared to go to court. I caught up with Schwartz, who had more to say about the situation:
This isn’t just about Anatolie; it’s about a movement to get Congress and the president to focus on the immigrants who are doing everything right, those who are contribuing to American society and aren’t taking any shortcuts. All you ever hear about when immigration is discussed is the issue of amnesty for illegal aliens. Meanwhile, the legal aliens in the queue – those who dot all the Is and cross all the Ts - are lost in the shuffle. Frankly, it’s insulting to them.Legal aliens who seek a green card or citizenship also have to lay out a lot of money, between lawyers fees and immigration applications – and the taxes they pay – and they are put in ‘la la land’ while waiting to find out about their status. Their very lives are put on hold.If the final appeal is denied, Anatolie and Maria will be given a deadline to leave or face formal deportation. And because he’s done everything by the book, he can’t hide – the government knows who he is and can find him. He’s not like an illegal alien who snuck over the border and no one knows who he is.

Hot Air’s Ed Morrissey has picked up on the story and notes:
This sounds more like a bureaucratic snafu rather than any kind of malice towards the Vartosus, but that’s hardly comforting if he gets deported and his wife loses her business. Hopefully, someone can intervene to bring some common sense to this situation, and encourage a family which is obviously contributing positively to the American experience to remain in the country.
Help has been requested from Congressman Jim Himes, who represents CT-04. (Former Congressman Chris Shays was part of the effort to keep Vartosu in the country.)
Vartosu remains hopeful. “I can say it’s like the American dream here. If you are a good citizen and a hard worker, you can make it and you can do it. That’s why I’m here.”

Immigration – how is it that hard?
Make it easier for those who do it right, and harder for those who wont.
This is exactly why we need immigration reform like that supported by the Dems but very few Republicans. Make legal immigration a viable option so that illegal immigration looks less benefitial by comparison. We eliminate the blackmarket if we create legal channels so that people who want to play by the rules can come with a visa, not a smuggler. It is the legalization of those already here that gets all the ink (and heat), which I support (you can't build a legal regime on top of a mass of illegality and since the 12 million here illegally are not leaving and cannot be realistically deported, it is the only way forward).
The opponents of legal immigration in the GOP (think Tancredo, Lamar Smith, Bilbray, NumbersUSA – the name says it all) and in labor (primarily the AFL-CIO and some others) have opposed reforming the legal system to make legal immigration a viable option (a system real employers and immigrants can actually use in a timely manner, say under 5 years instead of the current 7-22 years). Illegal immigration is mostly a target of opportunity to the people really driving the opposition to reform. If we increase (or fascillitate) legal immigration a little, we can reduce illegal immigration a lot.
The only way to immigration reform is to ENFORCE the laws already on the books!!! It's illegal to change the rules in the middle of the game!!! Get the illegals OUT of this country and let them come here legally like everyone else!!!

My wife waited thirteen years in her Caribbean island home for a legal visa to the U.S. She's met success here and was one of the first people I know to display the flag following the attacks of 9/11. She also considers herself an American first an though she very much loves her Caribbean heritage there's no question about her loyalties. Too many of the immigrants to this country come to make money only, not to establish a new heritage or history; and the only reason illegals can survive here, while taking American jobs, is by the largess of big government programs.
Our country and culture are based upon the rule of law. Communities with high percentages of members who routinely break the law are not viable long term. We strengthen the rule of law by allowing people who follow the rules into our country. However, allowing the illegal immigrants, particularly those who commit other crimes, to stay in this country will only destroy the stabilizing force that the rule of law provides. If you want stability, safety, and peace, then the law abiding immigrants must stay and the law breaking immigrants must go.
Another extremist estimate of the campaign against illegal immigration. Any of those "haters" mentioned would support immigration reform if it really dealt with the problem but it won't as demonstrated by the failure to prevent illegal immigration from occurring instead of facilitating it at every opportunity. The reality is there are millions of educated people who would like to come here in addition to the 12-20 million illiterates currently clogging every artery of our social safety net but they can't because INS is overwhelmed dealing with illegal immigration. Politicians won't challenge the illegals because they want naturalized sheeple as voters for the leftist welfare state.
First, deport all of the illegals we find. Give Sherrif Joe the job. Then, fire all the folks in imigration, especially the IT management. Create an efficient, 1990's system to replace the paper and stone age IT, and lets start roling. There is no reason that the data cannot be processed faster. Base their ability to keep their jobs on actual ability to perform (wouldn't that rock?)!
My wife, who is South African by way of Britain, then Canada, is incensed when she hears about people cheating the system.
It took her years, money, and a lot of special skills to get in, little did she know all she had to do was fly to mexico, cross the border and pick apples for a season.
At one of the interviews they asked her "Have you been, or are you planning on becoming a prostitute?" Do you know how hard that was to sit there and not start a series of comedic responses?
The whole immigration thing seems to be designed to keep the talented out and the on the dole types in.
We need to seriously reform our legal immigration process. Workers who will contribute to our economy are discouraged from doing so by a byzantine combination of paperwork and bureaucracy. These are the people we want here.
Cases like this happen because of misguided protectionist sentiments, which seeks to keep out people doing jobs they are "overqualified" for. As we see here, the problem is that government is not as capable of determining that as markets. Seeking to mimic market behaviors with regulations like this is just bad policy.
Everyone must be warned before coming to the United States. Even if you have a visa, you are putting yourself at risk of Homeland Security ICE officers. I have a friend that is from Paris France here on an education visa to finish his degree. He has been here since 2005. His visa is valid until March of 2010, His passport is valid until 2014, and his I-20 is current. He is not illegal. In 2008 He fell in love and married a U.S. citizen that just happens to be addicted to Prescription medications, He knew nothing about this. But he was arrested due to her mistakes. He was placed in detention, scheduled for deportation. He has been in detention center in Pompano Beach Florida for 5 months now. All this because of her mistakes. She should be the one in jail not him. Please everyone coming to America. Think twice. This couple has lost all there savings on lawyers, she lost her job, and they are in the process of losing there home. All this was caused because
Here is REAL immigration reform. Close the borders to all but people who Want to do it right. Deport or drive out the illegals who are here by eliminating the government perks that they get without ever contributing a cent. Lastly, and this is most important, repeal the amendment that states kids who are born here are automatic citizens. BAM! Instant "reform".
All this was caused because ICE has the wrong person in jail. They make up any story they want and when they are questioned about it you get nowhere. I have written many letters to Janet Napolitano, Senator Bill Nelson, Representative Ginny Brown-Waite and even President Obama. But no one will listen. So please people think twice about coming to America for any reason. Our immigration system is broken ….they all agree, but you put your life at risk when you enter our borders. Even if you follow the rules you may also lose everything as this couple has. No one will listen, no one cares. This man has never even had a traffic violation and is 51 yrs old. He has never worked in America has always been self supporting and took nothing from Americans social services. His American dream has turned into a night mare. Shame on America. I think it is about time someone revised this immigration and ICE practice. What is illegal in this case is the way DHS is treating this guy. John Morton and Janet N. should be ashamed of themselves. This is just wrong. While in there detention center they have abused him, denied him food and proper medical treatment. He is diabetic and they will not give him the proper food or medical attention. I think it is terrible.

I have a friend from England with exactly the same problem. Here is a guy, comes here on a Visa, starts a business, fully licensed and insured, contributes to society and the government is screwing with him on his citizenship. He actually had to leave the country for 3 months and then come back as a sponsored worker – killing his business. WTF is going on when these guys can sneak over the border, commit crimes and the bleeding hearts want to give them amnesty, when somebody else, who contributes to our society, is assimilating to our country gets screwed by the government and makes him and his family jump through hoops. This is seriously messed up.
Anatolie should change his name so it ends with a "z" — instant amnesty!

Punish employers harshly who employ illegals and make sure that if they have their babies here they are not citizens. That should stop them. Better yet have our troops at the border. They come illegally just shoot them.
There are numbers of people who have emigrated to America legally and it has taken them many years to do so. They know more about the greatness of America than a lot of those who have been blessed with been born and have grown up here. You may find them to be the most vocal in speaking out against the illegal immigrants.
The ONE thing that I seem to notice most about those spouting to legalize illegal aliens is the complete elimination of the word "illegal" anytime that they talk about those that are clogging up our hospital emergency rooms and prisons. They are showing no respect to those who chose to come here legally. I believe that most Americans support LEGAL immigration. Isn't that how most of us got here? It is the complete disregard of our immigration LAWS that should be brought into question. Enforce our current laws now. Expel any illegal who has committed a crime, AFTER he has served his sentence in our prison system. DEPORT them then and disallow any return. How can you expect anyone to respect any of our laws when they begin their time here flaunting the fact that they do not respect our immigration laws. It is not any of our right to pick and choose which laws we will obey and which we choose to ignore.
Remember to see how the word "ILLEGAL" is avoided in any of calling for immigration reform. It is not immigration or the legal immigrants that we oppose. It is, however, those here ILLEGALLY. Those who chose to show disregard for our basic laws.
All over the world, outside the consular sections of US Embassies and Consulates, lines of law-abiding people wait patiently for their turn to file for various visas – visitors visas, business visas, employment visas of various sorts, student visas, etc. They demonstrate respect for our laws and processes.
Simultaneously, we allow ten million (I think that number is probably double) illegals to enter our country with impunity, breaking our laws, driving down wages, sucking up taxpayer-funded services.
Simply put, this is a double standard. No way should amnesty be granted to illegals. What kind of message does that send to all those people world-wide, who follow our visa laws and wait, endlessly it seems sometime.
Before anyone gets on a high horse and raises hell with ICE, State Department, and the other agencies that administer visas and admission to the country, look first to Congress. Congress passed those laws, usually without commensurate funding to make sure they work.
I suspect that the interminable delays in processing Vartosu's visa applications can be traced to the workloads of the offices responsible for processing them. In such cases, each one must be investigated and adjudicated.
Consider this: After the Soviet Union fell and its satellite countries were free to issue passports to any citizen that wanted one, our Embassies and Consulates were mobbed. It was not unusual to see 700-1000 people daily lined up for visa processing. Each consular section had roughly three consular officers – usually first tour neophytes – to process them. You do the math. No way were any of those visa adjudications going to be done accurately.
Congress is very free with the way it legislates. It seems never to understand (or more likely, care) what the real-life consequences of its actions become.
This is why its important to make a distinction between Illegal ALIENS and legal IMMIGRANTS.
ILLEGAL ALIENS should *never* be called immigrants. They have not been granted immigrant status by the USCIS and have not (or should not have any) legal immigrant status. By definition they are neither law abiding nor of good character. (What part if ILLEGAL don't you understand).
By calling ILLEGAL ALIENS immigrants you both insult the legal immigrants who often wait for years and work very hard (and pay hard money) to come here.
Its not Immigration Reform – it has *nothing* to do with immigration. Its ILLEGAL ALIEN Amnesty.
Part A: The Socialist (d) tell us we do not have enough water to wash our cars or water our lawns in California. Enough gas to drive our cars, We do not have enough energy to heat or cool our homes, We do not have enough money to run our schools, and we have to much pollution so we can not drive the cars we choose, to many Cars on our roads, to many poor people, To much garbage, Not enough affordable rentals, Hospitals going broke from un-paid bills, and to many un-insured. How do those we elect to office solve these problems listed above?
Part B: Bring in 3rd world Labor and cut the legs out from under our American Blue Collar work force. Yet when it comes to the Citizens of Mexico we are the land of plenty in the eyes of elected office holders who sell American Citizens out to replace the voting blocks they aborted and all of a sudden we seem to have enough to make anyplace south of Sacramento look like America's version of Tijuana.
My question is what Laws Mandated by our Constitution do I get to break? .08 DWI Laws? If only I could get a buzz on a .08 Can I skate on that one? I buy the Federal Government a new Honda Accord each year and my car is a 2002. Can I have a tax amnesty? Soon the Government will regulate how we wipe our bottoms. 4500 Laws. You pick and choose which Laws you will enforce and which you will not. I want some laws I can break also. Oh that is right. It is not about the rule of Law. It is only about more revenue to steal from us to pay for them.

Here is a single page Law to Solve The Illegal Alien Issue once and for all. Any elected Office holder is welcome to steal it and use it as their own. Yes we can move twenty eight million illegal aliens back to Mexico by making them want to go back on their own. After all, Mexico did it!

Any Corporation or Company who hires an Illegal Alien (notice I left out the word knowingly) shall face a fine of $250,000.00 per Illegal Alien hired and the CEO, CFO, Owner, and person who hired the Illegal Alien shall spend no less then three months in Jail. Time to be served in the County where the offence against the Legal Citizens of the USA occurred.
No person, Corporation, or non-profit group shall hire, rent or lease to, sell an automobile to, or pay money owed to any Illegal Alien. Each offence shall incur a penalty of no less then $250,000.00 dollars and three months in jail levied against the CEO, CFO, Owner, and or persons in the County where the offence against the Citizens of the USA occurred.
Part B: Should a CEO, CFO, Owner, or persons be in violation of the Solving the Illegal Alien Law have no ability to pay fines. Jail time will be extended accordingly and property sized. Bankrupt Laws shall not apply to any guilty party or entity due to failure to pay fines.

I have been ranting about illegal immigration for many years. I was niave enough to predict that if the economy went backwards, the public and our Congress critters would get serious about deporting illegals. So much for that. Eight years hence, the number of 12,000,000 is still considered to be an accurate number as far as current level of illegals.__The defenders of illegal immigration argue that it would cost Billions to deport them.__SUGGESTION: Use Stimulus Money!!__The O Bow ma administration is ranting that they are creating jobs(maybe 100-200) by transferring illegal terrorists to Illinois(100-200 terrorists) and will likely spend Billions to do so.__Imagine the jobs created by undertaking a massive deportation of 20,000,000 illegals. The hiring of people to locate, round up, detain and transport 20,000,000 ILLEGAL aliens would create THOUSANDS of jobs, stimulate charter bus companies and alleviate Mega BILLIONS in future expenditures. A true win-win situation. O Bow ma__could even take credit for creating all these jobs. If he arrived on a visitor's visa instead of a business visa, then he is lucky he got back in at all. People don't understand that a lot of visas stipulate that a visitor cannot work while visiting. Foreigners who overstay their visitors visas or other visas, by laws Congress passed, are ineligible to stay and cannot return to the US for at least five years.
Excellent post! I can't imagine your wife having to watch these illegals get away with anything they want in this country when she fought so hard and LEGAL to become a citizen ,I don't think that the people coming here today care anything at all about becoming citizens, they're just looking for a free ride, and a way to get drugs into another country!! I think that San Francisco should be brought up on Federal Charges for allowing so many illegals to stay in their sanctuary city, clearly breaking Federal law!!

We have a close friend who came here with her family at the invitation and request of the FBI and DHS. They came from Germany where they were the top trainers for explosive sniffing dogs and guard dogs. They have worked world wide training these dogs.
They were here on a valid visa, again at the request of federal agencies. A year and a half later her husband died. She and her son continue to train the dogs, but now INS has said that because her husband died they will not renew the visas.
Even the FBI has been unable to "get through" to INS and get them to understand.
so here's a family that came to the USA under an invitation to bring their business here. They are totally self supporting, running an active business and now INS has decided they must leave.
Insane….you bet!
So, we are now exploring all other options.
The INS is WORTHLESS.
Its shamefully broken. Visa Express allowed 16 of the 19 hijackers in without any interview. Permanent green cards were forcibly expired making it impossible for permanent residents to even get a driving license until USCIS renewed. If a non-citizen fights for the US in our military, it takes up to a year to obtain the deserved citizenship, the worst delay seen. There wouldn't be so much illegal immigration if the processing times of documentation could be completed within weeks rather than months. Immigration cannot handle today's volume.
It's obvious reform is needed. Even in our health care system. The problem is that at every turn the democrats push for an all or nothing (aka comprehensive) approach with conditions like amnesty, public funding of abortion and government "options". If they truly wanted to fix what was wrong there should be no doubt that the public would back them 100 percent. The problem is with these politicians there is always a catch and every new bill is an opportunity to insert their agenda items. If they could but stay on subject and do what is needed rather than what they want we would be far better off.
The source of all this confusion in our government is discontent with our nation. It's not an objective mindset but one of contempt. If it were only a matter of fixing what is broken they could all work together to fix each problem. Instead we get politicians who wish to "fundamentally change" our nation. As if there was something wrong with the people that only the government can remedy.
Ultimately what is wrong with our nation is that our representatives do not listen to the people and take it upon themselves to shape this nation. Not by leadership but through subversion and tyranny. They vote their "conscience" rather than listening to the people and this has to stop.
Why would they do that? This man is a likely Republican voter, so they have no interest in helping him stay here and eventually become a citizen and vote…
Maybe if she'd answered "yes" they'd have approved her immediately…
It's all semantics where democrats are concerned. All they see is 12 million more potential democrats that cant afford to wait till the democrats get an amnesty bill passed.

So sad and wrong. it doesn't make any sense to deny imigrants who are qualified applicants for work and citizenship…And then, bring into our government known terrorists and expose citizens to their threats and charges. Where are the leaders of our country?
Now you see why holding my tounge was so difficult. "Why are you looking to expand?", "Define Prostitution", "You mean for money?" etc. etc.
Having been through the hoops of the immigration process for my wife and stepson, I can tell you for a fact that it's a nightmare. If you call 5 times with the same question, you get 5 different answers. If they screw something up, you get to start over and pay the fee again as well. Evil, arbitrary and mean-spirited. Then they scratch their heads when we don't want government-run health care.
And, having followed the rules, I have NO sympathy for the gate-crashers. None.
How many people should this country have? 300,400, 500 million or more? As with most systems, there is a carrying capacity that is optimum. When the capacity is exceeded, the entire system is degraded. So it is with countries and population. Every country has a limited number of resources. If the population exceeds those resources, then outside resources need to be sought. What happens when one country wants another country's resources? If the resourceful country doesn't want to sell or the needy country can't afford it, war. Currently in this country it takes 12 acres of undeveloped land to be developed for every added new person. Along with that land comes the accessory resources such as water,sanitation, energy, food and social costs. Do the math. Unless we want to be in a continual state of war for rapidly depleting resources, we need to make some careful choices today. The amnesty of even the tired figure of 12 million could increase this country's population to 60 or more million in a short period because of family reunification. Add in child birth, fraud and legal immigration and the population could rise over 100 million more in less then 60 years. The US is currently importing 125,000 legal workers to this country every month. This country takes in over a million legal immigrants each year.
The time is now to decide what type of country we will leave for our children. We cannot take in the entire world and not have this country suffer for it. There is a limit to the life boat's capacity, will we remain afloat or sink with the rest of humanity?

I agree with the lady that says send em all back. If you knew how much cost and trouble it is to do it right and to even hear about how they want to give the illegals amnesty. I think that any illegals anchor baby should have thier citizenship revoked and sent back with the parents especially any who are collecting any gov subsidy to live here.
The difference is your wife I presume is educated, and probably would never vote for a democrat. Most people south of the United States don't value education at all. In fact most latinos only vote for democrats because they believe in democracy. Not realizing or caring that the United States used to be a free Republic prior to 1913. In the end it is about power, sorry.

My Ukranian maternal grandmother and her mother WAITED for NINE YEARS to ESCAPE COMMUNISM in Europe and come LEGALLY to refuge, freedom, and opportunity in America. My grandma was 16 at the time. She and her mother settled in New Jersey. Some time later, Grandma married a LEGAL Czech refugee from World War I. They both learned English instead of demanding everything in their languages or insisting that Americans learn them. They became and were PROUD to be Americans. Although Catholic, Grandma and Grandpa OPPOSED illegal immigration. They brought up their children to be ARDENT, APPRECIATVE patriots. One of their children is MY mother, who passed this priceless legacy on to ME! Which is why I fight illegal immigration NOW!
i have been in the so called system for over 7 years now and still waiting , the nvc tell me they gave a way 10,000 green cards on the 1st of october 2009 in the catagory that i am in and they all whent to people with a priority date 2002 my priority date is 2006 so it seems they are over 4 years behind with this process ,
i have done everything right but i am starting to think is it all worth the never ending slog ?.
i own a ranch in texas paid for in full + vehicles , boat, trailers, ect, ect all paid for no outstanding debt's i came back to the uk to visit and now i cant even get back to the U.S. for a vaction untill my green card is issued.
the nvc tell me it has been approved but i have to wait untill it is issued before i can return whenever that will be who the hell knows.

Here's my reform plan. Create a 3-mile wide "no man's land" between the US and Mexico. Install land mines and allow Americans to shoot anyone crossing to our side. Those who want to come over bad enough and make it deserve to be citizens, those who think wiser or die trying, well, at least they won't be on our state-sponsored welfare. We also need a whack-a-mole policy for those who tunnel through the no-man's land. If they're still in the hole, they're legal to shoot.
I suggest he get his wife pregnant so she can pop out an anchor baby.

I guess I am a little late on this debate. But reading all these comments made me want to share my experience too.
Although not as dramatic as some others here, it follows the same pattern. I am a skilled marketing professional froma a South Asian country who tried to find empl,oyment here in the U.S. I sent out my resume to around 50 companies, got a response from 8 and got job offers from 3 firms. But none of them want to sponsor my work visa. Too difficult apparently. What pisses me off is that I am trying to get a job legally but can't because the immigration laws make it so difficult. Whereas all around me- I'm in New York- I can see hundreds of thousands of illegal immigrants, a lot of them, I'm ashamed to say, from my own stock. The U.S Immigration laws as I see it, is ass-backwards. It manages to keep out the good guys out (qualified, tax paying and legal workers) and encourage all the bad guys to come in (12-15 million illegal immigrants who all hope to be legalised one day).
It's a perverse system
