The way to solve any problem is to start with the basics. The problem: 1) 30 million without health insurance, and 2) cost.
The begining solution is to enable insurance companies to sell across state lines. Some states now require insurance companies to cover idiotic things like toupees, and seniors to be covered for pregnancy. If people can choose their coverage from a host of companies, costs will come way down.

Then, tort reform is necessary. The number of lawyers on the tv telling people that somewhere, somehow they have been damaged and they should immediately call 1-800 s-h-y-s-t-e-r is legion.

Also in the mix should be medical saving account. That's an idea whose time has come. Now add catatrophic coverage for major problems and about half of the uninsured will be able to buy coverage. For the remaining ten to fifteen million uncoverable people, congress ahould, if closely watched, be able to cover without screwing up the other 90% of America. At least too badly.

Given that the federal Constitution is silent about public healthcare, the 10th Amendment automatically reserves government power to regulate healthcare to the states, not the Oval Office and Congress. So Obama, Reid and Pelosi are criminally ignoring the following.

Article V requires Reid and Pelosi to rally Congress to propose an appropriate healthcare amendment to the states for ratification. And should the states choose to ratify such an amendment, then Congress would have the power to regulate healthcare.

On the other hand, the states can always choose not to ratify such an amendment, in which case Congress remains without constitutional authority to regulate healthcare.

In the meanwhile, Reid and Pelosi are treasonously basing Obamacare legislation on constitutionally nonexistent federal government powers. So they might just as well make legislation to build a federal prison for corrupt congressmen and move into it.

The bottom line is that Constitution-defending patriots have a big mess to clean up in DC in this year’s midterm elections.

I have had that happen also…usually when I have spent a lot of time on my comment…and it is long. I have taken to writing long comments on my email then pasting them here. In this manner I do not lose my well thought out (by my standards) comments. I have also found that instead of telling me my comment is too long, it just doesn't post. There are a few thing that get you deleted by the admin. such as too many ** or— or if you try to use Andrew's last name. It's a pain in the butt and would be much better if they just listed the rules for us.

While the Tea parties and similar organizations are being as vocal and visible as possible, citizens and militia's are quietly preparing for the disaster to come if the bill passes.

When did I state it was not the respnsibility of CSX for the derailment. I stated that CSX hazmat and emergency response team took exemplory action and saved the lives of thousands. The lawsuit was brought by one firefighter, as the result of an injury caused by damaged equipment returned by CSX. I agree that his suit is over the top, your statement that the towns fire dept was suing, because they were denied access, is false, there were over 250 firefighters working the site, that includes all of the towns firefighters!

CLEVELAND — A Concord Township firefighter is the latest person to sue CSX Corp. in connection with a Painesville train derailment.

Firefighter Robert Bambrick filed a lawsuit Thursday in Lake County Common Pleas Court claiming he was permanently injured as a result of the Jacksonville, Fla.-based company's misconduct.

After 112 CSX train cars derailed Oct. 10, 2007, near Heisley Road and Route 2, hazardous substances leaked out, forcing the evacuation of more than 1,300 Mentor and Painesville residents.

Once the fire was out, CSX took possession of hoses and other equipment used by the Concord Township Fire Department and promised to clean, decontaminate and/or replace equipment that was unsafe, damaged or worn.

According to the suit filed by attorneys Mark and Robert DiCello:

Five days after the incident, CSX returned equipment it determined was safe for further use by firefighters.

On Oct. 19, 2007, Bambrick attempted to use a fire hose that was returned by CSX after the derailment fire.

While using the equipment, Bambrick suffered a fracture to his right fibula.

The attorneys are claiming the injury was caused by CSX failing to properly test and/or discard overused and excessively worn equipment.

Bambrick — who stated he has suffered severe physical and emotional distress from the incident — is suing for more than $50,000 in damages plus attorneys' fees.

CSX spokesman Bob Sullivan declined comment.

Two class-action lawsuits involving the derailment are pending in federal court.

Forestbrook Lane residents Christopher Mann and Jeanne Myers are claiming CSX should be held liable for more than $5 million for property damage, personal injury, health scares and loss of income. A similar suit was filed by evacuee Jonathan Hirsch.

In Lake County Common Pleas Court, officials of Atlas Cinemas in Mentor filed a $5.5 million suit against the railroad in 2008, claiming CSX forced it to house hazardous waste cleanup equipment at the movie theater's Diamond Center Drive location without its permission.
