President Obama Addresses Comprehensive Immigration Reform: Legal or Just Illegal?
by Marinka PeschmannThis morning, President Obama will deliver remarks on the need to fix America’s broken immigration system. Undoubtedly, millions of illegal aliens, and those people who are thinking about jumping the border will be listening intently to make plans. But the largely ignored legal immigrants will also be listening in hopes for legal immigration reform. I am referring to the legal immigrants who followed America’s laws, and who have been stuck in the broken, backlogged, and dysfunctional United States Citizenship & Immigration Services (USCIS) for years.

I am also referring to the serious plight of legal immigrants who contributed to America’s national security, and who are facing deportation which for some of them means fighting for their life, like the author of the Son of Hamas, Mosab Hassan Yousef.
Will President Obama address this group or just the millions of illegals with a slap on the wrist and a fine?
Time will tell but in the meantime, let’s look at legal immigration to compare with whatever President Obama will propose tomorrow.
Following are some of the filing fees and applications required to legally immigrate.
First, legal immigration requires several steps. For instance, whether an immigrant is applying for permanent residence (Green Card) through employment-based, marriage or a relative petition, they must file and pay for the I-485 and I-485A –Application to Register Permanent Residence or Adjust Status, and the Supplement A to Form I-485, Adjustment of Status Under Section 245(i) respectively, in addition to earlier fees required during the legal immigration process. The 485s are essentially the background checks before being granted the green card.
According to the latest USCIS fee schedule:
I-485:
• If under the age of 14 years and filing with the I-485 application of at least one parent. Cost $600.00.
• If under the age of 14 years NOT filing with the I-485 application of at least one parent. Cost $930.00
• All others: Cost $930.00
• An additional biometric services fee is required… costs on average $80.00I-485A:
• If you are under the age of 17 years, or an unmarried son or daughter of a legalized alien and under the age of 21 years, or the spouse of a legalized alien under the Family Unity Program, there is no fee.
• If you are anybody else. Cost $1000.00In addition to the cost of the I-485’s, below are examples of earlier mandatory fees and filings in the legal immigration process.
To file the I-129, the Petition for a Nonimmigrant worker, “for employers to petition for an alien to come to the United States temporarily to perform services or labor, or to receive training, as an H-1B, H-1C, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1 nonimmigrant worker” or to “request an extension of stay or change of status for an alien as an E-1, E-2, or TN nonimmigrant.” Cost $320.00
The I-129 petition form notes: “Certain employers filing H1-B or L-1 petitions must submit supplemental fees of $750.00 or $1,500.00 or a fraud prevention fee of $500.00.”
The I-129 should not be confused with the I-140, the Immigrant Petition for Alien Worker which costs $475.00, or the I-129F, the Petition for Alien Fiancé, costing $455.00. Then there is the I-687, the Application for Status as a Temporary, costing $710.00, not to be confused with the I-698, the Application to Adjust Status from Temporary to Permanent Resident (Under Section 245A of the INA) which costs $1,370.00 and so on. It is worth noting the fees change periodically.
Welcome to legal immigration in America, where following the laws means arcane bureaucracy where you can be stuck in a 20-year backlog (as Senator McCain noted during his failed Presidential bid), all the while hoping to dodge the mindboggling incompetence at the USCIS, as previously reported here:
USCIS document production and mailing processes have raised concerns, as there is no mechanism by which to track delivery of USCIS documents to ensure receipt by the proper recipient. Last year, the Ombudsman highlighted some of the issues that may arise from delivery problems, including lost or stolen documents and unnecessary delays…
As the federal government continues to expand without meaningful internal reform, American’s will soon learn, what legal immigrants have known for years, how awful life can be at the mercy of a broken federal agency that broke under both Republican and Democrat rule.
So the big question for the President is: will the Administration reward the illegals or will the Administration finally take their job seriously, clean up the mess created by Washington, protect the borders and run a competent immigration agency?

Illegals continue to flow in with the hope of hitting the citizenship and welfare jackpots. Any remote mention of another shamnesty will only increase the numbers. Of course he will be speaking to future dimocrap voters rather than the majority of Americans who are in favor of border security, deportation of illegals, and real punishment for those that hire illegal aliens. 25 million out of work and yet we continue to see unchecked illegal immigration and import over a million legal immigrants every year! Stop all immigration legal and illegal until legal Americans are put back to work!! Jail the dang illegal alien employers and their HR staff. Take away all welfare and schooling for illegals and their anchors!

So the big question for the President is: will the Administration reward the illegals or will the Administration finally take their job seriously, clean up the mess created by Washington, protect the borders and run a competent immigration agency?
Reward the ILLEGALS since most immigrants choose to play by the rules and have waited. They want and are willing to play by the rules for the oppotunity to better their lives and therefore tend to support the minority party. They come for a better life and freedoms not more social welfare but an opportunity to thrive.
If the POTUS tries by executive fiat to legalize illegals then impeachment proceedings should start immediately. My ancestors ( two teen brothers) embarked to America in 1683, one died on the ship and was buried at sea. It is an affront to every immigrant that either made the arduous journey or spent time in bureaucratic hell to become a citizen of this great nation to watch a group so easily have citizenship bestowed solely for political purposes.
Wow… another example of how poorly the government runs any program. Can we get some people in Washington that actually have experience running a successful business? What the heck does Congress know about running anything? 20 years to get into the country by legal means and then another 5 years to get that critical surgery you need under the new health care program. Blood is shooting out of my eyes again…
The most important thing in this morning's address will be how illegal immigration effects our "Dear Leader". After all everything is about him. Mark the use of the word "I". We, the unwashed masses, who are too stupid to understand the nuances of the difficult task of getting re-elected, I mean governing, will need to listen long and hard so that we, inspite of what he says, come away agreeing with "His Greatness" and the view of what he is going to do. No complaining. He is always right.
It baffles me these people want to come here to escape their third world hell hole, but then want to turn our country into one. Mexico is a corrupt socialistic country, that's why despite their people and their natural resources they never advance and never will. Their government is Chicago politics to an art form. I hope November is not too late to wake up the voters. If we have weak apathetic voter turn out like we usually do, we are in trouble. People in the country care more about voting for Dancing with the Stars than they do their future!
Obama talks about immigration reform while suing Arizona for enforcing its immigration laws.
If the Federal government would just enforce the existing laws and protect the (southern) border from illegal crossings, we would be better equipped to speed the process of legal immigration along while streamlining it.
Instead, we know "immigration reform" is Obama-code for "grant all the illegals amnesty so they will vote Democrat".
This is all about "securing votes" not "secure borders"!
If he gets away with giving away citizenships to twenty five million law breakers right now, in twenty years the next batch will be fifty million!

If he actually does move to legalize illegals through executive order, I have to believe it will be the straw the breaks the union's back. If Congress doesn't move against him, the states will as too many are starting to realize the incredible damage unchecked illegal populations do. And we're smart enough to know that simply legalizing them won't make them self-supporting assets to the economy.
Being an immigrant myself (came from Czechoslovakia in '69 after the Russian invasion), I endorse amnesty, but only after the five year waiting period that I and the rest of the "legal" immigrants had to go through. But what I don't endorse is the sheer volume of illegals that will be legalized. One of the things the country needs to do is to control what KIND of immigrants it's letting into the country. These are all laborers. They have no higher education. Are there really that many labor jobs in this country that we need this many laborers? Seems to me that the government is artificially creating labor jobs now in order to keep food on the table of the people with no education. No, we need to ration how many laborers come into the country, and offset that with the doctors and scientists we need who are being squeezed out right now because we can only absorb a certain amount of immigrants at one time. Also, letting in this many Hispanics will change the culture of the nation from a meltingpot to a dual cultural society, half-American and half-Hispanic. That would be a travesty. We need to remain a meltin gpot.
As a legal Permanent Resident, I did not have any qualms about the paperwork, filing fees or time frame.
Each time my husband and I had to fill out additional packages of paperwork and pay a fee, we had one year from that date, to do so.
It allowed us to budget and to extend the timeframe over 2 years.
I think, that for all the work that is required to process immigrant applications, that the fees are reasonable.
[If filing fees are a difficulty, then supporting yourself once you are here will also be a problem].
20 years? That is surprising. I wonder how many people are in immigration limbo, because of the fault of DHS.
My application was handled in a very professional manner, by all the people that played a part in processing it.

I guess I'll wait and see what he says. So far all he's talked about is comprehensive immigration reform, which I wholeheartedly support. There is room for debate on how best to enact reform, but there are some things implicit in the definition of the word. These include securing of the border, removal of all currently here illegally, and increasing the number that can come in legally (which will be not only possible, but necessary, once all the illegals are gone).
I'm not stupid. I know that Obama does not actually want these things, and hence can't truthfully claim to support reform. I know what is therefore coming. He will propose something completely contrary to reform, but continue to refer to it as reform (a la stimulus, transparency, etc.). And at that point I will willingly brand him a liar telling yet another lie. It will be added to his considerable resume and hopefully be put on full display when he runs for reelection in 2012.
But I won't bash him for something he hasn't said or done yet. (There's far too much that he HAS already said and done that is worth of bashing). All he's said so far is that he wants exactly what I want – secure the borders and deportation of illegals – in a word, reform. So on immigration the president can count me as an eager proponent of his stated agenda. I will support every effort to bring about that agenda of reform, and oppose any effort to thwart it, including the one that he is surely about to kick off himself.

Well, he SAID he wants reform, and a defining element of reform is the deportation of illegals in favor of prospective legal immigrants who are playing by the rules by waiting to enter legally.
If he proposes to do something substantially different, then he will have been lying about wanting reform – which is admittedly not even close to out of the question.
Simply put, there needs to be an actual "waiting line" and a way to screen "potential" bad actors out and ensure that the only loyalties of "new" citizens are to America only.
If that was the approach I would be "okay" with it but still suspicious of the actual goals of the move.
We simply cannot allow for one president or party to arbitrarily change demographics in the name of ideology or simply maintaining power.
My great great grandparents came here from Germany, France and Ireland but they "asked" to come, they didn't sneak in and THEN ask.
You are right we ARE a nation of immigrants but we ARE a nation of laws first and foremost and we cannot afford to put that aside for the sake of political expediency or party power.
Anything less would be a surrender to lawlessness.
You did it right and by the law, I applaud you for doing so.

Actually, they are voting already, although no one knows how many are voting.
That Obama would bring in America-Hating marxists and muslims to steal our welfare is a given. But it also benefits him that they would vote for his policies to continue.
We need to stand up, check the voting lists for legal and illegal immigrants, and charge voter fraud to all those committing it now. Once we do that, no amount of Presidential pardons will stop Americans from taking this country back.

Legal immigration, like taxes, is hard to get done on purpose. Lawyers and tax preparers profit off of this fact. They then keep bad Politicians in power.
Applications for unemployment, welfare, and voting registration is easy to get done on purpose. Politicians benefit from poor and immigrant people who collect illegal benefits and vote to keep them in place.
If we switched these around, the country would be like it was in the 1950s – a happier and simpler place.
What we need to do is check the voting lists and federal payrolls and benefits rolls for legal and illegal immigrants. Make it a national priority. And when we do this, we will save trillions of dollars and ensure a future for our children.
They, the Neofeudalists, the chimera that National Socialisum and Marxisum became, want to remove the last obsticle to their New World Order, the Constitution, and our dear leader is just an expendable tool.

I've read some horror stories so I don't doubt the system for legal immigrants needs improving but my personal experience with the system was fine (my wife is an LPR).

Are you quite certain Obama said those words? I have the impression that he wants amnesty without a secure border. Quite similar to Calderon's wishes.
What does a "path to citizenship" look like, from the Democrat's perspective? It's all PC BS.
Give illegals already here a pass. Don't kick them out, don't deny them social services, medical, and free education for their children. Give them all a card that specifies they are "guests" or some, such phony definition. Give them legitimate Social Security numbers so they can get legitimate driver's licenses, be tracked, and quit stealing the numbers from children, dead people, and others of similar culture. Want the Fed to kick out some percentage of them, especially the bad actors? Want to see them stop feeding at the Social services trough? Want to see them mandate they learn English? Want to see them develop programs that will inculcate in them a sense of national loyalty and pride, so they will love our flag over theirs? Don't hold your breath. Sorry to say, but we're stuck with these people continuing to bilk us, while sending $billions back "HOME" unless and until a POTUS and a COTUS is elected with the political fortitude to say "NO" to the status quo.

That said, if there is an actual backlog of up to 20 years, for people "attempting" to complete their immigration process, then any accelerated pathway for those that DON'T EVEN attempt to do it legally, is absolutely ridiculous.

I am so tired of hearing about the left's desire for "comprehensive (fill in the blank) reform" ! Why is it so hard for them to tackle one problem at a time? Instead they continue to create excuses for and insist on cobbling together two thousand or more page bills that provide camouflage for their pork, power grabs and agenda items. CLOSE THE DAMN BORDER! It can't be any simpler than that. No excuses. Stop giving us stories about the futility of trying simply because there will be a few gaps that will have to be patrolled on foot and/or by air.
It's all too obvious that the left, not just Obama, wish to use border security as leverage to push through "reform". The left knows that their plans for amnesty and desire to put a bigger carrot on the end of the stick for illegals will inevitably be met with fierce resistance and so they pretend to go along with securing the borders and as we have already seen they are fully prepared to will conveniently de-fund such efforts once they have gotten their way. TWICE the government has offered amnesty under the precondition that the borders are secured and for the sake of "reform". BOTH TIMES the efforts/programs were de-funded and enforcement of said "reform/law changes" went limp over cut backs. Now our own government is going out of it's way to prevent state law enforcement agencies from enforcing (certain) federal laws of the chance they might offend someone.

His lying has intensified if anything. The usual tactics, straw man arguments, demonizing opponents, misrepresent facts. We're onto your tricks Mr. President. He's the one politicizing this for political gain before an election, not his opponents. No one is against legal immigration. What part of "ILLEGAL" don't he understand? LOoking at the speed and efficiency with which the fed gov't responded to a time sensitive oil spill, the way the various gov't agencies contradicting each other's orders and blocked each other's permit processes, at the legal and regulatory wrangling, law and jurisdictional interpretations that were challenged, queried, resubmitted and buried in soft peat for 3 months, the weight of burearocratic BS each layer of gov't piled on the process, the endless forms, regs, and of course confused and inadequate lines of communication……
If they start on amnesty today…..and by that I mean DROP HC, CAP AND TRADE, THE BUDGET, THE FINANCIAL AND HOUSING REFORM, AND ANY OTHER LEGISLATION….illegals will wait a minimum of at LEAST 5 YEARS before they even have a system in place to start processing them. When we did this before, it took years just to set it up, and who KNOWS how long to get each of them documented and registered.
By the time we vote these losers out in Nov, Obama will be talkin to a wall and perhaps a new Speaker of the house. So the idea that amnesty will even be viable, or that illegals will be VOTER READY sooner than 2015, looking at the gulf spill as a modest example, is a joke. Seriously.

Did you read my entire comment? I was being facetious. The only thing I said that he said was that he wanted comprehensive immigration reform. I'm quite sure he has said that.
Applying the only definition of reform that makes sense – that it necessarily involves deporting illegals and securing the borders – I translated what he said to show that it matches what I want.
I went on to indicate that I don't really believe he wants those things, and that he is therefore lying when he says he wants "reform" because reform necessarily includes those things. He has not yet said, for example, that he wants amnesty. When he does, he will have contradicted his statements that he favors reform, since amnesty is the opposite of reform.
I thought I was being pretty clear, sorry if I wasn't.

Reform means securing the borders. It's part of the definition. Therefore, in the absence of any clarification to the contrary (which I'm sure is coming), Obama has technically claimed to be in favor of securing the borders.

Disagree. Most immigrants come here to work and work their butts off. You are a protectionist. Protectionism does not work. The free market works, and that should include a free labor market. People who want to protect American jobs by keeping cheap labor out hurt the American economy. These policies have caused manufacturers to go overseas and out of country. Laws that try to keep people from voluntarily coming together to do something, like work, buy or sell drugs, or have sex, these laws are bad laws and are hard to enforce, especially if there is money to be made. These laws will be broken.
That is because half the people have below average intelligence

Yes, there are lots of manual labor jobs this country could have, if we got rid of minimum wage laws. Heck, I wish I could hire someone cheap to clean up my apartment, do my laundry, do my shopping, cook my food. Yeah sure, I could get a girlfriend, but then there is all that talking and personal interaction stuff you have to deal with. How much cooler would it be to have some from some third world country living in my closet that would do all that? These types of laborers would free up time for the more talented and educated doctors and scientist to do more doctoring and science. And it is not like these immigrants can not learn and better themselves. If they are motivated enough to leave their country to come here, they might be motivated enough to learn how to program a computer.

No, the next step is for more states to give D.C. the finger like Arizona. I REALLY believe this is the issue that will fuel the next civil war, or revolution. The ability of the federal government to protect the citizens of this country right now is nil. It's up to the individual states to take care of themselves. Sad, but true.

Unfortunately, there are still plenty of Republicans at the federal level who are also too afraid of the Hispanic vote to do the right thing. What a bunch of weasels. Not satisfied with exporting jobs, they import cheap labor. And import voters to keep the weasels in office, while trying to buy their vote with public benefits paid for by real Americans.
Assuming no terrorist walks in the back door with a WMD on his back, the issue with illegals will only become more heated with a double-dip recession, one-or-more states declaring bankruptcy and/or a national funding crisis.

Interestingly, I just read (OK, skimmed) the speech as posted on RCP, and am very cautiously optimistic.
He got a couple of basic facts wrong. He's saying something like 11M instead of 30M illegals in the country, and skirted around the idea that he and his party have been fighting for reform for years and been thwarted by the right, as opposed to reality which is the diametric opposite.
But for the most part, he articulated what we've supported forever. He said we need to secure the border. It also seemed clear to me that he recognized the fact that the chief victims of illegal immigration are legal would-be immigrants who are not allowed to come here as a direct result. And while he stopped just a hair short of saying that any path to citizenship must include admission of guilt, payment of fines or other penalties, and most importantly that the alien go back where they came from and follow the legal process correctly, from the back of the line.
At the very least, he absolutely articulated core conservative principles on the issue that cannot be considered satisfied without deportation of illegals before they can be documented.
Of course I'm still a skeptic, and I firmly expect to see legislation that completely contradicts everything good that he said. But I was expecting the speech itself to call for amnesty and turn reform upside down, and as far as I can tell it did not. The clearest sign of this is his allusion to Bush's proposals, which had some republican support and much opposition, but which also involve amnesty and was not reform in any sense of the word.
Though he was chastising Republican supporters of that proposal for changing their minds, he did register opposition of his own in the speech by explicitly condemning amnesty. So I guess to some extent there is indeed the beginnings of a contradiction.
But I remain a supporter of the specifics Obama called for in his speech – IE securing of the borders, reforming of the legal immigration process, and the ability for illegals to become legal immigrants ONLY after admitting their guilt, paying the piper, and going home to start the legal process from the beginning and to get at the end of the line.
Say one thing and do another? Of course, he's going to tell us what he wants us to hear.

it is hardly worth the effort to debate this, or anything else that he says, it's all bullcrap and he has already shown himself to be Anti-American in EVERY sense of the word -
