Sweetheart, Get Me Rewrite: ACORN and the James Rainey Saga
by Michael WalshThe hidden-camera videos by James O‘Keefe and Hannah Giles detailing the inner workings of the taxpayer-funded leftist racket known as ACORN have set off a storm of journalistic controversy, but not in the way one might think. Rather than engaging the substance of the stories first made available on Big Government and later on Fox News – that ACORN, to put it generously, seems to be staffed by an inordinate number of employees blithely willing to aid and, if possible, abet criminal activity – the dinosaur media has reacted not by investigating the message but by attacking the messengers, all in the name of “journalistic ethics.”
Now, when a “journalist” – I prefer the days when we called ourselves “reporters” – starts lecturing his readers about the saintly nature of “journalism” you know that the entropic, self-referential MSM has just about hit bottom. Long gone, apparently, are the days of the old Front Page, the 1928 play by Ben Hecht and Charles MacArthur – filmed four times – that lovingly limned the street-smart, ink-stained wretches (in the late Herb Caen’s famous phrase) who would stop at nothing to Get The Story. For decades – and certainly when I started in “journalism” in 1971 – this was model of the enterprising reporter: check your conscience at the bar, get the story, go home, go to bed, get up the next morning and do it all over again. These guys were our heroes:

Not pursuing a legitimate news story, as James Rainey and the rest of the Pecksniffian bien-pensant staff of the once-great Los Angeles Times seem intent on doing, because the young reporters are “agents provocateurs” and “political guerillas,” is bad enough. Who cares what they are? It’s like saying Hildy Johnson and Walter Burns are scum-sucking bottom feeders who would steal milk bottles from babies and nickels from newsboys if they thought it was a Page One story; a badge-of-honor insult those old-school newshounds would have worn with pride, alongside the egg stains on their ties and the lipstick on their collars.
After all, James “the Dog in the Night-time” Rainey works for the very same newspaper that since last year has been suppressing a potentially devastating videotape that depicts then-state senator Barack “Present” Obama gushing over his Chicago pal, Rashid Khalidi, a charter member of the University of Chicago-Columbia Obama axis of influence. As Andrew McCarthy, the former federal prosecutor who put the “blind sheikh,” Omar Abdel Rahman, in the Supermax prison for life for his role in planning the first World Trade Center bombing, notes:

Is there just a teeny-weenie chance that this was an evening of Israel-bashing Obama would find very difficult to explain? Could it be that the Times, a pillar of the Obamedia, is covering for its guy?
But it’s Rainey’s reasons for not looking into the apparent – one might say “manifest” – ACORN malfeasance that ought to be even more disturbing: “The duo certainly has caused a stir — and raised questions about an organization that in the past had received substantial government funding — but, sorry folks, please don’t call this journalism.” Right – and don’t call us late for dinner, either!
Leaving aside Rainey’s consistent misrepresentation that “the response from ACORN employees was not so uniformly compliant as the videographers have implied” – the evidence is right here on Big Government for all to see, so you be the judge – why not call it journalism? And is that really the most important issue at stake here?
In his September 23 column, Rainey resorts to one of the weakest of intellectual arguments, the “appeal to authority” – in this case, the Society of Professional Journalists – to dismiss the ACORN stories as tainted by their provenance:
Should news organizations be using this kind of subterfuge to get stories? If so, when? And when such hidden-camera theatrics come over the transom, how closely should they be scrutinized before they are thrown open to the public?
The answers — surprise, surprise — are not so simple.
Local and national television outlets have not been averse to assuming fake identities and sometimes using hidden cameras to expose, for example, unsafe factory working conditions or abuses in rest homes.
But the Society of Professional Journalists has set a standard that deception should be used only when every other reporting approach has been exhausted and only then in certain cases, most notably to reveal a severe social problem or to prevent people from being harmed.
To use the technical term favored by “professional journalists,” this is “laugh out loud funny,’ especially since – and this will probably come as news to the Los Angeles Times newspaper – ACORN itself has openly boasted, in its 2005 annual report, of doing exactly the same thing. As is well known, under the rubric of “Financial Justice” (ACORN’s lingo reeks of old-fashioned communist phraseology, as anybody over the age of 45 is aware), we find this heartwarming tale of the triumph of the human spirit:
Pretending to be a naïve tax preparation customer, Christina [Talarczyk, an ACORN activist in San Antonio] walked into a Jackson Hewitt office with a Dateline producer who had a camera hidden in his sunglasses. The tax-preparation employees were caught on camera as they tried to convince Christina to take out a high-interest RAL [Refund Anticipation Loan]

Now that we understand the Rainey Principle – that it’s not the method but whose ox is gored – where to begin? Let’s jump in the Wayback Machine, dial up “journalistic methods” and see where it takes us!
On January 12, 1928, a woman named Ruth Snyder was sent to the electric chair at Sing Sing prison for murdering her husband for his insurance money; her lover, Judd Gray, met a similar fate later that same day. One of “Ruthless” Ruth’s claims to fame is that she became the model for Phyllis Nirdlinger in James M. Cain’s novel, Double Indemnity (in the movie her surname was changed to the more euphonious Dietrichson).
But her place in journalistic history was forever enshrined by a “journalist,” Chicago Tribune photographer Thomas Howard, who was sent to New York at the behest of the Trib’s sister publication, the New York Daily News, to surreptitiously photograph the merry murderess’s hot date with Old Sparky. Although executions were routinely witnessed by the gentlemen of the press, acting on behalf of the public, photographs were strictly forbidden. The Daily News decided to test that unconstitutional “no law” restriction by bringing in a shutterbug unknown to the other witnesses. Having scoped out the room, and (thanks to some legwork by Daily News staffers), and knowing precisely the angle and distance he’d have to work with, Howard smuggled in a miniature camera with a single glass plate strapped to his left ankle, concealed by his pants leg. He had only one shot to get it right and he did. The next day, Friday the 13th, his picture appeared on the cover of the Daily News with the headline, “DEAD!”

Naturally, there was a great deal of huzzerei, and legal action was threatened, although it appears none was ever taken. Howard made a pile, his camera wound up in the Smithsonian and, according to some sources, he even got a job in the White House. What the “severe social problem” was is unclear, and as for preventing harm…
You’ll have to ask Ruth Snyder.

This is nothing new that there were sweetheart deals made between the Media and ACORN. Look at those that work for these networks and most of them also work with ACORN. A video was discovered last week on http://www.americanparchment.com where Roseanne Barr was defending ACORN and Obama and saying that these videos are a disgrace. Most of these media outlets aren't about reporting the truth they are just like politicians trying to make constituents happy.
I agree, there is no reason to sully O'Keeffe and Guiles with the same label Rainey uses for himself, a journalist.
They deserve more respect that that.

Acorn is an enemy of the state and they should be sent to the chair and pictures of it should be handed out as a reminder to other communists and subversives that treats await those that try to destroy this country. No doubt Rainey and his ilk thought the Pentagon Papers were journalistic excellence instead of treason. Rainey probably has a picture of Daniel Ellsburg on his desk.
I remember the days when 60 Minutes did undercover stories just about every week! And what about the scum that have gotten caught on NBC Dateline’s “To Catch a Predator”?? How is that any different than catching scum aiding and abetting prostitution and the exploitation of underage illegal immigrants?????

Again, this was a well-written article about a critically important subject. You don't get any better than that.
It use to be that journalists were the hope of the common man and subjectively kept a surveilance on those of higher power both politically, community and business. However, with the 'freedom movement of the 60's' which was primarily a student led revolt to do anything they wanted without regards to civility or rules, gained media attention and was embellished not for bad behavior, but for 'free expression' using JFK as their icon (JFK would roll over in his grave had he known how 'liberal' our country would become).
However, Journalism being the product of universities and it's youth and supported by its professors and a media made up of the same kind, began the liberal movement we see today where all rational and 'adult' thinking has been thrown out. This thinking has let things like ACORN and Obama's Chicago friends gain a foothold in media genre, resulting in not only the elimination of religion, traditional American values and those things that made America the best country in the history of mankind, into a downward slide of the minority view prevailing over majority view and logic….thus the decline of America as we knew it.

I am confused. You seem to be arguing that journalists ought to abandon ethical considerations because they work in a profession notorious for its lack of ethics. Isn't that the reason journalists are seeking to impose ethical restraints? Are you really arguing that an unethical pedigree is cause to ignore ethics in the future? Geez, man. That's like arguing New Mexico and Arizona shouldn't be allowed to have laws because they were once proudly lawless territories.
Of course, your article does provide one benefit: the readers can now understand on which side of ethical line you fall. That does raise one question, however: Why don't you have an "unethical and proud" badge on your webpage?

However, isn't this the same network that produced the "To Catch a Predator" series using hidden cameras to trap criminals? The double standard exhibited by NBC is disgusting and demonstrates the continuing media bias.

Perhaps you missed the point: Rainey is a hypocrite. ACORN and MSM resort to hidden-camera journalism, and it is applauded, as it gores 'the man' (or his ox). When the gored ox is ACORN, the hue and cry is against the investigators.
You deliberately miss the point.
The point is this: Neither instance was unethical journalism. The NBC/ACORN team-up to embarrass Jackson-Hewitt and the Giles/O'Keefe sting against ACORN were both perfectly ethical.
In both cases, the subject of the sting had an opportunity to behave in a way that would tend to bring credit to himself and his organization. Certainly, in the Giles/O'Keefe sting, the subject failed to take that opportunity, choosing instead to offer to facilitate illegal and immoral activities.

The point is, the Supreme Court was right when it ruled that there could be no prior restraint. Either than principle applies to everybody or it applies to nobody.
With OBAMA the mask has finally come off the mainstream media, and it is revealed for what it is – a schill for the Democrat. To assert otherwise is ludicrous. So….what do you do? As conservatives, we have to totally divorce ourselves from the mainstream media. We need a cable channel devoted to conservative news and entertainment. Golf channel, travel channel, how about a conservative channel?. ALSO WILL SOMEONE DO A STUDY OF THE HISTORY OF LIBERAL BIAS IN THE MEDIA?? I think it goes back to the radio days of William Paley, but we don't know since no one has looked at it. And, by the way in 1971 there was just as much bias as there is now – would Watergate have happened if Nixon was a Democrat?
It's hypocritical not to cover this story because of how it came about, if the paper would have covered it in other circumstances – which they clearly would. Same goes for the global warming e-mails – given the NY Times (for example) track record of publicizing unauthorized disclosures it is just hypocritical not to cover the story, or to minimize the story – if these were oil company internal memos would the media cover it? You bet they would! The argument is that when it suppresses these things the newspapers – the media in general reveal a bias toward leftist causes favored by Democrats, and against causes favored by Republicans. It is infuriating that the mainstream media doesn't come clean about these biases – although at this point it is ridiculous to assert otherwise.

O'Keefe and Giles should be held up as examples of how Americans need to do their due diligence when it comes to organizations taking taxpayer funds and giving them to others who may not be so deserving. Can they be protected under the Whistleblower regulations? Can the lawsuits against them be dismissed since they uncovered criminal and/or highly unethical behavior, despite the thin veneer of criminal behavior on their part? It would seem that the only way a politician could condone ACORN's behavior is if ACORN was a campaign contributor. I'd like to see a full list of politicians who have received funding from ACORN (and, ergo, from American taxpayers who weren't consulted about it). Politicians need to know that their days are numbered, especially if they received funding from ACORN, because it's more than just wrong, but bordering on criminal, to take money from the government only to give it back to a select group of government officials…doesn't anyone see the ethical quandaries here?

I am optimistic that sooner or later old school journalism will make a comeback. The libs were smart to take control many years ago over what was taught in universities and colleges to budding "reporters". We are paying the price now. I think it is time to search from the top down to find which institutions have journalism departments that are worthy of the name.
That's exactly how I feel. I honestly think Dems and Repubs are together in all of this, pulling our strings like puppets and playing good cop, bad cop, of course depending on who's in charge over there. We need a complete re-boot of the Washington Political machine. Vote them all out!

The "journalists" in the DOWNSTREAM MEDIA are just really PO'd because they're scooped every hour on the hour by thousands of amateurs. Oh, yeah, they're also not happy that their support for ACORN's candidate, the Chicago candidate, has directly resulted in so many of them losing their jobs. matter advocating, advising, or teaching the duty, necessity,
desirability, or propriety of overthrowing or destroying any
government in the United States by force or violence, or attempts
to do so; or
Whoever organizes or helps or attempts to organize any society,
group, or assembly of persons who teach, advocate, or encourage the
overthrow or destruction of any such government by force or
violence; or becomes or is a member of, or affiliates with, any
such society, group, or assembly of persons, knowing the purposes
thereof -
Shall be fined under this title or imprisoned not more than
twenty years, or both, and shall be ineligible for employment by
the United States or any department or agency thereof, for the five
years next following his conviction.
If two or more persons conspire to commit any offense named in
this section, each shall be fined under this title or imprisoned
not more than twenty years, or both, and shall be ineligible for
employment by the United States or any department or agency
thereof, for the five years next following his conviction.
As used in this section, the terms “organizes” and “organize”,
with respect to any society, group, or assembly of persons, include
the recruiting of new members, the forming of new units, and the
regrouping or expansion of existing clubs, classes, and other units
of such society, group, or assembly of persons.
