VIDEO: Days After Being Arrested, Anti-War Group Code Pink Holds Second ‘Dance Protest’ at Jefferson Memorial
by MRC TVLast week, Medea Benjamin, head of the radical anti-war group Code Pink, was arrested along with Adam Kokesh for dancing at the Jefferson Memorial. On June 4, 2011, she returned to hold a ‘free speech dancing demonstration’, so we sent Joe Schoffstall to check it out.
During the protest, the group claimed they were trying to ‘praise’ Thomas Jefferson. However, it was clear given the group’s history- and the events that happened just days before- they wanted to draw attention to their organization.
While the scene played perfectly into the script they were going for- minus arrests- it did leave some tourists unable to view the monument and the participants very happy with themselves. A documentary film crew there captured the whole thing, including our interviews with police on why tourists weren’t allowed re-entry after leaving the memorial.
Medea was not arrested this time and it was better organized than their first go-around. Police ended up blocking off the memorial and not allowing re-entry for about an hour until the group cleared out.

If Protesting Military Funerals is Legal under Freedom of Speech and Dancing at the Jefferson Memorial is not Legal under Freedom of Speech there may come a time when the United States Military rucks up to give classes on Constitutional Law.

Evidently someone had thrown a box of tea bags onto the white house lawn and gave the police a reason to shut us down. The police state, supported by our government is out of control.

We have rights and we also have laws. Law states you can not hold protests or demonstrations at National Monuments. Which is a good law, because some people travel great distances to see the monuments. You also have to have a permits for protest or assembly. Beck went threw hoops to get all the permits for his rally. People have rights, but not at the expense of ignoring the law. The court agreed with the district court’s finding that “Oberwetter’s expressive dancing falls within the spectrum of prohibited activies. The court added that “the conduct is prohibited because it stands out as a type of performance, creating its own attention and distracting from the atmosphere of solemn commemoration that the Regulations are designed to preserve.”

I see what you're saying, but this isn't about the right to assemble or the right to dance. They didn't go there to defend the right to dance or to protest a law against dancing. That's all pretense. They're asserting a right to be obnoxious, and they went there in hopes of being obnoxious enough to provoke their own arrest. They're encroaching on the rights of others to enjoy the monument. Dancing is just how they decided to do it. They could have played cards, did an aerobics workout, tossed a beach ball, played hopscotch, did yoga or whatever else… and when they were told to leave they would have claimed the authorities were trying to outlaw cards, aerobics, beach balls, hopscotch or yoga.
