Immigration Reform: Mayor Bloomberg’s Green-Card-for-Investors Idea is Already Law
by Marinka PeschmannNew York City Mayor Michael Bloomberg might want to retool some of his immigration reform initiatives within his new national coalition, the Partnership for a New American Economy, and team up with Arizona Governor Jan Brewer to tell the Federal Government to “do their job.”

Why?
Because the Mayor’s idea to give immigrant investors green cards to create jobs for Americans already exists. It’s called the EB-5 category for Immigrant Investors. In fact, the EB-5 has been on the books since 1990—that’s twenty years. The problem is the federal government-run United States Citizenship & Immigration Services’ (USCIS) inability to competently process applications.
It was last week when Mayor Bloomberg said on Fox News that he had suggested to the Obama Administration, “You say to immigrants who have money, and are entrepreneurs from around the world, ‘Come to America. We will give you a Green Card. If you start a business here and employ ten or more Americans, and as long as they are still working– you keep your Green Card.’ It matches our needs with their needs and everyone benefits.”
According to the United States Citizenship & Immigration Services:
The fifth employment based visa preference [EB-5 Immigrant Investor
Category], created by Congress in 1990, is available to immigrants seeking to enter the United States in order to invest in a new commercial enterprise that will benefit the US economy and create at least 10 full-time jobs…
Acquiring lawful permanent residence (“Green Card”) through the EB-5 category is a three step self-petitioning process…

It’s unfortunate the Obama Administration didn’t have the courtesy to inform Mayor Bloomberg that his great idea was already on the books before he spoke publically about it.
So what’s the problem for immigrant investors trying to create American jobs? Borrowing from James Carville, it’s the government-run immigration agency, the USCIS, stupid.
According to the Office of the Citizenship and Immigration Services Ombudsman (CIS) 2009 Annual Report to Congress:
… Congress allocated approximately 10,000 immigrant visas per year to this category to make the program an important job creating engine for the United States. However, EB-5 usage rarely has exceeded 1,000 per year. EB-5 underutilization is caused by a confluence of factors, including program instability…
This is extraordinary considering as Senator John McCain noted during his failed 2008 Presidential bid that legal immigrants can be stuck in grueling backlogs for “20 years,” waiting to find out whether or not they have been approved to live in America. It takes a mindboggling level of ineptness for this $2.6 billion agency, the USCIS, to repeatedly fail to fill this precious job creating quota because they cannot process applications competently.
But there is more Mayor Bloomberg and his highly respected coalition members comprised of top CEOs should know. From p. 55 of the 119-page 2009 CIS report:
Recommendation (to improve EB-5)
1: Finalize regulations to implement the special 2002 EB-5 legislation offering certain EB-5 investors a pathway to cure deficiencies in their previously submitted petitions. The Ombudsman understands that proposed regulations have been drafted, but have been stalled in USCIS’ internal rulemaking review process. As these regulations have been in the drafting and review process for over six years, they are long overdue…
And then there is this from p. 12:
USCIS document production and mailing processes have raised concerns, as there is no mechanism by which to track delivery of USCIS documents to ensure receipt by the proper recipient. Last year, the Ombudsman highlighted some of the issues that may arise from delivery problems, including lost or stolen documents and unnecessary delays…
Welcome to legal immigration in America. It’s a nifty sound bite but for countless lawful immigrants who sought America’s dream–legally, it has been a cruel nightmare or an exercise in futility.
But the system becomes more and more anti-legal immigration by the day. For those who were able to obtain status, for example, now the agency is kicking out lawful business owner immigrants, like this British couple who ran a restaurant since 2000.
Clearly Mayor Bloomberg, a wildly successful billionaire businessman, would have to agree that a private company with those problems would have been out of business years ago. Meanwhile, should it become law, the USCIS is the agency tasked to process a path to legal status for 12-20 million illegal aliens. That’s another one of Mayor Bloomberg’s immigration reform initiatives.
The dirty secret Washington politicians don’t want people to know is how the immigration crisis, a federal-government made disaster, occurred under both Republican and Democrat leadership when they abdicated their obligation to secure the borders and run a competent immigration agency. Mayor Bloomberg’s idea for investor immigrants was a good idea. It’s too bad the USCIS failed to implement it competently.

What's lacking is the fact that the investor loophole has been exploited by illegal aliens to get bank accounts, mortgages and auto loans. The ITIN was designed to allow foreign investors to operate in the USA. What we got instead is an excuse to be here illegally and do business.
Banks will accept the Matricula card and an ITIN to open accounts for illegals. Mortgages are written using the ITIN in leiu of the SSN.
So what, you say? Well, the IRS tells you up front that the ITIN is NOT a form of ID or proof of residency. The ITIN is a tax collecting ID number only. Period.

I was hoping for an open thread for this. Dow is plunging today. First quarter isn't as good as they original said. Imagine that. They can only scew GDP by adjusting inventories which can only be covered for possibly two quarters. It is coming soon. Growth is really non-existant. Private sector isn't hiring. These are easy to verify. Housing is down and without housing starts, durable goods remain flat if not negative. Inventories are sitting and they are lying. JMO.
Bear in mind there isn't one line, there are a bunch of lines for each visa category. Wives of American citizens obtain different visas than mothers of American citizens, who obtain different visas than computer programmers who obtain different visas than 'persons of exceptional ability' who obtain different visas than 'investors' etc, etc.
Some lines are longer than others (the wife of an American citizen can enter the US pretty much immediately, but the brother of a citizen would have to wait many years) and some visas last longer than others (after an initial 2 year visa, spouses of Amcits get 10 year visas which can be renewed up until the spouse acquires citizenship).
Yeah this is where they will all go behind closed doors and try to come up with more lies on how to explain it.
Meanwhile they're hoping that no one will notice with the hearing going on with kagan. Or however you spell her name.

I watch the markets consistently.
Wall Street has been fudging the numbers consistently. They KNOW the house of cards is not only fixing to implode, it is on fire as well, and the water lapping at the foundations is soaked with crude oil. There is going to be a big bang, and that is not theory.
In order to meet their numbers, businesses have reduced inventories, laid off employees and raised cah. Their balance sheets have "appeared" good for all intents and purposes, but warehouses are empty. Thusly, all inventory pipelines are empty.
People claiming the recession is over, are simply scared children whistling past the graveyard. It will take one catastrophic, cataclysmic event to shove US over the cliff. Or perhaps not, perhaps a series of small ones.
Meanwhile, Obama dithers and golfs.
Meanwhile the village idiots will be saying…The stimulus is working, unemployment is down and we are on the economic mend. Bouncin Ben Bernanke is sweating bullets because the Fed is behind the curve on raising interest rates and he knows that deflation is coming first and in a nano-second later, inflation is going to blast off. The end of August could be the end of the dollar. I hope I am wrong.

What this really points out, IMO, is that there are just too many laws on the books. Its IMPOSSIBLE for anyone to follow, because instead of taking a law, and starting over from scratch, they amend it with a further law, which gets ameneded, then regulated, then amended again, until NO ONE, not even lawyers, can figure it all out.
Look at the tax code… its so complicated the IRS can't answer questions about it consistantly, yet WE are held responsible for following it.
We need to take the body of laws Congress has passed in the last few years, start from scratch, and simplify them into somthing coherent.

At some point, the guy in charge has to be the guy in charge, and that means, especially to independent minded American types, he has to be a Class A Jerk. Truman had his "The Buck Stops Here" sign. Bush said "I'm the decider." (Obama said he was the one who makes the decisions, but the media treated that as a sign of strength and leadership.)
And to a certain degree people have to learn to accept that. Think about hanging over the plumber's back when you have him over to fix the pipes or what not. That's a great way to thoroughly annoy him, no? If you hire a professional to do a job, you have to give him space to do the job.
Of course the other side to that is what we are experiencing, and what I said in another post awhile ago. If you hire someone to do a specific job, you expect him to that job and no more. If you elect your buddy to go pick up a half-pepperoni/half-mushroom pizza, you expect him to walk back in with one. Not with half a dozen different calzones so everyone can have what they "really" wanted. Not a case of beer and three bags of munchies because you "know" you'll want them later. You sent him for a pizza, you want him to come back with a pizza. And if the plumber catches an attitude when you are lurking of his shoulder when he starts trying to rewire your home, he deserves the boot impacted between his buttocks.
So can we get good guys in?

On a more serious note, hopefully we are so close to the brink of just about everything, that American exceptionalism will emerge. I think honestly that there are exceptional people but I also think they need to know we need them, want them, and will support them. They will no doubt pull out some pretty ugly duck solutions and hand us some hard pills to swallow. Once we demand they show up to clean house, we BETTER BE PREPARED to pick up a broom and take that pill. Cuts both ways. But it's worth the bad taste if the medicine works, eh?

That is the book "The American Democrat" by James Fenimore Cooper. Yes, that guy. You want the section from the last paragraph on page 22 to the end of the first sentence on page 25.
From page 23:
"An example will better show the distinction. In art. 6th of the amendments to the constitution, we find the following clause: "In all criminal prosecutions, the accused shall the enjoy the right of a speedy and public trial, by an impartial jurt," &c. &c. &c. It is not the meaning of this provision of the constitution, that, under the laws of the several states, the citizen shall be entitled to a public trial by a jury, but that these privileges shall be assured to those are accused of crimes against the laws of the United States."
And the next paragraph:

Now maybe it is just me, but for some reason I take his writing that in 1835 to be massively more likely to reflect the original intent of the Founders in regards to the Bill of Rights than to that of people today, who by the direct statement of the "conservative wing" of the Supreme Court enjoy a much more liberal view of the Bill of Rights, that as a direct result of the 14th Amendment, that as a result of the incorporation principle, and that having evolved over more than a century to be more and more liberal.
I repeat: That's what the guys who "passed the test" on the 2nd Amendment have to say about it!
Now I know IANAL, and I cannot dot all the I's and cross all the T's to explain every last detail of that, even though I declare a talent in translating it out of legalese. But in fact, when you, me, or anyone else talks about their Constitutional Rights, those were originally only intended to apply to the federal government, and it has taken 142 years since the 14th Amendment was passed for all of them to apply to the states.
And let me add as well, THAT is why I am no fan of "state's rights", but only their reserved and delegated powers. Before 1868, before today, they could do whatever their individual constitutions let them do, save only for the set asides of the Constitution, which are quite few, including the requirement they provide at least a reasonable approximation of a republican government. That can, and for some time did, include hefty property requirements for voting, which are still perfectly constitutional! Only a fool would be eager to trade a tyrannical federal government for more tyrannical state government, as the state, being closer, is much more capable of inflicting harm on the individual.
And that is why I love the McDonald decision, especially Thomas' concurrence and Scalia's "retort" to Stevens. I am looking at it sitting at the pinnacle of a cumulative process, including its recognition of a right to armed self-defense.
Well, again, as a fanatical American Constitutionalist and American, I absolutely believe our exceptionalism will emerge in this desperate time and pull us back from the brink as it has repeatedly in the past.
Yes, it will be harsh, but doubly yes its worth an atrocious taste, and more than minor pain, if the medicine and treatment work.

You bring up some excellent points but immigration reform still needs to be an issue in this country. Many of the provisions put in place are lengthy and impossible to obtain sometimes. USCIS could also benefit from added staffing. In addition the public needs to be better informed. People think immigration reform is going to let illegal immigrants "cut the line". That's just not true. They will have steep fines and then get on the back of the line. To put in prospective where USCIS is, in regards to processing green card petitions, they just reached 2001. Our country can also benefit from immigration reform legislation like the Dream Act which focuses on promising immigrant students gaining opportunities to go to and graduate from college.
All of this must be done in conjunction with securing our borders. Some of the ill feelings towards immigrants come from smoke and mirrors political rhetoric that is plain false. Hearing people say that immigrants are stealing jobs is absurd. They are all unskilled workers working for next to nothing. If you are unemployed, are desperate for work, and still feel like illegals are stealing your opportunities, there are 50,000 job openings in Arizona for picking lettuce.
