McDonnell Favors Use of State Troopers in Enforcement of Federal Immigration Law
by Kevin MooneyVirginia’s state troopers should have the authority to enforce federal immigration laws against the most dangerous criminal elements, Bob McDonnell, the state’s Republican candidate for governor has argued. This policy stance has larger federalist implications and should curry favor with 10th amendment proponents, but it has earned little media attention throughout the campaign.

An obscure provision of federal law makes it possible for local and state officials to be trained as federal immigration agents. Section 287 (g) of the Illegal Immigration Reform and Immigrant Responsibility Act authorizes the Immigration and Customs Enforcement Agency (ICE) to form partnerships that can be shaped to suit local priorities. Although this option has been available since 1996, most partnerships have been formed in just the past few years, according to ICE.
In an interview, McDonnell said he favors state-wide application of the 287 (g) program because in his view it would compensate for the lack of resources available to ICE. While serving as attorney general, McDonnell worked with local governments in Prince William, Herndon and Rockingham counties to establish 287 (g) agreements. Tim Kaine, the state’s Democratic incumbent governor, has resisted using the program on a state-wide basis.
“With the lack of resources and staff both Republican and Democratic congresses have given to ICE, I think the only way we were going to have reasonable enforcement in Virginia is for Virginia officials to do it on their own,” he said. “287 (g) allowed a legitimate and prudent way to address that and so I was concerned about having each county and each city out there by itself, which was why I asked the governor to, in at least the most serious crimes, allow Virginia state police officers to be trained as ICE agents and he repeatedly refused.”
Gov. Kaine has said previously that he is opposed to having state officials assume what should be federal burdens because this would subtract away from their primary responsibilities.
McDonnell is unmoved by this rationale because state and local officials already encounter illegal aliens in their daily routine. He expects this dynamic to continue, so long as the federal government fails to step up and meet its enforcement responsibilities.
“Regardless of where people stand on immigration policy and the idea of comprehensive reform, there is broad agreement concerning the detention and removal of the most dangerous offenders who have committed crimes beyond their immigration violations,” McDonnell said.
There is a precedent for cooperation between Virginia officials and federal agents that could give a boost to McDonnell’s 287g, should he prevail on Tuesday. ICE agents placed 171 convicted sex offenders into deportation proceedings after exchanging information with the Virginia state police as part of “Operation Cold Play” back in 2008.
As a result of working in close concert with local governments that took up the 287g program, McDonnell said he would be well positioned to help craft the right program as governor.
“We actually had a template for how those agreements must be drawn up so they would meet with the approval of ICE and I think that’s a tool that a governor has to have at his or her disposal that I would use,” he said.
The idea of allowing for states to have greater autonomy and dexterity in the implementation of public policy could have larger ramifications, if a Gov. McDonnell can invoke the 287g program, as a successful example of federalism in action.
“There is a lot of discussion now about federalism and the forgotten 10th amendment and what the founders intended,” he said. “If the federal government would restrain itself and adhere to constitutional limits, we’d have a whole lot less national debt and we’d have more effective state governments that are closer to the people and listen better.”

Here in Arizona, our well known Sheriff Joe Arpaio was using that partnership to get help deal with illegal immigrants who violated the law.
Since Obama came in, the partnership has been rescinded and Arpiao harshly attacked.
If the Labor Government immigration scandal in Britain is any guide to the Obama Administration (and his admiration of Euro-leftist indicates it should be), there will be an attempt to convert illegal immigrants into legal Democrat votes as soon as possible.

For such a small word, IF is a rather large word, and carries significant implications and importance; IF the CON-gress of the United States lived up to their sworn oaths, to “Preserve, protect and defend the Constitution of the United States”, things would substantially different. IF George Bush had done his sworn duty, to do the same, instead of declaring war on terrorism, and patriots, things would be significantly different. IF the border states of Texas, New Mexico, Arizona and California all took and enacted the stance that Sheriff Joe Arpaio recently has taken, effectively telling the Federal Government, Janet Napolitano and the Department of Homeland Security to “go to hell” things would be substantially different.
Illegal immigration is a problem that the government has worked on in a typical government fashion, essentially bass akwards. Illegal immigration won’t be stopped in Virginia, or North Carolina, or Tennessee, or Michigan. The only place illegal immigration will ever be stopped is at the points of entry. Where would that be? At the border, or course.
Now why hasn’t the government figured that out?

The economy is in dire straights, there are approximately 15 million legal populace jobless and are they really intending to force through some form of AMNESTY? The growing grassroots organizations need more patriotic reinforcements to repeatedly call their politicians, who are supposedly protecting American workers, keeping our nation from irreversible OVERPOPULATION that will condemn us to third world density in large cities and communities. We cannot continue to absorb millions of impoverished, poorly skilled individuals. We have for decades which our elected representatives have ignored and introduced a serious balkanization through illegal usurpers who remain un-assimilated, refuse to learn our language and introduced a host incorrigible third world logic, not patterned on the way the multitude of abiding citizens see our culture, life style and values.
An example is the killing of animals in backyards for some ritual sacrifice. On a grand scale driving while drunk and ending the life's of whole families on the highways or pedestrians. Underage ravishment of children, accepted as the norm in many foreign lands. Superiority over women that has marked Middle Eastern men, that disregard human rights, including the ending a life because of dishonor to the family. There are many innocuous instances of female genitalia mutilation, consistent with customs of countries that still exist in archaic corners of our world? Foreigners come to our nation and demand us as a nation; our people comply with their compliances, not the reverse. In Europe a major problem is arising regarding extreme religious beliefs, which is a danger to the Judeo-Christian culture from the mass immigration from countries that have been in upheaval for thousands of years. We live in a country of moderation, freedom of thought and speech given to us by the founding fathers.
Why Europe is stomaching foreign immigrants dictating to Parliaments, the church is beyond my understanding, because it will eventually turn its population against these ideologies. The same as in the United States where trouble is already stirring, relating to another obnoxious possibility of BLANKET AMNESTY that is accepted by the US census bureau as a harbinger of population growth without restraints? States should use the 10th Amendment to enforce the law, regardless of the treasonous non-approach our federal leaders take to immigration.

There IS a reason this POTUS wants a national police force and invoked the Expeditionary Force as one of the first executive orders. Hell, he barely took his hand off the inaugural bible before DOD staffers became a pen-stroke away from being compelled to "serve" him.
They know the "new counter culture' would not sit back and watch the US Parliament take down the United States of America. They were expecting it. The states that are hogtied to the US Parliament may have little impetus but my guess is that the better run states in the Union will be ready to fire up the 10th Amendment.

The RANGERS could, and would stop the border nonsense. The times they are a changing though. I used to be from Texas. I left about fifteen years ago. I had a little place on the border. It had five miles of frontage on the Rio Grande. It was at Quemada, exactly half way between Eagle Pass and Del Rio. It was a war zone then, you couldn't go outside at night, and didn't go anywhere without an automatic weapon. I can't imagine what it like now.
I used to ride my horse freely across the river, whenever I wanted, to have lunch or dinner at a little Cantina. Nobody ever asked me who I was, or what I was doing. The only people at that time on the border who were worth a damn, were the brand inspectors and the tick riders. The border patrol? Government bureaucratic slugs, who who were too scared to get out of their SUV's for fear they'd get lost, or shot. They couldn't find their way back to town without a roadmap…………

The sheriff is a Constitutional officer. However, he drives his power from the state Constitution and not the federal Constitution! The sheriff is the chief law enforcement officer of a subdivision of the state: the county. He is answerable only to the people within the county that has elected him.
For the Feds to shut down a sheriff, any sheriff, they first must violate two Constitutions. Yes, we do have a problem similar to Europe, but we are not Europe.

I echo RT_Thinker here. I fail to see how any local law enforcement, unless specifically countermanded by their leaders (Like the bozo city council in SanFran who won't rescind "sanctuary city" status), can NOT enforce federal law. I do not understand why their hands seem tied when it is an illegal immagrant perp.
Is there a local law enforcement person here who can explain this to us?
I think McDonnell will win, however I'm alittle concerned with the race in NJ between Christie and Corzine. No matter what happens in these races, we all know that ACORN is actively working on this.

I love your posts but your insights are way too logical and way too simple and unfortunately the government is geared for complexity. Time to get back to simple.
What we are dealing with is mass migration from south to north from Mexico and central America to North America and historically "mass migrations have been slowed but never stopped" ((Robert Kaplan, "An Empire Wilderness" (out of print but available used from Amazon.com)). A fence along the Rio Grande ain't gonna do it. Got to address the root problem. Which is, among other things, the wide disparity of economic opportunities available below the border and above the border. If Obongo has his way this will happen but in the wrong direction. We have first got to get our house in order then deal with Mexico to get them honest and up to speed, rule of law, economically, job creation via small business, etc., etc. Otherwise our long term future is three countries, East coast Maine to Florida, West coast Washington to ?? and Mexico to Alberta.

It has been one of those "Urban Legend" stories; some claim it to be true, other false. In any event, Ol' Pershings soldiers caught about 100 Muslim Terrorists and lined them up against a wall. The troops all dipped their bullets in lard, and shot the prisoners. They let one go, to go home and tell what he saw, The rebellion ended.

The question in the Old Dominion isn't if McDonald is gonna win, it's by how much and how will it affect the VA House races. Now, if we can get rid of those D Senators and my stupid D Congressman, I think folks will realize that Virginia isn't trending Blue, and hasn't been, it's trending Virginia first, which is what it always has done and will continue to do.
It's one of the interesting tidbits about VA politics, no Democrat (outside of the Inside the Beltway regions of NoVA) runs as a tax and spender, but always play themselves as a fiscal conservative. That hasn't changed in the entire time I'll lived in the Commonwealth, over 20 years, and it doesn't look like it's gonna change anytime soon. Of course, that makes sense since our Bond rating is a matter of pride for everyone here (AAA Rated, so can you really blame us?), and there's definitely an attitude that considers history and the long view (which is usually good, but can sometimes lead the citizens to get caught up in "historical" moments, like electing the first black president).
All told, things are looking up here in the home of Henry, Madison, Mason, Washington, Jefferson, Lee, Jackson, and do I really need to keep on that list?

The old mule skinner tells the young mule skinner that these mules are really sensitive creatures and you have got to use pshycology to get them to do what you want. So the old mule skinner reaches under the box seat and gets out a four foot 2×4, walks up the head mules and hits them both over their forehead with the 2×4. He calmly waks back to the wagon and gets up on the box seat. The young mule skinner is stunned and says I thought you said they were sensitive creatures and you had to use pshycology on them. A record 12.7 million Mexican immigrants lived in the United States in 2008, a 17-fold increase since 1970. Mexicans now account for 32% of all immigrants living in this country. The second-largest nationality group of immigrants, Filipinos, account for just 5% of all immigrants in the U.S.
More than half (55%) of the Mexican immigrants in this country are unauthorized. Overall, Mexicans comprise about six-in-ten (59%) of the estimated 11.9 million unauthorized immigrants in the U.S. (see “A Portrait of Undocumented Immigrants Living in the United States,” Passel and Cohn, 2009).
No other country in the world has as many total immigrants from all countries as the United States has immigrants from Mexico alone. Other than the U.S., the country that hosts the largest number of immigrants is Russia, with 12 million foreign born, many of whom are natives of countries.
The number of Mexicans living in the U.S. is very large from Mexico’s perspective, too. About 11% of everyone born in Mexico is currently living in the U.S. This large-scale transfer of population has taken place fairly quickly in demographic terms. As of 1970, 760,000 Mexican immigrants, or 1.4% of Mexico’s population, lived in the U.S. And in 1960, Mexico ranked seventh as a source of immigrants to the U.S., behind Italy, Germany, Canada, the Soviet Union, the United Kingdom and Poland.
Large-scale settlement in the U.S. by Mexicans began in earnest in the 1970s. But it is not unprecedented. Irish immigrants represented a third or more of the immigrant population from 1850 to 1870. Germans were 26% to 30% of the foreign-born population from 1850 to 1900.
As a group, Mexican immigrants are younger than either other immigrants or the U.S.-born population. A higher percentage of them are male than either of the other group, and they are more likely to be married. They are less likely to be U.S. citizens than other immigrants, in part because they are more likely to be unauthorized. Mexicans have lower levels of education, lower incomes, larger households and higher poverty rates than other groups (Tables 1-2). They are slightly more likely to be in the labor force, where they are more likely to work in lower-skilled occupations; they currently have a higher unemployment rate than other immigrants or U.S.-born workers.

Thank you David, but I would even go farther. The "sanctuary city" designation is, in my opinion, illegal, and a nullity. Article VI makes clear that all public employees must be bound to support the laws of the United States. Local officials have no authority to select certain laws for enforcement, and others to be ignored. Personally, I would "defund" any city which attempted to.
The DHS has already tried, unsuccessfully, to shut down Prince William County's use of the system in place. PWC basically told them "we ain't stopping because we've been successful in cutting down illegal immigrant groups, which has led to a reduction in crime and gang presence in the County." Once again, it seems Virginia may be at the heart of a struggle between the Federal government and the States. Only, hopefully, there's won't be a major shooting war this time…

Personally I think Arizona’s new law is a great law. We all recognize that we need to allow a better path to citizenship, but since the state can’t grant the citizenship the only way we can protect ourselves is to enforce harsher penalties against all illegal immigrants. We can’t sort the good and the bad until the Federal government acts. Instead of protesting our actions people should be petitioning their congressmen to reform immigration laws. We just want to keep the criminals and drug dealers out of our state.
