Long Hot Summer Begins: Congressman Attacks Student

It is often difficult to witness people bearing the full weight of the consequences of their decisions, even when it is richly deserved. (And, in the case of House Democrats few have ever been more deserving of reaping everything they’ve sown.) We’re human, after all, and witnessing people on the cusp of realizing that they’ve lost everything can be difficult.
Last week, Democrat Congressman Bob Etheridge (D-NC2) attended a fundraiser headlined by Speaker Nancy Pelosi. He was asked by some students on the street whether he supported the “Obama Agenda.” He didn’t take it well.
Expect more of this. The hard, progressive left captured the Democrat majority in Congress and forced them to enact a fantasy grab-bag of legislation that is increasingly unpopular with the American public. We’re on the cusp of a deeper recession, millions of unemployed Americans have no prospect for work, taxes are about to spike higher and we’ve maxed out the national credit card. The Democrats were given a chance to run government and they’ve only succeeded in running it into the ground.
So, yeah, Democrats who are up for reelection this November are a bit testy.
Fortunately, Rep. Etheridge isn’t one of those gerry-mandered political welfare queens. According to the Cook Report, his district is an R+2 district. He has a credible opponent. Check her out here.
Let’s recap what we saw on this video. A sitting Congressman–a presumed living extension of James Madison and other founding fathers–was asked on a public street whether he supported the President’s agenda. His response was to hit away a video camera and assault a student. The age of Pericles this ain’t.
It is going to be a long, hot summer. But, you’ve been shown a politician who can be beaten this November. Act accordingly.

It is hard to imagine that people go to the ballot box and elect monsters like this man. I'm a peace loving guy but if that man would have done what he did to that fellow to me it would have been a major throwdown.
You have a right to know "Who are you? uh. How about "your boss," The unmitigated arrogance of these "public servants" is unbelievable. These guys got in power because of dissatifaction with their predecessor's spending policies, they double down on spending for political purposes and now wonder why they are being held accountable. Unbelievable! Congressmen like Etheridge do not want to be questioned about their motives. The left truly believes that they should be allowed to govern without having any decisions questions. They know what is best for us common folk and we are just too stupid to understand the wisdom of their ways.
Etheridge now has plenty of time to update his resume as come November he can go after one of the millions of jobs he and his proglodyte buddies in congress have created (or saved)
Fortunately, the congressman encountered a young student. Had that been a full grown adult, Bobbie Etheridge might have found himself on the ground staring up at the sky. That was strictly bully tactics on his part. Seems the dims are growing accustomed more and more to thuggery than human decency. Must be taking BO's ideas to heart regarding the use of in you face tactics.
Not to worry. The dims will write it off as a bad hair day.

Isn't that physical contact considered battery or assault in the 4th degree? I've served on two juries on assault trials that involved less violent contact than this Carolina bozo did to the kid!

Actually by the nature of the "unprovoked assault" it would be considered an assault 1, a felony with the risk of BIG prison time and fines!
I'm no lawyer but under "community care taking laws" I'm pretty sure the police would be compelled to prosecute due to the facts of the assault.

On a certain level, these "gotcha" videos make me cringe, because people I've met who are into this sort of thing creep me out. That doesn't change the fact that elected officials work for us, and should be able to answer (or shrug off) a questioner on the street without throwing a hissy fit.

The police may not allow the kid to "not prosecute", every city in America has "community care taking ordinances" for assault cases.
The "congressman" may not be able to avoid prosecution in this matter even if he wants to and that's just fine with me.
File an warrant for his arrest and then a personal civil suit to follow. He doesn't have immunity to assault someone. I only disagree on your post with regards to the Congressman finding himself on the ground. PEACEFUL resistance, and accepting the inevitable assaults (while being taped, for sure!) is the most powerful image available. Imagine the results if the Civil Rights marchers had physically fought back against the firehoses or the dogs. The establishment media would paint their fellow as the victim. Had the student fought back physically, instead of asking the Congressman to let go, the Congressman would be painted as a victim. The establishment media will already paint this Congressman as such, and with the student physically defending himself, that would be the only video to make it on the television.

Charge this clown with assault and battery! He had no right to touch this kid and he needs to be held accountable! No only is he a political hack. He is offensive to the American public with borish behavior. If this had been a Republican he'd have alreayd been arrested. My takeaway from his actions is that the answer is "No. I'm not at all happy with the President's agenda and I find your associating his agenda with me 'chafing' ".
I have to be honest, I really have a lot of respect for this Congressman. Most Democrats just get ACORN (or whatever they're calling themselves this week) or SEIU thugs to beat law abiding citizens up for them. But not this guy. He actually has the gumption to take matters into his own hands and assault a teenager himself.
It's good to see that there are still politicians out there who are willing to roll up their sleeves and connect with their constituents one on one.

You are walking down the street and two unidentified kids stick cameras in your face and start engaging you with cameras. They obviously aren't part of the media, but here they are, invading your privacy and filming you without permission.
Although the Congressman is a "public servant", he does have the same privacy rights that you or I have when he is not actually working at his job. That includes the right NOT to have someone stick a camera in his face and ambush him with questions. Especially in today's climate of grabbing video and posting it to YouTube for the sole purpose of embarrassment or even harassment.
That is apparently the motives of these two "college kids" in the first place.

Actually, there ARE laws that prohibit you from filming without permission, just as there are laws that prevent you from posting this video up on a public forum without permission. The media has to get the permission in the form of a "release" of everyone within camera view of a news story BEFORE that video is allowed to air. The filming of a movie or a television series has to do the same if it captures the image of any recognizable person or branding within a camera shot. The same holds true for filming for the purpose of a "project" like the ones these kids claimed to be working on.
For that "no comment" thing to work, you would first have to identify yourself as a "student working on a project and would like to ask you some questions…" THEN a "no comment" response would be appropriate. Why isn't anybody asking, or answering, the simple question which Etheridge asked? In short, who is this guy who is filming him – and whoever is filming the student who is filming him? It's obviously a set-up, and no matter how much we might dislike this Congressman or how he responded to what was obviously intended to be a provocative situation as a video ambush on the street, it's a fair question he asked. Who is this kid? Why couldn't he identify himself more accurately, rather than just proclaim himself to be a student doing a project? I am certainly not a defender of Etheridge or his actions, but I think it is fair for the person being ambushed to know who is confronting him, and why. It is not right to just shove a camera in his face and try to create a "gotcha" video.
Hopefully this disrespect was done by a progressive zealot, rather than a conservative activist. No matter how much we may disagree with our members of Congress, we should challenge them respectfully, and not be deceptive about who we are or why we are asking them a question. After watching this video, my sympathies are with the congressman. I don't share his politics, but this "student" did not identify himself, or introduce himself before demanding an answer to his question while putting a cell phone in the congressman's face. That's simply rude. You shouldn't approach people that way!

Just because someone is a public servant doesn't mean that people can treat them like this. There are ways to approach elected officials on a public street without scaring them and causing them to want to detain you–particularly when you won't identify yourself!

The law is not on his side. Get a clue. Even if the student was breaking a law filming the quack and asking him questions (please tell me what law that would be), the congress critter has absolutely no right to lay a hand on him. None. Did I mention that I have a bit more than a clue when it comes to the need for permissions and releases? As a person who actually makes his living dealing with such things, you cannot just ambush a person on the street with a camera, make recordings without permission and then publish them online or on air.
I have seen a lot of footage of tape wasted because just one person refused to sign a release or give permission for the use of their image.
As far as how a person responds, let me ask you the same thing that I've asked everyone else but can't seem to get an answer out of: How would YOU respond if I started following you around with a camera and asking you questions? Excuse me, but I am QUITE familiar with the law when it comes to recording or filming someone without their permission — on or off a public street.

I have been reading the descriptions of the altercation and finally was able to view the video on this site.
If someone came up to me on the street doing the same thing these young men were doing, they would likely get a similar response from me.
Of course you have a right to question your elected officials, but how does accosting them on the street with a video phone in an aggressive way serve any greater purpose than to try and elicit a reaction? It's a set up.

You can talk to congressmen on the street. If you notice at the beginning of the video, they were talking to him and he was responding. But, then they shoved a phone into his face–it's pretty obvious and it makes me angry and everyone thinks that kind of behavior is OK. It's not.
What these young men did crosses the line and their anonymity is very telling. Are they really students? Is there really a project that they are working on? Or are they agitators, just on the right, instead of the left?
They refused to identify themselves. They acted aggressively towards a member of congress even if it was a phone.

As for what I would do. Hard to say, since I've never had it happen to me. Let me tell you what I wouldn't do. I wouldn't man handle and "hug" the person videoing me or talking to me unless I felt I was being physically threatened. 1. "gotcha journalism" is what its called. It's an ambush–the purpose of which in this instance seems to be to agitate the subject and then get the reaction on video. The more professional form where a camera man and reporter go after someone is usually a tactic of last resort when the subject has been contacted and has refused interviews.
2. Well, is the person a student? is there a project? Who is he? This kind of anonymity reminds me of the Palestinians who "protest" with masks over their faces.
Answer me this: The congressman was fine with the exchange until the "students" got very close to him and put the camera phone in his face. If someone did that to you, wouldn't you want to know if they were actually your constituents or not?
And to answer your question, I would never aggressively invade someone's space like that with my hands or a camera phone thus making someone want to either bat me away or try and detain me.
If I was a college student doing a project, I would first contact the congressman's office for an interview or statement. If I did approach him/her on the street, I would introduce myself and communicate my purpose. I also wouldn't ask such a blatantly lame question. Isn't it kind of dumb to ask a democrat if they support the democrat agenda?
3. First of all, let's be clear–we don't know that the young man was a student. We don't know who he was. And yes, he was being aggressive. At first, he wasn't. He greeted the congressman; the congressman responded and he knew that he was recognized. But, then, as he continues to walk by, the man takes his camera and shoves it right into his face and asks the question.
The congressman responds with a question of his own which the man will not answer. Saying that you are a "college student" working on a "project" is not an answer.
Etheridge also asks him where he is a student from, again, there is no answer.
If they were sincere in their business, they would have approached the congressman directly as he came towards them on the sidewalk and introduced themselves and remained respectful and kept a respectful distance, something it is obvious from that video that they did not.
You try that with the President and see if you don't get arrested.
The congressman didn't need to say anything, but if you are going to shove something in the face of someone and they ask you who you are and you are cagey about it, it is certainly going to make them suspicious of your intent.
It is disingenuous for you to characterize what this young man did as simply "asking a question." He shoved something in someone else's face and refused to identify himself.
Congressman Etheridge doesn't owe just any person on the street the answer to any question whatsoever and neither do you or I, particularly when that person refuses repeatedly to identify themselves.
And this person continues to not identify himself to the people who watch this video.
Again, we don't know who he is, or what his real purpose is.
If you are a student and wish to interview an elected official, this is not the way to do it.

The congressman should have just kept walking and not said anything, or maybe calmly told the interviewer to contact his staff to schedule an interview. But the congressman is a human being, and I can't blame him for his basic reaction. If someone did that to me, I'd react exactly the way the congressman did. These were a couple of kids trying to employ a "gotcha journalism" scheme and they got a reaction that they hoped for. Nothing more.
He was in a no-win situation. Like I mentioned in a the above comment, these two kids were on a "gotcha journalism" project.
I notice that there is absolutely no explanation of what that "project" was all about, or what their goal was. They knew that if they ambushed one of these guys coming out of that fundraiser they were likely to get some footage they could use to embarrass the subject.
Given some recent prior "projects", we already know that by using creative editing they can make a subject on a video say just about anything. We don't even know if this particular video didn't start earlier than it shows and that maybe the Congressman told them no comment or to make an appointment with his staff. For all we know, they badgered him enough that he went off and they conveniently edited the video to make it appear he just went off on them for "no reason".
Right now the credibility of "students on projects" like this especially those highlighted by Breitbart are somewhere around zero, thanks to clowns like James O'Keefe and company.

You are going to "educate" me? I make my living deciding whether a particular shot or recording gets to see the light of day based on whether consent and releases have been acquired.
You, as a citizen, have a right NOT to be photographed or recorded without your permission. There are exceptions that will allow for incidental occurrences, but not where you are deliberately targeting someone.
There are recent cases where a number of police agencies are relying on this law to file felony charges against anyone who tries to video record police activity, based on the individual cop's desire not to be recorded. It doesn't matter what the person making the recording intends to do with it.

This is much ado about nothing. These "students" were rude and confrontational with the Congressman. He reacted badly, by pushing his way past them, but it was hardly an assault or anything like that. He has apologized. Have the "students" apologized?
Yes, it is a politician's responsibility to answer to his or her constituents. But there needs to be civility. If these students truly wanted to talk to him, they would approch him, introduce themselves, explain their purpose and ask if he would be willing to talk on camera. That's how you approach someone civilly, and I would guess that if they did this, he would have stopped and spoken with them. But that's not what they did. They approached him cold, stuck a running camera in his face, refused to identify themselves, and asked questions in an obviously slanted way (the reference to "the Obama Agenda," rather than asking about some specific policy or piece of legislation). Clearly they were trying to provoke him into doing something stupid, and they succeeded. Congratulations.
When you confront someone rudely on the street, you should expect to be treated rudely in return. The Congressman has apologized. The guys with the camera should do the same. And then we should move on and forget about this non-story.

1)Well then alot of investigative journalist television is filled with “gotcha” journalism. I personally remember when Geraldo Rivera used to ask questions of “greedy” business people on camera and it aired on National Television. I just thought it was funny that you brought that exact phrase up since no one here really refers to it as anything other than asking a question on camera. Curious that. My take is that this “gotcha” journalism moniker is merely a device designed to lower the impact of the video.

2)Okay. I would guess that the two people taking the videos were students and this video was their project. Maybe they were curious about whether or not the Congressman agreed with Obama’s agenda. Maybe they fancy themselves citizen journalists. Who cares?

3)How is asking a question being "aggressive?" You and I have very different ideas about what aggressive is, I guess. To me it sounded like one of the students said,"Hi. Mr. Congressman, Do you agree with Obama's agenda." And that was pretty much the exchange before the congressman got aggressive. I feel like I live in an alternate universe from you. Again, you might want to look at the video again.
Personally, if it was me. If someone came up to me on the street and asked me a benign question like "Do you agree with Obama's agenda?" on video, I would have said "Oh Hell No." and then I would have been curious about who the person was, but that's just me.

"Rights" and "laws" are COMPLETELY different things. When someone claims to have a "right", they designate the object of justice. With "law", it is the system of RULES. First of all, the Constitution is basically a contract between the people and the government. The Bill of Rights is a limitation on the Government, not the people.
The LAWS we've created over the years protect the people from other people or their actions. These laws confer a certain right to those people.
There is nothing in the Constitution or Bill of Rights that prevents you from entering my house. The Constitution only says that the GOVERNMENT can't enter my house without probable cause and a warrant. It doesn't prevent YOU from entering. But there are LAWS that prevent you from entering my home, thereby giving me the RIGHT to keep you out.
You miss the entire point here. There are LAWS that prevent you from taking pictures, audio or video recording another person without their permission. There are additional laws that prevent you from publishing that media without permission. It isn't always enforced mainly because people don't realize that they have the option to refuse if they want to — or they just don't know.
But in this particular case, given recent actions by people like James O'Keefe, a lot of public figures are leery of these pseudo-journalist projects — especially when they are ambushed like this guy was.

Actually, these college students need to learn how to approach someone politely and respectfully. You're a student, or a constituent, and you wish to speak with a Congressman. For "a project." You can call and make an appointment. Or you can approach him outside a fundraiser, introduce yourself and explain what you want to do. If you do this, people will almost always respond politely. But if you ambush someone with a video camera, refuse to identify yourself when asked repeatedly, and ask obviously slanted political questions, you are being rude and confrontational, and there is no surprise if the subject of your ambush responds rudely as well. I know there are laws that prevent people from being filmed/taped/photographed. I know that "rights" and "laws" are very much different. That much we can agree about. The Congressman does not have a "right" to demand who they are. The correct thing to do would have been to inform them that they were breaking the law (if that is the law in NC; not every state requires that both parties know that a camera is rolling), and for him to say "No Comment". A photographer by the name of Carlos Miller is on a personal rampage because he was arrested twice in the past for photographing and/or videotaping police at work, was asked not to, resisted, was arrested, beat both charges he claims, and now is on this rampage about his and all photographers First Amendment rights, as witnessed on his webpage blog "Photography Is Not A Crime. I have differed in opinion with the shenanigans these photographers pull as stunts to embellish their positions and have even challenged them to take it to court and see what the Supreme Court has to say but all they do is keep on slamming anyone that disagrees with them and… they pull stunts like this one. Cog I don't mean to belabor the point but I think the fine points are where the discussion is. Under the United States Code Title 18 Subsection 1514(c)1. "Harassment" is defined as "a course of conduct directed at a specific person that causes substantial emotional distress in such a person and serves no legitimate purpose". With this in mind where do you see the "substantial emotional distress" this Congressman endured? The "legitimate purpose" seems obvious to me, he is a public servant, sworn to uphold the Constitution and " well and faithfully discharge the duties of the office on which I am about to enter: So help me God." HarleyOne8, Thank you for citing the definition of Harassment. My use of the term was to address what appeared to me to be an obstruction of the Congressmen's path as shown in the video. As he had looked down before the video broke away (a segment of time in which we do not know what ocurred) and then engaged the student in what appeared to be a spot he would have had to leave the sidewalk to avoid, I called "harassment".
I think a rule in demonstrating is not to impeed citizens using the sidewalks in any way. I don't know where, or if, it actually appears in law. This was affirmed for me as recently as Tuesday, at an event.

Hi Cog, so how do you feel about the fact that the Congressman IS in fact our employee and has been asked, by an employer, his opinion on something he has power to vote on and instead of answering he pushes, shoves, and refuses to answer? Would you, if you were/are a boss or would your boss tolerate such behavior?
