Our Dysfunctional Congress
by Kevin PortteusWhen Senator Evan Bayh (D-IN) announced that he would not seek re-election this fall, he contended that “Congress is not operating as it should.” He lamented that partisanship and ideology have so pervaded Congress that “the people’s business is not being done.” Bayh cited the recent scuttling of a proposal to create a commission on federal spending, and the handling of a jobs bill. In short, Congress is no longer a properly functioning legislative institution.

Woodrow Wilson’s 1885 book Congressional Government is cited by virtually every scholar as seminal study of that institution. In it Wilson contends that the problem with Congress is that it is too preoccupied with legislating; the most important function of a democratic legislature is debate. Congress must debate, so that the people might receive “instruction and guidance in political affairs.” Legislators must constantly and publicly articulate their positions and attack those of their opponents. The New Republic co-founder Herbert Croly concurs, maintaining that Congress be transformed into “a parliament in the old sense of the word – a talking body, a battleground of opinion.”
The actual business of legislating would be handled by administrative agencies, which Congress would empower to devise and implement the means necessary to accomplish socially desirable ends. Croly observes that “social legislation is coming more and more to demand results rather than prescribe means.” With this understanding, Congress has been delegating legislative power for decades. Confronted with growing public concern over air pollution, Congress created the Environmental Protection Agency to implement regulations to clean the environment. The response of both parties and the White House to spiraling budget deficits has been to propose the creation of a commission to balance the federal budget. Over time, as political scientist Morris Fiorina has argued, congressmen have come to realize that delegating is electorally profitable. Congress earns credit for supporting environmental protection, but public blame for the burdensome rules necessary to achieve clean air is shifted to the EPA.
Freed from the arduous business of legislating, congressmen are able to focus upon debate. Debate, however, devolves into little more than posturing and maneuvering. Members have an incentive to take and hold extreme positions favored by core constituencies, demonize the opposition in order to score political points, and employ overheated rhetoric in support of both. These tactics mobilize supporters and win elections, but are not conducive to effective legislating. Deliberation is not a skill valued by the progressive understanding of a legislature. Such a legislature does not attract members of a deliberative temperament; once there, they have little opportunity for real legislating. The self-interest of legislators is effectively divorced from the exercise of legislative power.
When Congress is confronted with a situation, wherein it must actually legislate, it is exposed as being unable to perform its core function. In session after session, Congress is unable to pass a balanced budget in a timely manner. Health care reform has degenerated into a series of backroom deals and a summit, which wass little more than a staged photo opportunity. Congressmen, moreover, are unwilling to make decisions that may endanger their prospects for re-election, as they are conditioned to delegate those decisions. The recently enacted health care legislation assigns to administrators the task of making the decisions that will shape American health care. Unable to deliberate, and unwilling to take responsibility for making policy decisions, congressmen are reduced to engaging in fruitless partisan warfare and public grandstanding.
To solve the problem, it is imperative to restore Congress as a legislative institution. Congress must deliberate about public policy problems and enact laws that make tough choices about what policies the nation ought to follow. As stated in The Federalist, they must make “rules for the regulation of society”, rather than merely creating and empowering agencies to do their dirty work.
When Congress legislates, it is far easier to judge the body by its work, and the members by the real decisions they make. Legislative elections, in turn, would revolve around substantive policy alternatives, not position-taking. Congressmen would again have an incentive to become better legislators. Laws and lawmakers would be more responsive to public opinion and more responsible for the general welfare. In short, the solution is to eschew the progressive model of a legislature in favor of that embodied in the Constitution.
This transformation must come from within: the President cannot make the necessary changes, and when the courts have intervened on behalf of constitutional government (such as when they overturned the legislative veto), Congress has simply ignored them. The self-interest of legislators must be reconnected to deliberative policy-making. This is turn will only happen when public opinion understands the progressive nature of Congress’ dysfunction and returns to the constitutionalism of the Framers.
Senator Bayh says that Congress needs “real reform”, but a century of progressive reform has left that institution distracted and ineffectual. If Congress wants to do the people’s business, what it really needs is a healthy measure of unreform.

I have a minor suggestion. How about Congress just stop. A moratorium is declared for two legislative cycles that no laws are offered or enacted. They just get to sit on their asses and collect their pay.
The country would be better for it.
The responsibility of the US congress needs to be limited to only those enumerated powers granted to the federal government by the Constitution. The problem is not that congress legislates too much, but that it is allowed to legislate in areas of public life that they were never empowered to regulate. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Downsize the federal government.

Perhaps what needs to happen can be summed up as the dissolution of bureaucracies that receive the power to set policy without the need for individual legislation. Although it would take time to unravel the tangled mess of bureacracies we currently have, that is a goal conservatives would probably go for.

This is very true. It is also why I continually advocate an Article V convention to amend the Constitution. Specifically, we need an amendment that DEFINES and LIMITS the interpretation of the Commerce Clause such that we reverse every decision of the court which has been used to usurp the sovereignty of the States and of the People. We obviously can't rely on the courts anymore to limit the federal government, so we need to take responsibility to do it ourselves.
We need to find some way to establish TERM LIMITS for Congress. Politicians care about one thing, staying in power. The longer they serve, the worse they become. John Murtha, Duke Cummingham, Charlie Rangle, Tom Delay. The list could go on and on. Also, we need to disolve both the House and Senate Ethics Committees and have some sort of INDEPENDENT group to monitor the Congress. The House and Senate Ethics Committees have become nothing more than a whitewash panel. No matter what comes up, they drag it out for years, then bury it.

NOTHING, nothing in the Constitution gives Congress, nor any branch of government the RIGHT to tell the American people how to live the way that Congress wants us to!!! Their ONE job is to keep this country safe from foreign and domestic terrorism, and to ENFORCE the laws already on the books!! NOT of enact new laws that mandate us to abide to their way of thinking!!!
This article raises an interesting point. If Congress is supposed to listen to the people and debate merits and legislate; what happens when the people want something that is bad for the country? At that point our whole system degenerates into a "Lord of the Flies" scenario, which is basically what we have now. We all need to start making wiser choices if we want to fix this mess we're in.

The puppets in Congress are just another tool in the masterful game of DISTRACTION that is the core TACTIC being used by the "men" that control the US government-media conglomerate. The objective is to delay as long as they can so that you do not come to understand what really matters, the LAW, the FACTS and the TRUTH.
There is nothing to debate or argue, but they do, its great theater. The core of the matter however, is elected in Congress are complicit in a fraud of the highest order. There are just three at the core of the mass of corruption that has over-run the federal and state governments:

These 3-FACTS have NOT EVER been addressed publicly by any of those in the (federal or states) Congress, DNC, the RNC or the MEDIA (left middle and right [except at WND]. I sat here wanting to express just what you have expressed. As a first time active "member of We the People" at age 67 I am finally involved in local politics including my cup of tea, Liz Carter for congress in GA-4. Hopefully we can "Yank Hank". There are MANY more like me and those here. (Thanks Andrew!) who are behind the faces at the Tea Parties taking a stand after being moribund for so long.
You are absolutely correct that we have a lot of work to do and I really do think we are seeing just plain folks rolling up their sleeves! THIS WILL NOT be a QUICK FIX in November, but a really good start. The 3 chambered heart so well conceived by our founders is close to fibrulation! It may even 'crash and burn' since it is so 'clogged' with partisan seniority 'crud'.
Two good things I see are that many of the most senior dead wood congressfolk and senators will be displaced, this time, and We the People – Tea Partiers are parasitizing the Republican party.

We need both a budget that starts from zero every year for every agency so that they have to come before the budgeting folks and justify every red cent they're asking for -and- we need someone with enough 'nads to tell every agency that no matter what their prior budget was, they will get no more than 90% of that amount going forward. It would force the agencies to trim themselves until we get to a point where the budget is balanced every year. Hopefully, agencies that aren't needed will be weeded out by the process particularly if they are encouraged to rat each other out as part of the justification process.
If agencies are meant to do Congresses dirty work, let them work on each other as they fight for a steadily shrinking pool of Federal dollars.

TS, I have studied this idea for many years and I am continually amazed at how the debate invariably unfolds.With a clear understanding by a vast, vast, vast majority of people that the federal government has overstepped, overreached, and blatantly disregarded the limitations placed on it by the Constitution, fully supported by the federal court system, some brave soul, upon remembering the protection afforded us by the Framers in Article V of the Constitution, suggests that we may need to take responsibility for protecting our rights through a State run convention, the instant reaction to such an idea turns out to be, "No no. You must fear a constitutional convention. Too many things might change. Everything will be on the table. It could mean the end of freedom forever." On so on, and so on.
I'm going to tell you that this reaction has been written into the narrative by the very progressive forces that have labored to subvert the Constitution to begin with. Their greatest fear is that the people would take any such initiative to defend their liberties, and so they spread this unwarranted loathing.
And it IS an unwarranted fear. Remembering that an Article V convention can only take place on the request of 2/3 of the States, and that ratification of ANY PROPOSED AMENDMENT could only take place upon the approval of 3/4 of the States, how is it that you would believe that 3/4 of the States would vote to ratify changes that would HARM the rights of the People? On the contrary, that kind of convention would so focus the People on the matters of liberty that the very opposite is almost guaranteed to dominate the debate.
We need to shed this "fear" that has been foisted upon us and stand along with Jefferson in the belief that the collective wisdom of the People in matters of government is FAR SUPERIOR to the subversive whims of a central government; that SAME central government which has been subverting our Constitution AGAINST THE WILL OF THE PEOPLE, for generations, and that WITHOUT DEBATE or even much notice by the population at large.
Finally I'll note that their have been hundreds of constitutional conventions carried out by the States in our history, and NOT ONCE has any State's constitution been so radically altered as to harm its People. It has always resulted in the reassertion of personal liberties and founding principles.
Keep this in mind as you weigh the benefits and the dangers of an Article V convention; would you rather the State legislatures and the People decide how our government should be shaped, or do you prefer the the steady erosion of our Representative Republic at the hands of the detached bureaucracies that exist in Washington DC?

I do see what you're saying and yeh, there is ample reason to believe your point that this "fear" is perpetrated by the same folks who pervert the Constitution on a daily basis…and courts who do the same.
There is a movement afoot I have been trying to wrap my limited knowledge of gov't around, the Enumerated Powers Act….bottom line in my life I've seen so many well intentioned things, laws, amendments, etc, turned upside down and used to pervert the principles they were supposed to uphold and defend…I just don't have a lot of trust and once lost, it's so difficult to get back.
I will do this.
I will accept on faith your assertions and remove myself from the process since at 64 I have no intention of spending my remaining days on this earth becoming a Constitutional expert. I won't oppose those who do claim such expertise and will try to keep my "gut fear" in check, and hope that they are right, that this will be a good thing. Because frankly I don't see how it could get worse. I'm sure it can, but I don't see how.
Maybe the best thing folks like me can do is keep faith with our fellow citizens, those who obviously know more history and law, and just allow them to do what they think is best. I don't know you or your motives but I refuse to live my life FEARING what you have in mind for us as a country. So I will trust you, your knowledge, your motives, and hold faith that you and others calling for this can and will do your best to make things right again.

Changing congress sounds like a great plan….but look at that chart. Look what happened every time congress said no. Now is this possible because we're STILL in an H1N1 STATE OF EMERGENCY? Is that how Obama is able to do these things? Or is this just the way gov't works?
We sure as hell need to get an answer on THAT ONE. Because if it's just the way gov't works, we are in for more than just a fight for congress. THEY created these agencies and they have taken on a life and power of their own…….waaaay more than even congress has demonstrated they have.

In other words, turn the Senate and House into a puppet government while administrative bureaucracies not required to answer to the people for their actions would get busy legislating us into poverty for our own good. Well, it took nearly 100 years for Crowley and Wilson to achieve their aims, but clearly the tipping point is finally here. Debate only works when the other side is willing to agree on the tools of the debate: reason and logic, with the ultimate arbiter being reality. Once you've thrown those out, debate is impossible because you no longer have any tools which you can use to change the enemy's mind… except for force.

You're right John, and I think your support of this approach shows the depths to which the progressives will go to destroy the Constitution.
Consider:
1. What is being done in DC today is un-Constitutional and is therefore illegal.
2. Instead of enforcing the Constitution, you (and your ilk) want to change the Constitution to 'modernize' it in some way as if the words on a piece of paper will influence the actions of criminals. You have about as much chance of success in this endeaver as have the attempts to 'fix' our immigration problem by declaring amnesty for all illegals so they won't be 'illegal' any more.
3. Change all the laws and words you want – until the words become truly representative of the principles and morals in our government, they mean nothing and have no force whatsoever – not your proposed Constitutional modifications – not our current Contstitution.
4. Constitiutional amendments only become reasonable when the vast majority of the country has already adopted the change IN PRACTICE and the admendment is simply 'updating' the Constitution to 'allow' the new practice (such as Women's Suffrage for example).
5. I consider all calls for a Constitutional amendment process prior to all issues being settled as a means for the law-breakers to modify the laws in such a way that the law-abiding lose the legal standing for their arguments.
6. Leave the Constitution alone until we have resolved the Congressional, Judicial, and Presidential 'crises' currently foisted upon us by the statists and their 'progressive' lackeys.
DO enforce the Constitution by removing the institutions they have put in place to run their state-managed 'utopia'.
DO bring them up on criminal charges for the malfeasance, felonies, and treasonous actions they have committed while in Congress, the White House, and while acting as Federal Judges.
DO require them to forfeit all ill-gotten gains that resulted from their criminal activity.
DO require them to make pecuniary restitution to We The People out of their personal fortunes as a deterrent to the next batch of dictator wannabes.
Agreed – One politition in an empty House or Senate Chamber posing for the TV cameras does not a debate make.

That brings up an interesting point. Any time a lawyer runs for any legislative office, his opponent should a) not be a lawyer and b) point out that having a lawyer in the legislature is a violation of separation of powers and, on a more basic level, is like putting foxes in the henhouse.

Me, "and my ilk?" Whatever the hell THAT means. I would agree with you in principle that the Constitution as it is written should be sufficient to restrain the actions of those who would do it violence.
But let me ask you, how is that working out for you? Are these people restrained? Or has a monolithic group of subversives already shredded the integrity of the document?
And let me ask you this. Were the Framers (and their ilk) also just a group of subversives for having WRITTEN Article V into the Constitution? What other purpose would they have had for writing that clause into the original document, except that the People could use it in the event power had become so maligned and centralized that no better recourse remained?
You are right in one respect. There are a group of "progressives" out there that want nothing more than to destroy our Constitution. Where you miss the point is that THEY ALREADY ARE. Me and my ilk (that would be the American People) have one very powerful weapon in our arsenal to undo the damage that has ALREADY BEEN DONE, and that is the Article V convention.
I would hate to see us waste this powerful weapon that the Founders bestowed upon us be cause we as a People are too afraid of what those few in power MIGHT try to do to the process. We're better than that. We're better than they are. And we would win the day, if only we had the guts to take on our oppressors. Perhaps that's the only area where we lack.

Mr. Portreus, you left out one important detail in your congressional rant. Our current congress has just 435 members. Article 1 Section 2 The number of Representatives shall not exceed one for every Thirty-thousand. That means with our current population of 300 million there should be 10,000 members of congress. If your first reaction is congress should remain exactly where it is at then you are a leftist plain and simple. An educated rational person such as your self would (I assume) know the difference between a direct democracy and a free Republic. Currently we have neither. The Senate remains at 100 members unless we acquire more states then it is 2 per as outlined by our US constitution which every one seems to ignore including the Republican party. Thirty years ago, I wanted MORE liberty and LESS government. I think I was in a jungle getting a little antsy and a lot sweaty back then. Yup, it was really bad 30 years ago.

Senators and Congress must be a citizen for a least 7 years. Even if he is not a citizen being married to Michelle nullifies your argument in the first place. However, the argument is whether someone is a natural born citizen, and it doesn't really matter in either case because if we can vote him out in 2012 then it doesn't matter. Trouble is finding Republicans and Democrats who want to undo all the garbage that he has bestowed upon us. If you complain that congress doesn't listen I just told you why regardinghttp://www.thirty-thousand.org England has more representation in its parliment than the United States. You'll have to run for congress, state office yourself. There is no point arguing whether or not Obama is a citizen. No one will impeach him if he isn't and the argument is useless notice how if any one asks how the heck did he get an Indonesian passport in the first place if he is a US citizen everyone paints you as a kook or loon. It is better to find a better fight and concentrate on making sure he doesn't win re-election then again perhaps the election is already rigged in the first place. You should run a precinct or run for an elections clerk and nullify every vote that he gets. The left does it and the left wing of the Republican party does it too. Forget about the health care and the fringe birther and 9/11 crowd. Fight for more representation fight for smaller congressional districts and we will win our country back.

The other possibility that could be used is for the states to stand on the Tenth Amendment and tell the Federal Government to 'bug off'' like Montana and Tennessee have already done. As Thomas Jefferson said "Whensoever the General Government (Washington) assumes undelegated powers, its acts are unauthoritative, void, and of no force." Our states need to stand up to the Feds and tell then "NO!" and back it up with prison for Federal agents attempting to enforce unconstitutional laws.
It seems that our 30k friend didn't pass middle school math. Not exceeding one per 30k means the ratio of representatives to residents cannot exceed 1/30000. Representing less than 30k would exceed the ratio. Representing more gives a smaller ratio thus remaining in compliance. The clause only sets a minimum number, not a maximum. Math fail!
