Stopping the Runaway Congress
by Peter FerraraThe recall of New Jersey Senator Robert Menendez took a step forward yesterday with a promising oral argument in New Jersey state court. The New Jersey Constitution expressly provides for the recall of members of Congress representing the state in a provision adopted by a 75% favorable vote of the people in 1995. The New Jersey state legislature then expressly provided by statute for the procedures for such a recall.

The Committee to Recall Robert Menendez filed papers for the circulation of their petitions to begin last September. But the Secretary of State, who has no authority to issue rulings on constitutional questions, nevertheless refused to approve them on the grounds that her own New Jersey state constitution must be unconstitutional under the federal constitution, which she said did not allow such recalls.
The three judge appellate panel considering yesterday whether the recall should proceed expressed reluctance to declare a provision of their own state’s constitution duly adopted by the people null and void. They also seemed receptive to the argument by the recall committee that they were only asking the court for an order for the circulation of petitions to proceed, and there is nothing in the U.S. Constitution that prohibits that. To the contrary, the U.S. Constitution protects the political expression involved in signing a petition calling for the recall of an elected official, and the petitioning of government for the redress of grievances.
If the recall committee gets the required signatures from over a million citizens calling for the recall of Senator Menendez, and the majority of citizens vote to recall him in a recall election, and the Senator decides to thumb his nose at the will of the people anyway, then the issue of whether state recalls of members of Congress are constitutional under the U.S. Constitution would be presented to the courts. But until then all that the New Jersey recall committee is asking for is the freedom of political expression involved in gathering recall petition signatures, and the U.S. Constitution protects rather than prohibits that.
Based on the oral argument yesterday, the recall effort in New Jersey stands a good chance of getting the go ahead for now. That could have a powerful political effect in Washington right away. The law in 9 states provides for the recall of members of Congress, and those states include 12 incumbent Democrat Senators who are not otherwise up for reelection this year. So if the New Jersey courts allow the recall there to proceed, that means all 12 of these Democrat incumbents could be added to the ballot this year, putting majority control of the Senate even more in play.
That could cause Congressional Democrats to be more reluctant to follow Barack Obama off a political cliff. The 12 Democrat Senators potentially on the hook for a recall election will be more likely to decide they better spend more time listening to their voters than to Barack Obama’s ideological entreaties. That could be the final straw that stops Obamacare, in accordance with the will of the people.

1. Does the recall have to be because of a cause or wrongdoing, or merely because enough people sign a petition? What is the impetus for the recall of Menedez?
2. If the petition is merely an expression of free speech, why does it need to be certified by the Secretary of State?
3. What are the other states allowing recalls in this fashion?
This would be the best thing that we could hope for. Let Washington know that we can fire them for not representing the people of there state, district, ect ect…. They are supposed to represent the people that elected them. Progressives (who I really didn't know that much about until this last year) will lie, cheat and steal to get what they want. While there doing this they will promise you all the kool aid you can drink…Of course the kool aid is poisoned with socialist Ideals that will destroy our Republic.
I pray that this will work it would be fair and just to be able to hold Washington accountable!!!!
The right of 'recall' and term limits both need to be in the constitution!
12 years 'total' in DC period, that would allow for two terms in the senate or six terms in the house or three terms in the house and one term in the senate…
The congressional retirement program should be abolished.

I see the Dems dragging this all the way to the Supreme Court if the recall actually goes through. In the mean time we'd still be stuck with these losers in office until all options are used up by the Dems to keep them in.

There is absolutely no way this ends up in the US Supreme Court. If Menedez is recalled by his state, he'll step down citing the "will of the people of New Jersey".
Why? Because NEITHER party can afford the Supreme Court to rule that recalls are constitutional, because BOTH parties would see their senators and representatives being recalled with abandon.
We should get all over this in OUR home states, to impress on our state legislators
that we demand OUR state pass a state law covering this option. This is not a fed-
eral govt issue. Every states process may vary, but as I said in a post yesterday, we
should be able to RECALL, not have to wait to the end of uncooperative congress-
mens terms, to eject them. If they LIE, LIE, LIE to get elected, they should fear we will
come for them. Has this problem become so pronounced we must consider poly-
graph tests for candidates?
Let's put the word servant back into the job description of "public cervant". Two terms maximum in either body of congress. No more joining the ranks of lobbyists to collect your rewards. No more keeping the campaign war chests for personal use. No more pensions, and no more free health care for life.
Finally, a rule that every politician and staffer is subject to every piece of legislation passed, no exemptions. That goes for the president as well. It's PUBLIC SERVICE, not a license to steal!!!

As to the term limits, there should only be two terms. One term in office, one term in the prison.
12 years is too long. One Five year term is more than enough.

Fixes for Congress:
1. No Congressman/Senator will be allowed to vote if they are under ANY investigative procedings.
2. Term Limits, 20 years period of any combination of those listed below.
– House 8 years maximum
– Senate 2 terms maximum
– President 2 Terms maximum
3. Enumerated Powers Act – No bill SHALL be passed that is not covered under the Constitutions' enumerated powers.
4. GftGGftG Act – No bill SHALL be passed that excludes ANY government official.
– Good for the Goose, Good for the Gander
5. Public Records Act – Any individual running for public office SHALL be required to produce any documentation proving Constitutional eligibility.
Agreed, Alist — I have heard much about the recall of Menendez but absolutely nothing about the reason behind it. I would imagine recall would require some sort of gross mismanagement (beyond the normal mismanagement we are used to in NJ), or deep corruption. From what i know of Menendez, he is just an ultra liberal, Obama loving, professional politician. Is there more to this?
I can't wait to sign the recall petition! I sent Senator Menendez a very polite and respectful letter and e-mail imploring him to reconsider his vote on the healthcare bill. I received an e-mail in return thanking me for my support! The arrogance!

Not sure if we can really legislate good candidates. You let the voters off the hook too easily. You can legislate all the limits you want, but is we elect a bum, we get a bum.
Terms limits may make a marginal difference but in no way does it make up for a public that is not vigilant in electing people of character and holding those elected accountable.
What i see now is a voting public that has taken matters into their own hands and is holding representatives accountable.

In my opinion, she should also be recalled for her arrogance to stand in the way of the people.
We need to find some retired (don't laugh), congressman, maybe someone who got censured,
or was forced to resign, & find out how long one must serve in the Senate or House before the
system of graft begins to be irresistible. Just as any job there is a learning curve, as to collea-

time for all this graft & corruption. If we could get a sense of these facts, then we could determine

Why does the legal profession insist on using terms such as "oral argument"? "Oral communication" can get you in trouble as was clearly demonstrated by Bill Clinton a few years back. We technical types (scientists, engineers, mathematicians, etc.) prefer to use the term "verbal communication".
I guess that clarity and precision in language and communications is essential for those in technical fields but could be a detriment to the law and the "social sciences"?

I think, any mid to upper level management person, when hired by a corporation signs
a waiver agreeing to submit to drug testing & polygraphs. Not 100% sure about this,
but I believe it to be true.
The states can impose recall and term limits to their Congressional representatives, it doesn't have to be an amendment to the Constitution. Just as the states determine how their representatives are elected. Since the Constitution clearly states that the limits of the federal government and who can serve, the rest is left to the states and people under the Bill of Rights.

This is one of the major problems with our political system as it is. Our so called representatives have endeavored to embed themselves and make it increasingly difficult for the citizens to remove them outside of a regularly scheduled election. When our representatives are allowed to get so comfortable that they feel insulated from the will of the people they then begin to think their will is more important. This is why our "leaders" are so confident when thumbing their noses at us. They practically ridicule us because there is so little we can do about it. Unless these representative are, for lack of a better word, beholden to the will of the people they will continue to act according to their own. When they do so they no longer represent the people but themselves.

We'll be watching the New Jersey case down here in Louisiana, because there is a huge constituency for a recall of our idiot Democrat senator Mary Landrieu, who can't seem to stop making petty and stupid attacks on state officials who won't defend her Louisiana Purchase atrocities. The Landrieu recall effort has generated a ton of interest though it's stalled due to legal questions.
I think the idea of recall to be brilliant. This would force politicians to remember that that are accountable to their constituents THROUGHOUT their term, not just in an election year. If they have to fear they are going to be "Fired" because they are not acting with good will towards their constituents, they might serve the people instead of the special interests. The special interests might have vast amounts of wealth to throw around, but, we the people are the many, they are the few.
It is long past time that our elected officials are held accountable for their malfeasance.

If I read that right, the argument from the Sec of State of NJ was that the NJ constitution was not allowed to have a power not specifically enumerated and delegated to the individual states in the US Constitution? Franking privliedges, per diem for trips, no family along for the ride, free parking, bobbying perks, pension bebefits, subsidized health costs, resort retreats, more than generous budgets for administration and staff expenses, free plants from the U.S. Botanical Gardens, decorative objects from the Smithsonian (need a dinosuar?), furniture expense accounts and the ever loving exemptions and immunities from tax, pension and other lawsuits that would burden ordinary citizens.
Closing the House Bank was a big help just in getting congress to pay their own foor and entertainment expenses.
All perks they have created for themselves. This has to stop and since none are willing to even lift much of a finger to do so, they all must be voted out.

Referring to #4…the "General Welfare" clause is a further restriction on the enumerated powers of Congress. If a law meets any of the tests for enumerated powers; it must NOT be directed to a certain group nor omitting a certain group. It must be subjected to all citizens. That includes the idiots in Congress. We should be filing grievances against any federal law that does not pass the "General Welfare" clause.

Our politicians have acquired the right to ignore the people they are supposed to represent. Many of them are ideology driven to diminish our republic, and to lessen our freedoms. Others are driven out of greed and cronyism. But whatever they do, they treat us as if they are the imperial class, and since they have already tased and spent our monies into perpetuity, we are alreay their heavily taxed and paying subjects. We are already being dispossesed of the very real property which that money represents.
We have lost the right to protest as far as they are concerned, and they target us with lies, disinformation, and constant attacks of misinformation and propaganda, when we dare to exercise our freedoms of assembly, to protest, to petition against their corrupt governance . LOBAL CONSTITUTION FORUM
We are planning a four-day conference focused on the eventual creation of a Constitution for Earth. The first annual gathering will be in Philadelphia, September 14-17, 2005, at the birthplace of federalist government, the U.S. Constitution was signed on September 17, 1787.
Rather than specifically creating a particular document at this stage, our focus will be on fostering DEPTH and BREADTH in the peace movement.
By depth we intend that there be opportunity for full participation in deep dialogue with all other attendees, so each day will include face-to-face discussions of key substantive issues, such as (1) the desirability of world federalism; (2) whether it can be structured to assure respect for individual freedom, local autonomy, and participatory democracy; (3) its appropriate scope (minimalist vs. maximal) and values; and (4) strategies for implementation (practical ratifiability issue). With annual conferences, attendees will get to know one another well: of value in itself.
By breadth we intend outreach to a general public that has been mostly unaware of our goals and ideas. We intend to find ways to involve youth, especially the many college students in this area (there are 90 colleges in this region). We plan to do presentations to college classes before this conference. Besides top-flight speakers and analysis sessions, we will attract publicity with nationally known musicians. We will have simultaneous translations and some videoconferencing with sites worldwide.

THE WORLD GOVERNMENT INSTITUTE

WORLD CONSTITUTION AND PARLIAMENT ASSOCIATION
WCPA provides logistical support to convene consecutive sessions of a Provisional World Parliament, and a Founding Ratification Convention for inaugurating democratic federal world government, founded on the Constitution for the Federation of Earth.
This Earth Constitution features special origins:
elaborated by hundreds of people over more than 35 years;
from people of dozens of countries and all continents;
from nearly all walks of life;
scrutinized by many international lawyers, scientists and human rights specialists;
translated into 22 important world languages.
non-military – the system relies on legal force of civil police and citizens.
The Earth Constitution provides for sessions of Provisional World Parliament. Eight sessions have been held, enacting 30 world legislative statutes, providing an excellent legal basis for democratic world government. The law of the Provisional World Parliament is not subject to approval by national governments, but only subject to the duly-elected World Parliament, when that forms. We encourage a Founding Ratification Convention, for at least two dozen national governments to simultaneously ratify the Earth Constitution, thereby providing an impetus for rapid worldwide ratification by both nations and people.

THE WORLD FEDERALIST MOVEMENT
The World Federalist Movement is an international citizen's movement working for justice, peace, and sustainable prosperity. We call for an end to the rule of force, through a world governed by law, based on strengthened and democratized world institutions. We are inspired by the democratic principles of federalism.
WFM, located near the United Nations in New York, is an accredited non-government organization through the Economic and Social Council and an IRS 501(c)(3) non-profit organization in the United States. WFM brings together 30 member and associated organizations and 30,000 individual members internationally.
WFM serves as the secretariat for the NGO Coalition for an International Criminal Court, a 1,000+ coalition of civil society organizations advocating the swift creation of an effective and just international criminal court. WFM was also one of the principle organizers of the Hague Appeal for Peace, a global civil society conference held in May 1999 that brought together more than 10,000 activists from around the world.

VOTE WORLD GOVERNMENT
We are a brand new (since August 2004) initiative for a world referendum to demand the creation of a democratic world government. We want a permanent state of world peace through world law.
We bring two basic ideas. One is a strategy, the concept of a world referendum on democratic world government, conducted on the Internet, as a means of collecting a powerful, if not irresistible, mandate upon which we can insist on the creation of a democratic world government. Second, we bring ideas for making DWG “corruption-proofed.” This is discussed on our website.
We ask you to go to our website and be among the first to record their vote for democratic world government. Classes, offices, churches, unions, sports teams, families and other groups can conduct their own mini-referendums, using ballots printed on paper (see the “Printable Ballot” link at the top of our site). We think people will welcome this kind of local initiative if they feel they are part of a new approach that has a chance of succeeding. The act of voting is democratic, and it brings with it the need to inform oneself, to debate issues and consider consequences.
We need money, volunteers, and advice, and ask you to contact us to see if there are ways we can work together.

WORLD CITIZEN REGISTRY (RECIM)
Registration as a world citizen is the basic step for the individual who recognizes that the time has come to organize the world as a whole and who undertakes to work for that new world.
The world citizen is a person who feels his solidarity with all others, who is convinced that world security cannot be assured by rival sovereign nations and who believes the only way to save humanity is to substitute world order for the present international disorder.
To this end, he or she demands:
world laws to guarantee to individuals and peoples their basic needs.
world institutions to draft, enact and enforce these laws.
a peoples' world convention, democratically elected by the peoples of the world, with the responsibility of defining and establishing the first world institutions.
The World Citizen Registry, also called Registre des Citoyens du Monde (RECIM), founded in 1949, has its head office at 66, Boulevard Vincent Auriol, 75013 PARIS, France. It supervises the issuing of World Citizen cards for all countries. It publishes a bulletin (RECIMinfo) in French, English, Spanish, Dutch, German and Esperanto.
The Registration Centres, created by World Citizen Registry, make mundialist arguments known, issue World citizen cards within their own country, and send out their own information bulletin, or RECIMinfo.
